Musa said investigators were seeking "to ascertain his mission and why he intruded in our operational area, snapped video shots of troops and their deployment without clearance." Berends was held for 36 hours before being accused of spying and temporarily released, although he was expected to return for more questioning, the Reporters Without Borders statement said. It was unclear, however, if he had been formally charged with espionage, which can carry the death penalty in Nigeria. The military force charged with calming the volatile Niger Delta region is increasingly sensitive to media coverage of the conflict in the area, which authorities consider a military zone. Journalists and documentary filmmakers are occassionally arrested while working in the southern Niger Delta. The facts emerged as a group, Nigerians United for Democracy (NUD) condemned the perceived mishandling of the issue of the president’s health by Federal Government officials. . President Umaru Yar’Adua Photo: Sun News Publishing More Stories on This Section advertisement The Minister of Information, Mr. John Odey, had told the nation that Yar’Adua was away to Saudi Arabia on Umrah, lesser hajj. Odey explained that the president was hale and hearty and would return to the country after completing all his engagements in the Arabian country. Reports, however, indicated that beyond the official position on the president’s trip, which gave vent to wild speculations, the nation’s number one citizen was taking time to attend to his health problem. Agency reports on Monday indicated that while the president had not undergone kidney transplant, he had actually been admitted into hospital in the port city of Jeddah for intensive tests by medical doctors. It was further learnt that after the tests, he retired to a private home in the Saudi city. Nigerians are, however, querying why the Federal Government would be secretive about the state of health of the president, while its officials made it look they had something to cover up. Meanwhile, Nigerians United for Democracy (NUD) has called for the setting up of the constitutionally required the medical panel to diagnose the true state of health of President Yar’Adua. A member of NUD and human rights lawyer, Mr. Femi Falana, who made the call at a press conference on the state of the nation, said that it had become imperative for the Senate President to invoke Section 144, which empowers him to set up a medical panel to diagnose the president’s ailment. He explained that the role of the panel was to confirm whether Yar’Adua was capable of continuing to discharge the function of the president, adding, “This is the time to ask that the provision of Section 144 of the Constitution be invoked, that a medical panel be set up by the President of the Senate to examine the state of the health of the president.” According to Falana, “It is an unfortunate development that Nigeria will have to read and confirm the state of health of the president in local and foreign media, while what is being dished out from Abuja is official lies about the matter. Whereas we are told that the president has gone to Mecca for Umrah only to later confirm that the man was recuperating after undergoing surgery. “It is very embarrassing, you can only run a banana republic like this, where public funds are being expended to maintain the health of the President, yet Nigerians are not told the true state of his health,” he added.
