You need to go back and read the supreme court ruling on the 2007 elections that brought Yar Adua to power. The election was greatly flawed , INEC received stick from the supreme court on their conduct and yet Supreme court still upheld the election. You need to understand that the Supreme court in cases like this see themselves as the final keeper of the realm. Whatever judgement they will give will be in the interest of not creating chaos and heating up the polity. You didn't get my point. In that probability that the SC upholds the 25% it will automatically nullify the elections unless they also disqualify Tinubu. Which will now hand power to either Atiku or Obi. Unless you want to tell me it is certain that the SC won't consider the 25% in FCT. That certainty was not reflected in your comment. (See the bolded) |

Just take ur mind off any possibility of nullifying the presidential election or conducting any rerun . So assuming the court upholds the 25% in FCT doesn't it automatically nullifies the election? It's a possibility you can not ignore. The only way the election won't be nullified under the above assumption is if the court also disqualifies BAT. |

All votes are equal but they don't carry the same weight. 25% in Bayelsa is less than 100k votes, whereas 25% in Kano is almost 1million votes.
If all votes are equal then there is no reason for the framers of the constitution to require that the winner get 25% in 2/3 of the states and the FCT. The reason for that is to ensure spread.
That spread is the same reason why 25% in FCT is a MUST.
No past president has won election without winning 25% in FCT. It won't start now. |

The SC judgement on the Osun election gave primary status to BVAS evidence and secondary to IREV. That is where there is dispute in election results or accreditation, BVAS comes first then IREV second.
In this PEPT, there is no BVAS (it was deleted by INEC) and so IREV takes primary status.
The electoral act also mandates INEC to compare results on IREV before announcement. |

The petition stated that their votes were suppressed and that they won Rivers and Benue and also had more scores in Lagos, Imo, etc. They brought forms EC8AS as evidence to show manipulation of the results. So if the respondents did not counter the claim, if the petitioners provide their own results in their reply, the court will be forced to abide by it. |
