People who say the Supreme Court cannot review its own judgement if it finds very fatal errors therein, make me laugh.
So a simple question: if the Supreme Court sentences a man to death for murder based on evidence before it; and then developments later proves that the evidence upon which the SC relied on was false, will the SC allow that man to die just cos it cannot review its judgement? |

At best, he can offer his legal opinion on the matter and nothing else. The right thing is for the lawfully elected council members to institute legal action against the governor. Agreed Completely. All Govs must obey the order of the Supreme Court without exception and in this particular case is for a very good reason. However, it is strange that an AG is "directing" a State Govt. garfield1: Oga,the law globally and especially our electoral law has a lot of flaws and an intelligent hope took advantage of these loopholes.imolites may not have given him those votes but like all politicians who rig,he crafted means of rigging in those polling units using original inec result sheets, found a way to authenticate them at the units bearing in mind that you canjot cancel results emanating from units. He got a smart lawyer who proved and convinced the apex court that the results were genuine and unlawfully excluded.that's the summary. In those 388 units, votes from other parties doesnt matter because they didnt petition plus it will not stop hope from winning.you grab it? You are speaking the truth little by little now. No matter how you danced before, the above ia close to what happened. No other explanation possible. The Supreme Court for whatever reason(and this will be know soon) just perpetuated possibly the greatest assault to the electoral process in Nigeria. By the way, I dislike the PDP before now. But I will regard them as totally USELESS if they accept the nonsense that just happened in Imo. By now, they should be leading protest every where including Abj and Imo. They should boycott the national assembly, the Presidency till further notice. We have Clowns for politicians in this country. Am so pained!!! |
Politics › Re: Why INEC May Not Update Imo Guber Votes Tally Despite S’court Verdict by nameo: 11:13pm On Jan 15, 2020 |
garfield1: Elections held. Polling unit results were declared and issued to agents and police. At Ward collation, valid results from 388 polling units where Uzodinma got over 200k votes were not collated in the Ward results without any legal basis. So it is basically, votes in 388 valid Form EC8As were not included in preparing Form EC8Bs, which greatly affected the final result and placed him 4th. At the Tribunal, these original duplicate copies given to the party agents and the police were tendered and spoken to by persons who witnessed the unlawful exclusion.
The case at the Tribunal was simply for the Court to exercise its power to include votes from these 388 polling which were ignored at the point of collation without a legal basis, in the final result.
That is all the Supreme Court did. When you add the excluded votes, Uzodinma had over 300k votes. That makes him the winner.
The last time the Supreme Court gave a decision like this is in Omoboriowo v Ajasi and Nwobodo v Onoh in 1984. So I'm not surprised that it's sounding new.
As a lawyer, I don't speak to the politics behind decisions. I speak to the legal basis behind decisions. There was legal basis for this decision. But let the politics continue. Just ShUT it!!! You are NOT a lawyer. That you are equating those cases with this particular one clearly shows so. And every other thing written in your comment does not make any sense |

Just dancing about. And NO!! The court cannot "restore" the votes of a particular candidate/party and refuse to "restore" the votes of other candidates in same units in same elections only cos those other candidates didnt seek such determination. What do some of you chaps think the the judicial process is or works? Anyways, we await the written reasons for this judgement from their Lordships cos at this point nothing makes sense |

garfield1: Inec didnt do their calculations well.according to the electoral act, overvoting is calculated using voters register.the number you are seeing is from only card readers but legally, people can vote without card readers So the number of accreditated voters increases or changes? You mean 236,000 persons were not accreditated with card readers but manually and they ALL belonged to only one candidate? If it was the persons in the 338 units that were accreditated manually, is it that EVERY single voter in those units voted for one candidate? You guys should fear God!!! |

But 388 polling units, isn't that like half the entire votes cast all over the state. Why were they excluded, were they invisible, or were they quarantined becaus of malpractice (implausible on that scale though).
Anyone with a bit of commonsense knows that the police & other officials did the bidding of APC during the last polls. So did they all go to sleep during Imo elections, and allow PDP to rig? OVIHINNO: I was taken aback with the supreme court judgement initially until I read the details of the judgement. What's strange about the judgement? The facts of the case has been made bare, Votes in favor of HOPE wrongly cancelled were added back by the Supreme Court. He(Hope) now has the highest number of Votes consequently returned elected! The question that arises then is, does the supreme court has power to add back votes already cancelled by INEC? From a layman's point view I think answer is YES. Hopefully in the days ahead legal luminaries will elucidate on this matter and the whole contentious issues will be adequately addressed The Supreme court has the power to add back cancelled votes if they hold that it was cancelled illegally? But these vites were not cancelled by INEC. If not INEC would not have declared the election conclusive in the 1st place. I am reading now that the SC says that they were not collated!!! So who deliberately did not collate such a huge number for a single candidate? INEC? I hardly doubt that cos we are talking about INEC against the ruling party here! So again, who did? |
Politics › Re: PDP Press Statement On Supreme Court Judgement by nameo: 11:03pm On Jan 14, 2020 |
seunmsg: Except my memory is now failing me, Imo election was never declared inconclusive.
Please read my initial response very well and get my message. I blamed INEC and PDP for the mess. INEC should take more blame because they have the duty of conducting credible election. I’m very sad that those that cancelled over 200,000 valid votes almost got away with it. Unfortunately, nothing will happen to those that committed the crime. Exactly! It was never declared inconclusive. Bros, we are not talking about 1000 or 5000 votes here or there but 236,000 votes in 388 units( what is the total number of valid voters and no of units in Imo state). How is it possible that such a huge number and from such a huge units is cancelled for only one candidate? And none was cancelled for other candidates in these 388 units? Who cancelled it? INEC? Again, does that make any sense to you? Assuming this happened, it would be the most outrageous crime i.e political fraud, ever conducted in the history of elections in Nigeria and maybe even the world. How could INEC have been able to succesfully done that? |

seunmsg: There is nothing strange in the judgement. What I actually found strange today is the information that INEC declared Ihedioha winner after cancelling APC votes in 388 polling units. They cancelled the voice/voted of over 200,000 voters just to be able to declare Ihedioha. I’m really disturbed that it took the intervention of the Supreme Court to stop such a fraudulent move. Who cancelled over 236,000 votes(hope you know what that means) in 388 units( again i hope you know what that number is) in a single state? INEC? And was it only Hope's vote that were cancelled? If 236000 votes were actually cancelled, how come the election was declared conclusive in the 1st place? Some many questions. And you and I are just guessing |

And in a big way. Shouldnt their Lordships have taken the time to write the decision and share so the guessing game is reduced? |
Politics › Re: Deji Adeyanju Reacts To Supreme Court Judgement That Sacked Ihedioha As Governor by nameo: 9:21pm On Jan 14, 2020 |
CallMeDrino: Hope Uzodinma's case was that the 388 polling units spread across the state which he won was wrongfully excluded during collation by INEC.
The Supreme Court merely gave him back the units which skyrocketed his score over Ihedioha and fulfilled the geographical spread.
It’s that simple
#Copied If these units were actually excluded i.e 388 units(how many units are there in Imo again?), didnt other candidates win a single vote from these excluded units? Then, who excluded them? Then, where are these units located in Imo? If the SC wasnt irresponsible in this case knowing the huge shock in declaring a person who came out as 4th as the winner, it ought to have released the written opinion so every one is guided and nobody is guessing. This decision is so consequential for Gods sake for us to be guessing |
