Yes that's the requirement but for out-country applications, they normally want the applicant to meet the five-year residence requirement. I personally haven't seen or heard spousal visas granted 10-year route outside the UK except for in-country application. We will see how it goes .. . Spring go soon reach .. . oju lo pe si

Both, you and your partner must be 18 or over;
You need to prove that your relationship is genuine;
You intend to live together permanently in the UK;

There are exception pathways in the application process that could lead to a 10 yr route decision instead of a refusal.

I think this only applies to in-country applications. I doubt if one can bring their partner applying from outside the country.

But not impossible. There are exceptions - a British citizen who is not able to meet the new income threshold can still bring their partner over, just on a 10 yr route, as is currently the case

There are 2 types of 10-year route

Long Residence is a 10 years' continuous lawful residence which leads to ILR

The other 10 year route is if family (either by partner, parent or child) is at least settled

By mentioning section kinikan, you wan dey scatter HR head be that lol 🤪. They usually don't want to deal with wetin them no understand. They know the overview of the rules but not the indepth part of the Skilled worker guidelines. Some will involve their immigration lawyers if “we’ll get back to you” 🤞 is involved while it's just easier to say no to save them cost and time. Either way, we move 🙂

I wouldn't go that far LOL .. . In-country applicants will be fine. Las las them go use 10-year route. Unfortunately It will be harder for out-country applicants sha if the new min income isn't met.

Yes, it's crazy. I remember the uproar when they implemented the £18,600 threshold for the first time 10 years ago. So many British and settled families were affected, this new threshold is something else tbh.

And as it currently stands .. If the applicant has children, an additional £3,800 per year is needed for the first child and an additional £2,400 for each subsequent child. If this is carried over, minimum income for an applicant with 2 kids will be £44,900

Well .. . All these half baked stories sha .. Hearsay isn't the official guidelines is it? All visa forms will definitely ask you about your dependant(s) but there's a section on the form about 'applying and non-applying dependants' (can't recall the exact words). And if their dependant is not applying, you simply state the reason(s) why.

Couples are allowed to be on separate visa categories if they wish to.

I've heard about people going for biometrics appointments for visa extension and renewal and not being allowed to proceed because of the absence of the dependant, the problem is that once you indicate the dependant in the application, the person needs to show up, ok even if the dependant is not going to be included in the application, what will the applicant state as the reason of not including the applicant!

Any applicant can be on any visa category. The system asking about his/her dependant is usually standard and doesn't technically mean they have to be on a dependant visa.

I doubt because since they were both on an initial visa which is student visa, any new application they make, as they are filling the form either the psw or skill worker, the system will ask about the dependant.

I am so happy that I finally got my visa after a very long wait, 1 Canada tourist visa refusal, 1 Uk visit visa refusal and 1 UK student visa refusal.
I almost gave up and almost withdrew my application.

My initial resumption date was on the 25th of September and the deadline was 16th of October but I am thankful to my university for helping me with an automatic deferral to the next intake which starts on 20th of November.
ALL GLORY TO THE ALMIGHTY GOD.
I am still basking in so much 🤩 and to those still awaiting their visas I pray it comes through soon and do not give up.

Nah he can't switch. When you said recently completed his PhD, I assumed you were on a student visa.

Like mizgene said, you have to work towards getting sponsorship. Hopefully you will get one soon. 🤞

I applied for a student visa on the 8th of august 2023 and it seems like I am the only one still waiting for my visa outcome. Although my resumption deadline was 16th of October but my university had to defer my admission and update my CAs to the next intake which is 20th of November. My visa application is still pending, this week is going to make it the 12th week since I submitted. It seems everyone has gotten their visas and others that haven’t have withdrawn their application and planning to reapply for January intake. I was lucky that my course has a November intake but right now I feel alone and frustrated, I am just waiting. I have done 5 paid calls, I have escalated twice, the last escalation was last week Thursday and the last paid call was done yesterday. I was told I cannot escalate this week since the last escalation was just last week. I am really really worried and I want to know if there is any other way I can reach the home office so that I can get my decision on time. This delay is causing me a lot of distress physically, health wise and financially, please I will appreciate any help or suggestions. Thank you, gurus in the house please help

Mine is 3 months and counting. It seems to take an average of 4 months 😬 which is frustrating.

As this will be classified as overstaying, the guidance unfortunately doesn't say basically anything about children except the attached pic. Though there isn't any specific guidance I can find on the ukvi page, Citizens Advice advises the below link.

My spouse and I have just applied to switch from the student visa to a skilled worker visa. We are yet to do this for the kids (3) and their current visa expires at the end of October.
How would this affect them if we are unable to make an application before their current visa ends?

Not too sure how this will fly .. You now want to raise a complaint after 6 months of use? I doubt if you will be covered by the Consumer Rights Act especially when it's not a replacement or repair. Give it a shot and see how it goes though.

You don't have to apply at the same time. You can at any time before current visa expires.

Personally if it was me o I will submit as it is but if in doubt, amend the certificate (if it's a smooth process to do) or wait for the outcome of your wife (not sure if an affidavit is applicable to a marriage cert)
