Gombe State Governor, Ibrahim Hassan Dankwambo has described the attack on Governor of Ekiti State, Ayodele Fayose as shameful and undemocratic. Dankwambo’s statement followed manhandling of some supporters of the Peoples Democratic Party, PDP, including the Governor of the State, Mr. Ayodele Fayose in Ado-Ekiti, the State capital, allegedly by security operatives on Wednesday. We earlier reported that Fayose was teargassed by the policemen who laid siege at the Government House and was now receiving treatment at the Government House’s clinic. Reacting to the development, which has been widely condemned, Dankwambo said the attempt by APC to rig Saturday’s election will be resisted. He noted that there would be no need for deployment of 300,000 policemen if public institutions were independent. Dankwambo on his official Twitter page wrote “Just got off the phone with my brother, Governor Ayodele Fayose of Ekiti State. He has briefed me on the ongoing harassment by security operatives. What is happening in Ekiti state is shameful and undemocratic. Ekiti State Police & PDP Eyewitnesses Fault Fayose Attack Claim “Nobody Beat His Excellency.. His Security Details Were With Him” Ekiti State Governor Ayo Fayose sparked a huge controversy yesterday when he claimed that the police attacked him. The governor claimed that the police shot at him and fired teargas that blinded him in Ado Ekiti, the state capital. But the Police said the governor was not attacked. They said policemen fired teargas to disperse a crowd of people after they had been advised not to hold a rally. Reporters who were at the Police Headquarters rushed down to the Fajuyi Pavilion, venue of the planned rally when the news broke that the crowd was being dispersed. A Peoples Democratic Party (PDP) source claimed that Fayose was attending to complaints from members who had been denied access to the pavilion when a teargas canister fired from outside the Government House landed very close to him. The governor inhaled the teargas and went down, he said. Asked if other people with the governor did not inhale the teargas, the source did not reply. He said Fayose was taken to the Government House Clinic. The governor later emerged from the clinic with neck brace to address the crowd that gathered at the Government House. Fayose alleged that he was slapped and kicked by a police officer. He also alleged that he had been ordered to be killed. A PDP source who requested anonymity said the police did not enter the Government House, adding that “nobody beat His Excellency” who had his security details with him. Deputy Governor and PDP candidate in Saturday’s election, Prof. Kolapo Olusola, also alleged that he was beaten by policemen. The police said they stopped the PDP rally for security reasons and to maintain law and order. Deputy Inspector General of of Police (Operations) Habila Joshak said the PDP neither sought for nor got permit for any rally. Joshak said no unauthorised rally would be allowed in the state before Election Day on Saturday because of the prevailing security situation. It was leant that the APC leadership wanted to organise a road show which the police declined to approve. It was promptly cancelled. The Police Headquarters said “In furtherance to the presence of police officers around the Prof. Olusola Eleka pavilion at Fajuyi today (yesterday), two political parties intend to have their rally at the same date and in Ado-Ekiti metropolis but the commissioner of police advised the political parties in writing on the need to have theirn political activities at diferent time and because of the security implication.” Prince Dayo Adeyeye, who defected to the All Progressives Congress (APC) after the Peoples Democratic Party (PDP) primaries, described Fayose’s claim as the latest “stunt” from “a clownish dramatist.” It was not clear yesterday why it was only the governor who inhaled the teargas and how he got his neck injured as he addressed the crowd at the Government House wearing a neck collar. The Yoruba Council of Elders (YCE) called for peace in the state. Interim Chairman Adeleye Agbede said: “Ekiti are a peace loving people with unrivalled passion for education and development. Try to get your information right. According to the Government House sources, Fayose was enjoying himself taking gulder when the incident happened. He was informed that police fired the tear gas when Fayose's supporters threatened to burst out of the Government House for a street show that was never permitted by the police. This is not the first time Fayose is acting in this manner. He once organised a fake assassination theory when he asked his security aides to shoot his vehicle on a Lagos bridge to later claim that assassins sent by the opposition shot at him. In the course of investigation, the security aide that fired the shot confessed that Fayose was acting a stunt. Do you remember when Fayose set his G-Wagon on fire in Lagos because EFCC agents were on the trail of his car driven by his aides and loaded with hard currency suspected to be proceeds of crimes? Fayose is a man that will wrap a copy of English dictionary with the back cover of the Holy Bible and use it to swear to con his victims. Did you see him how he wept when Dr Daramola was assassinated? Do you remember the question he asked from his aides after that weeping session? He asked them: "Did I weep very well that will convince the people that I was innocent?" Do you recall that he did the same when Omolafe Aderiye was assassinated in Ado-Ekiti? Later nko, who was being fingered as Aderiye's alleged killer? I can give several other instances where this crook will act this way to deceive the public. The question we need to ask is: in the crowd of about 1,000 people, how come that it only Fayose that was affected by the fumes of tear gas? He claimed that his neck was broken. Can tear gas cause a break of the neck? Now he is saying that he wanted to go to the hospital even though all that he is planning is to escape from Nigeria. This is pure foolery. I am not one that will fall victim of that shameless lie that a gas fume will cause a man to break his neck, forcing a grandfather to be crying like a baby on television screen. Sir, listen carefully to the Channels footage of the scene and you will hear a voice in the background complaining that this trick will backfire to scare ordinary PDP members on election day. Fayose's action is a criminal and shameful manipulation of an incident that did not happen. Fayose should have waited till Saturday for real weeping sessions after Ekiti people would have finished with him. Shio! I only pity those who believe in Fayose's lie for obvious reasons. Ekiti State Governor Ayo Fayose has accused the Federal Government of blocking the gate of the Ekiti State Government House with security forces on Tuesday. Riot policemen prevented vehicles from going in and out of the Government House but allowed pedestrians to gain access into the facility. Drivers’ union members had dropped their vehicles at the Government House as directed by Fayose Monday night where an all-night party held till Tuesday despite the heavy deployment of security men. But pedestrians were allowed to go in with many going to join the Ekiti drivers unions who assembled at the government house since Monday night. A musician was on the band stand to entertain the commercial drivers and People’s Democratic Party (PDP) members on ground. Fayose also mocked the APC final rally held same day accusing the party of importing outsiders from neighbouring states to fill the stadium. Addressing the crowd at the party, Fayose criticized the Federal Government for blocking the gates of the Government House with battle-ready riot policemen. The Ekiti governor described the development as “an abnormality.” He thanked his supporters for shaming the All Progressives Congress (APC)-led Federal Government by appearing at the Government House despite the security presence. According to him, the presence of the crowd had proved to the APC that the masses were for him. Leaders of National Union of Road Transport Workers (NURTW), Road Transport Employees Association of Nigeria (RTEAN) and Pickup and Lorry drivers Association of Nigeria (PLAN) and Okada Riders Association vowed to vote for PDP candidate, Prof. Kolapo Olusola at Saturday’s governorship election. Ekiti State Governor Ayodele Fayose has described his Kogi State counterpart, Yahaya Bello as a “small boy” who is not a product of true democracy. In reaction to a statement made by Bello at the mega rally of All Progressives Congress (APC) in Ado-Ekiti on Tuesday, Fayose said thugs imported into Ekiti State by the Kogi state governor will not help the cause of APC governorship candidate on election day. The outgoing Ekiti state governor said Bello is a small boy who is trying to pay back those who rigged him into office. He encouraged Bello to learn from Ekiti before leaving the state. “He is a small boy, I don’t want to join issues with him. But tell him to learn from Ekiti when he is going back. He should see that flyover, there is nothing like that in Kogi. “There is no good road in Kogi. When you are coming from Ondo state, there is no good road until you get to Ekiti. When you are coming from Kogi, there is no good road until you get to Ekiti. “Tell Yahaya Bello that I cannot continue to reply the dog in my house. Yeye Bello is a small boy, he has no experience, he is an ordinary driver,” he said. The Police in Sokoto has arrested a self-confessed fraudster, Mahmuda Hamza, who has been extorting money from people with a police identity card. Parading the suspect with some area boys at the police headquarters in the state on Friday, the command’s Public Relations Officer, DSP Cordelia Nwawe, maintained that the Commissioner of Police in the state has declared war against area boys and other miscreants. The PPRO also advised parents to talk to their wards to be law-abiding “as it is not going to be business as usual for criminals in the state.” Hamza, in an interview with our correspondent, explained that he took the identity card from a deceased policeman and attached his passport photograph to it. “I am a fraudster and I know I have committed an offence but I am pleading, I will not go into crime again if I am pardoned. I am not an armed robber, but a fraudster. I have two wives and seven children and I feed them all from the money I make through this fraud,” he explained. The police also paraded one Usman Danmaliki, who hired dismissed police officers to extort money from villagers. Danmaliki was rearrested in a court premises after appearing before a magistrate for a similar offence. Port Harcourt Based Man Murdered During Visit To Pregnant Girlfriend In Abakaliki, Corpse Thrown Into Ditch Ebonyi State police on Sunday discovered the body of a man in a ditch near the military cantonment at Nkwoagu community in Abakaliki Local Government Area of Ebonyi State. The deceased, whose identity could not be immediately ascertained, hailed from Ishieke community in Ohaukwu Local Government Area. According to local sources, the man had come from Port Harcourt in Rivers State to visit a girl who he intended to marry. The visit was said to be his first since they began to talk on the phone. Sources added that the deceased stayed with his lover, who runs a small shop near the military cantonment, on Saturday and that they both were going home in the night before they were waylaid by some masked men. Confirming the incident, the state Police Public Relations Officer (PPRO), ASP Loveth Odah, said the body was found close to the military cantonment yesterday morning. She said: “ So, she has a private shop somewhere there. They left the shop and headed to their house. They wanted to sleep in the shop but the boy complained of mosquitoes. So they then headed to the (girl’s) house. “That day was the first time the boy was visiting that girl. The boy himself is from Ishieke community. May be somebody recommended the girl for marriage. The girl said that as they were going, three boys on masks accosted them and pursued them into a ditch. “ She was able to escape but those boys focused on the boy. They stabbed him to death while she ran for her dear life. So, this morning (yesterday), she then went and narrated the story to an elder in the community. “The elder came and searched through that ditch. That’s where they found the dead body of this guy.” Odah said there was suspicion that the girl’s former lover might have a hand in the death as the girl is currently pregnant. She reasoned that there was no way a new lover who came for the first time could have put the girl in the family way. A Lagos Magistrate’s Court sitting in Ikeja has granted a quack midwife, Regina Ibeto, bail in the sum of N50,000 following her arraignment for selling a newly born baby. Ibeto, 50, was arraigned alongside three others, Joy James, Gold Chukwunonye and Nkiru Ekezie, on two counts of child stealing. It was gathered that the mother of the baby, one 16-year-old Bukky, gave birth to the child on March 17, 2018 at Ibeto’s unregistered centre on Bunmi Ajakaye Street, Ajangbadi, Lagos. Bukky, who was reportedly impregnated by her stepfather, was taken to the centre by James with an arrangement to sell the baby upon delivery. Less than a week after the birth, the midwife reportedly sold the baby to one Nkechi through her friend, Ekezie, and Nkechi’s elder sister, Chukwunonye, for N250,000. James reportedly got N30,000 from the proceeds. We learnt that a neighbour of the midwife, who got wind of the criminal deal, tipped off the police and four of the suspects were arrested while others were at large. Ibeto said she sold the baby, who had been recovered, because Bukky told her she was impregnated by her father, and wanted to do away with the baby. She said, “I was at home when a friend brought Bukky who was due for labour. Bukky told me how his father impregnated her and said she wanted to abort the pregnancy because it was a product of abomination. “I asked her if she really meant what she said and she answered in the affirmative. I felt it would be an abomination if people got to know about the issue. I also felt she was too young for the stigma. “Luckily, Bukky was delivered of a boy and we sold him to Chukwunonye. I gave Bukky part of the money to start a new life and advised her to stay away from her father. She left and Chukwunonye took the baby boy. “I do not think I did anything bad. I only helped the young girl who was in confusion. The police later came to arrest me, accusing me of inducing pregnant women to deliver. I only assist women in labour to deliver their babies.” Ekezie, a mother of six, who hails from the Ekwusigo Local Government Area of Anambra State, told the police that although the money for the baby was paid into her account by Nkechi, she did not get any share. The 38-year-old said Nkechi had been barren for 18 years and had wanted to adopt the baby, adding that she was only trying to help her. She said, “Mrs. Ibeto is my friend. She called me on the telephone that a woman gave birth at her centre and that I should find a buyer for the baby. I called my friend, Nkechi, who lives in Imo State if she was interested in the baby. She agreed to buy the baby. “She sent N250,000 into my account. Out of the sum, N30,000 was for the upkeep of the baby pending when he would be taken to Imo. I withdrew the money and gave it to Chukwunonye, who paid to Mrs. Ibeto and collected the baby. The arrangement was that Chukwunonye would take care of the baby for one month. Nkechi has been barren for 18 years and I thought I was doing her good.” Chukwunonye, 45, explained that she agreed to buy the baby on behalf of her sister after Ibeto assured her that it would not backfire. She said the nurse had told her that the father of the baby was blind and was in dire need of money for treatment. A police prosecutor, Inspector Ben Emuerhi, on Tuesday, brought the four arrested suspects before an Ikeja Magistrate’s Court on two counts of stealing. The charges read, “That you Joy James, Regina Ibeto, Gold Chukwunonye and Nkiru Ekezie, on May 17, 2018 at 96, Bunmi Ajakaiye Street, Shibiri, Lagos, in the Lagos Magisterial District, did conspire among yourselves to commit felony to wit; child stealing, thereby committing an offence punishable under Section 411 of the Criminal Law of Lagos State, 2015. “That you, Joy James, Regina Ibeto, Gold Chukwunonye and Nkiru Ekezie, on the same date, time and place in the aforementioned magisterial district, did fraudulently take away one baby from her biological mother, thereby committing an offence punishable under Section 277 of the Criminal Law of Lagos State, 2015.” The defendants, however, pleaded not guilty to the charges and elected summary trial. The presiding magistrate, Mrs. O. Chairman of United Bank for Africa (UBA) Plc, Mr Tony Elumelu, has donated the sum of N500 million to boost the wealth creation programmes of Delta State Governor, Mr Ifeanyi Okowa. According to Mr Elumelu, who announced the donation yesterday, the fund would be provided by the Tony Elumelu Foundation (TEF), UBA group, Heirs Holdings, Transcorp, among others. The serial entrepreneur, who led some beneficiaries of TEF on courtesy call to Governor Okowa at the Government House in Asaba, expressed joy that within three years of being in office, the administration has impacted a lot on the lives of the people both in terms of provision of infrastructure and encouraging the jobless to be wealth creators through different skill acquisition and entrepreneurship programmes of the administration. “This is homecoming for me, I want to thank the Governor for everything he is doing in our state, there is a lot of improvement and from the airport to this place (Government House), we have seen a lot of projects,” he said, adding, “we are happy that within these few years, you have programmes where the beneficiaries have become employers of labour, we are going to create specific programme in Delta State and we are committing the sum of N500 million to the programme, the money will be from the Foundation, the UBA group, Heirs Holdings, Transcorp, among others.” In his remarks, Mr Okowa commended Mr Elumelu, who has empowered a lot of Africans through his foundation, disclosing that his administration has created a lot of entrepreneurs through different skill acquisition and empowerment programmes. According to Governor Okowa, the federal government should emphasise the need for Nigerian youths to go beyond acquisition of education certificates to include the acquisition of relevant skills that will enable them to be self employed. “We must be looking seriously at technical education to enable our children acquire relevant skills, as a government, we are changing the narrative when it comes to empowerment programmes, empowerment in our state has gone beyond just buying items for the people, but requires equipping the people with relevant skills that will enable them contribute to the growth of the society,” he said. A man arrested for setting his brother’s daughter on fire in Cross River state was today paraded by the State Police Commissioner Hafiz Inuwa. In his confession, 37-year-old Leo Columbus told reporters he set his 3-year-old niece on fire because she defecated in a neighbour’s house in Akamkpa local government area of Cross River State. According to him, he did not intend to kill her and only acted out of anger because of the child’s behavior. He said he started taking care of the child, his brother’s daughter, two years ago. Columbus said his neighbours had been complaining a lot of times that the little girl, who parents are in Lagos, was always defecating in their houses. “People had been complaining until that fateful day. It was not purposely. Someone came and reported to me that he had defecated in their place. With the annoyance that she went and shit in someone’s pumpkin and water leaf, I beat her,” he said,He said at the time he was burning some grasses and in anger threw the fire on her, which severely burnt part of her body. He also denied tying her to a tree while she was on fire. “When I saw she was burnt, I said look at what you have caused to me. I regretted. I applied JV and bought drugs and gave to her. I did not plan to kill her. She is brother’s daughter. I did it out of annoyance. It was anger that made me do it,” he said.He said he always leaves the little girl when going to work. “I can’t lock her inside. I always tell her to stay in the house and even if she wants to go to toilet, she should do it in the house, but she still goes out and shits in the neighbour’s houses,” Columbus said. Inuwa said Columbus was arrested immediately he set the girl on fire, while she was tied to a guava tree. Candidates have been selected from each State based on the criteria below: Criteria For Award - Pupil must be Nigerian and have written the National Common Entrance Examination organized by NECO in 2018. - Pupil must be indigenes of the State in which they were selected from. - Pupil must be in their final class (Primary 6) of a public primary school in Nigeria. - Pupil must be physically present to write the test at the designated school in the different locations. - Guardian/parents of pupils must sign a consent form confirming the authenticity of documentation provided during the accreditation exercise. The Ekiti State Governor, Ayo Fayose has again raised “disturbing and worrisome information” on alleged plots to rig the election in favour of the All Progressives Congress (APC) and its candidate, Dr. Kayode Fayemi. Fayose, in a personal statement he signed Monday night, listed INEC National Commissioner, Mrs. Amina Zakari, two Deputy Directors (ICT Dept), Mr. Paschal Uwaenwe and Mr. Abdulrazaq Agboola Yusuf as well as Director (Procurement Dept), Mr. Kenneth Ukeagu as the arrow-heads of rigging plot. Earlier on Monday, Zakari denied that she was working to rig the election for Fayemi and th APC. Buhari Fayose said that “The duo of Uwaenwe and Agboola are to pre-load card readers, supply faulty card readers to Ado and Ikere while Kenneth Ukeagu is to provide ballot papers for stuffing of ballot boxes, Forms EC8A, EC8B and EC8C series and other sensitive election materials. Two sets of the Forms are to be procuced bearing the same Serial Numbers. One set will be handed to Fayemi to change results of 503 Polling Units. “Also, real Youth Corps members, students of the Federal University, Oye Ekiti and Federal Polytechnic, Ado Ekiti that are to serve as Presiding Officers (POs) and Assistant Presiding Officers (APOs) are to be replaced with APC members. “Fayemi and other APC leaders have been meeting with these three INEC officials in Akure and Abuja and they are reporting directly to Mrs Amina Zakari. “Furthermore, Fayemi’s ex-Chief Security Officer (CSO), Hakeem Abiola and former ADC, Adeyemi Ajayi are to coordinate indiscriminate arrest of top functionaries of the State Govt and bribery of other security officials. Hakeem is already in Ado Ekiti, operating from a popular hotel located off Iworoko Road. “Also, Mr. Akin Fakorede of the Federal SARS is being considered for secondment to Ekiti State for the election. Nigerians are aware of the ignoble roles Akin Fakorede played in Rivers State and they want him to play the same role in Ekiti. “The Armed policemen to be coordinated by Fayemi’s ex ADC and Akin Fakorede are to invade the already selected 503 Polling Units, shoot sporadically in the air to scare voters away so as to be able to perpetrate the fraud. “Our question is; why will DSS and the Police post Fayemi’s ex security aides to Ekiti for an election in which he is a candidate? “We therefore call on the Inspector General of Police, Ibrahim Idris and the DSS Director, Lawal Daura to allow Ekiti election to be credible by ensuring impartiality of their men. “We also call on the INEC chairman, Prof. Mahmood Yakubu, to prevail on his officials listed above, who appear bent on frustrating the electoral commission for monetary gains. They must not be allowed to play any role in the Ekiti election. He should cause an investigation into the issues raised and personalities mentioned. “Most importantly, INEC Forms, especially EC8A, EC8B and EC8C must be countersigned by chairman or his trusted designate. “We also demand that INEC POs and APOs must provide additional means of identification, preferably Voters Card, to authenticate whether or not they are genuine corps members or students of FUOYE or Federal Polytechnic, Ado Ekiti. “The international community should monitor closely activities in INEC, particularly the officials mentioned above from now till the announcement of results of the election. Member of a four-man robbery gang, Offor Joseph, arrested recently by Police officers attached to Satellite Division, Lagos State Police Command, has revealed that he gave his mother N50,000 from his share of the N900,000 he got from his first operation. According to Offor, who was arrested alongside Chinedu Ogu, a member of his gang, they have informants that go to banks to monitor individuals who go to withdraw large sum. He said: “This is my third robbery operation. In the first operation, we made N900,000 and I got N200,000 as my share. I used the first money I made to take care of some pressing family issues and gave my mother N50,000; sister N15,000. “We received information that a Lebanese man had gone to one of the new generation banks in Satellite to withdraw a huge sum of money. We have an informant, who pretends to be carrying out transaction in the bank, but whose job is to monitor individuals that withdraw large sums. “I think it is insider’s connection. The gang leader has cashiers and others, who give him information. I don’t know the arrangement between him and the informant. All I know is that the information is always correct. “Our robbery gang is made up of four men. I bought the revolver gun from a friend in Bayelsa State. He usually goes to the militant camp in the creeks where he brings guns which he sells. He sold it to me for N35,000. “The second operation was unsuccessful, as the white man we wanted to rob didn’t go home straight. He was driving round Lagos and we were following him, but couldn’t pin him down. “He would enter one club after another until the fuel of our Okada got finished and we couldn’t locate him again. That day, we resolved that we should not be robbing only white people. But our informant in the bank will always discourage us, saying Nigerians don’t withdraw large sums.” On their last operation, he said: “On Monday (June 25) our informant told us a Lebanese man made huge withdrawal and gave us the description. We trailed the victim to his house in Satellite Town. As he was opening his gate, we attacked him with the gun and he handed the money over to us. “Unfortunately, trouble started on our way home when Sergeant Momoh Olachene and a team of policemen on patrol chased us till we were arrested. We don’t know how the Police knew we were coming from a robbery operation. “We would have shot the Lebanese man if he had resisted, because we were desperate to get money. I needed money to buy Keke Marwa (tricycle), while my partner, Chinedu, wanted to invest in commercial motorcycle Okada.” The second suspect, Chinedu Ogu, said: “I haven’t made anything from the operations. The first time they gave me only N40,000. “They usually take the lion share and give me peanuts. I am married with three kids. My wife doesn’t know that I am into robbery.” A pistol, four live ammunition, bag containing N350,000, ATM cards and cheques were recovered from the suspects. A young businessman, Evans Ukanna, who allegedly forged a Canadian visa after obtaining N8 million from a potential traveler, was yesterday arraigned before an Igbosere Magistrates’ Court in Lagos. Ukanna, 30, was charged with a four-count of conspiracy, fraud, forgery and stealing before Chief Magistrate O. O. Oshin. Prosecuting counsel, Mr Daniel Apochi, said Ukanna committed the offences between last October and November in Lagos. The lawyer said the defendant obtained N8 million from Mr Innocent Egbo, under the pretext of securing a Canadian visa and a travel ticket for him. The court heard that Ukanna told Egbo that he had connections at the Canadian Embasy and that he could help him secure a visa. “When the defendant could not secure the visa, he forged a Canadian visa and issued it to the complainant so that it could be acted upon as genuine to the prejudice of the complainant,” Apochi said. According to him, the offences contravened sections 285, 312, 363 and 409 of the Criminal Law of Lagos State, 2011. But Ukanna pleaded not guilty. His counsel, Mr E. E. Eze, applied for his bail. Matt Cappotelli, a professional American wrestler who was diagnosed with brain tumour back in 2005 has lost his battle to the killer disease exactly a year after he went under the knife for a life-saving brain surgery. His beautiful wife, Lindsay who announced his death on FB said he died around 3:30am on Friday the 29th of June 2018. WWE also confirmed the death of the Pro Wrestler in a tweet few hours ago. Although his brain tumour was removed after his wrestling career ended following the diagnosis in 2005, he continued to undergo screenings. Last year June, he started to experience seizure and migraine headaches. This prompted his doctors to do another scan where it was discovered that the tumour had returned. His surgeon managed to removed 90% of the tumour in December 2017. He was hospitalised shortly after the surgery and in May 2018, he was hospitalised again. Despite his troubles, Matt maintained a positive attitude until he passed away in the early hours of Friday. A Presidential aspirant under the platform of the All Progressives Congress (APC }, Barr. Christmas Akpodiete, has urged the National Chairman of the party, Comrade Adams Oshiomhole, to reduce the Presidential nomination fees to N18,000 or strike it out completely to conform with the position of a decided case law. The aspirant, who made the call yesterday in a letter to Oshiomhole and the National Working Committee of the APC, said that the right to vote and be voted for is a constitutional guaranteed right which will be breeched if his party, the APC refuses to jettison the nomination fees. A High Court of the Federal Capital Territory sitting at Bwari, on Wednesday, fixed July 3 to deliver judgment on a suit challenging the eligibility of former Minister of Mines and Solid Minerals, Dr. Kayode Fayemi, to participate in the July 14 governorship election in Ekiti State. Justice Othman Musa reserved his judgment after parties in the matter argued and adopted their final briefs of argument. The court had earlier ordered the service of hearing notices on both Fayemi and the All Progressives Congress, APC, who were listed as 1st and 2nd defendants, to enable them to respond to legal issues that were raised in the suit which was filed by African People’s Party, APP. The government of Ekiti State was equally cited as the 3rd Defendant in the matter. Specifically, APP, through its lawyer, Mr. Johnmary Jideobi, is praying the court to determine “Whether or not upon a calm reading of Section 182 (1) (i) of the 1999 Constitution as Amended and having regard to the indictment of the 1st Defendant by the Ekiti State Judicial Commission of Inquiry, the 1st Defendant is not Constitutionally disqualified to hold public office especially office of the Governor of Ekiti State of Nigeria? “Whether or not upon a sober reading of Section 182(1) (i) of the 1999 Constitution of the Federal Republic of Nigeria as amended, a political party [such as the 2nd Defendant herein] can validly sponsor a candidate [such as the 1st Defendant herein] constitutionally disqualified from vying for the office of a Governor of a State?” Against the background of the answer(s) that may be given to the questions of law, the plaintiff, claims the following reliefs from the court, against the Defendants: “A declaration that upon a calm reading of Section 182 (1) (i) of the 1999 Constitution of the Federal Republic of Nigeria as Amended and having regard to the indictment of the 1st Defendant by the Ekiti State Judicial Commission of Inquiry, the 1st Defendant is Constitutionally disqualified to hold public office especially office of the Governor of Ekiti State of Nigeria. “A solemn declaration that upon a sober reading of Section 182(1) (i) of the 1999 Constitution of the Federal Republic of Nigeria as amended, a political party [such as the 2nd Defendant herein] cannot validly sponsor a candidate [such as the 1st Defendant herein] constitutionally disqualified from vying for the office of a Governor of a State. As well as, “An order of this Honourable Court restraining the 2nd Defendant from either considering, screening, accepting and or sponsoring the 1st Defendant or holding him out as its governorship candidate in the forthcoming governorship election scheduled to be held in Ekiti State of Nigeria on the 14th day of July, 2018”. While adopting their briefs o argument, APC and Fayemi, through their lawyer, Chief Rufus Balogun, challenged the competence of the suit, even as they urged the court to dismiss it for want of merit. In a 28-paragraphed counter-affidavit that was deposed to by one Oluwaseun Odewale, APC told the court that it was “flabbergasted” by Report of the Ekiti State Commission of Inquiry that indicted Fayemi. According to APC, “The most worrisome aspect of the Report is the purported barring of Dr. Kayode Fayemi from holding public office for 10 years when the Ekiti State is not a court of law”. On his part, Fayemi maintained that he was not accorded fair-hearing by the Justice Silas Bamidele Oyewole-led eight-man panel of Inquiry that indicted him over alleged embezzlement and contract fraud. “I know as a fact that the incumbent Governor of Ekiti State, Dr. Peter Ayodele Fayose, acting pursuant to the resolution of the Ekiti State House of Assembly, constituted Commission of Inquiry to look into finances of Ekiti State between 2010 to 2014. “I know as a fact that Dr. Kayode Fayemi, the 1st defendant, challenged the legality and the constitutionality of the Commission of Inquiry on diverse grounds and he specifically raised the issue of the composition of the Commission further Inquiry which was deliberately constituted in such a way that Justice and fairness cannot be guaranteed to all the parties. “I know as a fact that some of the members of the Commission are civil servants and the Chairman of the Commission a retired Acting Chief Judge has an axe to grind with the 1st defendant and was waiting for an opportunity to have his pound of flesh”.
