To add what Zahra said, deportation will apply if spent 12 months or more in prison for a criminal offence.

Let me ask a rare question here.

I heard someone was deported for staying out of UK for more than 6 months after getting an indefinite leave to remain status. Story reads that he has been on ILR status for more than 15years but never applied for citizenship. (Jamaican village people at work)

I partly disagree with point 1. Section 3C is extended if application is refused and an in-time appeal is submitted.

A couple of points about section 3c which make the application turn around time significant:

1. If a decision is made before the expiry of permission, section 3C leave is not triggered, even where the application is refused and the applicant lodges an appeal by the relevant deadline

2. if someone has an outstanding application that was made before the expiry of their permission and they transition to section 3C leave, they can vary their application to another type up to the point that the Home Office makes a decision.. Once a decision has been made, though, any attempt to vary their application (i.e. lodge a new application) while they still have section 3C leave will be void.

For someone that's been in the country for less than a year or 2 and on a temp visa will no doubt have their application refused.

It extends section 3C and whether it's shorter or not, it's up to the applicant to find a sponsor within that time frame.

They've noticed the appeal process has been abused and as you rightly said, right to appeal may not apply.

Last thing one wants is to use all the money to fight staying and then be illegal. I hope they reconcile sooner than later.

I understand your point. I was recommending caution because the application could be determined quickly (especially due to the lack of strong supporting evidence). Last time I checked with a solicitor who used to work for HO, she advised that the turn around time for such applications is now a lot shorter.

Just my view and who knows, I might be wrong. However I think on a forum like this it's important to present all sides of a debate,pros and cons of an approach,to enable people make an informed decision.

Apply on the basis of nothing concrete really.

The whole idea is if there's no point based visa to switch to, private life just buys time pending s/he restores their stay.

It doesn't really impact future applications. It will be more of a personal impact (financial, right to work/rent)

He needs to be careful. Applications are more readily determined now, and he runs the risk of being found guilty of making vexatious claims which could impact future applications.

Though not part of Schengen but Rep of Cyprus has available dates

CAS is only applicable to the Main Applicant. You just need his BRP (alongside other required docs) for your application

I intend to apply as a partner dependent by July and my husband is the main applicant for the January 2023 start (he is already in the uk)

Going through the CAS , we noticed that the CAS is valid for only 6months from the date of issue in December 2022. And June 2023 will be the CAS expiration date.

Can I still apply for my visa in July . Does the expiration date also affects dependent application.

How come you don't come in as a dependant? I ask because couples tend to switch to a study visa as a last resort if sponsorship doesn't work out before a Graduate visa ends.

Also, hope you are aware that if he switches to a dependant visa, he will no longer be qualified to apply for a Graduate visa.

Yes you are entitled to your opinion like we all do but if the guidelines states otherwise with clearly written rules, then the opinion becomes irrelevant

It sounds like you don't know this but for any premature liquidation, a charge (like any fixed deposits) will be deducted from the contractual interest rate. That you can't access the fixed deposit until the end of the tenure is simply inaccurate. The last sentence says "that the applicant can access the funds at any time". ECOs follow the guidance and understand how certificate of deposit works.


You have to read waaaaaaaay back to see successful applicants who have used Fixed term.

U apply for Visa today with a certificate that will mature around December for instance.
ECO will kick your application out without second thought on grounds that the funds is not available and can't be easily accessible by the applicant.

Otherwise, in such case of using fd.notes short tenure of "30days", one can apply for Visa around May first using such fd.note certs. because originally the funds should have been settled in the account prior to the filing of Visa application.

Yes you can use your fixed deposit accounts (also known as Certificates of deposit) as long as it's held for the required 28 day period.

Please I wanna ask if I can use my personal bank account and that of my kiddies (son's - dependant) bank account which has a lump sum of amount in it for POF. But the money in both accounts are fixed deposit which tenures matures in June and July 2023 end respectively.

1. Can I use the statements for my Visa application or should I liquidate both and combine the sums in one accounts for the POF .

2. If I apply for Visa by next month May , how long would it take for me to get a response as I'm heading for September intake .

They most times have insurance coverage over all these items and the insurance pays for it.

Forgot to add .. . If you go directly to their website, it will give you about £20. You will have to use compare the market sites to get the £5 for PO.

I was looking at the GHIC option yesterday as well. There requirement is to use a 'Medical travel insurance' which you can get as low as £3 anyway. I got post office for about £5

Are you 💯% sure about thise. There are people that have changed sponsored jobs without their employers knowing. Example is that guy that had issue with driving a car that resulted in maltreatment. According to him, when he resigned, the employer didn't know what next for him.

I doubt if there's such law.

Anyone can switch visa to any category at any point. UKVI only expects you to have worked out your notice period.

I dont think there is any alternative o when it come to taking another empoyment as a sponsored skilled worker as his current employer has a big role to play in the process of changing sponsored jobs .
By law he can't bypass his current employer to take another sponsored employement somewhere else as the UKVI cannot even grant him a new COS if his current employer doesnt cancel the current one .Since he still has a binding contract on his neck , he just have to find a way of settling his contact with his current employer so that he can be gracefully released without any issue.
