Because it will not be easy for apc to win a senatorial rerun in bayelsa.
Again recall that the appeal court in atiku vs buhari settled this name issue and am sure the supreme court will follow suit when they give their ratio decidendi for dismissing atiku appeal.why was the high court judge misled . In my opinion with all the irregularities in his documents unlike that of Atiku and Buhari.he may lose his appeal even in Supreme Court. |

oshozondii: The All Progressive Congress in Bayelsa State has reacted to the court ruling disqualifying Senator Biobrakumo Degi-Eremiyon, running mate to the party governorship candidate, Chief David Lyon, as a travesty of justice.
Publicity secretary of the party, Doifie Buokoribo in a statement Tuesday said, “The judgement occasioned a miscarriage of justice, is glaringly perverse and against the weight of evidence before the Court. We are totally surprised that the Court could despite the objections by our lawyers, go ahead to determine a weighty criminal allegation of falsification and fraud solely on the bases of affidavit evidence contrary to well established judicial precedents that such must be proved beyond reasonable doubt by calling oral evidence.
“We strongly believe that the judgment cannot withstand a superior judicial scrutiny, therefore, our lawyers have filed a notice of appeal and other court processes to arrest the execution of the judgment pending the outcome of the appeal.
“We call on all our members and supporters not to be distracted but continue to peacefully mobilize for the November 16, 2019 elections.”

APC should appeal the judgment if there is a reason to do so.The appeal court will ask parties involved to maintain to maintain status cope until after election...... All these are done before the election...... In the case of Sokoto the Supreme court ruled that APC did not conduct a legal primary and that means it was not ready for the election. That is why PDP took over the state....This is not the case of Bayelsa where legal primary was conducted. So replacement of the disqualified deputy governor by APC is sacrosanct |

Oyo Governorship: Appeal Court rules in favour of APC but leaves Makinde in office
A Court of Appeal in Ibadan, the Oyo State capital, on Monday, upheld the appeal filed by the governorship candidate of the All Progressives Congress (APC), Adebayo Adelabu, against Governor Seyi Makinde of the Peoples Democratic Party (PDP).
The court, consequently, set aside the tribunal judgement that nullified the petition brought by Mr Adelabu against Mr Makinde.
PREMIUM TIMES reported how the election petition tribunal in September dismissed the petition.
Reversal However, the appeal court on Monday said the judgement of the tribunal was ‘perverse’ and therefore set it aside.
The court, however, did not make any further order concerning the election.
The court added that status quo at the time of filing the petition by Mr Adelabu remains, meaning Mr Makinde remains the winner of the election as declared by INEC.
The court, in its lead judgement, ruled that the appellants, the APC and Mr Adelabu, were not giving fair hearing by the tribunal.
The Electoral Act only gives a grace of 180 days for a case to be heard at the election tribunal.
The appeal court ruled that the tribunal had exhausted its time; therefore, the case could not be sent back to it for review.
The court ordered that the status quo before the tribunal’s judgment should remain. This means the declaration of Mr Makinde as the winner of the March 9, 2019 governorship poll in Oyo State remains.
The court held that if not for time, it would have ordered a re-trial at the tribunal, noting that “unfortunately, the time limit of 180 days for the tribunal had been exhausted.”
Three out of the four judges resolved all issues in favour of the appellants.
There was a dissenting judgment from a judge with a proviso that the panel could not nullify Mr Makinde’s election.
Reactions Counsel to Mr Makinde, Eyitayo Jegede, in his reaction, said the judgement did not mean Mr Makinde is no longer the governor.

FIRS AD
“He has not been affected in any way. The Court of Appeal in their wisdom said they did not agree with the lower tribunal. They did not also say that they did not agree with INEC. So, INEC’s declaration is sacrosanct and it remains until any other pronouncement from the court.
“We have not seen the details of the judgment. We were all in court and you (journalists) saw that the details were not read to us. As far as we are concerned, there is no cause for alarm. There is no implication on the return and declaration of Seyi Makinde as the governor of Oyo State,” he said.
The counsel to Mr Adelabu and the APC, Adeboye Shobanjo, also reacted to the judgement.
“You listened to what my lord said about the evaluation of judgment of evidence that when there are (is) evidence before the court, the evidence of all parties before the court should be evaluated.
“Judgment should not be based only on the evidence of a party in a case and if that was done during the trial, or during the judgment, that is contrary to the provision of the constitution on fair hearing.
“Second(ly), this court settled the issue of dumping of documents on election cases, and contrary to the decision of the tribunal that all the documents tendered by the appellants were dumped on the tribunal, the judgment made it known that the documents were not dumped on the tribunal.
“In totality, the appeal was allowed. But my lord said that because of effusion of time, that since the time for trial has lapsed at the tribunal, they cannot order for retrial of the case.
“But generally or totally, the appeal was allowed. It showed that the judgment of the tribunal occasioned miscarriage of justice against the appellants. The next step depends on my clients. They will brief us accordingly and it depends on instructions,” he said.
https://www.premiumtimesng.com/news/headlines/362257-oyo-governorship-appeal-court-rules-in-favour-of-apc-but-leaves-makinde-in-office.html . I am yet to understand this judgement. You cannot order a retrial but you can order a fresh election in affected areas.orvdeckare a winner. In the case of Osun winner was declared and it was contested in Supreme court....The appeal court on Oyo case should have taken a decision....The Supreme court will decide it finally. |

Citizenshelm: The Senate on Wednesday debated the sexual harassment bill initiated by Deputy Senate President Ovie Omo-Agege.
The bill scaled second reading on the floor of the Senate.
The proposed legislation titled “A bill for an Act to Prevent, Prohibit and Redress Sexual Harassment of Students in Tertiary Educational Institutions and for other matters connected therewith 2019” has 27 clauses.
The bill proposes up to 14 years jail term, with a minimum of 5 years, without an option of fine for any educator who commits sexual offences in tertiary institutions, Igbere TV reports.
The bill defines sexual offences as including sexual intercourse with a student or demands for sex from a student or a prospective student or intimidating or creating a hostile or offensive environment for the student by soliciting for sex or making sexual advances.
Other forms of sexual harassment identified in the bill are grabbing, hugging, kissing, rubbing, stroking, touching, pinching the breasts or hair or lips or hips or buttocks or any other sensual part of the body of a student; or sending by hand or courier or electronic or any other means naked or sexually explicit pictures or videos or sex-related objects to a student, and whistling or winking at a student or screaming, exclaiming, joking or making sexually complimentary or uncomplimentary remarks about a student’s physique or stalking a student.
Senator Omo-Agege, in his lead debate, said: “The most effective way to deal with the offence of sexual harassment in our tertiary institutions is to penalise the very impropriety of the act, with or without consent.”
According to him, sexual harassment must be defined in tertiary educational institutions as statutory rape with strict liability for offenders to be prosecuted easily.
On the extension of the bill to primary, secondary schools, worship centres and workplace, Omo-Agege said doing so will not be necessary because the Criminal and Penal codes already adequately deal with these categories with sufficient clarity.
He, however, stressed that the bill prescribes expulsion for students who falsely accuse educators of sexual harassment.
He said: “An educator whose character is maligned is at liberty to sue for defamation under the law of defamation which is well-settled in our jurisprudence and needs no duplication in this bill.”
The Senate also on Wednesday considered President Muhammadu Buhari’s Finance Bill, 2019 initiated by Senate Leader, Abdullahi Yahaya.
Senator Abdullahi said the bill essentially seeks to promote fiscal equity by mitigating instances of regressive taxation; reforming domestic laws to align with global best practices, and introducing tax incentives for investments in infrastructure and capital markets.

L . A similar bill DIED in the 8 senate during a public hearing because it was limited to higher institutions .The senate then believed sexual harassment affects every sector in Nigeria I believe a bill like this should be entitled: Sexual harassment in the private and public sectors. or Sexual harassment in Nigeria. |

Both man and wife live in the Modibbo Adama University of Technology town of Girei, in Girei LGA of Adamawa State.
The wife (name withheld) had earlier sought for dissolution of her marriage on grounds that each time she had sex with her husband (name withheld), she sustains injury.
She told the Nassarawo Area Court in Jimeta, Yola North, that her man is stronger than her, that his obsession for constant and prolonged sex is beyond her.
She said her problem is worsened by neglect, as he does not give her food nor provide her other basic needs.
She asked the court to dissolve the marriage, which was contracted on February 26, 2016.
The Nassarawo Area Court granted the relief after due process, but the husband, dissatisfied with the decision of the court, went to Sharia Court of Appeal, Yola, which referred the matter to Upper Area Court 3 for review.
At the resumed sitting of the Upper Area Court presided over by Umar Isa, the Court adjourned hearing on the suit to November 13, 2019.

fergie1989: In the last few days there have been reported cases of massive killings in Kogi State University, KSU, as cult groups wreak havoc on students.
A report puts the killings in the institution at 13 as at Monday.
The management of the institution are yet to react to the killings, but some students of the school have been venting their anger over the inability of the school’s authority to handle the issue and bring the cultists to book.
Twitter is littered with various reports by students of the institution calling for prayers over massive cult killings in KSU.
A student of the school who goes by the name, Labzy Usuff on Twitter said “They’ve been continuous killings in Kogi state University yet the management did not do anything about it.”
Another student, who simply preferred to be called by the name, Chemical Boy, lamented that that on November 1, a student was shot dead, the same day a student of the University of Benin was shot dead by cultists.
Sources in the school alleged that 10 students were killed in one day by cultists with several students resorting to prayers and calling on the public to pray for the institution.
When contacted, Police Public Relations Officer, PPRO, Kogi State Police Command, DSP William Ovye Aya, said it could not be true that about 13 people have been killed in the school, but said he would confirm and get back to PM News.
He later called to confirm the clash, saying that five students were killed at the weekend by cultists, saying it happened in a separate attacks.
Aya said the it was cases of homicide and that the police were investigating the matter.
According to him, from the look of things, the attack was cult-related as the five students killed were butchered with machetes.

How can a court issue u a document that they ordered your customary divorce when no court did any such thing . The Federal registry has sanitised the procedure now for marriages under that Marriage Act...If you are single you do affidavit for bachelorhood or spinsterhood If you are a divorcee you need to present evidence of divorce whether the marriage you did before was statutory or traditional. The evidence must be uploaded ito the marriage Registry. ..Additionally there are different forms of statutory marriage:Marriage between two Nigerians. marriage between a Nigerian and a foreigner. Marriage between the two foreigners....... The three have different requirements........This development is to check fake and make believe marriage that are common in Nigeria. |

CanadaOrBust: U r confusing customary divorce and statutory divorce. If u had a statutory divorce u r required to present a certificate of divorce. Not so if u had a customary divorce. To statutorily marry, you shouldn’t already be in any type of marriage whatsoever. But u r only required to present divorce document if u were statutorily married . You don't understand me....Ecitibiz.interior .gov.ng Go to the site and see requirement for remarriage whether your first wedding was statutory or traditional.... |

Olafisoyem: This is such a stupid move by the federal government and I’ll explain why.
First of all marriage is a right of every Nigerian of a certain age. The certificates show you as married.
The government is the body that should provide access to this right as stated in the constitution.
If the above is true then it’s the governments job to grant easy access to this right for all Nigerians. Our population is over 200 million.
So someone in government thinks for a country as big as Nigeria with such a population should have only 12 centres to serve the whole country.
Instead of them making things easy they make it hard.
One option would be to enforce that the LGAs provide the CORRECT certificate as proscribed by the government instead of stopping them from issuing certificates all together.
They are making Nigerians suffer for a argument between two layers of government.
Our roads aren’t safe and people should travel for hours just for a certificate. It’s not fair on the people and it just shows our leaders don’t have the people in mind. They don’t care! . You are right.... The local governments complicated the whole thing.. The local govts also licence some churches the right to contract weddings and give them certificates... Is it not ridiculous? The are doing this so as to be making money for their councils against the constitution .I have seen more than 20 different certificates from different places across the country... outrageous! I expect the federal government to have registries in each state of Nigeria. and if local governments are ready to cooperate .It will lessen the burden of all of us |
