CanadaOrBust: Not true at all. Statutory marriage does not require evidence of customary divorce before statutory marriage . This is one of the problems we are having in Nigeria which the federal govt wants to correct. If you are a divorcee. you must produce evidence of divorce of your first marriage either traditional or statuary marriage. If you go to the site of the federal govt marriage Registry you will be asked to upload your divorce evidence if you are a divorcee..... This is different from illegal marriages many people are contracting today. Anybody who officiates at a wedding without confirming the status of the parties invoked will be imprisoned especially when one of them is not free to remarry |

GistCaster: In a new development to the disagreement between the Federal Government and some local government areas over who has the right to conduct marriages in the country, the Federal Government has published the marriage registries and places it has licensed to conduct statutory marriage across the country.
The Federal Government, through the Ministry of Interior, re-emphasised its position that it was the only tier of government permitted by the constitution to regulate and conduct marriages.
It added that formation of statutory marriages was within the exclusive legislative list and that it was the regulatory body for the conduct of statutory marriages and the issuance of marriage certificates.
On its website, the ministry named the 12 registries in 11 states. They are the Federal Marriage Registries in Ikoyi, Lagos State; Abuja, Federal Capital Territory; Benin, Edo State; Owerri, Imo State; Port Harcourt, Rivers State; Kano, Kano State; Jos, Plateau State, Enugu, Enugu; Kaduna, Kaduna; Ibadan, Oyo State; Ikeja, Lagos State, and Makurdi, Benue State.
In an advertorial titled, ‘Public notice on conduct of statutory marriage’, in a newspaper on Wednesday, the Interior Ministry said, “The attention of the Ministry of Interior has been drawn to the publication in the PUNCH Newspaper of Friday, 13th September, 2019, page 42 under the caption, ‘Marriage: Ignore FG’s directive, LGs tell organisations’.
“The Ministry of Interior is therefore constrained to issue this notice in order to properly guide the public on the issue of Statutory Marriages under the applicable law in Nigeria.” The ministry explained further that it had the responsibility for granting licences to qualified places of worship as well as LGAs that compiled with the provisions of the Act (Sections 4(2) & (5) of the Marriage Act), adding that the ministry had the responsibility to appoint officers to serve as registrars in the Federal Marriage Registries.
The public notice added, “It is observed that the local governments have deliberately misinterpreted powers conferred on them by item 7 (1) of the Fourth Schedule of the constitution.
“For the avoidance of doubt, item 7(1) states that the functions of the Local Government include: registration of all births, deaths and marriages. This provision is clear and requires the local government councils to maintain registries to register births, deaths and marriages for record purposes and planning.”
The ministry, however, warned that any statutory marriage conducted in breach of the Marriage Act, CAP 218, Laws of the Federation 2004 would not serve the desired purpose.
Gist from Gistmore http://gistmore.com/fg-names-12-registries-licensed-to-conduct-marriages-nationwide . Constitution is very sensitive..... A woman marries a man .Suddenly the man disappeares. After seven years the court declares him missing legally....A year after the WOman remarries. three years later the first man reappears .Question : who will be the husband between the two men? |

Duggedised12: isnt this what the govt is supposed yo be doing to regulate the abnormailites? So many churches are licensed to operate as NGOs but need additional license to conduct statutory weddings, some think because headquarters is licensed branches are automatically licensed ,some obtain certificates from location govts councils which makes the certificate null and void .
This and many more is what i expect the federal govt to be looking into but they are more concerned about power tussle and massaging their ego at the expense of the masses ,what a country! . absolutely correct! |

CanadaOrBust: No true. They don’t ask for evidence of divorce b4 u can marry. In customary you can marry more than one wife without being guilty of bigamy. You don’t have to be divorced b4 customary marrying again . I am not talking about remarriage under customary law .I am talking about remarriage under the Marriage act or statutory marriage...Evidence of divorce must be presented |

CanadaOrBust: Traditional marriage usually doesn’t involve any papers neither does it usually involve any courts correct! A traditional marriage is complete when the dowry or bride price is paid and the wife is handed over to her husband..........The reverse is the dissolution....... it is in the constitution......However if you need a ldocument to support it you can dissolve it at the customary Court. |

CanadaOrBust: What is the use of the paper? What can u use it for . If you want to marry another person through a statutory marriage. the federal registry or licensed places of worship by the government MUST see the evidence of the Divorce.... Additionally as you are filing the notification for the New marriage Divorce evidence must be attached. This applies to those who want to do things properly. |

CanadaOrBust: This is a lot of wrong info. For one thing, u don’t have to go to any court at all to dissolve a customary marriage. It is considered dissolved as soon as the man’s bride price is returned to him . It is through that dissolution of traditional marriage requires return of bride price...The customary court will rule that it must be returned. Then the dissolution is compete. However some dissolve theirs without going to court as long as they return the bride price...The constitution however states that whoever want to have a documented dissolution of traditional marriage should do so at the customary court....The paper you get there can be used yo process another marriage when your divorced paper is presented |

Duggedised12: A paper from a local govt ,not a legal marriage document ,not a wedding certificate ,so why is it even there to begin with? Why confuse people , why does everything about Nigeria have to be disorganised and not straight forward? Why will you give a paper of notification that will take the same stress as getting a wedding certificate to people when you know it is worthless ?
If you ask me i think this is rather unfair to couples who probably are not even aware of this and think what they have in their possession is a marriage certificate, which i am sure with the "Nigerian factor" many couples would have been made to believe they were taking home wedding certificates.

The does not allow walking away and marrying someone else. The truth is we are just doing what we lime in Africa especially Nigeria. If you do a statutory marriage and go with another man or impregnate another woman it is 5years imprisonment if the innocent spouse goes to court.who will do that in Nigeria? As for traditional marriage which can make a person optional collect a Record Document in Local government you don't marry another wife until it is dissolved at tbe customary court. If you want to marry a person through a statutory marriage after you had married a Peron through a traditional marriage the marriage registry must see evidence of your dissolution of traditional marriage. |

Also which jurisdiction does that paper from the local govt cover, lets say a couple moves from that local govt to another state entirely and wants a divorce ,will the local govt recognize the paper from another local govt from the other state? . I respect you..These are the two questions I am expecting from you. This paper document cannot be presented at the embassy. It is not e wedding certificate..It is just a oaper notifying the government that you live as husband and wife.Additionally you cannot present it to file a divorce in the court. Remember you did traditional wedding.Such a wedding can be dissolved at a magistrate or customary court wit your document received at the local government. If you did statutory marriage it can only be dissolved at the High Court only and your wedding certificate must be shown to court to accept that a marriage exists between you and your wife..As for the jurisdiction of the Record Document you get from the local government it can be shown anywhere in the country but not as a wedding certificate. |

A marriage can be put on record in the local government just as a birth or death certificate is put on record there. The constitution gives the local governments the right to do this ..It is just for a record purpose. This is NOT a statutory marriage.according to the marriage act. You will not be given a wedding certificate from the federal government. You will just be given a paper DOCUMENT like birth certificate indicating that both of you live together as husband and wife.... |

This development is caused by the local governments. In the past the federal government delegated local governments to conduct marriage .Surprisingly local governments started producing Unified certificates different from that of the federal governments... Is this not an aberration? That is why the federal government revoked the right given to them as enshrined in the constitution . The local governments have appealed the judgement of the two lower courts in the Supreme court. Will the SC not sustain what is the constitution? TonyeBarcanista: By TonyeBarcanista
Wednesday, October 30, 2019, the Supreme Court of Nigeria, in a unanimous decision, dismissed the appeal filed by the Peoples Democratic Party and its presidential candidate, Atiku Abubakar, challenging the victory of President Muhammadu Buhari and the All Progressive Congress in the February 23, 2019 presidential election.
The seven-member panel justices that gave the judgement was led by the Honorable Chief Justice of the federation, Justice Muhammed Tanko with honourable Justices, Rhodes-Vivour, Amiru Sanusi, Uwani Abaji, Ejembi Eko, John Inyang Okoro and Olukayode Ariwoola making up its members.
The apex court did not state reasons for the judgement, it however left the camp of the president and ruling party in celebratory mode, while members of the camp of the appellants left the court room sadder than when they came for hearing.
Notwithstanding of the feelings of the interested parties, there are some issues that need to be discussed, these issues bothers on discarding traditions of the court by the CJN Justice Muhammed Tanko.
Firstly, the noninclusion of honorable justice Mary Odili and honorable justice Sylvester Ngwuta as members of the panel of justices that heard the appeal raised concern as both justices are senior members of the Supreme court bench, and the CJN, by so doing, discarded the age long tradition of having the most senior seven justices to hear presidential petition appeals at the Supreme court.
Secondly, composition of members of panel that heard the appeal did not reflect national spread as it excluded justices from the southeast geopolitical zone in the seven justices that heard the appeal. The panel has two justices each from the northwest and southwest geopolitical zones, one each from northcentral, northeast and south south zones and zero from the southeast zone. This is also against the age-long tradition of the apex court. More worrisome is the fact that justice Sylvester Ngwuta, a senior jurist at the apex court from the southeast zone was excluded.
Thirdly, the speed at which the appeal was heard and discarded left observers worried. This is because the names of the seven-member jurists that heard the appeal were only unveiled few minutes before commencement of hearing and the verdict was given less than thirty minutes after conclusion of hearing- all these happened same day and it is unprecedented in the history of presidential appeals in Nigeria. This left Nigerians to wonder whether the whole process was mere academic exercise as the court seemed to have reached a verdict even before parties argued their briefs.
Though the public await the reasons for the decision of the apex court, the question on the lips is of everyone is whether justice was dispensed or miscarried. This can only be answered by the conscience of the seven justices that heard the appeal.
May God Bless Us All and Bless Nigeria
http:///s550548af191031en_ng . I don't know why we like creating issues where there is no need to do so...First judiciary is governed by constitution not TRADITION.The constitution states that the CJN has the right to constitute the SC judges for the case. The selection is not determined by tradition nor according to geopolitical zones in Nigeria. So issue 1 and 2 are baseless and do not have any merit.Your issue 3 does not hold water too...The SC had received PEPT judgement, appeals iof PDP and the counter appeals of the APC and taken a decision on the case as it was .Oral presentation is just to hear what you have said in written documents orally. The SC can decide the matter same day if your oral presentation is illogically .repetitious ...After oral presentation the SC can go in for deliberation and decide if something NEW has arisen in oral presentation. If none their judgement can be given same day.It is still in order .There are cases like that in the SC. So nothing new in Atiku s case .... It is still in order. |

Brika: Leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, on Thursday, told the Federal High Court, Abuja, that he was ready to face trial if his safety would be guaranteed by the court.
Kanu told the presiding judge, Justice Binta Nyako, through his counsel, Ifeanyi Ejiofor.
Ejiofor told the court that the application to restore the IPOB leader’s bail so that he could face his trial was filed on April 1.
“We have an application for bail filed on April 1, 2019, the application was served on the prosecution and it is ripped for hearing.
“We urge the court to restore his bail on the ground that the court will guarantee his safety when he comes back to the country to continue his trial,” he said.
On his part, counsel to the Federal Government, Labaran Shuaibu, who told the court that he was just seeing the process, opposed to the application.
Shuaibu urged the court to adjourn the matter to enable them filed the necessary processes.
Delivering the ruling, Justice Nyako, who adjourned the matter till Jan. 16, said the only way he could guarantee Kanu’s safety was to keep him in the prison.
She said even judges no longer safe in the country.
“Even judges are being abducted in the country. So prison is the only safest place for him,” she said.
The News Agency of Nigeria (NAN) reports that Justice Nyako had ordered the re-arrest of the self-proclaimed leader of IPOB, Kanu.
The judge gave the order in a ruling after revoking the bail granted to Kanu.
She explained that the court gave the order because Kanu had failed to appear in court after his bail was granted in April 2017.
The judge also ordered that trial would continue in the absence of the IPOB leader and directed that a bench warrant be issued for his arrest.
NAN reports that Justice Nyako had granted Kanu bail on health grounds on April 25, 2017, and asked him to present three sureties, one of whom must be a serving senator, a Jewish religious leader and a highly respected person who must own a landed property in Abuja.
The judge warned the IPOB leader against granting press interviews, holding rallies or being in a gathering of more than 10 persons while on bail.
She had also warned him that the bail would be revoked if he flouts any of the conditions.

Prof. Itse Sagay (SAN), Chairman of the Presidential Advisory Committee Against Corruption (PACAC) has reacted to the Supreme Court judgment which validated President Muhammadu Buhari’s election, saying the lawyers of Atiku Abubakar, presidential candidate of the Peoples Democratic Party (PDP) only collected hefty sums from him.
Speaking in a chat with Daily Independent, Sagay said any serious lawyer with hood good knowledge of election laws would have known that there is no way Atiku could have won based on the two issues he promised his appeal on.
The two issues according to him are Buhari’s certificate and INEC server. When I look at these two major issues, i just wondered what the appeal was all about. For me it is about lawyers just making millions, maybe billions, because any lawyer going to court on behalf of Atiku with all that legal background has not done its duty as a lawyer”.
” I said so because when your client has no case, you should tell him. If he insists on going ahead instead of ridiculing yourself, you can refuse to take up the case”.
“I have done that on several occasions. So I am not surprised but the speed shows how hopeless the case was” he said. https://www.independent.ng/atikus-lawyers-only-made-billions-off-him-sagay/ . failed lawyers who are legal yahoo yahoos.....They are just scammers in legal practice. |

Press Statement
PDP Expresses Shock Over S/Court Verdict.
The Peoples Democratic Party (PDP) expresses shock at the judgment of the Supreme Court on the Presidential election petition filed by the party and its Presidential candidate, Atiku Abubakar.
Indeed, what we witnessed today was not what majority of Nigerians, who participated and observed the Presidential election expected; and this includes even members of the APC.
The PDP notes that it indeed made a solid case, with undisputable evidence, showing that Atiku Abubakar won the Presidential election and as such is surprised that the justices of the Supreme Court held otherwise; however, that is the highest court of the land.
Notwithstanding, the distinction of our case remains for Nigerians, including generations yet unborn, to appreciate.
The PDP expresses gratitude to millions of Nigerians across board for voting Atiku Abubakar in the election as well as for their unflinching support for our party during the election and throughout the duration of court proceedings.
Nevertheless, our party, indeed the nation, awaits the justices of the Supreme Court to release their reasons behind their verdict.
Signed:
Kola Ologbondiyan National Publicity Secretary . Notwithstanding, the distinction of our case remains for Nigerians, including generations yet unborn, to appreciate. ...........Which distinctions? Is it the poor witness presentation or illogicality of the evidence presented and argument? It is the worst case in the history of PEPT in Nigeria |
