Para 320(7)(a) and (b) are very explicit-

(7A) where false representations have been made or false documents have been submitted (whether or not material to the application, and whether or not to the applicant's knowledge), or material facts have not been disclosed, in relation to the application.

(7B) subject to paragraph 320(7C), where the applicant has previously breached the UK's immigration laws by:

(a) Overstaying;

(b) breaching a condition attached to his leave;

(c) being an Illegal Entrant;

(d) using Deception in an application for entry clearance, leave to enter or remain (whether successful or not);

unless the applicant:

(i) Overstayed for 28 days or less and left the UK voluntarily, not at the expense (directly or indirectly) of the Secretary of State;

(ii) used Deception in an application for entry clearance more than 10 years ago;

(iii) left the UK voluntarily, not at the expense (directly or indirectly) of the Secretary of State, more than 12 months ago;

(iv) left the UK voluntarily, at the expense (directly or indirectly) of the Secretary of State, more than 5 years ago, or

(v) was removed or deported from the UK more than 10 years ago.

Where more than one breach of the UK's immigration laws has occurred, only the breach which leads to the longest period of absence from the UK will be relevant under this paragraph.


The consequences/ban are-

One year if you leave voluntarily, without our having to pay or contribute to the
cost of your departure;
• five years if you leave voluntarily at the Government’s expense;
• ten years if we remove or deport you.


The concessions are stated in (7)(c)

(7C) Paragraph 320(7B) shall not apply in the following circumstances:

(a) where the applicant is applying as:

(i) a spouse, civil partner or unmarried or same-sex partner under
paragraphs 281 or 295A,

(ii) a fiancé(e) or proposed civil partner under paragraph 290,

(iii) a parent, grandparent or other dependent relative under paragraph 317,

(iv) a person exercising rights of access to a child under paragraph 246, or

(v) a spouse, civil partner, unmarried or same-sex partner of a refugee or person with Humanitarian Protection under paragraphs 352A, 352AA, 352FA or 352FD; or

(b) where the individual was under the age of 18 at the time of his most recent breach of the UK's immigration laws.

my dear i also have the same question, because am about moving to dublin myself but don't know how to start with my kids ,although we are Eu citizens ,i don't just know anyone there who will show me somethings about the city and all that, but incase u got answer to your qusetions i will like to be part of it.
Yours will be pretty straight forward as an EU citizen as far as rights of residency is concern.

Nigeria will not break up at this point,the problem/solution is not breaking up corruption is wide spread through the north and south of the country.
The corrupt political of the nation want to make point that they are untouchable.
The Police IG Okiro had a double promotion to to get what he is today.The most senior police officer is Onovo,but Okiro was promoted from CP to DIG without going through the post of AIG.The PSC never saw any wrong in that.The only way out is civil disobedience.

The former Chairman of the EFCC, Nuhu Ribadu was today officially invited for questioning by the Jos Office of the State Security Service (SSS), 24 hours after he was demoted by two ranks to Deputy Commissioner of Police (DCP).

A source in the presidency told SaharaReporters that Ribadu's arrest is imminent. The source further revealed that a cocktail of charges has been compiled by the Attorney General of the Federation, Michael Aondoakaa, an archenemy of Ribadu. Said the source: "He is likely to be accused of influencing the disqualification of otherwise-qualified politicians before the 2007 Elections".

The source continued: "He (Ribadu) is also to be accused of attempting to influence the cancellation of the Presidential Elections at the Presidential Election Tribunal. This is akin to treasonable felony, according to the Minister of Justice".

The Attorney-General’s plan is to detain the former EFCC boss without bail after charging him to court within 48 hours in cynical deference to Umaru Yar'adua's often-mouthed respect for the rule of law. A high-level security source sympathetic to Ribadu told SaharaReporters that once he is behind bars, he might be infected with a deadly disease or poisoned with harmful chemicals. "They have figured out that as Muslims we do not do autopsies on death", he added.

Ribadu’s demotion and impending humiliation are widely seen as continued victimization of the anti-graft czar whose efforts have led to the prosecution of several former state governors especially James Ibori of Delta State whose worldwide assets were frozen by a UK High court. Earlier this year, Inspector-General Okiro, who was himself sponsored to the job by Ibori, abruptly sent Ribadu off to a training course. Ibori was the main financier of the election of the current Nigerian Head of State, and he continues to wield considerable influence over Yar’Adua’s administration.

Our source stressed that Ribadu will be killed if Nigerians don't rise up and defend him, warning that the former EFCC boss “will die of ‘natural causes’ within the shortest possible time".

FEMI FALANA Reacts:

Having been made to wear their ranks, given statutory responsibilities and paid salaries and other allowances in line with their promotions the Police Service Commission cannot, in law, demote such officers by virtue of Section 151 of the Evidence Act which provides as follows:

“When one person has, by his declaration, act or omission, intentionally caused or permitted another person to believe a thing to be true and to act upon such belief, neither he nor his representative in interest shall be allowed, in any proceedings between himself and such person or such person’s representative in interest, to deny the truth of that thing”.


Since the said officers have acted on the fact of their promotion the Police Authorities are estopped from denying the fact of such promotion. In Obafemi Awolowo University v. Dr. A.K. Onabanjo (1991) 5 NWLR (PT 193) 549, the staff conditions of service provided that confirmation of employment of a university lecturer shall be in writing after a 3-year probationary period. The respondent’s appointment was not confirmed in writing after the probationary period but was allowed to continue to teach for three months thereafter. The purported termination of his appointment on the ground that he had been confirmed was set aside by the Oyo State High Court. On appeal the judgment was confirmed. Mustapha Akanbi JCA (as he then was) who read the leading judgment stated inter alia:


“Allowing him to continue to work and earn his salary, gave the impression that he was in for another term of office, as an officer who has satisfactorily completed his probationary period and has been re-appointed”,

Applying the above decision of the Court of Appeal to the controversial demotion of the aforesaid police officers the Police Authorities are ESTOPPED from denying the existence of their promotion since they have been made to believe and act on the basis of their new ranks.

It is also pertinent to point out that reduction in rank in the police force is a punishment which can only be imposed on an officer who has been tried and proven to have committed an offence or gross misconduct. In such a situation the officer affected must be given the opportunity to make a representation to the administering authority before that authority makes the decision affecting the person by virtue of Section 36(2)(a) of the 1999 Constitution.

In the light of the foregoing the Police Service Commission MUST reverse the illegal demotion of the 140 Police officers including the late Haz Iwendi who wore the rank of a Police Commissioner to his grave while serving his fatherland loyally and patriotically.


He then added the chilling forecast: “Let the world know that Nuhu Ribadu is about to be sacrificed like Ken Saro-Wiwa."

Meanwhile, the detained former head of the Economic Governance unit of the EFCC, Ibrahim Magu is spending his 3rd day in detention at the Nigeria Police Force headquarters in Abuja. Magu, a police officer recently transferred to the Ekiti State Command, was detained on the orders of the Inspector General of Police (IGP) Okiro since Monday morning as he honored an invitation to the headquarters.
Lawyers and family to the detained officer said they have been barred fom visiting him in detention since yesterday.

What is the yardstick for your qualification ? Are you holding brief for Ibori.I am sure you know James Ibori is capable of doing anything to keep his head above the water.
Saharareporter was able to bring to the public a primary evidence to proof Ibori conviction in London,which he wilfully refuse to declare before taking the oath of office as a governor of delta state.If Nigeria was actual a place where the rule of law reigns,his governorship past/position should have been declare null and void as if it never existed.And be made to pay back all the benefits he enjoyed as a governor of Delta state.

From the foregoing,it is clear that you can make an application to join your husband by fulfilling the requirements in para 76 of the immigration rules.In addition,your husband uncle CANNOT sponsor you as decided in a recent case law(PA (Student’s family: third-party support?) Bangladesh [2008] UKAIT 00016)(The maintenance requirements of para 76 of the Immigration Rules are not met by the provision of maintenance by a third party.).
Your husband can as well take up an employment (max 20 hrs per week) and your existing personal savings to enable you have a case/ground for a successful application.

A team of men of the State Security Service (SSS) visited the NIPSS today to effect the arrest of Nuhu Ribadu, an SSS source told Saharareporters that the Director General of the State Security Service (SSS) is personally handling Nuhu Ribadu's case. The team visited the office of the acting DG of NIPSS today to announce their presence and mission, it is unknown if Rubadu has been arrested as at the time of publishing this report.

Former EFCC Chairman, Nuhu Ribadu demoted ,
Former Chairman of the Economic and Financial crimes Commission (EFCC), Nuhu Ribadu, has been demoted down two ranks by the Nigeria Police force, his principal employer.

The former EFCC chairman, who became an Assistant Inspector General of Police (AIG) two years ago, is being demoted by the police authorities because of his arrest and detention of James Ibori, the former governor of Delta State. Although facing prosecution for corruption, Ibori has grown increasingly influential with the government of Umaru Yar’Adua. Only last Friday, for instance, Yar’Adua appointed David Edevbie, Ibori’s former finance commissioner, as his Principal Secretary. It is also known that the Inspector General of Police, Mike Okiro, was sponsored to leadership of the Force by Ibori.

Saharareporters had reported that plans were afoot to demote Ribadu and withdraw him from the National Institute for Policy and Strategic Studies (NIPSS) where he has been a student since February this year when he was controversially removed as the EFCC chairman.

Nuhu Ribadu has since disappeared from public view, but reliable sources told Saharareporters that two powerful politicians, Ibori and Bukola Saraki, never lost sight of him. They have worked with the Inspector General of Police and Yar'adua, who sources said, held Ribadu responsible for a series of media attacks on the illegitimacy of his government. With his demotion, analysts say Ribadu may be in for a prolonged season of humiliation, ridicule and endangerment.

Settling down and Immigrations issues makes it impossible to show gratitude since I got here. But anytime I remember this guy, I just feel I owe a debt yet to be paid. The calculation as Londoncool pointed out is not x 12 months as illustrated below(though not relevant to your case).

MAINTENANCE REQUIREMENT
28. Please refer to paragraphs 319C, 319H and
appendix E of the Immigration Rules.
29. One of the requirements for family members of
Tier 1 migrants is that they must be able to support
themselves for the entire duration of their stay in the
United Kingdom without needing help from public
funds (for example benefi ts provided by the state). If
they cannot, they could face fi nancial hardship because
they will not have access to most state benefi ts.
30. If the Tier 1 migrant (the main applicant) is
outside the United Kingdom or has been present in
the United Kingdom for less than 12 months, the
family member of the Tier 1 migrant must show that
he/she, the main applicant, or (for children) his/her
other parent who is also legally present in the United
Kingdom has at least £1600 to support the family
member in addition to any funds the main applicant
needs to prove he/she has enough money to support
himself/herself.
31. If the main applicant has been in the United
Kingdom for 12 months or more, the family member
of the Tier 1 migrant must have £533 to support
himself/herself.
For example, main applicant has been in the UK
for 6 months, who is making an application at the
same time as his spouse and two children must show
that he has £1600 for his spouse and £1600 for
each child, in addition to £800 required for his own
support. In total the family will require evidence that
they hold £5600 in available funds (£1600 x 3 = £4800
+ £800).
32. If the same main applicant and his family had been
present in the UK for two years, they would require
evidence that they held £2399 (£533 x 3 = £1599 +
£800) in available funds.
33. If a dependant applies separately from the main
applicant, there must still be enough funds to support
each member of the family. Therefore in the example
above, if the family has a third child, the main
applicant has been in the United Kingdom for two
years and the family appiles for leave to remain for the
third child separately, they must provide evidence that
they have an additional £533 in available funds


The balance of probability as always  insinuated ECOs are discretion which they exercise in deciding an EC.But can be challenged if it fall short as advised by their case work instructions.

   I don't want to wish her ill luck, but from observation, i regret to say that a visa application on such situation will by no means result in a refusal.

   One of the most traditional requirements for visa application assessment is the applicant or sponsor's financial status which also consist of job or occupation: Whether the husband's course lasts for one year or 20 years, under no circumstance will a visa be issued when the person inviting him/her is jobless.
   Most Nigerians get visa refusals because they're not well prepared or are rather misinformed. Let's not build hope on illusion nor invest career on faith. There's no such thing as "proof that you can get a job in the UK", such a prove does not exist, it's either you have a job or you don't have one.
   
   Man, don't disappoint me with the 800k thing, or perhaps we're taking about $800k, USA?

   Though, every application is said to be treated in its own merit, but the fact remains that previous application outcome do influence subsequent ones, if not, there wouldn't have been such questions as:
*"Have you ever applied for a UK visa before?"
*"Was it issued"
*Did you appeal"
*How's this application different?" etc

   Please, guys, let's not just form the habit of encouraging everyone to apply with illussional hope, let's assess the situations of applications before encouragement: As for me, i believe it's better to prevent a winner than to persuade a looser.
ECOs are guided by the IMMIGRATION DIRECTORATES’ INSTRUCTIONS and the case in question is guided by Para 76 of the Uk immigration rules.

Spouses of students or civil partners of prospective students
Requirements for leave to enter or remain as the spouse or civil partner of a student or prospective student
76. The requirements to be met by a person seeking leave to enter or remain in the United Kingdom as the spouse or civil partner of a student or a prospective student are that::

(i) the applicant is married to or the civil partner of a person admitted to or allowed to remain in the United Kingdom under paragraphs 57-75 or 82-87F; and

(ii) each of the parties intends to live with the other as his or her spouse or civil partner during the applicant's stay and the marriage or the civil partner of is subsisting; and

(iii) there will be adequate accommodation for the parties and any dependants without recourse to public funds; and

(iv) the parties will be able to maintain themselves and any dependants adequately without recourse to public funds; and

(v) the applicant does not intend to take employment except as permitted under paragraph 77 below; and

(vi) the applicant intends to leave the United Kingdom at the end of any period of leave granted to him.

Leave to enter or remain as the spouse or civil partner of a student or prospective student
77. A person seeking leave to enter or remain in the United Kingdom as the spouse or civil partner of a student or a prospective student may be admitted or allowed to remain for a period not in excess of that granted to the student or prospective student provided the Immigration Officer or, in the case of an application for limited leave to remain, the Secretary of State is satisfied that each of the requirements of paragraph 76 is met. Employment may be permitted where the period of leave granted to the student or prospective student is, or was, 12 months or more.

Refusal of leave to enter or remain as the spouse or civil partner of a student or prospective student
78. Leave to enter or remain as the spouse or civil partner of a student or prospective student is to be refused if the Immigration Officer or, in the case of an application for limited leave to remain, the Secretary of State is not satisfied that each of the requirements of paragraph 76 is met.

As for my hubby, though he has his own private accommodation, NI, pay telephone bills,bank account , but the issue is that he does no work and if i should include all these the ECO might want to see his source of income like payslip or so. Please more encouraging advise is welcome

I am sure your application will have a positive outcome.
If your husband course will last for another 12 months,your will be given a dependent visa for 12+ months which will entitle you to work.With your qualification/experience and possible proof that you will be able to secure a job in the UK(Print out from Online job agencies that suit your qualification and experience) will help.
Secondly,with a total of 800K (naira) in your account is a boost and a proof that you will not be a burden to the state(recourse to public funds).
Third,your past visa denial maynot be revelant in this case because of changes in your circumstances since the last refusal.
Lastly,the ECO will bear in mind Article 8 the right to family life when deciding your application,provided their proof that the marriage exist.

Nigerian professionals ignorant of ''progress'' at home

A professor of veterinary medicine at the Tuskegee University, Alabama, United States of America, Prof. Lekan Ayanwale, has said most Nigerian professionals abroad are not interested in returning to the country because they are ignorant of the progress the nation has made over the years.

Ayanwale, who migrated to the USA in 1996, said that the professionals still believed that the condition that forced them to seek greener pastures persisted in the country.

The former University of Ibadan lecturer, however, declared that the brain drain that hit the nation in the 1990s had turned out to be a blessing as most of his colleagues had been sufficiently equipped to fasttrack the development of the nation.

He spoke when he led a delegation of the Nigerians in Diaspora Organisation to former President Olusegun Obasanjo in Abeokuta, Ogun State on Wednesday.

He said the visit of the Ogun State members of the organisation, which was formed when Obasanjo was the nation’s President, was informed by the impact the body had made in changing the perception of most professionals abroad on the need for their input in the nation’s economy.

He said, “Most people are still not willing to return despite the mark they have made in their fields. They are ignorant of the mark Nigeria has made in different fields.

“The current trend that we are encouraging in NAIDO now is to help some people to train abroad; gain the skill and knowledge and come back home to use it to help the country.”

Ayanwale, who is the coordinator of the state indigenes in NAIDO, contended that the nation had gained from the exodus of its core professionals and academics to foreign countries.

He said, “I believe the skills and knowledge we have acquired had helped us to compete favourably with our counterparts anywhere in the world.”

Given that your husband is a student, a dependant who does not have a job, i regret to advise you that he does not meet up to the requirement for spouse invitation, therefore, you'll not be eligible for spouse visa.
Though, previous visa refusals do affect subsequent applications, but yet, every application is said to be considered in its own merit.
The husband not having a job as a student will not be used in totality to decide on a balance of probability,bearing in mind the uncle is the sponsor and the poster(wife) is a worker in Nigeria(maybe with some savings)and she can as well prove her possibility of getting a job when in the UK(CV,job adverts and her profession).

Kudos for various good response to individual visa enquiries, my question is

I want to apply for student dependant visa to stay with my husband who is a student in UK, what are the necessary documents to submit with this application? as my hubby there is not working his uncle who sponsored him sends money to him but am working here, also i have applied for student visa and was denied thrice here, i hope this does not have any effect on any other application.

Please note, my hubby came home and we are legally married after my student visa refusal was denied and we married legally as i have my wedding certificate (Islamic and registry)

There is no need changing to Carburetor because the can performance is made to specification which include Auto transmission.
From experience car fuel consumption is influenced by the following-
-The tyre pressure gauge level(it should be specified at the manual or the rear door)
-Level of transmission fluid
-Blockage of the the injector(fuel channel)
-Your driving habit
-City driving or highway

Let people who want to travel to please do.If the obsession is for a better life fine.Migration is part of human nature.I can tell you there alot of Nigerians even here in the UK who cannot regularise their stay after their studies and have no immediate plans to go back home.So what happen to them after all the ambitious trip to get a better education without a better plans for the post study period.

@brownbonno, I am over 100% sure that the information is true. and I am preparing maself for battle and like TOYOSI20 said, (sorry Toyo if I may bend your phrases, what can a person do in such a situation? accepting lies is like prolonging the inevitable. and I think that cutting ties from a close one is one of the hardest things to do in life. I think in my case the most painful one is that he´s been lying through his teeth all this while and he is still at it. better beat him at his game as I have been knowing about this for quite some time. There are tidbits of truth that are falling into place that really make my jigsaw puzzle to fit together.
My dear a jigsaw is an assumption.100% sure of your secondary evidence,might not be admissible in law.Since there is no perfection in human nature you can as well take your man in and enjoy your lives.
