For the sake of democracy and the principles of rule of law, the constitutionality of the action of NASS to elevate Jonathan to the position of Acting President should be challenged in the court of law. |
oyb:Have you degenerated to this moronic level? What really happened pal? This post showed that you can not even hold elementary geographical debate of Nigeria without self-induced noticeable flounder. Believe you me; you will not do well in social studies too. |
@~Bluetooth I am of the view that the dumb-arse that goes with the avatar, ~Bluetooth, is a Yoruba. The dude is a regrettable freak of nature. I wonder what the people of Yoruba land think of this inherently intellectual midget. The dude lacks everything that means anything to everybody. The junk wrote with wrong intentions about promotions and command assignments under Ironsi. Assuming that the Punk-arse is a well- informed jerk, he or she would have realized that Ndigbo were short-changed during aforementioned promotion exercise granted that the ethnic group accounted for 67% of officer’s cadre in Nigerian armed forces as of January 1, 1966. For posterity sake, let us look at positions in Nigerian armed forces and who occupied which positions as of January 1, 1966. GOC Gen Ironsi COSS Brig Ogundipe 1st Brigade CO Brig Ademuleyun 2nd Brigade CO Brig Maimalari Army Chief of Staff Col R Adebayo Deputy Army COS Col Muhammed Kur Adjutant Gen. Lt Col J Pam Quartermaster Gen Lt Col A Unegbe Navy Chief Commodore Adelenwa Wey Air Force Chief Lt. Col. G korubo 1st Battalion CO Lt Col F Fajuyi 2nd Battalion CO Lt Col Y Gowon 3rd Battalion CO Lt Col W Bassey 4th Battalion CO Lt Col A Largeman 5th Battalion CO Lt Col E Ojukwu LGO Lt Col Eze Artillery Corps Lt Col A Madiebo Insp. of Signal Maj M Muhamend 1st Recce CO Maj H Katsina 2nd Recce CO Maj J Obienu NMTC Lt Col Shodeinde NEMC Lt Col V Banjo NAEC Lt Col Olutoye I am sick and tired about the shameful denials from persons of Yoruba stock about the act of cowardice displayed by their men in uniform aftermath of July 29, 1966 coup and attributed such act to the number of officers or lack thereof in Nigerian army prior to January 15, 1966. It is even damnable to allude that such behavior was instigated by lack of promotion of Yoruba officers during Ironsi’s regime. I must state unequivocally that Yoruba had the largest number of officers in strategic positions in Nigerian armed forces prior to the first coup d’état and had the second largest number of army officers in Nigerian armed forces by January 1, 1966 based on ethnicity. |
Should anybody take a drunkard such as Becomrrich seriously? |
Anybody that calls the agitation of independent nation states from the colonial contraptions scattered all over Africa as foolhardy fantasy is demented. |
christ! Are you guys pretending not to know the pains Northerners have inflicted in Nigeria? incredible to hear these comments from people living in Nigeria.
You should honestly question yourself about the handiworks of those that supported or aided the northerners to the present stage. My grandfather told me to forgive the wrestler that is holding me on the ground but never forgive the bystander that is urging the wrestler to apply a stranglehold on me. What is engendering the recent dislike of the northerners by the offspring of the goons that joined forces with north in 1966? I hope that OP does not belong to the intended group. |
Ogba is in Egbema of the Rivers State and witnessed the massacre of civilians by the 15th Brigade of 3MCDO under the command of Major Olu Makanjuola during Nigeria/Biafra civil war. Omoku is in Ahoada of the River State and the son of the community was the first Secretary-General of Ohaneze Ndigbo. Ogbia is a community in Bayelsa and mixture of Ijo and Ekpeye. Ekpeye speaks a dialect of Igbo just like Etche, Ikwere, Ngwa, Wawa, Uratta, Abriba, Ukwa etc |
If the story making rounds about the sacking or redeploying of Attorney General and Minister for Justice, Mr. Michael Kaase Aondoakaa, appears to be true, I must categorically say that Nigerians have no business in democracy. It is nothing short of political vendetta and brazen display of silencing the dissenters. I must warn those who partook in such deplorable political act to remember that what goes around comes around. The people that seemed happy that a person who does not agree with their political view is sacked should also rejoice when a person who seemed to tow their political views is removed. I warn you again do not shout or fan minority sentiments or south against north or civil war when Goodluck Jonathan is impeached. |
The fact remains that Nigeria was partitioned into three (3) original regions: North, West and East. Again, later political machinations saw creation of Mid-western region. However, sectional and ethnical politics had dictated the usage of certain political entities and nomenclatures such as Middles Belt, Niger Delta and the useless south-south. I had hoped that most Nigerians understood the fact that Fulani, Hausa, Kanuri and Nupe politicians of then northern region of Nigeria used them to achieve the political ends of northern political elites. I have said and continue to say that the innocence of Nigeria died on July 29, 1966 and the subsequent events that followed. I would want people to pronounce their ethnicity instead of hiding behind nomenclatures such as Middle Belt, Niger State and South-south. |
Reptyle:Before grinding a flawed analogy to stupor, I must submit that there was no election conducted for my job and the code of conduct for the staffs made it clear that “If you are sick it is imperative to notify appropriate quarters by calling in or sending email to that matter. In addition, I do not have a vice who could step in as the acting person”. Unlike the Section 145 of Nigerian constitution that says; “Whenever the president transmits to the President of the senate and the Speaker of the House of Representatives a written declaration that he is proceeding on vacation or that he is otherwise unable to discharge the functions of his office, until he transmits to them a written declaration to the contrary such functions shall be discharged by the Vice-Presidents as Acting President”. The three key words in the above paragraph are “whenever” very infinite in real time and “until” indication of end time and “contrary” opposing the content of such letter. There is no compelling clause in the paragraph that will dictate a time limit when the President had to transmit such letter and what action to be pursued if the president fails to do so. The issue is discharging functions as Vice President or Acting President. |
Shoot2Kill:I agree that tribalism is a colonial weapon used to create internal division among Africans by lumping them together so that there will be no unified front or cohesive arrangement to fight colonialism. The colonial act of lumping nation states into one country in Africa had engulfed the continent with perpetual backwardness. Please be informed that using USA as analogical reference point on the thread by Ikengawo is historically wrong. The British was the dominate ethnicity in building of USA. Other Europeans that settled in the New World had to tow along with British mandate or be wiped out. When Swedish prime minister visited Maine in 1882, he was shocked to his bones that his country men could not speak or understand a word of Swedish any longer. The Native Indians were almost killed to extinction by the British descendants in order to ascertain that British culture and way of life are entrenched in the psychic of the people. Europe and Asia continent saw more ethnical wars that shaped and usher rapid development of countries than Africa. Nigeria must disintegrate along strict ethnic lines or agree to treaties among certain ethnical groups based on close affinity. |
The president has committed so many impeachable offenses that you would need volumes to state them. The principal ones are negligence of duty, failing to receive foreign ambassadors who have been posted to Nigeria, appointment of INEC commissioners so that they can form a quorum, fulfilling our international obligations, chairing of so many committees, like the weekly National security briefings. He could be impeached for Negligence of duty (gross misconduct), except you are telling me a Governor or a president can just disappear and reappear 6 months later, without any information about his whereabouts and continue from where he left.
Good a thing that I am not due in Nigeria for long time to come. Few Nairaland intellectuals have informed the general public that being sick, health-wise, is a culpable offence in Nigeria and would attract impeachment machination if the person is the country’s President. I could longer wander why many sick Nigerian are rudely killed in the institutions meant to save lives and cure of people of their ailments. What a cesspit that passes as a country. |
I'm afraid that Jonathan may find himself in a trap. If the AG decides to challenge this senate resolution in court, I'm afraid the AG will have a very strong case and the backing of the constitution. You don't address an illegality with another illegality. The senate has the constitutional power to impeachment the president, they should start that proceeding immediately to checkmate any funny business from the AG. The senate resolution is legally worthless, useless, irresponsible, and shameful. I suspect that as soon as an impeachment process is started, we'll see a letter to the senate from Yar'Adua promptly. Jonathan should refuse to be sworn in on the basis of this useless resolution.
What impeachable offence has Yar adua committed? The Nigerian constitution that dealt with succession did not declare that the president should be impeached if the President fails to transmit a letter of absence to Senate President and Speaker of the House. The senate has no power to jump start impeachment procedures without culpable offence committed by the President. |
Pifa:The word “whenever” is infinite in real time. It could be now, tomorrow and next six months. As it is now, the section 145 does not provide what the Vice President should be doing and never explicitly declared what should happen if the President fails to transmits such letter to the Senate President and Speaker of the House. The word “until” tends to say that once the letter is transmitted to correct quarters the Vice President becomes that acting President. |
Knight1:Thanks pal for your input. Many so-called Nigerians can read but lacked the comprehensive pedigree to understand due to self-indulgence in sectional sentiments or beclouded with ethnical bias. If Nigeria tends to grow democratically, it must strictly observe and adhere to the dictates of the constitution baring none. |
mikeansy:You should have known better than now. I had thought you were trained in legal issues and should be in better position to tell if all these political brouhahas about Nigerian presidency were constitutional. By the way, I had no reasons to change my profile because the political changes in the cesspit called Nigeria do not make my plate. |
mikeansy:You have written more a like a pseudo-lawyer or a true democratic than ranting based on sentiments. |
Jonathan is the Acting President and believe it or not, he has been acting since the President Yar adua has been away on medical issues. If the President is dead, the national assembly should set in motion the process to swear the Jonathan as President and declare the position of VP. As it is now, Jonathan is constitutionally a vice president allowed by the law to discharge the duties of the president. Let us assume the president is still alive, when Yar adua comes back, if ever coming back, would still remain president. |
The tone of many suckers shouting One-Nigeria and united cesspit called Nigeria would suddenly change if the federal government will build an airport stature of MMA in Port Harcourt or in any Igbo land and expand the seaports in Calabar and Port Harcourt to rival or surpass the ones in Lagos. The moment of the volume of international traffic on business or pleasure ventures start to elude Lagos, the reality will set in the minds of these loafers. I wish during period of Jonathan acting as president, he will be able to champion the implementation of these two projects (befitting International airport and deep seaport) including the improvement of network of roads and address the acute shortage of electricity. The southern Nigerian must have more than one “Lagos”. |
As the Minister of Information, she should have informed Nigerians the present state of Mr. President’s health condition instead of letting Nigerians into her political shenanigans about the constitution and transition of power to the VP. |
egheleghe:What an efulefu. If it has gotten to the point of you denying Etche too, it shows you are very shallow on your ancestral history. Was it not true that Echefulem and Ikweeri were bothers? |
@OP Are you not this same dumb arse that gets twisted out of human form when the issue of good-for-nothing southern ethnic groups, including Yoruba, joined their masters from northern region of Nigeria to fight Biafrans? Please address the name-calling to your ridiculous forbearers and quit this shameful shenanigan of trying to paint entire southern Nigerians with one brush. |
Ujujoan:Please, I am not admitting that the president is incapacitated. I am not even 18000 miles from Yara adua. For posterity sake, if the president suddenly falls sick and could not discharge his duties as stipulated in the constitution, there should have been a clause under section 145 that would have provided the means of transmitting power to the VP. The constitution needs amendment or better still allow the ailing President to die. |
