Ebisco012: The Chief of Army Staff, Lt.-Gen. Tukur Buratai, on Thursday, asked the Federal High Court in Abuja to trash a suit seeking to compel him to produce the ‘missing’ leader of the proscribed Indigenous People of Biafra, IPOB, Mr. Nnamdi Kanu.
A team of lawyers representing the embattled pro-Biafra agitator had in the suit, prayed the court to order Buratai to produce their client either dead or alive.
The lawyers who were led by Mr Ifeanyi Ejiofor, told the court that they had not seen or heard from their client since September 14 when the Nigerian Army invaded his house “on a murderous raid, where life and mortar bullets were fired on unarmed and defenceless populace, leaving 28 persons dead and abducting many”.
Pursuant to section 40 of the Federal High Court Act, F12, LFN 2005 and section 6(6) (1) (4) of the 1999 constitution, as amended, Kanu’s lawyers applied for “an order of Habeas Corpus ad subjiciendum, commanding the Respondent (Buratai), to produce the Applicant in Court”.
However, in a counter-affidavit he filed in opposition to the suit, Buratai told the court that Kanu was never in custody of the Nigeria Army.
He maintained that contrary to claims in the suit, soldiers who were deployed to the South-East for ‘Operation Python Dance II, did not have any contact whatsoever with Kanu on September 12 or 14, or anytime thereafter as alleged.
The counter-affidavit read in part, “That the applicant (Kanu) is not and has never been in his custody or in the custody of any person, officer or institution receiving instruction directly or indirectly from him.
“That the applicant was not at any time whatsoever arrested, taken into custody or detained by the Officers and men of the Nigerian Army.
“That the officers and men of the Nigerian Army did not have any contact whatsoever or confrontation or any operational engagement with the applicant on September 12 or 14, 20l7 or any other date thereafter, contrary to the allegations in the affidavit in support of the application.
“That the allegation of invasion of the South-Eastern part of Nigeria by officers and men of the Nigerian Army, especially the applicant’s home and or residence is totally false.”
He told the court that during “a peaceful movement” that formed part of Operation Python Dance II, soldiers, on September 14, pursued a truck loaded with arms and ammunition into a compound which was identified in the suit as jointly owned by Kanu and his father.
He alleged that the fleeing truck and its occupants ran over Army barricade and defied soldiers’ order stopping them to be searched.
“That while on a peaceful movement on the said September 14, 2017, the soldiers randomly conducted stop-and-search operations as are necessary and it was during one of such exercises in Umuahia, Abia State, that it flagged down a truck, which as it turned out later, was loaded with arms and ammunitions of varying degrees and descriptions.
“Rather than comply with the stop order, the driver and other occupants of the truck recklessly ran over the barricade mounted on the road by the soldiers and sped off, whereupon the soldiers at the point gave a hot chase and called for reinforcement to enable them pursue and arrest the fleeing vehicle. The soldiers did not fire any shot at the fleeing truck in order to prevent the loss of lives.
“That the truck loaded with the arms and ammunition was pursued into a compound which has now been described in this application as belonging to and under the control of the applicant (Kanu) and his father.
“That it was the legitimate attempt by the officers and men of the Nigerian Army to arrest the fleeing occupants of the truck and impound the truck that precipitated the deliberate igniting of the ammunition in the truck by persons now believed to be IPOB members.
“That the act of the IPOB members resulted in sporadic explosions within the said applicant’s compound”, the affidavit further stated.
“Throughout the duration of the Operation Python Dance II, officers and men of the Nigerian Army obeyed the Rules of Engagement and Code of Conduct to the letter as there was no reported case of indiscriminate shooting, unlawful arrest, detention or torture, contrary to the wild, bland, untrue, incorrect, bogus and insipid allegations contained in or oozed out in the affidavit of Prince Mandela Umegborogu Esq.
“The allegations of firing of live bullets on the applicant’s relatives, killing of scores of persons, wounding and arrest of many, attack and invasion of applicant’s home, barricade at Isialangwa, arrest and torture of civilians by officers and me of the Nigerian Army, as stated by the deponent, are a figment of his imagination as same are not true.”

But what might have escaped the radar of politicians and Nigerians in general, is that government might have seized the opportunity created by the case in ECOWAS court to embark on peace building with the easterners who have been dancing to the drum beat of secession.
Perhaps the current unusual magnanimity towards the lgbos who have been crying out loudly about marginalization since the end of the civil war 47 years ago, is part of the strategy of defrosting the icy relationship between president Buhari and easterners who gave him only 5 (or is it 3%) votes in 2015 presidential election and are assumed to be bearing the brunt of casting most of their votes for the candidate that lost the election. Whatever the case may be, it is safe to conclude that with election 2019 in the horizon, CHANGE is beginning to take hold in terms of politics of inclusiveness as opposed to exclusiveness which was fuelling secessionist tendencies. APC party chairman, David Oyegun had put it crudely when a couple of months ago, he reportedly advised lgbo people to join the APC if they wanted to enjoy government patronage that would translate into prosperity. But President Buhari appears to be wooing the lgbos (After Arewa youths served them quit notice) by turning on his charm in a bid to convert them into his burgeoning political family via good deeds.
The different approaches or strategies adopted in trying to get the lgbos to say YES to APC by the chairman of the ruling party and Mr President suggest a sort of bad cop, good cop scenario playing out. Whatever the case may be, it is worth recalling that it was Rochas Okorocha’s lmo state where governorship election was inconclusive in 2015, so a re-run was called and APC literarily pulled the rabbit out of the hat to give then presidential candidate Buhari the infamous ‘5%’ votes of the lgbos, which helped him clinch the presidency. By and large, the critical contribution that the paltry lgbo votes made to candidate Buhari’s electoral fortune, compared to the estimated 24% that Kano voters brought to the table, is a typical case of when the less becomes the more.
But as it would appear, president Buhari might have considered only the face value of the 5% votes, hence he reportedly felt not indebted to the lgbos but only beholden to the northern and to some extent the south west voters who cast the majority of votes for him. That mindset probably informed the vile comment credited to president Buhari with respect to his plan to give unto the Igbos little government patronage that is proportional to the votes that he garnered from their zone. Sadly, that’s a narrative that has been giving fillip to the notion that the lgbos are being deliberately excluded from government . . It boggles the mind that in a society where perception can easily become reality, two and half years after the faux pax or Freudian slip by Mr president in far away USA found its way into public lexicon and discourse, nothing seem to have been done to debunk or confirm the gaffe until a couple of days ago. As a result, the whispers in the dark advanced from being mere conspiracy theory spurn by president Buhari’s competitors, to something like a statement of fact, which has been hanging over Aso Rock villa and APC like an albatross. So now that president Buhari is dangling the carrot ostensibly to harness or harvest the votes from the east to facilitate a win again for him or the party in 2019: would lgbos take the bait?
It may be too early to tell, but suffice it to say that in a country where ‘stomach infrastructure’ occupies prominent position in the electioneering process, anything can happen. Already, president Buhari’s cabinet ministers from the east such as Chris Ngige, in charge of Labour and productivity, Ogbonanya Onu responsible for Science and Technology, who were Governors and as such had grass root following are getting their campaign machines into overdrive in their bid to convince their people that the grass is greener on the APC side. Similarly,Rochas Okorocha of lmo state which is the only lgbo state controlled by APC in the east and Orji Uzor Kalu, former Abia state governor who is a latter day APC convert and Buhari devotee, are also strutting the vast land of the lgbos stirring up positive emotions in the desperate bid to court ndi lgbo for president Buhari assuming he decides to seek re-election or for the APC candidate as the case may be. None typical politicians like Foreign affairs minister, Geofrey Onyeama and trade, commerce and industries minister Okechukwu Enelemah, who are originally from the private sector are also expected to weigh in with any clouts that they can muster to get their boss or party re-elected as the ruling party.
Unfortunately, there are no lgbos heading influential or cash cow parastatals or agencies like NNPC, NPA, NCC,NCAA,NLNG, NIMASA,NDDC, amongst many other geese that lay the golden eggs to lend helping hands to the cabinet members from the east in the mission to capture the eastern votes. But if president Buhari in pursuit of his proposed expansion of federal cabinet and appointments into vacant board positions offers lucrative political appointments to more sons and daughters of lgbo, and promise to construct the second Niger bridge, and rehabilitate the badly dilapidated roads in the east, APC and president Buhari may make more inroads into the east.. Such is the power of give and take which is referred to in politics as horse trading.
The Anambra state gubernatorial election is a referendum of sorts because on that occasion the lgbos would be taking steps towards choosing whether to remain outsiders which they seem to be now with the hope that one day a knight in shining armour would rescue and take them to another island where they will presumably be free or allow themselves to be properly wooed like a bride and get integrated into the scheme of governance in Nigeria. Trust me, what happens in Anambra on November 18, 2017 may be a window into the pattern of the general election in 2019.. The outcome of the recent local government election in Anambra state should be a pointer to the way the pendulum may swing in 2019 and therefore a wake up call. A similar situation is evolving in the USA where the democrats are crushing Republican Party candidates in the mid term election one year after the ascendancy of Donald Trump as the most controversial and polarizing president America has ever had. As a franchise holder of American presidential system of governance, would a similar scenario play out in Nigeria?

There was no paper trail showing her displeasure. 4. In the Memo, that was passed through her office, she did not indicate her objection to Maina reinstatement, she simply passed the buck to another department. 5. The woman failed to provide @MBuhari's response to her on the issue.
She is still not honest on the matter. From claiming she has no knowledge of the reinstatement, to now saying she warned the C in C about it shows that she is just pussy footing about and in some cases telling outright lies. Just like tipping the DPO off about a certain wanted notorious criminal that just strayed back to his division and the best he could do was to take no action because it was a verbal tip off. Nigerians really deverve their leaders. |

Which means as at the time of the verbal expression of worries,neither PMB nor The head of service were aware that Maina had resumed!
By the way can dunces like you appreciate the legal intricasies and documentation involved in this case? You are just running from pillar to post and back to pillar. A real anti-corruption czar on hearing the impending reinstatement of Maina would have immediately alerted the EFCC, on whose wanted list he has been for 4 years, to effect his arrest and thereafter decisively deal with the cabal that initiated that move. He did no such and he was reinstated. But Immediately the scandal leaked, he was quick to sack Maina and issued a phantom query to the HOSF requesting her to repeat a story she had told him informally just to save his face. Buhari is increasingly becoming shameless and your ilk much more. |

In a memo to the Head of the Civil Service of the Federation, the President equally demanded a full report of the circumstances of Maina's recall and posting to the Ministry of Interior. The report is to be submitted to the office of the Chief of Staff to the President, Mallam Abba Kyari, before the end of work today, Monday, October 23, 2017.
