A Statement by his Excellency, Mr Babatunde Raji Fashola, SAN the immediate past Governor of Lagos State

“When you wrestle with a pig, the pig gets happy and you get dirty.”

This statement of profound wisdom informed my silence in the wake of manipulated and unsubstantiated allegations of wrongdoing recently being levelled against me. They started a few weeks to the end of my tenure, and have continued till date.

They range from allegations of extra marital paternity of children, to mundane and phantom conspiracy in the National Assembly, a debt profile for Lagos State and lately a website upgrade contract of N78million, which is being distorted.

In so far as the allegations of paternity are concerned, they are wicked and false. I have no biological children other than my two children.

Of course, I adopted three children who became orphaned as a result of the tragic DANA Airplane crash of 2012 and the adoption followed due process. Those who do not care whether they hurt innocent children or invade the privacy of other citizens in their mindless rage against me will have their rewards served upon them in the fullness of time.

As far as my alleged involvement in the National Assembly elections are concerned, they remain only the products of the imagination of those who made the allegations. I was out of the country at the material time and returned only in the early hours of that morning to Abuja, and from there proceeded to Lagos.

As far as debts of Lagos State are concerned, the fact is that Lagos had always had depts. her population is growing and for a long time she has run deficit budgets to cater to the needs of that growing population.

All the debts contracted in my time were approved by the Parliament in the annual budgets, some have been paid back and the financial status was healthy and stable when I left. The outlook for the state and her rating by Fitch was long-term foreign and local currency IDRs at ‘BB-‘, short-term IDR at ‘B’ and national long-term rating at ‘AA+(nag)’.

When we all pause and reflect and think, we will realise that there are a sizeable number of companies who are running business, who have no responsibility for Security, Public Health, Public Education and other responsibilities of Government, who borrow more than Lagos State Government, whether collectively or individually.

As far as the website contract is concerned, yes there was a contract, It went through procurement and was approved by the Government agency authorised to do so.

One of the services was an “upgrade” quoted for N12.5 million but awarded for N12 million. There were other services that were new; like a handover countdown clock, mobile Apps for Google, for IOS and iPad, forMicrosoft and for Research in Motion (Blackberry), which the existing website did not have, as well as the annual maintenance cost of managing the website.

It was for all these services that the contract was issued for N78 million, which the Lagos State procurement agency gave a No objection based on the advice of the Ministry of Science and Technology, who are the Government adviser on ICT matters.

In publishing this Contract award which was the Government tradition under my watch, the procurement agency’s website summarised it as “upgrade” only without detailing the other services and this has been distorted by the agents of hate as their suspected “smoking gun”.

For those who are familiar with mobile applications, they will know that users either pay for them online or download them for free.

What is usual is that applications for service are usually provided to users free, but somebody bears the cost.

Since these applications were to be made available to the public for free access and to assist Government communication, we decided to pay for them.

The entire documents are with the Lagos State Government and are available for those who seek the truth. For the record, since 2008, long before the Freedom of Information Act ever passed, we had put out our contracts on the State website because people deserve to know.
It is regrettable that a “summary” of the contract has been deliberately distorted to misinform the public.

This particular website came into being as a result of the decision I made to make my telephone number public for the several thousands of people seeking to reach me daily.

The website that is now under attack helped me to do my job and to respond to citizens, and the contract was issued to run till my last day of office. It stands logic upside down for to “fraudulently” award a contract and then have it published on a website.

To date, there have been 27.666 million hits on this website with 1,844 videos, 34,381 photographs, 2,531 Press Releases and 595 Speeches, among other items for public communication.

I have chosen to make this personal response because as the head of government at the time of the transaction, the buck as they say stops on my desk and also because of the many calls, text messages and mails coming from many people seeking clarification; and to prevent fiction from being mistaken for truth.

I expect that there may be more distorted allegations without evidence, for reasons that remain in the realm of speculation because, I have been informed reliably that large amounts of money are being paid to some of these agents to bear false witness.

I cannot conclude without responding to the crusade of CACOL and their ilk, seeking my prosecution on allegations that have no proof and writing “pre-emptive” letters to the Presidency.

In case they are unaware, I am not looking for a job. I expect them to know that allegations of wrong doing are not resolved without evidence, neither are they resolved in press conferences.

I have served my state, and by extension, my country for Twelve and half years and I did so with my heart.

I am taking the rest that I believe I have earned.

For those who still wish to remain in the mud, they should look in the mirror.

For those who wish to throw mud at me, they should look at their own hands.

As for me, I have moved on. My job is done.

Her aide lied that it was just rumours, then later admitted and said it was forprotection after stepping on toes, then finally it was retold as cars procured to be added to the pool of cars to be used to convey foreign partners of the ministry. Super Story!

Besides making expenditure without a budget, the BMWs asregistered were never found by the house committee that investigated the matter.

Since GEJ came from the SS, they adopted him as their own. They liked the idea or him being accepted as
Nigerian president as a precursor to Nigerians accepting the idea of an Igbo man as a president because believe it or not,
they already know how unattractive an Igbo man as a presidential candidate is to the generality of the Nigerian populace.


So GEJ loosing the election the way he did (when they wanted him to win) just infuriated them.
Believe it or not, they firmly believed that after GEJ, it would be an Igbo man in 2019. So GEJ losing the way he did
impressed in their minds that there was no hope for this hoped acceptance of a president of Igbo extraction.
This happened to them in both a conscious and subconscious level.

There is hardly any election season in which agitations for Biafra and an Igbo presidency does not increase together.
Oh yes, if GEJ had not lost they would not be protesting now. But the implication of his loss was more devastating to
their political calculations than to any other group of people. That is why they are even more grieved than the south-south
whose son actually lost the elections.


Sadly, this is not the way to go about it. These agitations do not earn them any diplomatic capital (like most of the actions they are proud about).

To be honest, it is my view that Igbos have been earnestly involved in diplomatic self-amputation over the years.

Three days ago, Nigeria's budget-monitoring tech organization, BudgIT, released a detailed document on the states of Nigeria; their economic situations, debt burdens, budget-funding capabilities, internally generated revenue ratings and financial sustainability.
This move is part of a greater plan to engender transparency in our budgets, as well as demand better accountability from our various state governors across the federation.

The document had some revealing details, some shocking details, as well as some downright damning ones. I guess reality is truly different from state-sponsored propaganda and social media rhetoric.

[size=14pt]Ability Of States To Meet Recurrent Expenditure[/size]
In this category, the states are ranked by the figures realized after subtracting the total monthly salaries paid by the states from their monthly income. The states in red are states whose monthly incomes are unable to meet up with the monthly wage bill. In other words, states that are unable to pay their salaries without having to borrow. States in green, on the other hand, are states whose monthly incomes are enough to adequately pay salaries and still have some leftovers for other engagements.

From the table above it can be deduced that Lagos, Rivers, Delta, Katsina and Enugu are the top 5 states with the highest leftover cash even after meeting monthly obligations; while Osun, Plateau, Ogun, Nasarawa and Oyo are the bottom 5 states as well as the states with the greatest inability to meet monthly payments without having to borrow.
Perhaps interesting to note, is the fact that Osun state's monthly shortfall is larger than the monthly shortfalls of Ekiti, Bauchi, Abia, Kaduna, Zamfara, Imo and Gombe, combined.

On a region-by-region basis, it can also be deduced that:

1. In the South-South, all other states are green except Bayelsa and Akwa Ibom.

2. In the South-East, Enugu, Ebonyi and Anambra are able to meet recurrent obligations, but Imo and Abia are unable to.

3. In the South-West, Lagos is the only state currently meeting its recurrent obligations while all other sister states, Ekiti, Ondo, Oyo, Ogun and Osun, are unable to.

4. Taraba and Yobe are the only North-Eastern states without monthly shortfalls

5. Niger, Benue and Kogi are the only North-Central states currently without shortfalls.

6. Zamfara and Kaduna are the only North-West states with shortfalls.

BudgIT published the final info known as "State Sustainability Index". This is the rating of the states by their financial sustainability. It factors in the state's IGR, as well as its total debt stocks, AND recurrent expenditure before arriving at its final figures.
This is the standard formula used in calculating state sustainability index:

From the table above, it can be deduced that Rivers State, with its high IGR and relatively low debt, is Nigeria's most sustainable state, with Lagos, Enugu, Delta and Katsina all trailing in that order to make up Nigeria's top 5 most sustainable states.

Counting from the bottom, on the other hand, Plateau, Osun, Nasarawa, Borno and Ekiti are ranked as Nigeria's least sustainable states, with their low IGRs and inexplicably high debts.

On a personal region-by-region ranking (gotten by adding all the indices for every state in each region and dividing by the number of states in said region), the South-South is by far Nigeria's most sustainable region with a cumulative average sustainability index of 8.27

Coming a very distant second is the South-East with an index of 6.43

In third place is the North-West with an index of approximately 5.45

Number 4 is the South-West with 5.43

Coming fifth place with an index of 4.39, is the North-Central

And scraping the bottom of the barrel at last place, is the insurgency-torn North-East with an index of 3.97

Excerpts of the Interview By Gabriel Enogholase, Benin.

MR. Daniel Aiyanyo Omoigui, father of the Chairman, Federal Inland Revenue Service (FIRS), Mrs. Ifueko Omoigui Okarau, and former Surveyor General of the Federation, turned 80 last Thursday. In this interview on the milestone, Omoigui speaks on why students run away from mathematics and his narrow escape from death during the civil war.

He also speaks on Bakassi Peninsula, which, according to him, has never been part of Nigeria but has always belonged to Cameroun. He adds that he was forcibly retired as Director of the Federal Survey because he refused to do the bidding of a former minister that would have transferred oil wells belonging to Bendel to Ondo State.


What would say about your early working experience?

After my education at St. Patrick’s College Asaba in 1949, I came back to Benin- City and took a teaching appointment at Niger College, Benin, in 1950. Besides, I also read at home to prepare for my future challenges while there.In 1953, I took the entrance examination into the University College, Ibadan, passed and I took the Inter.

B.Sc examination of the University of London. I entered the University College, Ibadan to read mathematics in October of that year, but, in December, the result of the Inter. B.Sc University of London came out and I passed. Therefore, I had to move to the next class and graduated in 1957.

How did you find yourself in the Federal Service and rose to the position of Surveyor – General of the Federation?

I joined the Federal Survey Department in 1957 in Lagos and the job took me virtually to all parts of Nigeria. In 1958, I was at the Royal Military Survey Institute, London, for further studies and I came back to Nigeria in 1959. I got married to my wife in 1958 and she came to join me in the United Kingdom in 1959.

In 1964 – 65, I was posted to do Geodesic Survey throughout the country and, because of this nomadic life, I decided to keep my family in Lagos permanently. In 1966, I was posted to Markudi to take charge as the only office outside Lagos then.

This was a very trying period in the history of the country because of the tension generated by the 1966 coup d’état. I was still in Markudi when the second coup of July, 1966 took place and there was trouble all the country. In September 1966, there was trouble in Markudi and so many people were killed.

So, what was your experience during the civil war?

I would have lost my life in Markudi if not that God used one Lt. Col. Adeniran to save our lives. At that time in Markudi, the town was essentially made up of Igbos because the Tivs were predominately farmers. Lt. Col. Adeniran gave us non-natives a platoon of soldiers that escorted us from Markudi to Lafia, then Suleija and to Jebba.

At Jebba, it was a terrible and horrible experience at the River Niger Bridge. People were asked to identify themselves. When I told them I was a Benin man, an army sergeant from Zuru who had lived in Benin came and spoke to me in Benin language, and I replied.

That is what saved my life. After the civil war, I started the boundary demarcation of the entire country, so, my stay in London helped me a lot in this assignment. Most of the documents today on boundary demarcation were produced by my team.

Then you were involved in the demarcation of the boundary between Nigeria and Cameroun Yes. In August 12 – 14 ,1970, the first meeting of the Nigeria/Cameroun Boundary Committee took place in Beau, Yaoundé. The Nigerian delegation was led by the late Chief R.O Coker.

I was like the technical secretary to the committee. There were representatives from the Customs. Immigration, Cabinet Office in the delegation. When we came back from Yaoundé, the delegates from the External Affairs Ministry did their report to their Commissioner, the late Dr. Okoi Arikpo, who then wrote to the Commissioner for Justice and Attorney – General of the Federation, Dr. Teslim Elias, for his opinion on the Nigeria/Cameroun boundary issue. Elias’ reply has remained a landmark legal opinion that Nigerian has no claim to Bakassi peninsula; that all we needed to do was the maritime boundary between both countries.

The General Yakubu Gowon administration followed Dr. Elias’ opinion. From 1970 -1975 when General Gowon was removed from office, I took part in the negotiations.

I have all the documents. What Gowon did then was to convene a meeting of the Supreme Military Council to brief them on the legal opinion and Col. Olusegun Obasanjo, as he then was, was the Commissioner for Works while Col. Murtala Muhammed, as he then was, was the Commissioner for Communications.

I was then the Assistant Director in charge of the Mapping Section at the Federal Survey Department and, in 1978, Chief Coker retired from the service and my colleague took over as Director of Federal Survey.

In 1979, we had a civilian administration and, in 1981, the Cameroonian gendarmes invaded Nigeria and five of our soldiers were killed. With my experience, even though not heading the maritime section, I was requested by the National Asembly to tell them the exact location where the killings took place.

I told them it was in Cameroun, east of Ekeng. Although they knew it was in the Cameroun, they started to flex muscles. When Buhari took over in 1984, he set up a task force on Nigeria’s boundary with Chad Republic and I was a member of the task force.

It was then we knew that Richard Akinjide had sought the opinion of a Cambridge Director for his opinion. I was then brought in to supervise the technical report while the main report did agree with Elias that Bakassi was in Cameroun.

The Permanent Secretary was Ambassador Edwin Dove in the External Affairs Ministry while Hamzat Ahmadu now Chairman of Leventis was the Director – General. They were aware. Chief Uffot Ekaette was the private secretary to General Gowon and he knew about the issue.

In 1984, as the Director- General of the Federal Survey, following a re-organization in the Federal Ministry of Works, I initiated the establishment of National Boundary Commission when I was told that Cameroun had established its National Boundary Commission because of the sensitive nature of the issue. The Vice President was made the Chairman because of the sensitive nature.

In 1977, the Obasanjo administration set up the Justice Mamman Nasir Boundary Commission and, following its report, the boundaries of some states were changed. Part of Western Ijaw went to Rivers State, part of Bendel went to Ondo; part of Rivers went to Cross Rivers and part of Imo went to Rivers.

Because of this, some oil wells changed hands. There was an oil well in Rivers very close to Imo and I was asked to demarcate where the oil well was actually located. After the exercise, it was found that the oil well was in Rivers.

Moreover, because parts of Bendel had gone to Ondo, there were five oil wells very close to the boundary. Initially, the Ondo people wanted the royalty to be shared 50-50 because they were very close to the boundary between both states.

In 1981, a Yoruba man, who was Director of Survey, wrote to the Ministry of Finance on the issue and, after charting, it was found that the oil wells were in Bendel State. He wrote to the Ministry of Finance that the Yoruba would not take this.

He went to Lagos, met with the Director of Survey and reported that a Bini man was behind the charting. Then my Director said no, he charted it. In 1984, Bamidele Otiko became the military governor of Ondo State and came to Lagos to meet my Director. At the meeting, my Director told Otiko he was responsible for the charting.

When Chief Olu – Falae became the Secretary to the Federal Government, he directed me to write a letter that pending the resolution of the Ondo – Bendel boundary adjustment issue, they should be sharing the royalty 50 – 50. I declined to write the letter.

They then posted one Ondo man to be the permanent secretary. He was reported to have said he was posted there to do their bidding and they would call him an outcast if he did not. After reading the file, he said I should do something, on the issue and I said, ‘No, you are the permanent secretary, draft the letter and sign it.

He refused. The then Minister of Works, Alhaji Abubakar Umar, was a witness to all these. Later some people did a letter purportedly written by me. When Mamman Kantagora became the Works Minister, he told me that the Armed Forces Ruling Council (AFRC) had retired me.

That was in 1988. The following week, the then Ondo governor called a press conference and told the media that I forged the map of Ondo – Bendel States to remove oil wells from Ondo to Bendel. The newspapers that published the story were sued for libel and I made them to write apology letters.

Since I was retired, they have not carried out any survey on the Ondo – Bendel boundary issue
The Akoko-Edo come to mind.

They have no business being in Edo state, but Ondo state with their fellow Akokos.

I can see his engine has already began overheating.

For those who do not know, Folawiyo has already completed its Aje 4 and Aje 5 wells for production. So Lagos has already moved to the production class, no longer exploration class, and obviously no boundary dispute is involved with the beheading Igalas.

I believe the "mama tongue" as used in pidgin could mean the mum's language, different from the general term "mother tongue" used to infer native language.

It's very likely the dude is of mixed heritage, but obviously that already calls to question his "Igboness" if I am to conclude by the impression Igbos have created, casting aspersions on the origins of some notable Igbos.

You claim someone is Yoruba but the very statement you hold as evidence is fraught with error as "digbo" doesn't correlate to "dibo".

If you like, proceed on a tribal purification when you get your country. The headache is for those who would find themselves in a country where no man trusts the other.

A right does not require a police validation to be exercised.
