Anybody that thinks unseating two governors and demistfying APC's conspiracies in Ekiti by Fayose was no mean feat, then such person needs mental check. Thousands of Falana and even Buhari can't impeach Fayose in Ekiti. All they're doing is just wild goose chase.

The president himself had sown the seed of sentiment and suspicion in his so-called anti-corruption crusade by overlooking the alleged corrupt acts of his party members, hence it's completely illogical to bash those people that see Bruce's travail as witch hunt. Let the anti corruption war be holistic and the hue about witch hunt would die naturally.

No doubt, one issue that is consistently in the news right from the inception of this administration is the fight against corruption. Virtually no day passes without a headline bothering on corruption related stories ranging from recovery of stolen funds, arrest of looters, suspects been placed on wanted list just to mention but few, all thanks to the new Sherrif in town. One year down the line, the picture is getting clearer and from all indications, a particular section of our polity is feeling the heat.

Without prejudice, corruption has been a bane in our quest for first-world status, hence any action geared toward confining the monster to the bottomless pit should be welcome by all and sundry. However, what should raise people's concern is the manner at which the menace is been fought. For the admirers of Buhari and his style of anti graft crusade, the end justifies the means. To them, how this govt arrives at its destination in ridding Nigeria of corruption does not really matter in as much as our stolen commonwealth is recovered. But from all pointers, unless we choose to shy away from the truth, this anti-corruption crusade cannot be said to be holistic, honest and all-encompassing..

And this brings us to the story of Prophet Eli in the Bible. The old man of God was a revered figure in the history of Israel. He was used mightily to judge that nation when they turned their back against the Creator. In short, many wondrous works were done by him. However, towards the tale end of his journey, Prophet Eli began to overlook the excesses of his household. He concentrated all his efforts in judging other citizens of Israel while completely ignoring the atrocities of his immediate family-his children. The long and short of this story is that after series of warnings which he arrogantly ignored, the wrought of God was unleashed on Eli and his household. Death came upon his children and from the ensuing shock coupled with his old age and fragility, Eli died miserably.

I guess someone is asking the question; what's the take home from this tale? We can't continue to pretend about the selective nature of Buhari's anti graft war. From available statistics, more than 95% of those caught in this administration's dragnet of EFCC onslaughts are members of the opposition. This should raise suspicions and resentments from those who loves Buhari and Nigeria in particular. God can never be happy with a leader that indulges in selective justice and the consequence can be dire. Eli was anointed by God to judge Israel but he deviated from His original plan and ended baldly. Nobody wishes Buhari's fate to be like that of Eli but he should learn from the mistakes of the old prophet.

Since there is no immunity for impunity as far as electoral
malfeasance is concerned the investigation by the EFCC is
in order.
The senior lawyers who have questioned the freezing of
Mr.
Fayose's account on the ground that the EFCC did not
obtain a court
order have not read section 28 of the EFCC Act which
provides that
"where a person is arrested for an offence under this Act,
the
Commission shall immediately trace and attach all the
assets and
properties of the person acquired as a result of such
economic or
financial crime and shall thereafter cause to be obtained
an interim
attachment order from the Court". The law permits the
EFCC to
freeze an account or attach a property of a criminal suspect
and
proceed thereafter to obtain an ex parte order from the
appropriate
court.
I am not unaware that by the strict interpretation of section
308 of
the Constitution no court process can be issued or served
on a
governor. But because immunity cannot be pleaded or
invoked to
cover electoral fraud, elected governors are served with
court
processes and dragged to court to respond to allegations of
electoral
malpractice. However, in order to give effect and validity to
the
equality of the rights of all contestants in a presidential or
governorship elections, it has been held by the Supreme
Court that
immunity clause cannot be invoked in election petitions.
Otherwise,
public officers covered by the immunity clause may take
advantage
of their positions to rig elections and thereby sabotage the
democratic
process. The rationale for suspending the operation of the
immunity
clause during the hearing of election petition was explained
by the
late Justice Kayode Eso in Obih Vs. Mbakwe (1984) "
If you choose to be deceived by politicians who parade themselves as legal luminaries or social critics, that's your headache. Section 28 of the EFCC Act can only be invoked WHEN AN ACCUSED IS ARRESTED AND HIS ASSETS IS THEREAFTER SEIZED. The question is; was Fayose arrested for any criminal act? As far as the Ekiti election is concerned, justice has been served on all concerned parties through the tribunal. If Buhari and Falana want to constitute their own tribunal for retrial, good luck to them. This is not about Fayose but the law must not be trampled upon to score cheap political points or settle scores. No legal proceeding can be instituted against a sitting governor. Simple.

Femi Falana is undoubtedly a shameless and irresponsible lawyer, no apologies. A so-called social critic who often sacrifice decency on the altar of parochialism and petty politics. He has shown times without number his uncanny hatred for the person of Fayose but must he turn logics on its head by twisting sections of the constitution to give substance to his fallacious dispositions? For the avoidance of any doubt;

1. Section 308 of the Constitution clearly says a judicial proceeding be it civil or criminal CANNOT be instituted against a sitting President, VP, Governor and Deputy Governor.

2. The EFCC Act allows officials in (1) above to be investigated while in office but forbids actions that lead to prosecution including Freezing of their Accounts/seizing their assets.

3. There's is a clear difference between investigating and placing embargo on account been investigated by way of freezing. An account can be investigated without been frozen.

4. Section 28 of the EFCC Act allows the Account of accused individuals WHO HAVE BEEN ARRESTED to be frozen. In this index case, Fayose was neither arrested nor placed on restricted movement. In fact, Section 308 forbids EFCC or any other law enforcement agent from taking such step against Fayose. Therefore, on what ground did the EFCC hing its decision to freeze Fayose's account?

I am not a lawyer but if placed side by side with Femi Falana, I will rub his legal robe in the mud. He's such a double-mouthed and unstable personality.

You can only determine how proficient a govt is by the effectiveness of its economic, political and sociocultural policies of which Buhari has failed grossly. Let him return our Naira value back to its position of May 2015.

Mr. Godwin Obaseki has won the Edo State gubernatorial primary of the All Progressives Congress held at the Samuel Ogbemudia Stadium in Benin, the state capital.


NigerianEye closely monitored the election which went into the middle of the night through to early hours of this morning, was contested by 12 aspirants.

2,873 delegates from 192 wards of Edo state were accredited for the primary election. Obaseki scored a total of 1618 votes to emerge APC’s flag bearer over his closest rival , Pius Odubu who happens to be current deputy governor, having 471 votes. Here is a breakdown of the results per candidate ,

Nigeria's future is pitiably bleak with APC in power. What sort of confusion is this? Few days ago, the same presidency raised the issue of 40% counterpart funding by the States. Today, it's a different tune apparently to counter Fayose's reactions. It's obvious this feeding scheme is unsustainable going by daily permutations on its modus operandi.

Meanwhile, I am just back from unexplainable back-to-back bans (2 times under two weeks) a move I suspect to be a ploy to frustrate critics of this trial-by-error Buhari's govt out of Nairaland.

You're right. Fashola and Tinubu were always heard canvassing for implementation of State Policing when they were in opposition. The duo has suddenly gone silent on the issue despite being in control at the centre. I now detest Nigerian politicians with passion.
