So, unless the defense is mental instability, i don't see how you can choke a man for 9 minutes and then say you don't intend to kill him. The man was practically pleading with the officer not to kill him. The man informed him that he cant breath. He stopped moving and the officer did not let go of the choke hold. If the officer had let go of the choke hold and the man in the ambulance on the way to the hospital, then you can argue, he did not intend to kill him. But the man died before the arrival of the ambulance.
If after the clear cut video evidence with lots of witnesses, the police man (men) walks free, then there is something fundamentally wrong with the US justice system. You are being understandably emotional but emotions don't win cases in court. You saw an intent to kill. A defence lawyer might see a standard procedure that went wrong. It is not open and close case like you think. Like I earlier stated, the defence lawyer might even claim that the sensationalism of the case would never guarantee a fair trial for his clients because people have already formed an opinion on the case. In that case, the case might not get to trial not to talk of conviction. The possibilities are endless in this case. |

larrysworld: In a case of this magnitude, it is very risky to overcharge. The prosecution seem to be taking the case on the face value based on the heat it has generated in the public hoping it will go into the courts with the same steam. There is a vast difference between a 2nd degree murder and 3rd degree murder even though they are both murder charges. In the 2nd degree murder charge, you have to proof there is an INTENT to kill rather than INDIFFERENCE to human life in the 3rd degree charge.
Now intent is quite difficult to prove as it is not usually a clear cut case and this is the reason some prosecutors stay off 2nd degree murder charge unless there is compelling evidence. If going by what we saw on the video, the best will be a 3rd degree murder charge to ensure the officer does not walk because we can't prove intent he wants to kill, he was simply trying to make an arrest and the unfortunate happened due to his indifference (carelessness) regarding human life. If they go for 2nd degree and are unsuccessful in proving intent, then the officer would walk. Mind you, the juror has to be unanimous in their decision either guilty or not, just one juror disagreeing will lead to mistrial. To bring the case for a 3rd degree murder after having charged a 2nd degree; they would have to declare a mistrial and re-litigate the case all over again.
Now this is my opinion: There is more to this case than we really understand or can see. The two people apparently knew each other and even though George Floyd (RIP) was not a saint, he does not deserve to have his life cut short. I have a feeling that the prosecution might "intentionally" want to bungle this case for reason best known to them (i.e. was this done to intentionally start a race riot in the country). A similar case happened in Baltimore in 2015 and the guy walked because the prosecution could not prove their case.
America is a very litigious society. Don't forget their law is called Criminal Justice System; not Victim justice. It is the criminals that seem to get more justice at the end of the day not their victims. You don't prove INTENT in second degree murder. There is no right or wrong answer to the charges, once they feel they can prove it. I don't see the prosecution intentionally bungling it because the world and his family lawyers are watching. Getting a conviction is what I am not certain in this case. |

Even if there are underlying conditions, the video showed that he died as as result of being chocked. The prosecutor can simply put the police officer under the same conditions he put George floyd and see if he survives. If he survives for 8 minutes handcuffed with his hands at the back, with a knee on this throat and two other people with kneeling on his chest and ribs, then it will prove the choking didn't kill him. In law, you need to prove beyond reasonable doubt. With the toxicology report, it is tough to argue that the drugs found in his blood was not a factor. You will see a lot of fireworks in court over this. Another dimension is the jury, the prosecution teams are to convince the entire 12 jurors. Then another remote consideration is fair trial . The defence lawyer might argue that based on the sensationalism of the case, there is no one in Minnesota who hasn't formed opinion on the case, so his clients might not have access to fair trial. Remember that jurors will be drawn from Minnesota. As incredible as it may sound, the case might never make it to trial , not to talk of conviction. |

Any other reports that could have come outside of this ( doctored or real ) is immaterial. Murder is murder and floyd was hale and hearty as at the time of arrest. The cop showed no pity because when the EMS personnel came, who could have checked his pulse, the cop never took his knees off him( as if he said, I must ensure you die here before I leave you) In a medical profession in which i operate, a surgeon could be jailed if he or she made mistakes in the course of operating on a sick patient. The judge would not say after all, shebi he was sick before and likely to die. Same applies to a doctor who assisted in killing a patient. The cop killed floyd and so, it doesn't matter what the report says, it doesn't matter if he was said to have had criminal record or not( a criminal could repent and still be of good use to the society after serving his nail term or granted parol). Murder is difficult to.prove, especially against the police. The law favours the police more and that explains why there has been one conviction against the police in the history of Minnesota. This is a criminal case, and intent is so difficult to prove. Don't forget the defence lawyers too are smart and will explore every lacuna in the case. It takes one juror out of 12 to dissent to get acquital. Do not forget that fact. |

I posted about the wide difference in the conclusion of 2 distinct Medical examiners, one for the State and one for the family. That nothing to do with what you just posted. I know litigation works in the US, especially in situations like this. My comment really has nothing much to do with his Covid-19 status but more about how come 2 Doctors could come to such a varied conclusion on the same subject matter. Some Nigerians would say that this can only happen in Nigeria and not in a so called "sane Country. I understand you but it is not unusual to have differences in opinion in what subject matter experts say during a trial. Each side will want to defend and justify his own. But the jury will believe the medical report of the state more. There is likelihood of bias with the private examiner hired by the family. That differential in opinion doesn't favour the prosecution. |

larrysworld: You are right about Covid being classified as a non factor in his death but the prosecution will not get the maximum sentence for the Policeman. The reason being that upgrading the charge to 2nd degree murder might mean they have over played it. His autopsy showed he had drugs in his system which when coupled with him and the Policeman having known each other will make the case more of a premeditated murder or manslaughter. The racism issue will not be valid once it is proven that they are well known to each other. I believe there is more to this case and it's not just about spending a fake $20 bill but we shall see. Upgrading the charge to second degree murder doesn't mean he can't still be convicted for third degree murder. Like you opined, it's a difficult case to get a conviction in court. |

Murder is murder. If you want to kill somebody fast, grab his neck and prevent blood flow to the brain. By the time you release the neck, the person would have gone...and that's why we dont encourage that. Any attempt to grab someone in the neck is an attempted murder...a serious crime.
No amount of fake autopsy report would override the fact that the police officer committed a serious crime. A police officer is meant to save lives, even the lives of a criminal so he could live to serve his/her punishment. When the accused is handcuffed, he/she has been overpowered. Let him run like Usain bolt, he would still be caught. Pinning down his neck after the arrest and handcuff alone is not acceptable because the guy wasn't armed. He never had any criminal records which could have proved he was the one who presented the counterfeit bill. He was merely a suspect found around that place when the cops arrived. He could have sued them for damage if later released. Thank God for this because the smart whites would have used criminal record to set the idiot cop free. I cant wait to see him rot in hail. This would also serve as a deterrent to others because the whites too are protesting against the act of police brutality I think you missed the point sir. That autopsy report is good for the prosecution. The defence lawyer would want to establish that his underlying medical conditions are partly responsible for his death. With this report , the defence lawyer can't explore that because the report says even though he is asymptomatic, that plays no role in his death. Bro, it's a tough case that hangs in the balance. You can never know which side the jury will swing. |

Take home salary for lecturers after IPPIS deduction without allowances: PhD LII is #130,000 PhD LI is #163,000 plus min. 3 years post PhD Senior Lecturer #235,000 plus min. 6years post PhD Professor ��� #345,000 plus min. 10 years post PhD Senior Professor ��� #423,000.... Minimum of 3years gap with hard work. Many spend as high as 5years before they can move up the ladder of promotions.
REMEMBER From these peanuts of a pay; They teach a crowd for a class They supervise multitudes They attend conferences from their pockets They attend seminars from this peanuts They write and publish articles in reputable journals (enquire the cost of publishing).....etc They undergo rigorous stress to carry out research. They spend minimum of 4 years in BSc They spend minimum of 2 years in MSc They spend minimum of 3 years in PhD (in Nigeria is near impossible they even spend upto 5 years and above).
Consider their rigours, the pain, the emotional trauma, physical drain, brain drain, intellectual drain they go through just to be qualified for their job specification...
I think our Lecturers work like elephants and earn like ants, they deserve a better pay or renumeration.
In terms of welfare: You know that 50% of your lecturers don't have good offices/furnitures. Most lecturers lack good working environment. Most lecturers handle/teach a crowd of students yet they still try to deliver lectures in such environment (instead of the normal 30-50 students class size). Most Lecturers supervise projects at their expense. You want his best yet you deny him the best.
When you compare this salary with those of other Federal Govt agencies it's very very ridiculous. If you compare it with Universities abroad then Nigeria �� salary scale for lecturers is infinitesimally small.
Before you criticise them; First put yourself in their shoes. Could you have studied to PhD just to earn #130,000? Could you have invested the better part of your life upto Prof just to earn #345,000? Think! They may not have been the best they should yet they are among the best in the world especially if they are giving the right environment to practice.
Before you criticise ASUU/Lecturers think. Except you are happy with the state of the university system.
NO COUNTRY CAN GROW BEYOND IT'S VALUE FOR EDUCATION.

If IPPIS doesn't capture the allowances or any details, ASUU should tell the FG, and the software will be worked on to capture those requirements. Attempt to whip up sentiments by telling us what lecturers earn won't work; that should be a separate issue that ASUU should address with the FG, it doesn't justify not enrolling to IPPIS. Your piece did not factor in tax that lecturers have shortchanged the State govt overtime. Will the lecturers accept to pay these money back or the FG will still have to pay on their behalf?
