Anambra State Governor, Chief Willie Obiano was awarded "Nigeria's Governor of the Year 2014" at the weekend in Houston, Texas by the USAfrica. While speaking as the special guest of honour at the USAfrica Interactive Forum the Governor urged the international business community and Nigerians in the Diaspora who wish to invest in his state to take advantage of the one stop agency, the Anambra State Investment Promotion and Protection Agency (ANSIPPA) to make such investments without the rigmarole of dealing with multiple, incoherent agencies and offices. The former banker and auditor also listed prudent management of the resources of the State, economic enablers and aggressive attack on all forms of crime as the highlights of his performance in the past nine months of his administration. Gov Obiano hinted that “even as my government is being commended for several achievements, we are going to achieve more significant projects in 2015 such as a cargo airport and an inland seaport. The flyover projects in Awka will be ready for use.” In his welcoming remarks, Dr. Chido Nwangwu, the Founder & Publisher of USAfrica, described “Gov. Obiano as a high-achiever who has dominated his environment in Anambra and has within 9 months left indelible marks on the Anambra landscape. I think he’s a technocrat who has made Anambra better and a humanitarian.” Further explaining why Obiano bagged the prestigious recognition, Dr. Nwangwu noted that “since taking over the mantle of leadership of Anambra State, the banker turned politician has, with purposeful zeal attracted investments and with the courageous heart of a bull, confronted criminals and miscreants who had unleashed mayhem and gripped the peace loving people of the state in the throes of trepidation, fear and death. A Tale Of Two Flag-offs - By Peter Obi On Tuesday, the 5th of January, 2015 the All progressives Congress (APC) flagged of its campaign in Port-Harcourt, where it attempted to showcase what it has to offer Nigerians. Like I said in my recent intervention in media after the event, it was nothing but empty declarations about what the party ‘would like to do’. The APC had nothing to offer in terms of real understanding of the problems of the nation and any detailed plans about how to solve them. The People’s Democratic Party (PDP), on the other hand, flagged off its campaign in Lagos, the supreme headquarters of the APC yesterday the 7th of January, with clear and loud statements about its understanding of our national problems, the steps it is taking in dealing with them and how it will continue to steer the ship of state towards sustainable development, according to 21st century standards. The important thing to note here, among others, is the absence of a plan for national development from the APC fold. During the flag-off by the APC, the party said it would stop insurgency, but did not say how. It showed no knowledge of the capacities and challenges of the armed forces and was content to merely assure Nigerians that, once elected, it would stop insurgency the way its flag-bearer stopped the Maitasine group in the 1980s. it President Jonathan and the PDP rally of yesterday to know that past Nigerian governments, including that of Gen Muhammadu Buhari, have consistently failed to equip the armed forces and make them combat ready. The APC failed to situate the problem within the contemporary global and national challenges and, therefore, had nothing to offer by way of real solutions to the problem. This is a detailed summary of a report by the Petroleum (Special) Trust Fund (PTF) Interim Management Committee set up on July 7, 1999 by former President Olusegun Obasanjo. The report summarized that PTF under Buhari's supervision was grossly mismanaged to the tune of N25.7Billion. This blog in no way intends to witchunt Buhari as he may or may not have been a direct beneficiary of the fraud, rather the main culprits are consultants whom he appointed to run affairs in the trust fund. Read on... Background The PTF was set up by the Sani Abacha administration in March 1995 with General Muhammadu Buhari (Rtd) appointed to head the Fund which was formed sequel to the increase in the pump price of petrol to N 11 from N 3.25. General Abacha had said then that the Fund was to distribute the gain from the increased price on social and infrastructural projects. The Trust Fund started work with an initial capital of about N60billion in 1996 with a mandate that included the rehabilitation of roads and waterways, educational and health institutions, providing textbooks and stationery, procuring essential drugs and vaccines, providing water supply systems, reviving crumbling agricultural sectors, connecting outlying areas to the national electricity grid, extending railways and telecommunications and ensuring consistent food supply. On assumption of office in 1999, President Olusegun Obasanjo disbanded the PTF. One of the discoveries made by the administration was that between its inception and July, 1999, the funds that accrued to the PTF stood at N 181 billion. It was also muted that the Consultants appointed by the Executive Chairman of the Trust Fund, Gen Buhari constantly fleeced the country of funds running into billions. In 2000, the Obasanjo administration set up an Interim Management Committee (IMC) to take a look into the affairs of the Petroleum (Special) Trust Fund and ascertain among other things, how much has been spent by the PTF so far, especially payments made from inception to September 30, 1999, and what is on ground to justify the huge expenditure. The Committee the set to work and accomplished all the terms of reference by March 2000. For reasons best known to him, Obasanjo failed to act on the report findings. The Interim Management Committee (IMC) members were: Dr. Haroun Adam (Chairman), and Alhaji Abdu Abdurrahim, Mr Achana Gaius Yaro, Edward Eguavoen, Mr. T. Andrew Adegboro and Mr. Baba Goni Machina as members. A summary of their report is given in the next paragraph. Terms Of Reference One of the terms of reference of their appointment was to carry out verification exercise on ALL projects and programmes prior to packaging the projects and programmes for subsequent transfer to the appropriate line ministries. The recoverable exercises of the under-listed projects were completed and the various reports and the IMC recommendations forwarded to President Obasanjo for further directives. In all there were seven terms of references and they covered areas such as: PTF consultants, Fund recoveries from financial institutions, Food Supply, Education, Health, Water Supply,e.t.c. Discoveries For the sake of clarity I shall outline the findings of the report according to projects undertaken. 1. Afriproject Consortium (APC) AFPRI- Project Consortium (APC) Afri-Project Consortium were contracted by PTF as Management Consultants and Project Consultants. The Executive Chairman of PTF also delegated to them "the power of Engineer (sic) in all appropriate project requiring such power." Inotherwords Buhari gave them a blank cheque and total freedom to do as they pleased. Afriproject Consortium then assumed an absolute power of initiation, approval and execution of all projects. Three reputable management consulting firms were engaged by the IMC to verify all payments made to AfriProject from the inception of PTF up to 30th September, 1999. After the audit verification it was discovered that they have over charged PTF for their services to the tune of N2,057,550,062 (Two billion fifty seven million five hundred and fifty thousand and sixty two Naira only). 2. PTF-Assisted HIV/AIDS Programmes The intervention of PTF in the HIV/AIDS was flawed due to professional negligence by the management consultants, AfriProject. There was an excessive order of HIV/AIDS kits which resulted in most of the kits expiring before use. Also there was gross inflation of the purchase price. These two factors combined resulted in a loss of N579,000,000 (Five hundred and seventy nine million Naira only). Are you satisfied with the outcome of the reconciliation meeting? Yes I am. I thank the Vice President, Arc Namadi Sambo, who led the peace talks and also thank and congratulate the people of the state for their maturity. Mr Vice Vice President spoke to the party members like a father, and everybody in the PDP family agreed with him on the need to close ranks and work together. What is your reaction to the the statement of Governor Rotimi Amaechi, the Director of Gen Buhari's campaign, that the APC supports the soldiers involved in mutiny? The statement, if it is true, is unfortunate and least expected of a public officer of his status. I have always maintained that leaders in corporate and public life should strive to maintain exemplary character and behaviour that is worthy of emulation. Their pronouncements and disposition must be responsible, devoid of abusive, or inciting words that could undermine the moral fabric of the society. On this same issue of security in particular, lives have been lost by the civilian populace and military personnel. That is why public figures must be sensitive to these things and show signs of serious social responsibility at all times. We are expected to speak with restraint and decorum, knowing that we can make or mar society. The Archbishop of Enugu Anglican Province and Bishop of Enugu, Most Rev. (Dr) Emmanuel Chukwuma, has called on the Catholic Bishop Conference of Nigeria to summon immediately fiery Catholic priest, Revd Father Ejike Mbaka, and discipline him over his recent proclamation on President Goodluck Jonathan. Father Mbaka had during the New Year service at his Adoration ground in Enugu declared that President Jonathan’s administration had brought bad luck to the country and urged him to quit even as he later raised the alarm that his life was under threat because of what he said. But Archbishop Chukwuma told Daily Sun yesterday in Enugu that what Mbaka said about Jonathan was inflammatory and therefore, called on the Catholic Bishops Conference of Nigeria to check him with a view to curbing his excesses. The archbishop said it was unfortunate that the First Lady, Dame Patience Jonathan, had visited Mbaka’s Adoration ground, where he alleged she gave the priest N5 million and Mbaka eulogised the President, urging him (Jonathan) to continue in his good works without fear or favour only to turn back suddenly to make negative statements about him. “What Mbaka had done is very much inflammatory and disgraceful against Mr. President. One, therefore, wonders if Fr. Mbaka was settled for him to change gear and we are calling on Mbaka to mention those religious leaders, whom he accused of going to Aso Rock to wine and dine with the President and therefore, could not speak the truth as he claimed. “Fr. Governor Willie Obiano of Anambra state has said his government is beyond attracting investing of $1.65 Billion direct investment as it is equally doing everything possible to internally generate revenue of about N3.2 Billion monthly. Correspondents report that Obiano told chapel members in a parley at his country home that before he took over government, the IGR was N500 million but that he is currently generating N1.1 Billion and that he is not satisfied until it gets to N3.2 Billion to enable the monthly salary of the state workforce generated through IGR. He said his government has the potentials to block the loopholes adding that his government has not abandoned any project by the previous administration as it is a continued government. Obiano said the state has attracted about $1.65 billion investment from investors since March 17, 2014 when the new administration was inaugurated. These investments, he said, were attracted to key areas covering agriculture, hospitality and tourism industry, power generation, trade and commerce, among others. Obiano told the Correspondents that he has his eyes on the ball despite the numerous distractions and appealed for support to enable him actualize his vision and mission for Ndi-Anambra. He informed them of his various programmes and achievements as well as challenges facing his government. The governor stated that through the Anambra State Investment Promotion and Protection Agency (ANSIPPA) headed by eminent Anambra people, investments had flowed in from the Coched Farms $175 million, Ekcel Farms Limited ($150 million) and Grains and Silos Limited ($11 million). Others attracted to invest in Anambra by Obiano administration are Delfarm Limited and Songhai Regional Centre from Benin Republic with $200 million investment, West Africa Inter-continental Trade Centre ($320 million) and Cardinal Developers and Trust which took over the completion of Anambra’s four-star luxury hotel in Onitsha, among others. Apple is facing a lawsuit for not telling users about the amount of memory required by its flagship operating system. The legal complaint revolves around iOS 8 and the amount of memory it reserves for itself on iPods, iPhones and iPads. The complaint alleges that it takes up so much space that far less than advertised is left for people to store their own data. Apple has yet to issue any official comment on the lawsuit. The complaint has been filed in California by Miami residents Paul Orshan and Christopher Endara who say that iOS 8 can occupy up to 23.1% of the memory available on some Apple devices. In addition, upgrading devices from the earlier iOS 7 to 8 can cause people to lose up to 1.3 gigabytes of memory, said papers filed in support of the legal action. The amount of memory taken up by iOS 8 can mean users run out of storage and, the pair allege, this is helping Apple force people to sign up for its fee-based iCloud storage system. The lawsuit is seeking millions of dollars in damages for those using Apple devices facing the storage squeeze. So far, Apple has not responded to requests for comment on the lawsuit. The latest upgrade to iOS 8 was released in late September but Apple was forced to withdraw and then re-issue it because the first version meant a lot of iPhone 6 and Plus handsets could no longer make calls. http://ndibenonso..com/2015/01/the-rivers-judiciary-crisis-tale-of.html It is no news that all courts in Rivers state have been under lock and key since June 2014. Lawyers and Judges are out of job, cases are piling up and people cannot get justice which is their fundamental human rights as enshrined in the 1999 constitution. Like the proverbial suffering grass and the fighting elephants, the two major characters in this drama; The National Judicial Council (NJC) and Governor Rotimi Amaechi seem not to want to shift grounds while the judiciary in the state lingers in limbo. Before I continue it may interest you to know the rest of the cast in this interesting story. I have already mentioned the star actors: The NJC and Governor Amaechi. Others are: Justice Peter Agumagu, Justice Daisy Okocha, Hon. Justice Lambo Akambi, The State Judicial Service Commission (JSC) and the Rivers State House of Assembly. Now that you have seen the personalities involved in the imbroglio, I shall proceed to give us a little background of the crisis. Since Rivers State was created from the defunct Eastern Region in 1967, the seniority criterion had been adhered to strictly in the appointment of Chief Justices (CJs). Hon. Justice (Sir) Michael H.F Holden, a British, was the pioneer CJ by virtue of his being the highest ranking judge at the time. After he retired in 1976 and went back to the U.K, he was succeeded by Justice Ambrose Alagoa (1978-79), Hon. Justice Donald Graham Douglas (1979-1992). But the seniority criteria was tampered with when Douglas on his exit, favoured the appointment of Justice K.D Ungbuku in 1992 instead of Justice F.N Ichoku who was the most senior then. Justice was however served when in 1996, Bayelsa State was carved out of Rivers. As a result Ungbuku being a Bayelsan went on to become pioneer CJ in the state, leading to the return of Justice Ichoku as CJ from 1996 to 2001. Justice Ndu replaced Ichoku in 2001 under controversial circumstances as he was not the most senior at the time but he was left to continue because of his magnanimity and humility. When he finally retired in 2014, Governor Amaechi being a lawyer himself, sought to restore the seniority criterion by appointing Justice Agumagu as CJ. This was the beginning of problems to come. But what does our constitution say about the appointment of a substantive Chief Judge of a State? Section 271(1), item 21(c) of Part I to the Third Schedule and item 6(a) of Part II to the Third Schedule of the Constitution provides the answers. The said provisions respectively go thus: 271(1) ‘The appointment of a person to the office of Chief Judge of a State shall be made by the Governor of the State on the recommendation of the National Judicial Council subject to the confirmation of the appointment by the House of Assembly of the State.’ 21(c ). ‘The National Judicial Council shall have power to recommend to the Governors from among the list of persons submitted to it by the State Judicial Service Commission persons for appointment to the offices of the Chief Judges of the States…’ 6(a) (i) The Commission (State Judicial Service Commission) shall have power to advise the National Judicial Council on suitable persons for nomination to the office of the Chief Judge of the State’ From the above we can comfortably summarize that to appoint a CJ, the State JSC has to first advise the NJC with names of possible candidates for the position based on their local knowledge . Then the NJC will choose one and recommend same to the Governor who in return forwards the name to the House of Assembly who confirms him. End of story. But was that the case in Rivers? We shall see in the next paragraph. Following the appointment of Justice Agumagu without input from the NJC, a group called the Kengena Unity Forum challenged the appointment in a Federal High court presided over by Hon. Justice Lambo Akanbi. The judge ruled that Justice Agumagu was not qualified to be appointed acting CJ of Rivers state by virtue of his not being a State High Court Judge at the time of his appointment. Justice Akanbi must have based his decision on section 271(4) of the constitution which states that the most senior Judge of the High court should be appointed as acting CJ. Some lawyers who I interacted with explained that since Agumagu at the time of his appointment was the head of the Customary Court of Appeal (CCA) while Justice Daisy Okocha was the most senior judge of the High Court. Following Akanbi's ruling Governor Amaechi filed another suit before the same judge, questioning the power of the NJC to force a recommendation on the State Government. Justice Akanbi this time ruled as follows: "I cannot allow the argument of the defence counsel, that the governor must accept the recommendation of the NJC. The body that is most suitable to make recommendation of a nominee of a chief judge of the state is the state Judicial Service Commission (JSC), because they have local knowledge of the most suitable candidate, than the National Judicial Council.” “What the constitution recommends is 10 years of legal practice and we are in a dynamic world. And so, the issue of most senior judge can no longer be the only criteria of appointing someone to such an important and exalted position.” Irked by this Judgement, the NJC moved to suspend Justice Agumagu making it clear that it will not recognise him as the CJ. It went further to issue him a querry asking him why he should not be punished for violating his judicial oath. Justice Agumagu in reaction, approached a Federal High Court challenging NJC’s decision to suspend him and praying the court to restrain members of an investigation panel set up to investigate the allegations against him from taking any further steps in respect of his case until the determination of the suit he filed. The stage had thus been set for the stand-off. A critical look at the developments above will reveal certain flaws which I will point out from a layman's view as I am not a Lawyer. First of all the NJC erred in wielding the big stick on Justice Agumagu. If they were displeased with the ruling of a federal high court Judge, the right thing to do in my opinion was to file a counter suit in another court. Till a contrary ruling is obtained, the NJC, a revered body of eminent judges, would have maintained the status quo and not go on to illegally suspend Agumagu, an act similar to that of our lawless politicians. That they are the NJC does not mean they are above the law. Secondly Governor Rotimi Amaechi violated section 271 of the constitution by not carrying the NJC along in appointing Agumagu. All things being equal, his action in the eyes of the law can be said to be make the appointment null and void. If he wants the state to appoint the CJ without the NJC's input then he should seek amendment of the constitution from the national assembly. Thirdly, some legal luminaries have argued that the State High Court and Customary Court of Appeal are both high courts and therefore Justice Akambi was wrong in disqualifying Agumagu earlier on grounds of not being a member of the high court. I agree with them totally. Conclusion: We call upon all parties in this dispute to sheathe their swords and in the spirit of the new year find an amicable solution to this impasse. I would recommend an out of court settlement. Several years ago, the Enugu State House of Assembly rejected Justice Agbo recommended by the NJC and instead preferred Justice Umezulike. The then NJC chairman Justice Uwais intervened and settled the matter amicably with Umezulike finally appointed. The present NJC in my opinion should tow this reconciliatory path. Governor Amaechi should also learn to bury his ego and reach a common ground with the NJC. Since Justice Agumagu is 4years senior to Justice Daisy Okocha and is due to retire in December 2015, he should be allowed to become CJ for some months after whicj Justice Okocha who herself is due for retirement in January 2016 should occupy the office till her retirement. That way justice will be served both ways. Lastly. the house committee on Justice should move swiftly to amend the relevant section of the constitution affecting the appointment of Chief Justices in order to avoid another crisis similar to what we have in Rivers state presently.
