VisaOfficer:
Use your real DOB! You can explain what happened with the agent, but you would have a hard time explaining why you procured a passport with an incorrect date of birth.

he use Ondo.pls.how can I go about it... i ve

VisaOfficer:
It sounds to me like someone played without your knowledge and is now trying to get money from you -- or is trying to sell you a fake identity. Let me say for the record that if you are not the same person as in the original photo, you will be permanently banned from entering the U.S. and may be arrested.

That said, if it's just an error, just write a letter to KCC explaining it and let them know what the real data should be.
Those two cases are from the same person and you can see that the VO gave two different answers and there is no evidence the KCC actually accepted his request to change his DOB judging by the following posts from him:

akintunde95:
thank you VO for your response about my question.... But i have write KCC several times about the real data ... They reply that KCC DOES not have chance to change data in initial form and they continue that i should complete form Ds230 and Dsp122...... Pls what do you refer me to do ......
akintunde95:
pls house i need help i send E-mail to LagosIV@state.gov to change my former E-mail and they reply me dat...... Thank you for your email.

We have no records in our system for your case yet, please contact Kentucky Consular Center to update your case..... Pls what do they mean......

This is the typical case of what we are discussing here. He emailed the KCC as directed by the VO and was told that they can't change it rather he should complete another form. Then he came back again to ask the VO the same question and her reply was:

VisaOfficer:
Use your real DOB! You can explain what happened with the agent, but you would have a hard time explaining why you procured a passport with an incorrect date of birth.

I don't think it is worth it bro , all u have been able to come up with is a thread on nairaland by someone whose identity can't be independently verified and who stated it clearly that all her answers are her own personal opinions .
No she is not one of those dodgy visa agents. When she started her first thread last year i removed it (i think she was actually banned at that time) because i thought she one of those visa agents imposing as VO but she emailed and asked me to verify her details which was done and the admin restored the thread.

So she is not one of those.

ineedhimbadly:
@ Justwise and Girlflo - what is your opinions on this case, I know your name is Justwise but I feel like you do not know much about 320. Take a look at this.

n the case of Mumu (paragraph 320; Article 8; scope) Bangladesh [2012] UKUT 143 (IAC) Judges of the Upper Tribunal Storey and Lane have dismissed an appeal against a refusal under paragraph 320(7A) of the Immigration Rules. This reads as follows:

(7A) Where false representations have been made or false documents or information have been submitted (whether or not material to the application, and whether or not to the applicant’s knowledge), or material facts had not been disclosed, in relation to the application.

The tribunal finds, perhaps rather unsurprisingly given the text of the rule, that the deception need not be that of the applicant and dismisses the case under the Immigration Rules. Note, though, that the tribunal explicitly records that dishonesty is required. An invalid document or a document that is marred by a mistake is not necessarily a dishonest one that would be caught by paragraph 320(7A). On the facts of this case the dishonesty was established: the false document in question deliberately misstated the appellant’s age so that she wrongly appeared eligible for a spouse visa at a time that the rules (unlawfully) required her to show she was aged 21.

The tribunal also addresses the suggestion that the appeal should be allowed on human rights grounds notwithstanding the deception. The argument that it was pointless to dismiss the appeal because a future application would succeed (paragraph 320(7C) would exempt the applicant from refusal under paragraph 320(7B)) was rejected, as was the inverse contention that the current appeal should now succeed because there was a risk of future refusal under paragraph 320(11).

The possibility that a case with different facts might succeed on human rights grounds was, however, explicitly left open:

Nothing in what we have just said should be taken to amount to a finding that it will never be disproportionate in Article 8 terms to uphold a decision under paragraph 320(7A). Each case ultimately turns on its own facts.
There may well be cases where, despite the public policy issues inherent in paragraph 320(7A), it would nevertheless be disproportionate to refuse entry clearance. The point we wish to make, however, is that the effect of 320(7B) and 7(C) is not such as to cause paragraph 320(7A) to be “read down” in a general way.

This case is notably a relatively rare example of the section 108 procedure being used, where an appellant’s representative is excluded from the hearing room while evidence of forgery is examined. One assumes the safeguards in OA (alleged forgery; section 108 procedure) Nigeria [2007] UKIAT 00096 were observed.

Close on the hooves of Mumu followed another case on paragraph 320 deception, that of Singh (paragraph 320 (7A) – IS151A forms – proof) [2012] UKUT 00162 (IAC). In this case UTJ Lane, sitting alone this time, deals with one of the increasingly frequent cases of alleged non-disclosure on a Visa Application Form (VAF). The slightest mistake on a VAF seems to trigger these dishonesty refusals at certain entry clearance posts.

Mr Singh had previously overstayed in the United Kingdom. He had then attempted to make a Tier 1 application which had been rejected. He made a voluntary departure and as he did so he was served with an IS151A form on the ‘flight-side’ of the airport when he was randomly encountered.

In making an application to return to the UK some time later, Mr Singh had answered ‘yes’ the question on the VAF about whether he had made a previous application in the United Kingdom and provided the date of application and the Home Office reference number with which he had been issued. He answered ‘no’ to the question about whether he had previously been refused a visa to the UK or any other country. This was a correct answer as he had been refused leave to remain, not entry clearance, colloquially known as a ‘visa’.

Despite this, First-tier Tribunal judge I F Taylor felt that there was some sort of ‘in the round’ deception by Mr Singh. The Upper Tribunal had no hesitation overturning this finding, describing the judge’s approach as ‘an excessively harsh test’.

This left the remaining question of whether Mr Singh’s negative answer on the VAF to the question about whether he had been ‘otherwise required to leave’ the UK or any other country. UTJ Lane found that the UK Border Agency had failed to establish their case, which was that Mr Singh had been served with a document that would actually require a person to leave the UK.

The appeal was therefore allowed.

Even if the relevant document, an IS151B, had been served, some might question whether such service at the departure gates really amounts to ‘requiring’ a person to leave. It suggests a certain amount of wishful thinking at the Border Agency and it also casts considerable doubt on removal statistics. I wonder how many supposedly ‘enforced’ removals in the immigration statistics are actually cases like that of Mr Singh, where the migrant is served with papers when they are in truth making a voluntary departure?
Do you know the difference between 320(11) and 320 (7A)?

Since I knew nothing about 320(11) does it also mean that your immigration lawyer know nothing about 320 (11)?

Anyway good luck with which ever decision you decided to take. My apologies for getting involved in your case. Was only trying to help because my ID was mentioned.

All the best.
Done.

Hello,

please i need help in understanding what might be wrong with my DV lottery visa application at the embassy in yaounde. I was interviewed on the 16th of September 2014 and the consular officer told me at the end of my interview that my visa has been approved and he gave me a yellow paper to come on the 9th of Oct 2014 at 3PM tp pick up my visa. I was at the embassy on the 9th of Otober and while the names were being read for pick ups, i did not hear name, no further information was given to those of us who didnt hear our names as when next we should call at the embassy or what to do. Curiously, I called the embassy on the 15th of October to find out about my visa, I was asked my case number which i gave and i was asked to come back on the 22/10/14 for a final decision. I told the lady that i do not understand what she meant by ''final decision'' because the consular officer already informed me during my interview that my visa has been approved so what final decision could she mean this time but she insisted that i come back to the embassy for a final decision on the 22/10/14

I just wish to find out if there could be a problem with my visa considering that people who were interviewed with me on the same day received their visas on the 9th of October 2014.

Thanks and waiting for your reply.

Justwise, u can change anything but ur photo. Sometimes, the pix requirements won't just make sense...like an old photo on the ground can get u selected. Agents go to any lengths to play for pple because they know the good news means sth to u and in turn they get sth. Embassy frowns against them merging couple for money...paying them is not embassy's problem... and that is y at d interview day, the VO may ask u ....did u play urself? At a point, that VO acknowledged d good work agents do...many pple don't play if not for agents and he could totally be a stranger. Embassy frowns at not including existing pple like kids, adopted ones and spouses. Some pple don't even believe they will be selected ...when that happens, confusion and denials follow for married pple who entered single or married couple who don't know themselves or forged marriages...while some 'wise' ones continue unmmaried...problem comes when they wanna bring relatives over or adjust status for citizenship.

The StSteven and other cases make u not to believe... I understand that but that Chicago guy and others are right.

Us don't care much on ur DOB until u land... they know we lie and have learnt to live with it. But what benefit will a 30yr-old gain saying he is 25 on the lottery that 100yr-olds are invited to enter? Pple lie still...not knowing the need.. because it is our blood now or an agent imagined wrong info. Now they wanna put d correct ones to save them some explanations.

That woman that pmed VO was real...her pal entered for them but omitted one of her kids and that cost them d visas...if they had not bothered on including the omitted kid in their ds260 forms...visas would have been given. The omitted kid left in Nigeria.

It is crazy...honest pple pay for little mistakes when the mistakes are unpardonable... u know she said she wldn't have mistakenly or knowingly omit her kid when she included her in their b1/b2 visa application. However, VO couldn't and should entertain that...the law was stricter than nothing.

That Chicago guy has tried. Dv lottery is luck until u get into d US...pple who just realized they have adopted kids...came back and had their visa canceled. Pple with O'level that is supposed to be d minimum qualification got denied. A lot depends on how u have made ourselves to be perceived, the madness to get out which comes from bad leadership and lack of information make little things overlooked elsewhere aren't here.

I didn't win but was selected in 2012 but the result was rescinded after 13 days and we lost the class action. However, I had applied and some won..pple began seeing my keyboard as the magic one. Some pple didn't believe entry was meant to be free...they wanna pay big money to associate seriousness to the pass to the US. Had hard times making folks to play right. I will be good in Canada next year. I'm working on it. I need to feel the outside world... OMG ..I have got an early exam!
huh huh Are you for real?

Don't condem this guy, we all experience different things. The rule you are talking about may be recent. In 2006, I experience this thing because of real age and official age mentality. I couldn't even remember the age I gave, but the reality stage is when you are filling e-dv entry because what ever is on that form is what will be forwarded to the Nigeria embassy and you need to have document to back up what ever on that form.
I take that as a reasonable line of argument rather than pointless denial of facts.

It could be that 8yrs ago as you said that change of DOB or name is allowed but as you can see from evidence provided its not allowed now.

Rules can be bend a little, they are not all that rigid because they know that people sometimes makes a honest mistake.mind you, experience as they say is d best teacher jigga and d rest on Dv 2014 thread knows this.Initially I believed that once an entry has been made for dv lottery, no changes can be made after been selected, but we were wrong when we found out that some people were granted visa after they filled for changes on there form st kcc.
The bottom line is that certain changes can be made on your form in as much ad u have a valid and genuine document to back it up. Especially, errors in names, dob, and address .
I know egoistic attributes in some people will not allow them to accept a simple truth, they see every other people as criminal, liars, fraudsters and imposter. As I mentioned before go through dv2014 thread and see the or interview experience, then you will know what Jigga was trying to explain.

I believe in facts and not cock and bull stories about 3rd party experience that can not be verified. Give me a link in that thread where somebody was about to change DOB after winning.

There is nothing like rule bending here, we are discussing about legitimate way of doing things, i know many of you are struggling to understand this because you are used to bending rules and using short cuts.

Just in case you are still struggling to get this....this abstract is from official visa lottery website:
If you have already made an error and you are selected for the program, then the consular officer who is going to interview will decide about it on the day of the interview. Some time if the KCC finds out that your online submitted entry details didn't match with your details in the visa application form, you may not get the visa interview letter.
So double check everything in the application form before you submit it. According to the rules you can't blame someone else for the mistakes or errors in your submitted entry.

Bro I respectively disagree with you on this. You can only do that if you have at least half of your fees paid then set the remaining on instalment, even at that it's still going to be a tall order, let's assumed that your fees is £10,000 and you deposited £5000 and your course starts September to finish July, you will be given maximum of 6 months to pay the rest. To be able to meet up you need to be saving at least £1000 a month to pay fees, rent, bills and food. 20 hrs a week security job will not give you that money.

You can not pay your Msc school fees, rent and bills from scratch working part time as a foreign student.
