22nd March, 2018 FG SHOULD NEGOTIATE RELEASE OF CHRISTIAN GIRL Boko Haram insurgents yesterday returned 104 out of the 110 girls abducted on 19thFebruary, 2018. Five of them had reportedly died while one, Leah Sherubu, was not released. According to Khadija Grema, one of the freed girls, Leah was not released because she is a Christian and she refused to put on hijab or convert. The Muslim Rights Concern (MURIC) condemns Boko Haram’s attempt to compel Leah to use hijab. Equally reprehensible is the attempt to force her to convert to Islam. We reiterate for the umpteenth time that Boko Haram’s doctrine is heretical and its methods stand in contradistinction to those of pristine Islam. The Glorious Qur’an asserts that there is no compulsion in Islam (2:256). It says Allah himself could have made the whole mankind Muslims if He had wished (11:118). It forbids forceful conversion or punishment of non-Muslims by Muslims and limits the role of Muslims to admonitions alone (lasta alayhinm bimusaytirin 88: 21 – 24). Furthermore, it declares that each shall have the right to follow his or her religion (lakunm diinukunm wa liya diin 109:1 – 6). Once again we reject Boko Haram as an Islamic group. We urge the leadership and members of the group to re-examine its ideological base. Leah Sherubu must be set free because the basis for holding her after setting her schoolmates free is faulty and unIslamic. We invite the Federal Government (FG) to widen the scope of dialogue with Boko Haram by incorporating doctrinal issues. Islamic scholars should be involved in such discussions with the insurgents. This process is sine qua non for the deradicalisation of Boko Haram. Military defeat of Boko Haram alone amounts to a pyrrhic victory without ideological re-engineering. We charge (FG) to go back to the negotiation table in order to secure the release of the only Christian girl among the Dapchi girls who is being held back by the insurgents. Nigerians have been united in their prayers for the release of the Dapchi girls. FG should note that Boko Haram is not as daft as many people think. By withholding the Christian girl, they seek to divide Nigerians once again along religious lines. MURIC expresses solidarity with the parents of Leah Sherubu, the Christian girl in captivity. Our hearts are heavy with grief over her plight. We salute her courage. Shame on Boko Haram for oppressing a lone, vulnerable and helpless girl. Shame on all those who suppress freedom of worship. We appeal to Nigerians to invoke special prayers in the mosques and churches for this Christian girl who had the courage to stare her oppressors in the face. We should also continue to pray for the remaining Chibok girls. As we round up, we repeat our exhortation to the Nigerian authorities: to set Leah Sherubu free is a task that must be done. Praise be to Allaah. Firstly: The month of Rajab is one of the sacred months of which Allaah says (interpretation of the meaning): “Verily, the number of months with Allaah is twelve months (in a year), so was it ordained by Allaah on the Day when He created the heavens and the earth; of them four are Sacred (i.e. the 1st, the 7th, the 11th and the 12th months of the Islamic calendar). That is the right religion, so wrong not yourselves therein” [al-Tawbah 9:36] The sacred months are: Rajab, Dhu’l-Qa’dah, Dhu’l-Hijjah and Muharram. Al-Bukhaari (4662) and Muslim (1679) narrated from Abu Bakrah (may Allaah be pleased with him) that the Prophet (peace and blessings of Allaah be upon him) said: “The year is twelve months, of which four are sacred: three consecutive months, Dhu’l-Qa’dah, Dhu’l-Hijjah and Muharram, and Rajab Mudar which comes between Jumaada and Sha’baan. These months are called sacred for two reasons: 1- Because fighting therein is forbidden unless initiated by the enemy 2- Because transgression of the sacred limits therein is worse than at other times. Hence Allaah has forbidden us to commit sins during these months, as He says (interpretation of the meaning): “wrong not yourselves therein” [al-Tawbah 9:36] Although committing sins is haraam and forbidden during these months and at other times, in these months it is more forbidden. Al-Sa’di (may Allaah have mercy on him) said (p. 373): In the phrase “wrong not yourselves therein”, the pronoun may be understood as referring to twelve months. Allaah states that He has made them a measure of time for His slaves, which they may use for worshipping Him, and thank Allaah for His blessings, and they serve the interests of His slaves, so beware of wronging yourselves therein. The pronoun may also be understood as referring to the four sacred months, and this forbids them to wrong themselves in those months in particular, as well as it being forbidden to do wrong at all times, because it is more forbidden at this time, but it is worse at this time than at others. End quote. Secondly: With regard to fasting the month of Rajab, there is no saheeh hadeeth to indicate that there is any special virtue in fasting all or part of this month. What some people do, singling out some days of Rajab for fasting, believing that they are better than others, has no basis in sharee’ah. But there is a report from the Prophet (peace and blessings of Allaah be upon him) which indicates that it is mustahabb to fast during the sacred months (and Rajab is one of the sacred months). The Prophet (peace and blessings of Allaah be upon him) said: “Fast some days of the sacred months and not others.” Narrated by Abu Dawood, 2428; classed as da’eef by al-Albaani in Da’eef Abi Dawood. Even if this hadeeth were saheeh, it indicates that it is mustahabb to fast during the sacred months. So if a person fasts during Rajab because of this, and he also fasts in the other sacred months, there is nothing wrong with that. But singling out Rajab for fasting is not right. Shaykh al-Islam Ibn Taymiyah (may Allaah have mercy on him) said in Majmoo’ al-Fataawa (25/290): As for fasting in Rajab in particular, the ahaadeeth concerning that are all da’eef (weak), and in fact mawdoo’ (fabricated). The scholars do not rely on any of them. They are not among the da’eef ahaadeeth which have been narrated concerning virtues, rather most of them are fabricated and false. In al-Musnad and elsewhere there is a hadeeth which says that the Prophet (peace and blessings of Allaah be upon him) enjoined fasting the sacred months, namely Rajab, Dhu’l-Qa’dah, Dhu’l-Hijjah and Muharram, but this has to do with fasting during all of them, not just Rajab. End quote. Ibn al-Qayyim (may Allaah have mercy on him) said: Every hadeeth which mentions fasting in Rajab and praying during some of its nights is false and fabricated.” End quote from al-Manaar al-Muneef, p. 96 Al-Haafiz ibn Hajar said in Tabyeen al-‘Ajab (p. 11) There is no saheeh hadeeth that would count as evidence which speaks of the virtue of the month of Rajab, or that speaks of fasting this month or part of it, or of spending any particular night of it in prayer. Shaykh Sayyid Saabiq (may Allaah have mercy on him) said in Fiqh al-Sunnah (1/282): Fasting in Rajab is no better than fasting in any other month, except that it is one of the sacred months. There is no report in the saheeh Sunnah to suggest that there is anything special about fasting in this month. Whatever has been narrated concerning that is not fit to be quoted as evidence. End quote. Shaykh Ibn ‘Uthaymeen (may Allaah have mercy on him) was asked about fasting on the twenty-seventh of Rajab and spending that night in prayer. He replied: Fasting on the twenty-seventh of Rajab and spending that night in prayer is a bid’ah (innovation), and every bid’ah is a going astray. End quote. The rights of a Muslim brother in the hadith include the followings: 1. A Muslim is a brother to another Muslim. So, * Do not harbour hatred against one another, * Do not artificially inflate prices against one another, * Do not be jealous of one another, * Do not turn desert one another, * One of you should not enter into a transaction when the other has already entered into it; rather be brothers one to another and servants of Allah. * A Muslim is a brother to another Muslim; * He does not wrong him, and * Does not desert him, nor despise him. Piety is found here [pointing three times to his chest; despising his Muslim brother is enough of an evil for any man to fall into. * Every Muslim’s blood, property and honour are unlawful to be violated by another Muslim.” Muslim, Bulooghul-Maram 1539 2. Do not outweigh your brother; he should not enter into a transaction when his brother had already entered into but not finalised… Muslim 1412 4. Do not boycott…your brother: It is not lawful for a Muslim to boycott his brother for more than three days. al-Bukhari 5718 5. Example of brothers in their affection, mercy, and compassion for each other is that of a body. When any limb aches, the whole body reacts with sleeplessness and fever. al-Bukhari 5665, Muslim 2586, Shu’ab al-Imān 10379 6. Help your brother * He who relieves the hardship of a believer in this world, Allah will relieve his hardship on the Day of Judgment. * He who makes easy what is difficult, Allah will make it easy for him in the world and the Hereafter. * He who conceals the faults of a Muslim, Allah will conceal his faults in the world and the Hereafter, for Allah helps the servant as long as he helps his brother. Muslim 2699 7. Pray for your brother There is no Muslim servant who supplicates for his brother behind his back except that the angel says: For you the same. Muslim 2732, 8. Six beautiful rights: * To respond to his sneeze, * To respond to his invitation, * To greet him with peace when he meets him, * To visit him when he is sick, * To follow his funeral prayer when he dies, and * To love for him what he loves for himself. Do not seek out faults…of your brother * Do not spy on each other, * Do not seek out faults, * Beware of suspicion, for suspicion is the most false of speech. * Do not contend with each other, * Do not envy each other, * Do not hate each other, and * Do not turn away from each other. Rather, be servants of Allah as brothers. al-Bukhari 5719 10. Find something good about your brother instead. If you hear something from your brother that you reject, then make an excuse for him up to seventy excuses. If you cannot do it, then say: Perhaps he has an excuse I do not know. You weep a times while reading Nigeria news most especially Boko Haram. But something is not clear to me about the issue BOKO HARAM, FG negotiated for the release of few Chibok girls, early yesterday, they brought the recently abducted girls themselves. Who are FG negotiating with? How come they (mediator) know them (Boko Haram)? Does that mean FG know those in charge? But remember people are dieing daily on this issue of Boko Haram. Our military men are always killed by those guys and FG claimed they negotiate with them, but why not negotiate with them to end the terrorism. This to me is an irony. If truly you negotiate with Boko Haram and it is not politics like people claimed, why can't you negotiate with them to put end to terrorism? Or what's your view? |

The West African Examinations Council (WAEC) has bowed to pressure, and is ready to amend the part of its 2018 SSCE Examination that clashed with the Friday Jumah prayer. The affected subject is Chemistry 1 and 2, which was originally slated for 2pm to 5pm on Friday, April 20, 2018. Following reactions from Muslim organisations, the Director of Public Affairs, WAEC Nigeria, Mr Demianus Ojijeogu has confirmed the slight amendment to Premium Times. Mr Ojijeogu said: “For the sake of the people who will go to the mosque, the exam will be delayed till they come back”. Oyo State government has warned that it will continue to seal private hospitals that employ or train any auxiliary nurse in their health facilities as part of its efforts to reduce quackery in the state. Commissioner for Health, Dr Azeez Adeduntan made the disclosure after Oyo State Taskforce on Private Medical Practice sealed eight private health facilities in Ibadan and reassessed others for reopening. At Apete, a suburb of Ibadan, the task force met a graduation ceremony for nurses ongoing at one hospital, while another had slated a graduation ceremony for its nine trainees. Also, another hospital being run by an unregistered nurse, that was initially closed in 2008, but practicing under another name in Orogun, was also sealed. Offences of the sealed hospitals range from non-registration of the premises, unhygienic hospital environment, improper disposal of medical wastes and failure to have qualified medical staff on ground. Dr Adeduntan, speaking through Chairman, Oyo State Taskforce on Private Medical Practice, Dr Adebisi Ayoola, said only those that trained at accredited and approved training institutions are expected to be working in these facilities. He declared: “there is no room for the training of the so-called auxiliary nurses; anybody that is interested in the profession should attend established and government accredited medical and nursing schools. “In Oyo State alone, there are 12 institutions where they can be trained as nurses. Often, those we called auxiliary nurses are mostly people who do meet the criteria to attend such schools. Auxiliary nurses are quacks, as far as Oyo State government is concerned.” Dr Adeduntan, however, warned private hospitals and medical laboratories with their annexes that only registered with the Corporate Affairs Commission to also get them registered appropriately by Oyo State government. According to him, all facilities found culpable for any offence that regulates private health facility practice stand to face a penalty of N100, 000 or one-year imprisonment. The exercise, which he said was a continuous one, he declared, was not targeting anybody or vindictive but corrective, urging people who need information on criteria for registration on any health facility, including medical laboratories to freely come to the ministry. Fourthly: Determining what materials prevent water from reaching the skin is dependent on the nature of these materials. The scholars studied this matter, and reached the conclusion that materials are of two types: The first type is material that has substance, i.e., it remains as a layer (on the skin), so when it is placed on the body it remains cohesive, separate from the skin, and can be removed by peeling or wiping it off. The second type is material that has no substance, i.e., it does not form a layer, and as soon as it lands or is placed on the body, it loses its cohesiveness and it breaks down and is absorbed by the skin, and there is nothing left of it; rather only traces of it remain, such as colour and the like. Based on that, it may be said: If the dirt has substance in the sense that it forms a layer on the skin to the extent that it prevents water from reaching the skin, then it must be removed when doing wudoo’. If it is simply a matter of colour, or it had substance but it is very little and can be removed with water, then it does not make wudoo’ invalid. Thirdly: With regard to the hadith mentioned in the question, there is a difference of opinion concerning it. Al-Haafiz Ibn Hajar (may Allah have mercy on him) said: Regarding the hadith of Anas, it was narrated by Abu Dawood, but its isnad includes al-Waleed ibn Zarwaan, whose status is unknown…. It also has other isnaads from Anas, but they are da‘eef (weak). End quote from at-Talkhees al-Habeer (1/86). It was classed as saheeh by Ibn al-Qayyim in Tahdheeb as-Sunan, and by al-Albaani in Saheeh Abi Dawood. Assuming that it is saheeh, the command mentioned in the hadith may be understood as meaning that it is mustahabb, so as to reconcile between this and other reports, because the majority of those who narrated reports about the Prophet’s wudoo’ did not mention running the fingers through the beard (to make the water reach the skin); if it were obligatory, he would not have omitted it from his wudoo’ (and would have done it every single time), and if he had done it in every wudoo’, then those who narrated descriptions of his wudoo’ would have mentioned it, and they would have made sure to describe how he did it in a clear way, or most of them would have done that. |

Lawyers have been wearing the wig and gown as the approved outfit for court appearances, since this country became independent, and since law school started in 1962. The only approved, prescribed uniform for lawyers appearing in court, is the wig and gown - NOT wig and hijab!
