The Economic and Financial Crimes Commission has released the statement below announcing the release of Innocent Chukwuma, the chief executive officer of Innoson Motors.

The businessman was released on bail, the EFCC said.

The Economic and Financial Crimes Commission has released Nnewi, Anambra-State born Industrialist, Chief Innocent Chukwuma on bail.

The business man who runs a local auto assembly plant was arrested on Tuesday December 19, 2017 at his Enugu residence, following his refusal to respond to invitations by the Commission, after initially being granted administrative bail by the Commission, while his surety could also not be found.

Unfortunately the industrialist resisted arrest and stirred controversy by bringing six truck-loads of thugs to block the entrance to his Plot W1, Industrial Layout, Abakaliki Road, Emeni, Enugu, home.

This was after he initially misled the Police Command by informing them that his home had been invaded by armed robbers and kidnappers despite the fact that operatives of the Commission duly identified themselves to policemen guarding his home.

His unruly thugs encircled and manhandled operatives of the Commission who had gone to effect the arrest.

Consequently, a distress call was sent to the Commission’s Enugu Office for reinforcement.

In all of this, the Commission’s operatives acted with decorum and civility. No one was manhandled or assaulted by the EFCC team, and not a single shot was fired, despite the provocation.

Chief Chukwuma and his brother, Charles Chukwuma (who is still at large), are being investigated by the Insurance and Capital Market Fraud Section of the Commission’s office in Lagos over matters bordering on N1, 478, 366, 859.66 fraud and forgery.

The industrialist, among other infractions, allegedly used forged documents to secure tax waivers.

This is barely comprehensible.
The way and manner EFCC muddled up issues here is indicative of an attempt to hoodwink the readers.
Is the alleged "deployment of tugs" part of the reason for arresting Innoson?

Nigerians demand a more wholistic and clearer reason for the arrest and not merely this terse statement.
The investigation into Insurance and Capital Market Fraud is not good enough reason to arrest him, the EFCC should have invited him and if they did, we need to sight copy of the invite.

Our law enforcement bodies must not only be fair but must be seen to be fair.

The governments policy aimed at encouraging local & foreign investments should not be jeopardized by the over-zealousness of agencies like the EFCC.

I think there are agitations here and there for one thing or another but its only Igbos that have continually sought secession. Apart from this, I think Nigeria is largely united and that is why the 1967 attempt was not successful.

Furthermore by being a contract staff it means you are working at the will of your employers, you have no right other than what is stipulated in the terms of the contract of your employment and usually under this type of employment the employers will prepare the terms of the employment solely which favours them and when you sign, it is binding and you can be relieved of the employment at any time, because you are not a permanent staff. There is nothing bad and it has no effect which is beyond the employment.

TO KNOW MORE ON EMPLOYMENT READ FUTHER

Now there are 3 types of employment
* EMPLOYMENT WITH STATUTORY FLAVOURsademployment backed by the Law in which an employee can not be dismissed or tamper at the will of the employer) Eg Civil service, public Service.

*EMPLOYMENT UNDER CONTRACT: (Master Servant relationship) in which the employment is determine by the terms of contract if there is no agreed term the Employer has right to do what ever he likes at will even to the extent of waking up and dismiss the employee without any reason and the Law in this situation can not be of any help. Because you cannot force a willing servant on an unwilling Master.

*EMPLOYMENT AT PLESURE OR WILL OF THE EMPLOYER:, in this type of employment the employee is working at the will of the Master and the Master can do whatever he likes and at any time concerning the employment.

TERMINATION OF A MASTER AND SERVANT EMPLOYMENT

A master can terminate the employment of his servant at any time and for any reason or for no reason at all provided the termination is in accordance with the terms of the contract of employment the motive for such termination is irrelevant. See Osianya v. Afribank Nig Plc. (2007) 6 NWLR (Pt.1031) 565 (SC).

TERMINATION OF WRITTEN CONTRACT OF EMPLOYMENT

Where there is a written contract of employment, it is outside the province of the Court to look anywhere for terms of termination of the contract, other than in the written contract. See: Katto vs. C.B.N (1999) 6 NWLR (Pt. 607) 390 at 405, paras. D-F.

The terms and conditions of contract of employment are the substratum of any case where the issue of wrongful termination of employment calls for determination. The importance of the terms of a contract of service in determining the question of termination of the contract was emphasize as follows by Mohammed JSC in Ifeta v. Shell Pet. Dev. Co. Ltd (2006) 7 MJSC 121 at page 133, para. G
"In the determination of this issue, I need to emphasize the bindingness of the terms of the contract of service between the parties. There is no doubt that the parties’ freedom of contract carries with it the inevitable implication of sanctity of their contracts. This means that if any question should arise with respect to the contract, the terms in any documents which constitute the contract are, invariably, the guide to its interpretation. On this premises, the material question is; what did the parties in the instant case agree with respect to the termination of the contract of service”
In the absence of a written contract of employment either of the parties could abrogate the contract on a week’s or a month’s notice, or on payment of wages for a week or a month or whatever was agreed period for payment of wages.

That is the Law in Nigeria !!!

My father had served the government for 35years and also as a principal of schools. Tho a pensioner.
Five years ago he was employed by a renowned private school as the principal.

Prior to his employment, there was this principle that was sacked because of his misconducts...like fighting teachers, misappropriation of funds and all. He happened to be the husband of the daughter of the aged owner of the school. The owner of the school sacked the man and that was how my father came into the picture. This is his 5years in office, he had convinced the aged owner who's in London for increase in teachers salaries, pays them during the school holidays, borders quality food and steady electricity. He was loved by all and even as his son I also felt the tremendous changes in the school. He took this school as his own and I know he used to support the school from his own purse according to the staff.

One morning, yeah...last week, we got a call from the man's daughter that my father should resign with immediate effect that her husband again is taking over. Not just that, but also has just 2days to pack out or vacate the school premises.

Just like that? We called the owner but not reachable and according to reports the old man is sick, treated in London and his son is also in London. So the daughter was handed over to manage the school since she's the one in the country. Just last term, my father realised so much money and yet the daughter refused paying anybody that there's no money for any payment.

My father has packed to the village and I can't move to the villa with him since I'm still job hunting in the city.
Truth is I'm staying with a friend for now to fix my head round this whole ish and pension isn't steady for my father... I need at least something doing just to support them.

I'm open to work anywhere provided the pay is good.
I've got a poultry farm but capital to install it for production.

I've read testimonies here and I believe in no time all this shall be history. smiley
