Hello @justwise, @2n2k, @ askari, @whytegirl and nairalanders,
please there is a part in the visa form asking this question:

Tell us about work for the following types of organisation:
1)Armed Forces (including compulsory national or military service)
2)Government (including Public or Civil Administration and compulsory national service)
3)Media organisations
4)Security organisations (including police and private security companies)
5)Judiciary (including work as a judge or magistrate)

For most graduates who have done NYSC, does question No2 apply?

Please your answers.
2n2k:
He wanted to know where to classify his NYSC experience in the light of option 2 in the question. Does participating in nysc scheme mean one has worked for government? If so, all nigerian graduates (except those exempted) must fill that they have worked for government even if they served in private sector.
The option is there already

@ Justwise, from day1 that I submitted, my wife was anxiously expecting their call and after a while we kept writing and calling their UKVI enquiry that we have not heard anything, they then refused the visa (after 6 months+) claiming that wife was called 7 to 9 x on different days and she did not answer calls! and they even claimed that there was an occasion she rejected their call after they introduced themselves. BEWILDERMENT!!! huh DISCOMBOBULATION !!! A lot of questions beg for the answer with their busy schedules calling a person 7-9xhuh Why did they concentrate on phone calls alonehuh? someone anxiously expecting to be called will now be rejecting callshuh?--------------------------Justwise. I am confused, people in the house!!!
The question is..did they call your wife?

I am appalled at some of y'all's replies to people's posts. How difficult is it to be polite and courteous to strangers? Really! Even if you doubt the veracity of someone's story, calling the person a liar and being all crude and superior is not the right attitude. It speaks ill of your character and does nothing to belittle your victim's. Be courteous always. Peace.

Hi, thanks for help so far. I am hard working and very dedicated. However, the nature of my course limits me. For example, I go in for lectures from 9am to 3/4/5pm Monday to Friday and my course is only full time.

Also, I usually have long holidays of 2-3 months and I do as many shifts as possible during this time. I don't think I would want to go down the route you have suggested as I'd like my hubby to study in the UK.
I understand that..was only thinking outside the box as regards to studying in other EU country.. Does he work in Nigeria?

I was told that they have a lot of backlogs of appeals. I am dazed and confused! The first application spent six months+ before it was returned refused! family settlement/family reunion.....Justwise
What was the reason or reasons for the refusal?

@justwise

Thank you for your reply.

I am not blaming the ECO for not informing, it the Hotel that I feel aggrieved with tbh.

The Hotel replied my email and see their reply below

Hello Bleep,

Thank you for your email.

You reserved an advance purchase reservation, the card that we tried to take payment on declined and were were unable to contact you as we did not have an email address and were unable to contact you on your telephone number.

We have reinstated the reservation however the payment is still declining,

Have you another card that we are able to take payment from?

Kindest regards

Alexandra

I guess I took it for granted. I would apply more care next time

For Future Application this is what the ECO stated.

Any future UK visa applications you make will be considered on their own merits, however you are likely to be refused unless the circumstances of you application change.

You should note that because this application for entry clearance has been refused under paragraph V3.6 of the immigration Rules any future application will also be refused for the same reason under paragraph 320 (7B) of the immigration Rules or paragraph V3.7 of Appendix V of the immigration Rules.

A refusal under paragraph V3.7 of Appendix V of the immigration Rules may attract an automatic refusal period of up to 10 years. The period starts from the date of the previous event in which deception or submission of falsified documents or information was employed.

So I guess I should not bother appealing.
Secondly, I guess I am yet to attract an automatic ban but will likely do if a similar situation occurs. Do you agree?

I guess I should forget about the conference for now but I plan to reapply fairly soon. Now given the reply from the hotel do you think their response will be useful during future application when I am asked declare previous refusal and the reason.

I acknowledge I have goofed and took for granted crosschecking my details before sending my application. Hope to learn from it. I will appreciate if you can tell me what you think for about reapplying.
You don't have any right of appeal as i pointed out to you before.

If you want to reply then attach the email from the hotel and use the blank space in the form to explain what happened.

Don't copy the email and paste in word document then print, print the email right from your inbox so as to contain all the details from the hotel..e.g email address, the date it was sent, printing day etc

Gurus in the house! I need your URGENT advice, after my application for family settlement, was refused last year on flimsy reason, I immediately appealed the decision since November 2015 up until now my appeal is still lying fallow (9) months after without a date fixed for the hearing after their usual 15 weeks of review which has lapsed 4 months ago, their usual response is with many emails, they have not got respondent's bundles, they have not overturned their original decision, therefore the appeal will progress through the appeal process .....please note that we are unable to provide timeframes for the appeal process (as a whole or each procedure within the process)due to a number of varying factors. Even,If they maintain that appeals are currently heard within 12 months on average, and 9 months hearing date has not been fixed by HM Courts & Tribunals Service at the Ministry of justice? what can we do?

True. But she only works under 12 hours (probably because she needs more study time). Working more hours might jeopardise her grades.
Going part time adds a year to the end of her graduation schedules.
The question still remains, how does a student sponsor another student(in her present default position) ?
If I can pay my way from degree to Msc as a foreign student working part time during term time and full time during the holidays then a home student can do that without a doubt. Its all down to discipline and commitment

A full time student with under 12 hours work per week, sponsoring another student in another country?
How would this be feasible? Not unless this student has some monster savings or earns between £500 - £1000 per hour from her part time job.
As a British citizen she can work more than 20hrs a week and can also go part time studying and full time working.

Hello everyone, I'm new on here and it's my first post today! Yay!! Don't get me wrong though, I occasionally come on here to read news and comments! The comments are hilarious and usually makes my day!

I am writing today to seek for advice from the well informed and knowledgeable people on this forum. My issue is with regards to the UK spouse visa.

Basically, I'm wanting to gather as much information as possible to enable me plan my life in advance so as to know the best time to apply for a visa for my fiancé.

I currently live in the UK and a full time student too(British citizen). I work most weekends too averaging a total of 11.30 hours per week. I have consulted gov.uk for visa information and it seems I am ineligible to apply for my fiancé. Well, we're going to get married before making any application.

Having done some research online, I realised I didn't meet the financial requirement as I am a full time student. So here's my question, is there a different way I can go about this? I don't want wait till I graduate before inviting my fiancé over as the duration of my course is long. Again, I know it will be more stressful to me then.

P.S: I am full time student and a British citizen too. I'd like to know if there are alternative ways of my husband to be joining me before graduating from University.

Can you afford to sponsor him to study in any EU country with a cheaper fees? If you can do that then you can get married there and apply for EEA before the UK officially leaves the EU

Mennnnnn this Dude just changing my words, anyway let me use your find to tell you know somethings.
student with children can use the right to a family life rule. So that student brought that child with them from their home country when he/she obtained the student visa?
The only reason they access that rule is because that child was born in the UK for a person that has a resident permit.

And I never tell you the right of Appeal was only applicable to just spousal visa, I only said student and visitor's visa.

You said the right to a family life is universal rule which is not.

Criminals and Asylum seekers use that right because to have a child, girlfriend, boyfriend or partner that has British passport or a resident permit.

@Portsmouth86 thanks for throwing more light from your experience put the fact that spousal visa has the right to appeal the deportation decision and only be returned back home after he/she has lost the appeal case which the appeal with take weeks to be heard and not immediately, And if the sponsor standing by her partner the deportation will never take place.

Unlike @justwise that said a spousal visa holder will have to return to their home country to appeal the decision. That is only the sponsor that can appeal from UK

NB:- if that sponsor stood by the spousal visa holder that deportation is unlikely to take place because both partner will get their facts right and with the help of a lawyer it will never happen.

@justwise only you said spousal visa has no right at all now you say they have hmmmmm and you just run around bring all other categories of visa that is not relevant to the issue.
I rest my case your here there's is pointless arguing with you on issue you know thing about.
Yes right to life family is an universal human right and its not peculiar to spouse visa holders alone and if you don't know this then its pointless debating this with you.

And no an asylum seeker doesn't have to have the baby here with a British passport holder to claim right to family life, they can claim that even with a child born outside the UK.

So you believed that a student visa holder with a child by a British passport holder can claim life to family life?

Obviously you know very little about this subject and i will advice you to read Article 8 Right to a private and family life

This is an abstract...

Family Life

Article 8 also provides the right to respect for one’s established family life. This includes close family ties, although there is no pre-determined model of a family or family life. It includes any stable relationship, be it married, engaged, or de facto; between parents and children; siblings; grandparents and grandchildren etc. This right is often engaged, for example, when measures are taken by the State to separate family members (by removing children into care, or deporting one member of a family group).

Why must it be bombing and beheading every time certain people get provoked?

Boko Haram is at result of hatred been preached to the lower class of the hausa by their elites.

As for Kenya, I will advise you to sit down and do your research how Kenya Government brought Al Shabaab to their domain. Before you quote me again, research on what I just said.
This is the problem..we always come up with one or two excuses to justify killing each other.

So because of hatred been preached to the lower class of the hausas by their elites a group came up to kill both Muslims and Christians right?

Boko Haram did not kill only the elites in fact poorer hausas suffered more as they carried on their killing spree.

Don't tell me to sit down and research jack because i'm sick to my back teeth with some of you who always come up with these excuses.

To me, the tragedy in France is reprisal attack not Terrorist attack.

The only solution to be done to permanently end the perpetration of reprisal attack is for the self acclaimed WORLD POWER to leave MUSLIM countries alone. Why always them?

Iraq was a better country before the western country invaded Iraq. Libyan citizen once live like queen and king in their domain, they enjoy almost everything free of charge/subsidize rate before France led NATO turned Libya to Terrorist castle.

Now let ask ourselves, let put ourselves in the shoe of Iraqi and Libyan, do you think these people will be happy with their oppressor? I have a lot to say but my heart is too heavy now thinking how Iraqi's are killed every seconds with no media to fight for them.

Before you start calling me names, ask yourself this question; why are countries like Switzerland, Poland, Ukraine, Sweden, Austria, Luxembourg to mention few are exempted by the terrorist?

France and Belgium problem started the day they led NATO to Libya. America play indoor game in the invasion in Libya and they recorded the first casualties as the blood of their ambassador to Libya was wasted for the invasion. The frontiers, France and Belgium are still counting casualties.

Moral of the story, don't do EVIL.

There is room for constructive criticism and counter fact.
Nigeria govt is not occupying any Muslim country but why do we have boke haram? Kenya is not occupying any muslim country but they have al-Shabaab, lets not go into this blame shifting and call a spade a spade.

I don't know so much about using guardian's other than parents. If it's your parents, I believe that should be fine as long as you provide a letter from them giving their consent to sponsor you, as well as your birth certificate.
For guardians other than blood parents, I'm afraid I don't know. It might be safer to move it to your own account. But maybe justwise or OlowoB can shed more light...

Its very difficult to get a visa using legal guardian as an adult especially in Nigeria, Nigerians don't go through court process before taking a relative as a ward and you can't do that just when you are about to apply for visa.

Better for him to put the money into his account as you suggested.

wales600:
Dear @Justwise,

I need urgent advise.
I applied for a 2 -year UK visa. Date of submitting my application was 16th May, 2016. I collected my passport yesterday and my application was refused.

The reason for refusal is as follows:

The decision
I have refused your application for a visit visa because @I am not satisfied that you meet the requirement of V4.2(a)-(e) of AppendixV: Immigration rules for visitors and I have also considered your application under paragraph V.3.6 of Appendix V: Immigration rules

. You have provided a hotel reservation for XXXX from Bleep to Bleep. Our office contacted the hotel on 9 June 2016 and was informed that the reservation was cancelled on 28th April 2016. This was before you submitted your online on 16/05/2016. I note you have declared on your application form that you will stay at the XXXX. Given that you cancelled this booking before you submitted your visa application online. I am satisfied that you applied deception when making your application. I am therefore not satisfied that you have accommodation arranged for your visit to the UK. This in turn leads me to doubt your intentions to travel on this occasion.

. Given the above I am not satisfied that you are a genuine visitor and will leave the UK at the end of your visit or that you have sufficient funds available to cover your costs whilst in the UK without working or accessing public funds.

.Your application for a visit visa has therefore been refused under paragraphs V4.2(a) and (e) and V.3.6 of the Immigration rules

He concluded to future application thesis with that there is no right of appeal or right to administrative review.

Here is outcome of my investigation:
1. I was never aware that my reservation was cancelled on 28th April 2016 until yesterday when I collected my passport. The UK EO is the first person to inform my me that the reservation I made on 20th April, 2016 (which was approved with reservation number) was cancelled on 28th April 2016.
2. I called the hotel yesterday to enquire the reason for this cancellation, and their Guest relations rep informed me it was cancelled because the credit card detail I registered online did not go through and was subsequently cancelled.
3. I asked why he did not contact me when the credit card details did not pull through to enable me make alternative arrangement or notify of the cancellation. He said they did not have my contact details (which is strange given that they sent a confirmation of my reservation to my email).
4. I subsequently requested that hotel write me an email stating the reason why my reservation was cancelled, which he promised to do. I have also written to the hotel as follows:
"I have been informed that my reservation was cancelled on 28th April, 2016. I would like to confirm the reason for the cancellation on this date as this was not done by me and why I was not notified of this cancellation on this date and on time to allow me make alternative arrangement as this action has had a detrimental effect to me with regards to the Petroleum Engineering conference I was scheduled to attend in August."

See the hotels cancellation and rate description policy below:

Cancellation Policy: Must purchase at least 3 days in advance.A deposit for the entire stay is due at time of booking.Canceling your reservation or failing to arrive will result in forfeiture of your deposit. Taxes may apply.

Rate Description: Great value on this fully prepaid rate. Advance purchase is required. A full prepaid non-refundable deposit is required at time of booking. Your credit card will be charged between the time of booking and day of arrival. Deposit is non-refundable if reservation is cancelled. Reservation non-Transferable

Here are my prayers:
1. Given the EO decision was arrived at with information never available to me at the material time, I wish to appeal the decision. Do you advise I go ahead?
2. If answer to 1. is affirmative can you advise me on how I can go about this.

My Immigration History:
1. I have never broken the terms of my stay before and never been refuse a visa or permit before now
2. I was granted a 1 year UK student visa in 2006
3. A 2 year UK post study work permit in 2009
4. A 2 year US visa in 2008 (with 2 visits in 2009 and 2010)
5. A 2 year US visa in 2015 (was in the US for 2 weeks in November last year for a similar type conference)

I need an urgent reply to enable make a decision on the next step forward as my conference is in middle of August, 2016
You don't blame the ECO for not informing you about the cancellation blame the hotel.

You have no right to appeal the decision, you can only reapply with evidence of correspondence between you and the hotel about the cancellation. If the hotel gives you a written explanation then better as it will support your case.
