In fact, the results may not be certified, in many CA races, till 3 weeks after Election Day. ![]() In a vote-counting center in Santa Ana, Orange County, they’ve already proceed 700,000 mailed ballots. To put int into perspective, the same center processed around 1,000,000 mailed ballots 2 years ago. So, the excitement in this year’s midterms is super high! There are four Congressional seats, here, being held by Republicans that could flip to Dems. In my district - the 50th - the incumbent Republican rep Duncan Hunter, is in a toss-up contest with the Dem challenger, Campar Najjar. The district is usually a reliably Republican one, but Hunter’s multiple indictment’s by the federal DOJ for campaign-finance violations, and anti-Trump sentiment, has made this district surprisingly competitive. |
It’s Election Day! I mailed my ballot, and the voting line in a precinct close to where I live isn’t a long one. Keeping my fingers crossed for a long day!

It is true, according to the rules of statutory interpretation, that the intent of framer of a law should be considered when interpreting the said law. The 1800's statement made by the Senator, to the effect that, "This will not, of course, include persons born in the United States who are foreigners, aliens, who belong to families of ambassadors or foreign ministers accredited to the government of the United States, but will include every other class of persons." is what is in contention here. But the bolded part shows that the amendment was intended to exclude ONLY children of accredited diplomats of other sovereign nations. The statement also does not explicitly mention illegal aliens as well. If there was an 'or' between 'aliens' and 'who..' in the Senator's statement, then one could reasonably assume that children born in the US to foreigners do not possess U.S. birthright citizenship. Moreover, the term “subject to the jurisdiction of the United States” covers all persons in the US, except diplomats of sovereign countries |
Kophschmerzen:Still on my way to becoming an attorney though ![]() Despite what Trump fans may want to believe, the 14th amendment applies to anyone who is subject to the jurisdiction of the US. Some individuals such as diplomats, aren’t subject to the jurisdiction of the US, hence their kids born in the US aren’t automatically US citizens. However, children born here, to undocumented immigrants, are US citizens because their parents are also subject to the jurisdiction of the US. The parents could apply for some amnesty or asylum or could be deported from the US. |

A civil society group, Kingdom Human Rights Foundation International, has asked the Federal High Court in Abuja to stop the Independent National Electoral Commission from recognising, accepting or listing President Muhammadu Buhari as the presidential candidate of the All Progressives Congress in the forthcoming 2019 election. The KHRFI, in a suit, which it filed on Monday, alleged that by virtue of section 91(9) of the Electoral Act, Buhari’s nomination as APC’s candidate is illegal, null and void for accepting a donation of N45m worth of APC’s nomination and expression of interest forms from a group named Nigerian Consolidation Ambassadors Network. The plaintiff contended in the suit marked, FHC/ABJ/CS/1228/2018, that by virtue of section 91(9) of the Electoral Act, no individual or other entity can donate more than N1m to any candidate. It added, however, that in violation of the said provision of the Electoral Act, Buhari on September 12, 2018 “submitted the illegally purchased presidential nomination form to the National Chairman of the All Progressive Congress”. The plaintiff, through its lawyer, Mr. Okere Nnamdi, sued Buhari, the Office of the President, the Attorney-General of the Federation, the APC and INEC as the 1st to the 5th defendants respectively. An affidavit filed in support stated that the APC, relying on the “illegally purchased nomination form” the APC on October 6 and 7, 2018 held a National Convention in Abuja where Buhari emerged a consensus presidential candidate of the party.
