Umana dey talk rubbish.

According to Justice Okoro's letter. He already reported Umana and Ameachi's visit to the Chief Justice of Nigeria, he simply reminded the CJN in that letter what he already discussed before with respect to the alleged visit.

Justice Okoro is also vindicated because he used that visit as a basis disqualifying himself in part-taking in the appeal cases at the level of the tribunal.

The writer of that letter is a stark illiterate. Who represents an authority in matter of Administrative affairs in the Judiciary? The CJN ( who is also chair of the NJC) or DSS and EFCC.

Pastor Ekpeyong should give his own version, let us know what really happened on that day.

For those commenting, I will advise you to go through Justice Okoro's letter in the Nairaland politics section. You will see that he wasn't reporting Umana or Amaechi in that letter. He simply made reference to a report he had already made earlier this year, well before he was even arrested/investigated and suggested that it was possible that they are using DSS to blackmail him because he refused to play ball.

Justice Okoro's case sounds much more plausible than ademola (Okoro didn't resist the search warrant and he asked to contact the Chief Justice of Nigeria while they searched but the seized his phone).

Justice Dimgba too has a strong case, they took Justice Okoro's search warrant to search and arrest Justice Dimgba and when he insisted on a proper search warrant; they simply told him "whatever, they have orders from Abuja to search his house".

Plus Justice Dimgba alleged that they also took the drafts of yet to be delivered Judgements from his house which is a criminal offense of the highest order.

If it can be proven that Buhari approved that operation, that is enough grounds to warrant an impeachment if the Judiciary through the NJC files a complaint at the National assembly. Let's see how this goes.......

For your information, Abiola's election didn't destablize the country. It was tagged as a free and fair one. Neither did the cancellation of the election destablize the country.

It was the actions of aggrieved members of the electorate of remarkable influence - after the cancellation - that created the kind of atmosphere that seemed to be a National security crisis.............

The peace pact of 2015 was provoked by 2 things. An comment allegedly credited to the US that by 2015, Nigeria as we know it will breakup and a comment credited to Buhari that if what happened in 2011 repeated itself in 2015, the baboons and the dogs will be soaked in blood (a metaphor for War).

Learn one thing, there exist on the internet, a billion and one definitions for every item on the internet. All with different perspectives.

For example, when CLEEN defined National security, it's perspective was based on access to information. When National Institute for advanced legal studies, NIALS, defined National security, it gave 2 backgrounds/basis.

A legal one (which currently reflects what exists in the National Security Act - that clearly defines what is expected of the DSS as opposed to what you assume or would have me believe).


And a non-legal one, which even includes food security as well as social security.

If you have ever undertaken a study on National security - which I doubt greatly - it would be clear to you that it's too broad to define. Hence, a nation like ours can makes assumptions on what we think National security is.

WE SIMPLY STATE WHAT WE EXPECT OF OUR AGENCIES AND DOCUMENT IT INTO LAWS. AND NOWHERE IN OUR LAWS DOES DSS NOR THE PRESIDENCY HAVE THE RIGHT TO ARREST JUDGES IN THE MANNER WITH WHICH IT WAS DONE.


Period.............it simply a matter of law and not wild guesses or assumptions.

Try getting a PhD or devote your time to research matters of significance within a research community.

Trust me bro, the problem is that no body want to go to farm again. Everyone want to be bankers or work in slumberger or Mobil ( even agricultural engineering and agric related graduates). And many states have rendered their youths to begger, just like ekiti.
No thanks to the government that can't declare state of emergency on agricultural research and products via mechanized farming. We seriously need mecahnized farming this country. I wonder why federal government can't partner with LG over federation to invest in specialised agricultural products that can grow well in each LG to boost crop production. Similar thing was done during ibb regime through ,was it MAMSER or DIFRII programs (dunno exact name).
The news is good if we know how to make use of it.

I read the entire press release with the hope of seeing one prosecution and conviction secured by NJC.

Unfortunately they could not cite one instance, despite their long epistle.

NJC, is a corrupt body of Judges, that has been shielding their fellow corrupt Judges.

Most cases decided by NJC have only led to dismissal with a pat on the back to go home and enjoy proceeds of the corrupt .
I sorry but I doubt you read it clearly!! The Job of NJC is to recommend disciplinary action and not to take it.

The Njc functions purely in an advisory capacity, they don't even appoint judges, they only recommend judges.

If you remember when amaechi had a battle with NJC as governor of rivers state. The NJC recommended Justice Okocha - a woman, who was the most senior and experienced Judge of the high court to be chief justice of rivers state.

Ameachi chose to appoint one other Justice who was President of the customary court and the oldest judge in rivers - against the NJC's recommendation. The NJC simply suspended the person amaechi chose after he went to go and do swearing. Because of this, amaechi refused to swear in any other person as chief justice and for 2years of his remaining tenure as governor, all the courts were closed in Rivers state because of the pride of one man.

The moral of the story, is that NJC simply recommends while the executive appoints. They can only suspend you after you have been sworn in by order of the executive and that's all - and even suspension cannot be indefinite.

The NJC cannot prosecute anyone, they will only recommend them for Compulsorily Retirement and prosecution. It is the executive (governors/Mr President) that are expected to retire and then forward NJC's recommendation to the Attorney Generals's office of the state for further action.

You don't expect them to act like the DSS and expect to be seen as impartial do you??

In any case, NJC will respond only to evidence relevant to the allegations on ground and nothing else. Not even to "Buhari said so".

This is what I have always said but the "I too sabi pass Baba God" squad no go let us hear word.

The only reason Mr President is still safe is because the DSS has blown a massive lie that it is the President of CSNAC that wrote petition that made them to be arresting/investigating judges - outside their statutory mandate as stated in the Security act - and the NJC cannot act without evidence.

This is even illegal, the arrests/investigation of judges by the DSS can only be justified if they were approved by Mr President. If they were proven to be approved by Mr President, then he would have created grounds for impeachment for himself.


They have also made mention of Judges who they recommended before these arrests for compulsory retirement and prosecution for Professional Misconduct, yet the governors have refused to retire them and is allowing them to still operate!! Why?? Nobody is talking about this, na only Sai Baba na e them sabi.

Have said this thing before, but nobody wants to hear, people just look at the judges as ordinary human beings - which is true because they are - but collectively, they represent what constitute the Judiciary which is an arm of government. Under the principle of separation of powers, which is deeply entrenched in our Nations laws, no arm of government can interfer in the deep matters of another legally as it relates to core functions of that arm.

The President - the executive - cannot be seen to be directing security operatives to prosecute a Senator for Professional misconduct as it relates to core functions of the legislature - which is law making. The house committee on ethics has to be referred to first, the house will be written to and them it will be deliberated on, and then referred to house committee on ethics. The house committee's recommendations sets the pace for what should happen, then Security operatives can de directed by the house in line with what is decided with reference to the outcome of the findings of that committee - either through sittings, investigations (whether directly or indirectly) etc.

The same applies to the Judiciary and the NJC. At the present state of things with respect to what is flying around in social media circles - I have said it time and time again but the nays always want to have it - no court is qualified to entertain this case, in the manner built by the DSS; so what was their game plan from the beginning?? If not to blackmail the Judiciary!! They did it to the Senate, and accused them up padding budget - when it was clear to all and sundry that these people in the cabinet don't know jack about budgetary processes and now na Judiciary turn.


How can you claim to bypass the NJC in such a fashion; simply because some confused persons are still shouting Sai Baba - all in the name of National security - and you think that will hold water in a court room??

Just imagine the level of unintelligence displayed by an intelligence agency?? You served a faulty search warrant on the wrong house and arrested the person inside and came to start sharing documents that are supposed to be classified on social media - that is assuming truly the matter was one of National security. See as they just disgrace themselves before the world.

No wonder personnel dey abandon the service in droves......... angry

some of you need serious IQ test before making comments, your interpretation of the paragraph you quoted, shows that there is a fundamental flaw in your ability to process simple information.

A terrorist suspect is a threat to National security, the fate of the same terrorist suspect is decided by the courts headed by judges.
If a corrupt judge is induced to deliver a bias judgement, the judge automatically becomes a threat to national security by complicity.

For the record, aside from Reverend Kings case and another one, as far as the first 2 sets of arrests of judges were concerned. All the cases bribes were involved, where election related cases and not National security cases.

DSS uses its sweeping powers under the Security act - which clearly states the duties of the DSS - to arrest people all in the name of National security.

The problem with that act, is that unless the case(s) are directly linked to National security - and not indirectly like your assumed case scenerio depicts - it has to be assented by Mr President himself before it goes through or is approved.


Sting operations like the one allegedly used by the DSS, costs money. Its not free, and that is also an important reason why DSS can't go running around arresting/investigating people over issues that are not a direct threat to National security.


But DSS made a fool of itself when it alleged that the entire sting operation was as a result of a petition sent by one fellow who leads a collation of civil society groups and not Mr President. This I guess was in response to comments that the President is operational responsible for DSS and sent them to arrest the judges, as a way to spite/attack the Judiciary for not allowing him to do as he pleases in court with his poorly handled anti-corruption cases.


The petition alleged corruption and not National security, plus the last time I checked the leader of the CSNAC wasn't the president of Nigeria. He doesn't have the power to make them investigate Basket mouth, let alone sitting Supreme court or High court judges.

The right thing DSS should have done, is to refer the case to EFCC. The problem is that EFCC cannot arrest people without an arrest warrant - in the manner that the DSS did - and that's why Buhari used DSS just like he did for Dasuki. DSS did the gorund investigation using search warrants and their sweeping power - in the name of Nationao security - while EFCC prosecutes.


The problem is that it involves judges and NJC must be involved. Fundamentally, it involes the ethics of Judges with special regard to cases they handled. If a man breaks public propert and he is a judge, do what is required by law.


Its no biggie, but as far as Nigerian law is concerned Ooh; only NJC can deal or recommend disciplinary action to judges with respect to ethics in handling court cases.

Let no man deceive you Oooh, in the absence of proper reference/recommendations of the NJC on their arrests/arraignment, no Judge in the whole country is qualified to sit over the cases as presented by DSS.


DSS can't even arraign/prosecute them. That why the entire press jingle they are doing over this case is just stupid, pointless - aside from shoring up political capital that is expendable in the next elections by Buhari - it can't secure a conviction.

And what good my over-smart, over-intelligent friend, is a sting operation that doesn't lead to a conviction??

Its as useful as the first tissue paper used to wipe the first crap that came outta my asss the first time I took a crap as a baby.

Nigeria is in recession because of the ill-managements of buhari's administration. The problem is not “lack of funds” but lack of dexterous, disciplined and qualified individuals in the govt. And also those who does not want nation to progress by making plans to vote and rig in the certificateless cattle rearer in 2019 to continue thwarting the economic progress of the nation.

These are the facts of the matter

Nowhere in the media has DSS given an official statement on what happened. All stories on this issues in the press coming from DSS has been based on unanamed "Top/Senior intelligence officer" or "A close sources at the DSS" which is strange. Should a government agency be peddling rumours over matters of state especially if it is truly a national security issue??

When Jonathan/Yar adua was there, we had Maryln Ogah as Spokesperson of the DSS giving press conferences: why have they abandoned this standard and responsible practice if they are not creating room for deniability in the future??

Nowhere in the press does it say that DSS had an arrest warrant to arrest the judges. An arrest warrant is to be issued by a judge and no judge will give a warrant for a matter purely under the Jurisdiction of the NJC. What the alleged Top intelligence officer with no name at the DSS said they got was a Search warrant issued by a magistrate judge. To search the premises of the judges and after the alleged search, they arrested them on grounds of National security.



The DSS never said the Judges were arrested for allegations of corruption. What they saying officially is that they arrested Corrupt judges on allegations of breach of National security.....

Those are the facts. In my own opinion, the reason for the last item is simple. The DSS do not have the budget nor the power constitutionally to investigate corruption without a direct order from the presidency - it is outside their brief - what they have is the right without an order to investigate breaches to Sovereignty as a Nation internally and externally through National security and that is why DSS officials are involved in the Boko-haram war.

DSS can only arrest/restrain anybody - including the President of Nigeria, yes even the President of Nigeria is not above this power - on the grounds of breach of National security and that's why they are using that excuse because only NJC can sit/discipline sitting judges with respect to how they handle court cases at the first instance.

Plus DSS said they recovered $2million (#1billion) in a judge house. Can you for sure confirm this except in open court where they will tender evidence for the whole world to see??

Why haven't DSS released Dasuki to defend himself in court for the EFCC trials for stealing $2.1billion for the whole world to see??

Why is it that it is when the Judge denied EFCC's motion to try Dasuki secretly and hide the details of Dasuki's trial from the press that DSS decided to detain Dasuki on the grounds of National security??

They told the world he stole $2.1billion, but they don't want him to say his side in court and everybody is praising Buhari............

Have you seen all the cases they are claiming the Judges collected bribe to deliver judgement? Why is it that 99 percent na election matter??

Yes the government may have been a tad bit extreme in the way it went about arresting these corrupt judges.
But who can say he or she doesn't know that 99% of cases concerning elections, fraud, and human right abuses have not been ridiculous since 1999?
You would see a politician like Saraki or Tinubu get accused of fraud with clear facts yet the cases would eventually be treated like any other regular everyday case and the accused party always goes Scott free except he or she has earned the wrath of the government previously.

Anyway, you are neither a lawyer nor a Judge. No sound person who has had the pleasure of interacting with the court process with respect to cases, make such claims.

A judge is designed to be Unsentimental, unemotional and as much as possible restrict himself within the scope of reliefs sought in his court; no matter what the stakes are. That is why lawyers are meant to be skillful in both arguing, examining and presenting a case to provide maximum benefit for his client.


Meaning, if you accuse someone in court to be guilty of fraud in court - who can actually be found guilty of manslaughter - it is not the place of a judge to tell you; "this fraud case wont work based on the circumstances sorrounding the case, try manslaughter". He will simply declare the person not guilty and go and sleep. it is the place of your lawyer to examine all angles and advise on best courses of action.

Sometimes, it may even involve not going to court.

It also means that you must be socially and financially bouyant to retain the services of a lawyer to handle your case.

I once had the opportunity to review the charge sheet of a political figure that was 3000 pages - you can't pay me to read any more than 500 of those pages, I go just tire - but a lawyer will receive cash to read all over 3000 pages and summarize and prepare a defence.

The Judge will examine both 3000 pages charge sheet revealing how many count charges and the instances of each count plus documented evidence attached and the x number of pages of defence plus documented evidence attached and make a decision.

So if your lawyer is not well motivated socially and financially, he will not put much effort to read and prepare, he will just speed read and not read in closer detail like his mates who are well paid and that could affect your defence.

And that is why a politician will steal billions and escape with a smack on the wrist from a Judge - because he has the millions to pay a lawyer who has read the matter over and over and knows which technicality to rely on - while a small thief who can only afford to pay coins to lawyers - that may not even fuel the car(s), not to talk of pay school fees - who will just speed read and just do what they can while still using corner of eye to look for politician or better client that will pay better money.

You think Femi Falana was able to pay Falz school fees when he was going to school by defending the poor??

Some of these big law chambers charge as much as #1,000 to #10,000 per hour per lawyer that they assign to handle your case on working days - and a case could stretch for as much as years. Houseboy whey thief money from Oga bedroom can he afford that??

Plus court cases no cheap like that Oooh!! A friend of mine who is late now, was asked to cough up #1.8million just to file a case at the court of appeal over a land dispute he lost at a lower - I come dey wonder, why you no use the money buy another land ni? undecided If to say the people pay am that money for the land, e go dash them the land, carry one of e fine daughter give the guy as bonus seeh cheesy - it is well.

Even if you find, a big law firm handling such cases, they do it pro-bono (free of charge) just as a way of giving back to society and marketing/advertising their services/skills to the rich who may be watching.

That's why you see lawyers like Keyamo and Falana and the rest of them making comments on issues, dey quote all manner of laws and making arguments upandan, they no really care. Them dey sell market; that's all.

But all around the world, lawyers make it big defending the rich and not the poor.....

The only thing I perceive the Judges are guilty of - which 99percent of police men on the street may be guilty of, which amounts to blackmail and that's why the Judges will protest is this - Judges are designed to live very solitary lives away from society; this is to help them avoid clash of interest as much as possible.

I cannot be playing golf with someone and sit over a case involving him or a case involving my inlaw or a staff of my company and expect to be impartial.

The law regulating their practice requires that they limit themselves from engaging in any other form of commercial activity besides their work..

A judge owning a law chamber or registered businesses pushing for government contract is a complete no no!! The same way a police man driving a danfo bus when he is off-duty is a no no. That why DSS is ranting that they found money in their houses.

Its blackmail and if you look closely, 99% of their cases DSS are claiming they collected money from are poliitical.

The Judges cannot make a defence before the NJC that they own thriving businesses, even though all of them including the Chief Justice of Nigeria do. And that's what DSS is using to blackmail them.

So when people talk about corruption and corrupt judges, what do people really know about Judges?? Do they have family members who are Judges?? They don't, else they would understand what DSS has done wrong.

Even if a judge is corrupt, to point of collecting cash is very very difficult; in short almost impossible. It is a lot easier/understandable to say that a Judge did something in return for a favour.

A case in point, the second to that last CJN, retired a particular judge - I can't rememeber the name but even if I did I won't want to mention it now, considering the current atmosphere - and reviewed some of that Judges cases.

That judge was priviledged to have someone write a biography of/about him - he was close to retirement by some years - esama of Benin kingdom, Chief igbinedion went and paid like #6million at the book launch. The judge didn't even attend the launching.

Many months laters, a distant relation of the Igbinedion family had a case in this man's court and received a lighter sentence - he was charged with some form of fraud along with some other persons - the lawyer representing the Co-accused, whose client got heavier sentences, petitioned the NJC and the CJN and not only was that Judge retired but judges were banned from having their Biographies done while they were still on the bench and that case was reviewed.

So sometimes, things like that could happen. It could be mistakenly - remember some of these judges have a lot to read they are quite old - some may be deliberate but the manner DSS did it was unlawful and that is the truth.

It is equally blackmail because the Judges themselves cannot even sue them without permission from the NJC. They don't have that right, it is that bad.

So they are sitting ducks, una whey dey talk for here. No surprise if Buhari/osibanjo/Lai mohammed dey kneel down dey beg them for background while DSS and ignorant Nigerians dey shout "Corruption fighting Back" without understanding the dangerous precedence this matter will set for the Judiciary.

In any case the battle line has been drawn, only CJN can mediate and beg his Judges not to retaliate, because with the way DSS is going, they have the upper hand. And you know skilled judges in this country are few - judges sef in this country are few - so you can't afford to be sacking judges anyhow.....

Plus! Why has DSS refused to give an official press briefing and is choosing to speak through "A Top intelligence officer" of the DSS??

Do you remember?? When Dasuki was taken to court, the EFCC tried to apply for a secret trial when they wanted to called witnesses for the prosecution.

The judges refused on the grounds that what EFCC offered as the facts of the case as well as the witnesses were already on the pages of newspaper and it was no secret and denied a motion for a secret trial.

Instead of this case to proceed, DSS arrsted and re-arraigned Dasuki on grounds of National security in another court - which could prompt a secret trial if a motion is moved - and DSS has refused to release him for prosecution witnesses to be called and the EFCC trial to proceed. You see how blackmail and technicalities works??

Corruption cases, election rigging etc don turn to National security, simply because know the only leeway/legal right or option they have to arrest the judges, without an arrest warrant is based on National security. Them don call am National security.

Bet it, Na EFCC go prosecute these cases in court, just like they did to Dasuki and Saraki initially.

DSS go form investigation, abusing their statutory powers and call any case they get involved in a matter of National security. Arrest people for no just cause, then when they hand over the folks to EFCC or ICPC for prosecution.

So that if a judge sitting over the case, issues an order, it will be binding on only the prosecuting counsel and not the investigators. (In the case of Dasuki, EFCC is the prosecutors while DSS are the investigators).

As Court don give order to EFCC, concerning Dasuki, FG go use DSS violate am for background. EFCC go do like say, them no know wetin judge dey talk for court.

Unfortunately, you chose to do this to Supreme court Justices and Principal officers of the Judiciary as well and just like the internet, the Judiciary never forgets..............grin

Guy no dey form Lawyer for Nairaland here. The Judges were allegedly under investigation for allegedly taking bribes to deliver judgement in favour of the bribe givers.

In fact according to the last comment allegedly made by the "Anonymous top source in the DSS"; they went to the NJC to present the case of a Judge who was bribed #200million to influence a case but the alleged judge didn't deliver on the Job.

NJC is statutorily forged exclusively to appropriate disciplinary measures on Judges strictly with respect to unethical behaviour with respect to handling of Court cases/proceedings within the Judiciary as an Independent arm of Government.

There is no other agency qualified by law to do so. So to even be typing all this mumbo jumbo, is proof of lack of understanding of the Basics of the Judiciary as a whole as an arm of government.

The reason why everyone will and should blame Buhari for this madness, is because the DSS went out of it brief as statutorily prescribed by law - an action only the President can sanction - because it intends to play up the case as a matter of National security.

Let us get one thing clear from the start. Aside from the Executives in this country and Principal Heads of the Legislature.
Nobody is immune from arrest really for criminal offences by the police.


Having said that, it is important for me to say boldly and categorically that I strongly believe that the men of the DSS didn't have warrants to arrest these gentlemen - no matter what Hogwash they want to sell using the Media propaganda machine of the APC.


I have also taken time to read different accounts of what happened in the media as allegedly stated by the SSS and all were given by anonymous sources; not one single official P.R.O officer attached to the SSS has spoken; and it is strange that SSS hasn't deemed it fit to hold a press conference explaining in clear terms what's happening.


No official statement has been given by the SSS till now. Yet everybody knows that the SSS had a search warrant and an arrest warrant when they went there, simply by virtue of anonymous sources.


Instead, they are testing the waters with anonymous sources first to see if Nigerians will buy their madness; before they move further.


For the record, a warrant for arrest is issued by a Judge only. DSS asking a judge for a warrant to arrest a judge over receiving cash to deliver judgement won't fly; and even if that happened in this case, such a judge will be sanctioned by the National Judicial Council why?? Ethical grounds.

The Judiciary isn't just a profession or a system of professions, its an arm of government. Just like the executive and the Legislature.


First of all, it is outside the brief of the DSS to investigate such cases. DSS will only move outside it brief except prompted by orders/directives from "My Oga at the Top". Its like saying, Federal government Hospitals have started administering health care services to stray dogs. huh It makes no sense.


It would take only a directive from the very top to cause such agency to work outside it brief - most especially when you consider that such a action/operations require a budget to prosecute them. Who will authorise the release of cash for a government agency to do another agency's work??


Also the police won't be so stupid to seek a warrant for arrest for such men/issues, matters relating to disciplinary action concerning unethical behaviour of Judges in handling Court cases is the exclusive preserve of the NJC.


Taking any action and saying you want to prosecute them first without going to the NJC won't stand a day in court.


If you like, make your belle sweet say them arrest big men for a change in this country. All you simply did, was expose their activities but in the end, you ruined your chances of sending them to Jail through due process.


What's the value of a sting operation that cannot lead to a prosecution/successful conviction?? It likes qualifying for the world cup and having ball possession of 86% but losing every match. Does it have any value, considering that whether you will or lose you are going pay the team at the end of the day.

This is what DSS has done, that wailing wailers are crying about and Hailing Hailers are rejoicing over............


Do it with due process and let Nigerians reap the benefit and not APC or Buhari. It is the countries money that was used to sponsor this mess and it will lead us nowhere.
