Please keep to the argument monkeyleg. If you check carefully, you'll find you have made no point at all, what d'you want the kids to say?

Revealing a chilling prophetic vision, Bakare said: "Neither Buhari nor IBB nor Obasanjo nor Atiku will be part of the new Nigeria. They are part of the old that has decayed and is still decaying. The new is coming forth. It is the counsel of the Lord that shall stand in this nation. Everyday you giv us more reason to be scared of your mentor's government!

Look at the way you are blatantly supporting daylight human right abuse!

Now i know that some of us non-supporters of GEJ will have to go undercover when he rigs himself to power cause you have, based on your postings, proved beyond reasonable doubt that your mentors government will be a no-respecter of human rights!
Why don't you go live in the bush if you hate law and order? Everything you have written is really daft sir.
Go defame someone in the US and see if your arse won't serve time.

@Beaf,

Your whole argument wreaks of shyt. So you support a barbaric law like this? Whether there is a law that supports jailing some1 for talking is not a justification for this. Laws like this should be scrapped coz it simply enables politicians to oppress and intmidate people. Do you know if the young man also has evidence and BTW evidence or no evidence these ppl can use their power to ruin the man's life. If they were to do it to you your freakin evidence might not be sufficient enough for them to do you like they did Wiwa. This is Nigeria please.

You have lost it.
The law is what it is, you must not defame anybody, regardless of if you do it on the street or the Internet. The fact that Sule Lamido is a governor is merely incidental, it could be anyone, and many people in the West where you are have been jailed for exactly that. Stop talking like a fool and make sure to avoid trouble.

This is defamation on the Internet from the point of view of US law; http://www.internetdefamationlawblog.com/
Same thing from a UK perspective; http://www.law.ed.ac.uk/it&law/c10_main.htm

Defamation is NOT a jailable offense, it is only punishable by fine, that's why the dude shouldn't be locked up to begin with.

This should be a civil action not a criminal action.  I wonder where sir Beaf is getting his information from.

FRN vs MR XYZ if found guilty could be a jailable offense.

MR ABC vs MR XYZ if found guilty is a civil offense and punishable by monetary fines.

If Mr XYZ has refuse to pay the fines, then it becomes an offense against the FRN and thus jailable.
Really?

Mukhtari Ibrahim Aminu, the man arrested and arraigned before a Magistrate Court in Dutse for allegedly insulting Governor Sule Lamido of Jigawa State on Facebook has been remanded in prison till February, 7, 2011.
The accused person was arrested by the police 10 days ago for allegedly sending an abusive text message against Governor Sule Lamido through his face book page.

In his ruling, the presiding judge, Magistrate Mustapha Saád fixed February 7 for ruling on the bail application filed before the court by the counsel to the accused person, Barrister Adamu Abubakar.  When the case came up yesterday at Dutse Magistrate Court II, the accused person pleaded not guilty after the prosecution counsel, SP Peter Amedi read the First Information Report (FIR) to him and the judge asked him whether he committed the offence or not.

The prosecution counsel, SP Peter Amedi, told the court that the accused person had on February 19, 2011 posted an abusive text message insulting Governor Sule Lamido on his facebook page, hence, defamed the character of the governor. SP Amedi told the court that the accused person’s action contravened section 393 of the penal code, therefore leading to his arrest by the police and now arraigned before the court of law for prosecution.

In another development, the state Commissioner for Justice Barrister Tijjani Inuwa Dutse has applied to take over the case from the police. Standing before the court for the Attorney General, Barrister Muhammad Lamin told the court that the Justice Commissioner was empowered by section 211 of the Nigerian Constitution to take over any case from anybody and or stop it entirely.
Defamation is a jailable crime.

I hope the next time you open your mouth and say something negative about a Nigerian politician you get thrown into the next jail, preferably Kirikiri prison and locked away to rot. You must have lost all your senses. Please when you find them holla back.

To even say the crazy power drunk governor is on the same level with Fashola in terms of performing miracles is laughable and a big disgrace. Dude I've admired your sense of reasoning on NL until today. You have shown a certain Nigerian trait that I detest passionately. Even Pope John Paul has been criticized by people yet Vatican has never issued arrests. Even Gov. Lamido is Jesus Christ himself he is not above any criticism and as long as the defendant was not threatening his life he has no right to use the police force to intimidate the young man. Instead of fighting crimes our police are being used to intimidate people. The governor should have went ahead to prove the man wrong by continuing to perform well and show transparency. I am sure people will see things for themselves. What happened to filing civil lawsuits though I still wont agree with that but atleast that is far more humane and sensible than arresting someone. If Obama and American officials were to reason like animals the way many Nigerian leaders do everyone will be in jail by now.
Freedom of speech please. This democracy (I guess Democrazy in Naija) so if you can't stand the heat then dont run for office.
Mr smart, do you even know Mukhtari Ibrahim Aminu's exact words? If you don't then you have wasted your time typing this crap.
There is no reason why the Internet should be a place where manners are lost and there is no law. Thats what my argument is. Should those who defame others on the web go scott free? Defamation is a jailable offence in the real World.

As for personalising it to the times I have spoken harshly about politicians, there is always cast iron backing evidence whether it has been Ibori, Buhari, Atiku, IBB etc, so I fear nothing.

The examples you've given don't actually support your case that the man should have been arrested.

First example - Immigration rules can be complex. Where the FBI feel there is even the slightest threat to their president, the complexity is compounded. Remember, some countries will not let HIV+ people into their country.

Examples 2 & 3 - Clearly examples of persistent stalking and harrasment. Whether online, or physical, these would be deemed criminal.

A derogatory, but non-threatening (and the reports didn't indicate there were any threats) message to a governor, is no cause for jail. In countries that claim to have democracy/rule of law, this would not be criminal.
My point has never been that the man should have been arrested, it has always been that the very same laws that govern us on the street also govern us on the Internet. Unfortunately, most people think the Internet is anonymous, therefore anything goes.
Mukhtari Ibrahim Aminu doesn't need to be told this anymore, he is now realising first hand, a few more like him will sanitise the way we Nigerians use the web; its just horrible.

You have delved into some detail about the validity of the punishments for the examples I sited, but the fact is we do not know Mukhtari Ibrahim Aminu's exact words and why they caused so much consternation; therefore, how can you conclude the his being hauled before the law is not valid? Lamido's being a governor cannot make Aminu any less guilty if he committed a jailable offense.

Your excerpt does not explain anything.  The US president has within his powers to bar anyone from coming to the United States even for reasons he might not wish to disclose to anyone.  In this case, the President exercised the powers of his office, and he can claim to have done so judiciously without being questioned by anyone or running risk of subverting due process.

In our own Lamido's scenario, a man gets LOCKED up for insulting a "bigger man". . . his freedom of movement within his own country denied, I can't even believe you compare the two.  In the US, people insult the president and the governors in the open without being scared of harassment by law enforcement agents, most probably because that's a country where people know that office holders are not meant to be worshiped
The US President did not lift a finger, it was the FBI and British Police; they had the discretion to ignore or act and they chose to act. If a person decides to take legal action for an offence committed against them on the web, they are well within their rights to do so.
The fact that a person is operating on the web does not exempt them from the law in any way, shape or form.

Depending on the fellows exact Internet comments, it was at the governors discretion to ignore or prosecute, he chose to prosecute. I'm quite sure that Mukhtari Ibrahim Aminu's facebook comments couldn't have been the only negative ones against the governor, he must have really gone overboard with something. I believe his case should serve as a warning and look forward to a couple more, so that we can all be more civil to one another.

The underlining word here is, "discretion." Nobody has the right to be obnoxious because they are on the web.

Unfortunately the Internet is not the Wild Wild West where anarchy reigns. Another UK story:

Unemployed man faces jail after leaving obscene messages on internet tribute sites
By Daily Mail Reporter
Last updated at 1:22 PM on 9th October 2010

An unemployed man who trawled the internet leaving obscene messages on tribute sites for dead people is facing jail after being brought to court under a rarely-used law.
Colm Coss found Facebook memorials to victims of high-profile tragedies around the world - and defaced them with sexual slurs.
His targets included a site dedicated to Jade Goody, the reality TV star who died of cancer.
Colm Coss, pictured leaving Manchester Magistrates Court, found Facebook memorials to victims of high-profile tragedies around the world - and defaced them with sexual slurs
He was prosecuted under the Communications Act 2003, which governs all 'communications networks' including internet, e-mail, mobile phone calls and text messages.
Coss of Ardwick, Manchester, also posted sick comments about a car crash victim in Australia, and a dead baby in the U.S.
Coss targeted the sites purely for his own amusement and to get a reaction, Manchester magistrates were told.
He was only caught when he sent residents on his street photos of himself saying he was an internet 'troll' - a term used to describe someone who posts offensive comments to upset or provoke a reaction from others. The neighbours rang police.
When Coss was arrested, he admitted the offence.
Matthew Siddall, prosecuting, said: 'The defendant told police that he finds the comments amusing. He said it causes reaction.'
Coss, who showed no emotion during the hearing, has previous convictions for harassment and dishonesty, the court heard.
District Judge Khalid Qureshi told Coss: 'This crosses the custody threshold.'

Coss was granted bail and will be sentenced later this month.

Banned from the US

A BRIT teen who sent an email to the White House calling President Obama a "p***k" has been banned from America FOR LIFE.
The furious FBI asked local cops to tell college student Luke Angel, 17, his drunken insult was "unacceptable". Luke yesterday admitted he fired off a single email criticising the US Government after seeing a TV programme about 9/11.

He said: "I don't remember exactly what I wrote as I was drunk. But I think I called Barack Obama a p***k. It was silly - the sort of thing you do when you're a teenager and have had a few."

Luke, of Silsoe, Beds, said it was "a bit extreme" for the FBI to act.

He added: "The police came and took my picture and told me I was banned from America forever. I don't really care but my parents aren't very happy."

A Beds Police spokesman said: "The individual sent an email to the White House full of abusive and threatening language. We were informed by the Metropolitan Police and went to see him. He said, 'Oh dear, it was me'."

Officers will take no criminal action.

Joanne Ferreira, of the US Department of Homeland Security, said there are about 60 reasons a person can be barred.

She added: "We are prohibited from discussing specific cases."

I am happy I can confess to this because I am afterall human and this is not about just winning some lame online argument. The man is human and not God, as a result he is not above mistakes (non of us are), he also should be allowed to change is mind and all I am concerned with in that regard is a substantial reason or explanation (by him) as to why he changed his mind, simple. What I find irritating is the sanctimonious attitudes of some posters as if they are above certain things. We are all human. No need for cheap propaganda. I will look out for the man's explanation and see if it can convince me.
If he simply changed his mind that would be fine, but he claimed to be revealing a prophesy from God. His claim that God was speaking is very decietful. His words and actions cast him as what Christian call, false prophet. God never spoke to him:

Bakare said, “Let me tell you the truth by the spirit of God, neither (President Olusegun Obasanjo), OBJ, Atiku (Abubakar), IBB and this tall one, (Muhammadu) Buhari are part of the new. They are part of the old that is decaying. That old one is passing away. The new is emerging and these ones are not part of that new.”

Is somebody not mocking God here? shocked
How can the deliverer of such a "prophesy" become the assistant to one of the "sons of turmoil?"

Damn!

IBB Will Fail - Pastor Bakare

The Punch/Sun, Nigeria .The pastor of the popular The Latter Rain Assembly, Lagos, Pastor Tunde Bakare, on Sunday said the dream of a former military dictator, Mr. Ibrahim Babangida, to rule the nation in 2007 would fail, adding that IBB is a decaying matter.

Bakare, who spoke at a special programme of the church titled, ‘If the truth must be told” in Lagos, said the script to install Babangida was already being acted out.

He said, “As it is right now, only God can stop IBB from becoming the president of this nation again. You are likely to disagree but the strategy to bring him back has been perfected and the script is being acted out.

“But there is good news there because God has shown me how to stop him.”

The cleric, who did not tell his audience the strategy to stop the Minna-based General from becoming the president in 2007, added that none of the presidential front runners would make Aso Rock.

The pastor, whose prophecy in 1999, shortly after Obasanjo was elected president, caused a major outcry, said the prophecy was not informed by hatred for the person of the President or a dislike for the country.

He said, “I love my country and I love the President. I pray for my country too on regular basis. I do not wish Obasanjo or any other person any evil. But my concern is for my country and what God has put in my heart to tell the nation. I suppose that the over 1,000 pastors that gathered to pray against the March 7, 1999 prophecy now know better.”

Making references to his 1993 and 1999 prophecies, Bakare declared that only the counsel of God would prevail in the nation’s situations.

“When God warns his people, he only wants them to repent of their evil ways and seek forgiveness. God is not interested in killing anybody,” he said.

Supporting his message with illustrations, the pastor said those who “balanced the equation” in the deaths of (Sani) Abacha and MKO (Abiola) were still around and could play a major role in the present crisis rocking the Presidency.

Bakare in his statements couched in deep analogies, said of Nigeria’s present scenario, “By the present exposures that are going on between the President and his deputy, vipers eggs are being hatched, spiders’ webs are being woven. At the end, these will heat up the polity, heat up the system and make the nation ungovernable.

“It is also clear that your accomplice in crime will expose you.”

He warned against bloodbath, saying that the nation could not afford another civil war.

On the leadership the nation desires, he said, “We do not need dishonest leaders, who are clever by half; who live in denials. We must reject body language politics in Nigeria. We do not need people who confuse personal account with the nation’s account.”

In its own report, the Daily Sun said Bakare declared Abiola was murdered.

The cleric posited that it was divinely ordained that former President Ibrahim Babangida, incumbent President Olusegun Obasanjo, Vice President Atiku Abubakar would fight to destroy themselves for the nation to move forward.

He said Nigerians should not be surprised about the exposure of corruption in high places as he likened the gladiators to partners in crime against the nation.

"A word of caution to our people. They should not take sides or join in the battle that is going on. He who digs a pit will fall into it. Your accomplice in crime might double cross you.
"By the exposure that is going on, viper’s eggs are being hatched while spider’s web is being woven deliberately to make the nation ungovernable so that we will have no choice but ask them to continue until October 2007," he said.

Until the sons of turmoil destroy themselves, this nation will not know peace."

The preacher described the ruling Peoples Democratic Party (PDP) as a basket of serpents and scorpions and insisted that the people must wrest power from them through peaceful and proper transition.
He alerted the nation to what he described as "the contraption of evil" that is going on in high places and warned the president to always watch his back as those who killed M. K. O. Abiola were still around.

"The same people who balanced the equation that if Abacha is dead, M. K. O. Abiola must follow suit are still around. Whoever tells you M. K. O. died a natural death has lied. They contrived his cold murder.
"When Abacha died, Abiola was still in prison and IBB for the first time since he left power for his fortress in Minna came to Abeokuta to see the current president. He came to greet him and came to offer him the package of the elders of the north and at the same time, to present it (offer to be president in 1999) to the then General Obasanjo.

And he (Obasanjo) replied him: ‘I have been head of state. I have been prisoner, there is nothing else to be in my nation. Number one, I don’t have the money to run for an election. Number two, M. K. O. the man who won the election is still in prison. What would I tell my people?’ He was assured. Read between the lines and lies. Shortly thereafter, M. K. O became history."
In graphic presentation, Bakare drew the attention of the congregation to the recurrence of Babangida’s name in the past political maneuvering and pointed out that the former military president was still very much loaded with tricks.

"Don’t forget his code name in the PDP registration is 007. You are about to see the greatest theatrical performance in the history of politics in Nigeria," he said.
Bakare noted that those who said Obasanjo was the most acceptable candidate to all the segments of the country would soon do the same in respect of Babangida.
He said nothing on ground at the moment could stop Babangida, except God, regretting, however, that the current political gladiator could not take Nigeria to the promised land.
Pastor Bakare recalled that he had alerted the nation on several occasions to the direction God was taking the country.

The fiery preacher said rather than take counsel from the Holy Spirit, President Obasanjo and the other political actors continued with their "contraption of evil."
"Rather than he (Obasanjo) clinging on to God, he is relying on his own understanding. He is looking at his friends and thinking they are his enemies," Bakare said.
According to the pastor, whatever the political actors planned, "it is the immutable counsel of God that shall prevail in Nigeria.

"Don’t think God has forgotten Nigeria. In all these accusations and counter accusations and maneuvering, it is the immutability of God’s counsel that is our anchor and it will prevail."
Pastor Bakare said God would raise new leaders for the nation, who would rule with the fear of God, fairness and justice and He would heal the land and make it flourish again.

So what have you gained from hauling abuse and shouting? Has it changed Buharis words as a sharia zealot?
You are coming across as just as crude as Buhari.
