LG Caretaker Committees Illegal, Unconstitutional – Court By OLUGBENGA SOYELE — Oct 24, 2015 2:50 am | Leave a comment Justice Abdulfatai Lawal of the Lagos State High Court sitting in Igbosere yesterday declared as illegal and unconstitutional the appointment of caretaker committees to run local government councils in Nigeria by state governments. Justice Lawal, who made this declaration while delivering judgment in a case filed by the National Conscience Party (NCP), seeking an order nullifying the appointment of caretaker committees appointed to administer local governments by the Lagos State government. In the judgement, the court held that no governor is constitutionally empowered to take over the administration of local governments through sole administrators or caretaker committees. The court also held that the system of local government can only be managed by democratically elected people and if the state house of assembly should make any law validating sole administrators for local government, such a law will be invalid and unconstitutional. The judge held further that the Lagos State Local Government Law, which allows for the appointment of caretaker committees, is illegal and unconstitutional. It held that section 1(3) of the constitution stipulates that Nigeria should not be run in any manner that is contrary to the constitution. “I call upon the Lagos State GOVT to immediately implement the judgment of the court by dismantling all the illegal structures of local government caretaker committees. “I also call upon all state governments where the local governments are being manned by administrators to conduct elections immediately,” the Justice Lawal stated. The judge also held that section 1(3) of the constitution stipulates that Nigeria should not be run in any manner that is contrary to the constitution. The court rejected the argument of LAISEC that it was waiting for voters’ register from INEC since the same voters’ register and polling booths were used for the April, 2015 elections. Consequently, Justice Lawal directed LASIEC to conduct elections in all local governments within 30 days. The applicant, National Conscience Party, through its national general secretary, Comrade Ayodele Akele, had filed the action for a declaration that the local governments in Lagos State can only be run and managed by a democratically elected administration. The party had sought for an order directing Independent National Electoral Commission (INEC) to supply voters’ register to Lagos State Independent Electoral Commission. Besides, the applicant is seeking for an order of mandamus compelling LAISEC to forthwith conduct local government elections in Lagos State and to declare the caretaker committees as illegal. In response, Lagos State government and LAISEC stated that upon the expiration of the tenure of the last local government administration in October 2014, Lagos State governor, by executive order appointed interim caretaker committees headed by executive secretaries, to run the affairs of all the local governments, in order to avoid a vacuum. The National Conscience Party is contending that this is in contravention of section 7 of the 1999 Constitution which states that only a democratically elected government can be allowed to run the local governments and section 1(2) of the 1999 Constitution which states that no part of Nigeria shall be governed in any method that is contrary to the Constitution. But counsel to Lagos State, Lawal Pedro, SAN and counsel to LAISEC, Yemi Adesina, submitted that unless INEC has given the voters register to LAISEC, elections cannot be conducted. They argued further that the delay in the conduct of local government elections could not be blamed on the Lagos State government. They urged the court to dismiss the case. |

Barely a couple of days after the Akwa Ibom State Governorship Election petition was decided by the presiding Judge in favour of Obong Umana Okon Umana of All Progressives Congress(APC), the frustrated members of PDP have decided to stage an infantile and premature campaign to mobilize for the forthcoming re-run election, which will be held next year. Information has it that Mr. Udom Emmanuel earlier today ordered that all major roads leading to Wellington Bassey Way where state Government House is located be closed. Hundreds of hired PDP supporters had gathered at Global Edifice where the flag-off is billed to be launched. The campaign, which is said to have been masterminded by the State Attorney-General, Mr. Uwemedimo Nwoko, who had pre-informed the governor that, if the APC proceeds to Appeal Court, it will be given the remaining 13 Local Government Areas. According to a source in the know of plan, the campaign which is staged at the entrance of Government House, Uyo, is to remind the electorates in Uyo to put all hands on deck to ensure that, the PDP wins the election re-run. The State Chairman of PDP, Obong Paul Ekpo, had shortly after the ruling informed those who cared to listen to his/their woe, that the judgment was confusing and has caused uproar in their camp, adding that, the re-run will render PDP useless. It will be recalled that, Barr. Uwemedimo Nwoko had today lamented and cried bitterly on Channels Television, noting that, if a re-run is to be conducted, PDP will lose woefully, especially, as the Change Mantra has come to stay in the state. A former Senator, who hails from Etinan Federal Constituency, had confirmed that, the re-run campaign has just started, noting that, the timetable of the campaign will be made public in a jiffy. ‘I am a stakeholder of the PDP in the state, we received the judgment with dismay, and it has really disorganized us. As it stands, if we do not start now to campaign, APC will over run us with a landslide victory in the re-run election, which is why we have decided to commence immediately. ‘By next week the timetable will be made available, I can assure you that, we will tour each of the 18 Local Government Areas, three times before the re-run. ‘My fear is that, Udom Emmanuel doesn’t have sink well into the heart of the people considering the posturing of Udom as Akpabio protégé. Again, if you do an electoral analysis in the LGAs cancelled, you would see that over 80% are APC strongholds. Imagine that Uyo LGA is cancelled. Many of the LGAs cancelled have large voter base. How will we win without early planning especially now that Akpabio is no more in the state and the entire security architecture in the state are such that will be very difficult breaking their ranks, but this one is off record, dont quote this part’, the Senator pleaded. Meanwhile, a team player in APC has described the PDP’s gambit as infantile and useless, noting that, Obong Umana Okon Umana will reclaim the remaining 13 Local Government Areas before the actual election. In a related development, Udom Emmanuel is reported to be very angry with some of his cabinet members who coordinated the tribunal arrangement.
