Comparing Hisbah and Amotekun is like comparing apples and oranges; the are quite different.

One was legitimately created and signed into law (Act no. 4 of 2003 & no. 6 of 2005, in the case of Kano Hisbah) while the other (Amotekun) isn't passed by any state assembly nor assented into law by any state governor (or regional governor if such exist).
Hisbah duties and responsibilities include:
" - Rendering necessary assistance to the Police and other Security Agencies especially in the areas of prevention, detention and reporting of offences;
- Assisting in traffic control.
The Law that established Hisbah Corps was also categorical in not allowing them to carry firearms or any lethal weapons for self defence.

What about AMOTEKUN?
What does the law establishing it say, if at all one exists?

Just like what is happening now; the FG at that time declared Hisbah illegal; what did the northerners do?

T[i]he Government of Olusegun Obasanjo through the Inspector General of Police Mr. Sunday Ehindero in a press briefing on 7th of February, 2006 declared the Hisbah Law and the operations of the bodies created by the Laws as unconstitutional and illegal.

Is AMOTEKUN even backed by any Law?

On 8th February, 2006 the same Inspector General of Police Sunday Ehindero ordered his officers and men to effect the arrest of the Chairman and Commander General of the Hisbah Corps, Mallam Yahaya Farouk Chedi and his Deputy Mallam Abubakar Abdulkareem Rabo. They were arrested in Kano and immediately taken to Abuja where they were detained.

Has any Commander of AMOTEKUN been arrested, despite the fact that they are not backed by any known law and are made to carry fire-arms?
Would the atmosphere not have been more volatile by now if such has happened?

5. The same Government of Olusegun Obasanjo through the Minister of Information, Mr Frank Nweke Jr. in another press briefing made serious allegations that the Hisbah had sought foreign assistance from Libya and Iran for training as a terrorist group.

Has there been any such or similar allegations by the Federal Government against AMOTEKUN, even though the outlawed notorious Yoruba Ethnic Militia (OPC) with history of violent crimes against other ethnic groups and even the police, are integral part of the outfit?

Despite all the blackmail by Obasanjo Administration against HISBAH, no insults or overheating the polity were seen.

Northern Leaders and Intellectuals did not use emotion and blackmail to handle the unwarranted assault by the Obasanjo led Federal Government.

Northerners did not accuse Obasanjo and Ehindero (both Yoruba) of executing a Yoruba domination agenda.

Northern Muslims did not accuse Obasanjo, Ehindero and Nweke Jr. (all Southern Christians) of executing a Christianization agenda.

Rather, common sense prevailed and the Attorney General of Kano State took the matter to the Supreme Court where it was resolved.

Now, if the Yorubas believe AMOTEKUN is legal or created by any law and that the duties and responsibilities of the outfit (including the issue of holding fire-arms or lethal weapons) does not contravene any provision of the constitution, what is stopping them from approaching the Courts for settlement of the matter?

Why can't our Yoruba brothers pursue the issue of AMOTEKUN based purely on its merit and without joining HISBAH which differs in legitimacy, structure and functions, into their agitation?

Why can't they go about the matter with maturity and without insults or emotional blackmail against the Northerners especially and anyone of them who has reserved public commentary aligning with their agitations?

Is the group of South West Governors not made up of at least a lawyer? Rotimi Akeredolu the Governor of Ondo State is not only a Senior Advocate of Nigeria but also a former President of the Nigerian Bar Association. Why has he been unable to provide legal advise to his peers on the legal implications of setting up AMOTEKUN the way it was done?

To begin with, open grazing is not feasible and will always create a problem when Fulani moves to an area not used to their method of animal husbandry. This method is not sustainable and will always create crises, the best solution is to completely stop open grazing in regions south of the River Niger and Federal government should build smaller dams along waterways in North to cater for grazing during the dry season in the North.

Ultimately, we'll need to move into 21st century of cattle rearing, where such a trade is treated as a business and all battles are placed in a ranch.
You are free to create laws to ban open grazing and follow the said law accordingly; but communities are not at liberty to take the law into their hands by resorting to self help, as in this case, by chasing anybody away or holding their cattle ransome.
The community are in this way worsening an already bad situation by potentially putting themselves in harms way in event of reprisals.

In this same community, my dad's farm was eaten up last year, another of his farm was eaten up last week. This is his only source of livehood. What do you expect him to be eating when years,months,weeks,hours of labour was destroyed in a day. It might interest you to know that the king is even helpless as he has gotten several warning from military base in the State. When one seems to be helpless, u resort to self help. That was part of the lightling last year.

We are peace loving people but are not fools nor cowards You may not have heard of ijare but I tell you let them even think of reprisal or make attempt. They would suffer more. We don't make mouth.

As regards your question, I may not be able to speak for the community, but paying for the damages they caused should be the condition for the release of their cows.
Why bother chasing them away and risking physical conflict when you could have easily resolved the problem by obliterating their cows by remote control with lightning - instead of resorting to self help and now have to be sleeping with one eye open in case of reprisal?

While not condoning the destruction of farmlands; at the same time two wrongs cannot make a right:
You warned them and the they heeded and went to a distant place to resettle.
You still traced them and chased them away (even though no longer a threat to your
farms).
After they ran away, you took their cattle (over 100 in number) to your ruler's palace.

Questions:
Now that you have their cows as hostage, what do you expect to do with them should
their owners want them back?
What do you expect would happen should anything happen to their cows?
Is confiscating/retention of their cows consistent with existing laws?
If the community was as organised as they seemed, what stopped them from inviting the
police arrest/prosecute the culprits amongst them?
Is chasing them away consistent with their constitutional right to freedom of movement
and association?

There is always the right way and the wrong way of doing what is right; unfortunately resorting to to self help is not one of the rights ways.
It is an easy route to escalation and potential violence with attendant loss of blood/life. - I foresee reprisals if those cows are not returned.

The security architecture as presently constituted cannot work. The Nigerian Police Force was a colonial hang over with the sole purpose of protecting the colonial administrators from sometimes hostile natives. They owe their allegiance to the colonial government.
The Nigerian Police force main pre occupation is to protect the government in power and their conniving elite.
There are murders on the streets everyday without the police caring to carry out investigations and finding the murders. If one government official or a big man is killed, the police will Fish fish out the culprits under 48 hours.

A federal police cannot be expected to enforce local or customary laws, it just doesn't make sense. This is one of the reasons the police are useless during prosecutions and are often disgraced in court. You expect a police man from Enugu to learn the state and customary laws of in ogbomosho, to be able to successfully prosecute a case in ogbomosho.

A state house of assembly makes laws, a state high Court interprete the laws, but you expect a federal police to enforce the laws. Does that make sense?

Not that I exactly oppose hisbah Police or Amotekun or even Biafra secrete service (that is if the chief executives of the south east states decides to name their Police as such), my grouse is in the laws governing their creation and operation. They should operate within the confines of the constitution and not try an impose laws that limits freedom guaranteed by the constitution.
The issues you raised in your 1st paragraph will be addressed once the problem of corruption which riddles the police, like the rest of our society, is resolved.

Current police postings involve retention of 1/3 of indigenous officers in their states of origin; while the other 2/3 are drawn from other states/regions.

In theory, this arrangement would address the issue of local peculiarities, including prosecution of customary laws, knowledge of customs and traditions by indigenous officers; while the rest would be expected to provide the much needed objectivity and neutrality required in their duty in maintaining law and order.

I agree entirely with your views in your last paragraph.

I live in Abuja and I travel extensively across the north-central, south-west and north-west zones and all I see are angry youth ready to do anything to makes a living. How do we control our explosive population, create wealth in our rural areas through cartage industries, farming and agro-processing?

As people, we need to look holistically into conflict resolution, wealth creation and population control mechanism.
First, the minds and hearts of our youths need to rescued from our current lot of unethical politicians who have hijacked them through manipulations by sowing the seeds of hate and distrust within them in order to advance their (politicians) selfish agenda.

In this way they have polarised our perception, mindset and communities along the lines of tribe and religion so that they can remain popular and relevant as champions of their ppl at the expense or our national unity and security.

Our youths need to be re-programmed into eschewing these tribal and religious divisions and start seeing themselves as brothers an sisters and believing in our unity rather than division.

They must realise that their enemy is not tribe, region or religion but the hidden forces who encourage their disunity so that they can dominate and exploit them.

Secondly, we must eliminate corruption in all it ramifications in order to ensure transparency and accountability in governance and therefore justice in terms of equitable distribution and opportunities among the citizenry.

If we can achieve this, then everything will fall into place.

No one is against community policing, the presiden even said so himself; however, such arrangements must have approval and be sanctioned by the FG and relevant law enforcement agencies.
As for your question (in bold) I have already addressed it in one of my earlier posts.

- because there is always the danger that such outfits can easily be hijacked or get out of control and therefore mushroom to something never imagined or intended before (e.g. an ethnic supremacist witch hunting or separatist machinery) in view of which no govt will sit back and fold its arm at such possibility.

They are being arrested and often killed in the process every day - their pictures are all over the internet if you care to look.

Don't just pretend that northerners are some kind of angels that are devout ethnic bigotry. The truth is we are guilty of ethnic chauvinistic because has always shown that some section of the country are ill bent on dominating and unfair to others when they are in a position of authority.

It's imaterial if Fulani terrorist has killed more northerners than southerners or more Muslim than Christians or the fact that some demography decided to keep mute in the face of injustices doesn't mean we should keep mute and continue to act all is well. The core north sees Fulani as their lord that can do no wrong but we in the southwest don't share in such sentiment. We'll continue to make laws that will protect us against external aggressors be it Fulani, Hausa or Igbo.
Indeed, states are entitled to enact laws and enforce them so long as they are consistent with the Nigerian constitution; that much is clear - I also think that was the message the AGF was trying to get across.
