vikiviko, It is sad to note of the visa refusal even with Wale professional and immigration history.But we must not loss sight of a fact that the issuance of Visa is not a right but a discretional offer to the applicant on a condition.This condition(s) are the Visa application requirement,in this case a hostel reservation/accomodation is needed for a visa to be approved. FYI Nigeria embassies have her requirements which have to the fulfilled for a visa to be approved. Wale as an experienced traveller should have known better and do the right thing.In either way Sweden/French,he need to meet the requirements. |

Osunbor's faction rejects PDP peace deal, Anenih urges truce From John-Abba Ogbodo, Abuja THE crisis rocking the Edo State chapter of the Peoples Democratic Party (PDP) may linger on as the faction loyal to Governor Oserhiemen Osunbor rejected the peace formula from the party's national secretariat. It said that the arrangement conferred undue advantage on the former chairman of PDP Board of Trustees (BOT), Chief Anthony Anenih. "We totally reject everything that has been said here. If you want election, come and meet us in Edo State. We have just seen and heard a script which we have heard many, many times before now. In Benin City, if you phone somebody now, he will read to you that very thing that has been kept as secret for a very long time. "In any case, we want to tell you, Mr. chairman, that we totally reject, repeat, I reject everything that has been said here. If you want do election or congress, come and meet us in Benin City. Thank you." This was the reaction of the Osunbor's faction, led by former military governor of old Bendel State, Samuel Ogbemudia after the PDP national Chairman, Prince Vincent Ogbulafor had spoken on the position of the National Working Committee (NWC) on the crisis in the state. At the end of the meeting, all the parties proceeded to the conference hall opposite the national chairman's office for the meeting. Ogbulafor, in his opening remarks, commended all the parties for the efforts being made to restore peace in the state chapter, stressing that PDP would not like to lose Edo to another political party. He reiterated that without peace in the state, there would be no progress. Going biblical, Ogbulafor noted that even in the bible, the emergence of Matthias was through election, an indication that there was politics in biblical times. 'I will not like Edo to go to another political party. Ogbulafor said he had consulted widely and the position of the leadership of the party was that the Anenih faction should be allowed to produce a new chairman for the state while the two controversial candidates on both sides-Edward Sado and Dan Orbih for Osunbor and Anenih stood disqualified. He asked the deputy national chairman to read out the other details which appeared to have conceded the chairmanship position at the ward and local council levels in the areas where the governor has strong hold to Anenih's faction. At the state level, the Anenih group was given chairmanship, treasurer, publicity secretary, financial secretary, woman leader, state vice chairman (south) state vice chairman (north) assistant secretary, assistant publicity secretary and organising secretary. On the state governor's side, they had deputy chairman, state secretary, state organising secretary, youth leader, auditor, legal adviser, state vice chairman, central, two assistant secretaries, assistant financial secretary, assistant organising secretary and assistant legal adviser. At the end of the announcement, which was punctuated at intervals with protest, Akhigbe, who said he did not belong to any faction, faulted the party and urged the leaders of the party to cancel the outcome of the last congress because the formula worked out by the party would not work. Curiously, immediately after the meeting, Anenih arrived at the party secretariat and held a closed-door meeting with Ogbulafor for about 30 minutes. Later, he offered to abide with the decision of the party's leadership. He said: "No sacrifice is too great to be made, particularly by those of us who are foundation members of the party in the interest of millions of our party men and women. "I appeal to all party members in Edo State to accept the decision of the PDP party and ensure that efforts are made to strengthen the party because of the numerous challenges ahead. saysth:FYI, The embassy have no right to with hold your WAEC certificate(either for forgery or otherwise).They are suppose to lodged the case with the Police and deposit the certificate as an exhibit.The onus is now on you to clear the issue with the Police with a proof of the originality of the document(alibi). Regarding your sponsor ,the company as you are aware is a legal entity and the finance/account belongs to the company and not your sponsor.Except there is a deed that specific a relationship between you and the company by way of employer-employee relationship or a WILL assigning the company to sponsor your education/undertakings in a situation of death of your parent/relation/major share holder etc. |

If i may ask, 1.Do you have proof of your initial entry into the UK(Visa)(not very important)? 2.Do you have 2 years documentary evidence as a proof of your cohabition with your partner(utility bills,bank statement etc)? 3.Do you and your partner have an accommodation ?4.Can you sustained yourself financially without recourse to public funds? If the answer to the above questions is YES.I suggest your best option is to apply/submit an application for the extension of leave to remain in the United Kingdom as the unmarried partner of a person present and settled in the UK. NOTE:If there is an enforcement against you before your application is made to the Home office,your 2 years cohabitation will be lost.Applying for EC from Nigeria means you have to fulfill all the immigration requirement for a fiance/married/spouse visa.Finally be aware that overstayers will have a UK EC ban for up to 10 years as from October 2008. You possible option is to apply for (FLR(m) as unmarried partner in a relationship akin to marriage(with documentary proof of at least 2 years of living together). Your marriage in the church may not be recognised if a licence was not sorted from the Marriage registry by your church for the marriage. Since the father of the expected baby is British, the Baby will be British at birth(even when you are illegal).You have to pay for your NHS cost as an overstayer except you put in your application to the Home Office to regularise your stay before your EDD. Mr. Aondoakaa, who has established a reputation as an ally of corrupt serving and former governors and ministers, is apparently turning his eye towards his ministry’s funds. Saharareporters is in possession of a document which reveals how the controversial minister compelled each department of his ministry to approve at least N1.1 million each towards his April 29 2008 press briefing. The document is in the form of a memo dated April 22 2008 was signed by Mrs. Abimbola Coker, the Secretary of the Nigerian Law Reform Commission. Minuted to the commission’s department of finance, the memo indicated that Aondoakaa had in a meeting required that each department contribute to the ministerial press briefing slated for April 29 2008. The media briefing was meant to present the ministry’s activities. A source within the Ministry of Justice told Saharareporters that Mr. Aondoakaa did not give any account of how the money was disbursed. The source also suggested that the minister may have levied various departments of his ministry according to the size of their budget, but we were not able to confirm that this was the case. However, we were able to obtain the approval granted by the Law Reform Commission. An Abuja-based senior advocate of Nigeria reacted by stating that “The memo gives a glimpse into the corrupt ways of the minister and the double standards applied by Yar'adua to deal with corruption amongst members of his cabinet.” The SAN also said: “I wonder why former Health Minister Professor Grange is being prosecuted when Mr. Aondoakaa has acted, and continues to act, in a more ethically improper manner both with regard to funds as well as his shameful effort to help people like [former Governor James] Ibori and [one-time Petroleum Minister] Dan Etete to evade prosecution abroad.” Saharareporters has reliably gathered that Yar'adua personally instructed that the minister of health case be “given maximum escalation” because of the involvement of Iyabo Obasanjo-Bello, daughter of former President Olusegun Obasanjo. Several sources have told Saharareporters that Yar’adua was aware that several other ministries were involved in the embezzlement of unspent budgeted funds. For example, investigators reportedly found that the customs department also embezzled its unspent budgeted funds, but Yar'adua decided to let the culprits to go unpunished. Also, Yar’adua’s close friend and minister of agriculture, Mr. Abba Ruma, was said to have misappropriated unspent funds at his ministry. But when he was caught, he and Yar'adua worked out a scheme to fly him out to Germany on the ostensible ground that he was critically ill. The Senate will soon begin the process of confirmation. However, I will like you to give consideration to the following issues arising therefrom:- 1. That the Office of the Chairman of the Economic and Financial Crimes Commission (EFCC) is not vacant. 2. That if you come to the assailable conclusion that it is vacant, Chief (Mrs) Farida Waziri lacks both moral and constitutional authority to be the Chairman of the Economic and Financial Crimes Commission (EFCC). ABSENCE OF VACANCY OF THE CHAIRMAN OF ECONOMIC AND FINANCIAL CRIMES COMMISSION (EFCC). (a) Appointment of the Chairman of EFCC Section 2(3) of the Economic and Financial Crimes Commission (EFCC) Act No. 1 of 2004 provides as follows: “(3) The Chairman and members of the Commission other than ex-officio members shall be appointed by the President and the appointment shall be subject to confirmation of the Senate” Mallam Nuhu Ribadu was appointed the Chairman of the Economic and Financial Crimes Commission (EFCC) and his appointment was confirmed by the Senate. After the expiration of his four (4) year term, Mallam Nuhu Ribadu was re-appointed in April 2007 for another four years by virtue of Section 3(1) of the Economic and Financial Crimes Commission (EFCC) Act, which provides as follows: “3(1) The Chairman and members of the Commission other than ex-officio members shall hold office for a period of four years and may be reappointed for a further term of four years and no more.” (b) Removal of Chairman of EFCC from Office Section 3(2) of the Economic and Financial Crimes Commission (EFCC) Act No. 1 of 2004 provides thus: “3(2) A member of the Commission may at any time be removed by the President for inability to discharge the functions of his office (whether arising from infirmity of mind or body or any other cause) or for misconduct or if the President is satisfied that it is not in the interest of the Commission or the interest of the public that the member should continue in office.” Mallam Nuhu Ribadu is the current Chairman of the Economic and Financial Crimes Commission (EFCC) and he has not been formally removed as Chairman of the Commission by the President in accordance with the enabling statute. Consequently, by the Economic and Financial Crimes Commission (EFCC) Act, the Office of the Chairman is not vacant. What then is the effect of Mallam Nuhu Ribadu’s posting to National Institute for Policy and Strategic Studies (NIPSS)? The National Institute for Policy and Strategic Studies is set up by an Act i.e. National Institute for Policy and Strategic Studies Decree No. 20 of 1979 (now Act) contained in Cap. N51 Laws of Federation of Nigeria, 2004. The directive or order for Mallam Nuhu Ribadu to proceed to National Institute for Policy and Strategic Studies cannot be taken as his removal from office as Chairman of the Economic and Financial Crimes Commission (EFCC). Whether the order that he should go to N.I.P.S.S. was made by the President or the Inspector-General of Police cannot be substituted with the clear provision of Section 3(2) of the Economic and Financial Crimes Commission (EFCC) Act. In any event, the training arrangement/Instruction/Directive/Order either by the President or by the Inspector-General of Police cannot be tantamount to the removal of Mallam Nuhu Ribadu from office. The Inspector-General of Police has no right to order Mallam Nuhu Ribadu to go on a course in the NIPSS because Nuhu Ribadu, after confirmation of the Senate, has become a special public officer enjoying statutory protection brought about by the confirmation of the Senate in accordance with the Economic and Financial Crimes Commission (EFCC) Act. Importantly, Mallam Nuhu Ribadu was no longer under the command and control of the Inspector-General of Police who is a member of the Commission with Mallam Nuhu Ribadu as the Chairman in accordance with Section 2 of the Economic and Financial Crimes Commission (EFCC) Act. I can liken the Mallam Nuhu Ribadu situation with a Commissioner of Police who has not retired and who is nominated as a minister by Mr. President. Once his appointment is confirmed by the Senate under Section 147(2) of the Constitution of the Federal Republic of Nigeria, 1999, can the Inspector-General of Police remove him from ministerial duties to go to NIPSS for one year? The obvious answer is NO. Mallam Nuhu Ribadu is in the same position. His appointment has been previously confirmed by the Senate. How can the Inspector-General of Police override the Senate confirmation? It will be against the tenets of the Economic and Financial Crimes Commission Act and the spirit and intendment of the confirmation power of the Senate. The moral incapacity of Chief (Mrs) Farida Waziri to be confirmed as the Chairman In the unlikely event that the Senate comes to the remote conclusion that the Office of the Chairman of Economic and Financial Crimes Commission (EFCC) is vacant, I make bold to say that the nominee of Mr. President, Chief (Mrs) Farida Waziri, has no moral capacity to head the Economic and Financial Crimes Commission (EFCC) on the following grounds: Although Section 2(1)(a)(ii) of the Economic and Financial Crimes Commission (EFCC) Act allows a serving or retired officer not below the rank of Assistant Commissioner of Police or equivalent to be appointed as Chairman of Economic and Financial Crimes Commission (EFCC), Chief (Mrs) Farida Waziri cannot be appointed and confirmed as such, because she has acted at least in one instance in a way which, if appointed the chairperson of the Commission, it will bring her in conflict with the Code of Conduct for Public Officers enshrined in Part I, Paragraph I in the 5th Schedule of the Constitution of the Federal Republic of Nigeria, 1999. (a) Senator George Akume a former Governor of Benue State and now a current Senator of the Federal Republic of Nigeria since 2007 was under serious investigation of the Economic and Financial Crimes Commission (EFCC) for alleged acts of corruption. His International Passport No: A0086687 issued on 10th February, 1999 was seized by the Economic and Financial Crimes Commission (EFCC) in the course of investigation while serving as a senator. (b) On 8th November, 2007, Chief (Mrs) Farida Waziri as surety to Senator George Akume, an Economic and Financial Crimes Commission (EFCC) suspect under investigation, collected Senator George Akume’s International Passport No; A0086687 which was earlier seized by the Economic and Financial Crimes Commission (EFCC) to prevent Senator George Akume from travelling out of the country. Obviously, this act by Chief (Mrs) Farida Waziri really showed some sort of “relationship” between Senator George Akume and Chief (Mrs) Farida Waziri. It also shows some personal interest that Chief (Mrs) Farida Waziri has in the investigation of Senator George Akume by the Economic and Financial Crimes Commission (EFCC). EFFECT OF CHIEF (MRS) FARIDA WAZIRI’S ACT ON THE CODE OF CONDUCT FOR PUBLIC OFFICERS IN THE CONSTITUTION If Chief (Mrs) Farida Waziri is confirmed as the chairperson of Economic and Financial Crimes Commission (EFCC), what she did on the 8th day of November 2007 in respect of Senator George Akume is clearly in conflict with Part I, Paragraph I in the 5th Schedule of the Constitution of the Federal Republic of Nigeria, 1999, which provides that: “1. A public officer shall not put himself in a position where his personal interest conflicts with his duties and responsibilities.” The moment Chief (Mrs) Farida Waziri is confirmed as Chairperson of the Economic and Financial Crimes Commission (EFCC), her duties and responsibilities as Chairman of the Commission will bring her in conflict with the interest generated in Senator George Akume’s investigation for corruption which will affect her decision to charge Senator George Akume to court for prosecution or not. If I may ask the question – Is there every likelihood that this interest may lead the Economic and Financial Crimes Commission (EFCC) to compromise the Senator George Akume investigation thereby tainting the moral and statutory authority she may have as the Chairman of Economic and Financial Crimes Commission (EFCC)? The obvious answer is YES. It is equally obvious that when it comes to the confirmation process on the floor of the Senate, it will be unnatural for Senator George Akume not to vote for the confirmation of his benefactor. THE MESSY SITUATION OF THE CONFIRMATION PROCESS OF CHIEF (MRS) FARIDA WAZIRI At the moment, the following Senators are facing criminal prosecution for corruption in the law courts in Nigeria: 1. Senator (Dr) (Mrs) Iyabo Obasanjo-Bello 2. Senator (Dr) Chimaroke Nnamani 3.
