You are right. The applicant must have misrepresented in the past. What many people don't know is irrespective of outcome of visa interview, you are not sure until the stamp is in the passport.

the 3 days used to process the stamp into the passport is used to check for admissibility, misrepresentation, criminality status e.t.c Only after a name clears against many database checks will the stamp be affixed in the passport.

Sincerely, I think a way or the other she has probably lied in her application or applied in the past with different credentials, or they did actually receive information or the v.o that gave her the visa changed his mind after she left the visa hall probably due to a rethink on the part of the v.o
Nobody can say anything for sure, we all can only assume the situation.

His current visa is valid for the duration of his passport. For OWP, off the top of my head, it's proof of marriage, funds, medical and home ties I believe.


Most crucial requirements are Enrolment certificate of spouse in a DLI, funds, marriage certificates, medicals, security certificate, letter of invitation from spouse, necessary application forms.

OWP will be valid for duration of the Study Permit of invitee.

QUES 1.
I and my wife 'playfully' (ie without any serious intention to immigrate) applied for DV 2012 and we didnt even bother to find out whether we won or not, though we didnt get any correspondence that we had been selected.

Fastforward to 2015, myself, wify and 2 children are planning to apply for tourist visa to the US.

Do you think that 'playful' DV application will not be our undoing now (cos I dont know whether our names will pop up in their system as people who have once applied for DV before(immigration visa) now applying for non-immigrant tourist visa)

N/B:
We have previously travelled as a family to the UK in 2013 and will be doing same this year.

She did'nt check one single document. I think it's about one's composure and confidence. Then ur ability to look into their eye while answering their questions. And ultimately don't see it as a do-or-die affair. If they had denied i would taken my son to Dubai

Ahan uncle how can you say this, does a conference take 5 months to attend? 6 months is usually the standard approved at the p.o.e and lesser is approved at the discretion of the officer once he senses foul play, and your purpose of visiting will definitely be asked too, so there is no way she will escape questions when she wants to return back because she probably must have said she will only be in for a few weeks.


We should not create unnecessary fear of CBSA officers. Neither over emphasized POE entry refusal. What is the ratio of those who get sent back to those who gain entrance.

You should only fear if you over stay. That's when you have broken the law.

Don't think so. They approved a stay of 6 months max for that visit. She stay 5 months. Its within time allowed and she has not broken any law. So what is there to fear.

If I stayed that long and the border officials ask why, I will tell him how much I bought ticket and say I wanted to maximize my money....lol!

If one member of a family unit gets a USA visit visa, it boosts the chances of every other person in that family unit getting it. Don't be afraid, let them apply together. Just make sure they take along your USA visa page showing the CBSA admitted stamp.

Confidence is key. So you might want to tutor your wife on likely questions she will be asked.

Well I have obtained visa from a few visa issuing countries for vacation without my wife and 2 kids.
Also, I remember applying once as a family going on vacation and we were all refused.

Single and No travel history is not good. Reduces your chances for a visa. My advise is don't be discouraged if you don't get it on those grounds. And be thankful if you get it.

www.cic.gc.ca/work is where you can get all information. Google that.

Chances are largely dependent on eligibility. So the question would be Are you Eligible for a Work Visa? That's what you should determine. You can try using the Come to Canada questionnaire.

if you're going to Canada on a visitor's visa, the kids cannot school and you cannot work. You will only be able to stay for 6 months max in the country on visitor status.

if you apply for work permit as a temporary foreign worker, you may work if approved and your kids can school if they are equally approved to accompany you.

to get a work visa, you need a job offer, Labour Market Opinion, and other documents which you may research on the CIC website.

You are on AP - Administrative Processing. It could take weeks or months for you to be processed. It means embassy is investigating you. You would have to wait for the outcome.


My advice - if you're refused eventually (I don't pray so), next time you apply at the embassy, request from the VO for a Waiver of Inadmissibility. If you are eligible that is.

Hello Justwise and other GURUS,

With utmost respect and appreciation i seek your assistance in shedding more light to my situation on the subject matter (Section 221(g) of the United State Immigration act and as it affects my application. I am a married man with a 5 year old girl child. I applied for a US student visa on 2002 and was refused (God knows i have forggotten why) and since that time i have never attempted any visa until 2009 when i got an offer of employment from a sport management firm in SA and i moved there then later took my wife and child with me in 2011. We travelled to the UK in 2013. We tried applying for a US Visa Visa in 2013 and 2014 as tourist but we were refused do to loss of memory on my side as i did forgot to mention that i was refused in 2002 and this counted against us in 2013 and 2014 i suppose.

Later, I got a Schengen Visa to attend an IT conference in Poland which also gave birth to our securing another Schengen Visa for my Family to visit France for the 2014 December holidays to resume work in January 2015.

Without further Ado, i was approved from work to attend a conference in the United Kingdom on IT and i applied alone again for the US visa only to be given a blue form (Form 221(g) herewith attached) that i will be called upon that further verification/investigations needed to be done on my case and this makes me so concerned as i do not know what this really means.

Please i implore you to further explain as to what and why this might be happening in my case and what outcome should i expect. The form is attached.

If you want a USA visa, concentrate on how you will answer questions convincingly. Trust me, documents are the last thing you should worry about.

Don't fumble when you answer questions. Look straight into the eyes of the interviewer.

If you believe the reason for refusal was because you are single or you have no previous travel history. Then, the only logical thing to do is reapply either when you have married or after traveling out of Nigeria to other countries.

As for your contact getting in touch with the embassy, that stuff don't work anymore. Except your contact works in the White house.

I guess where the problem from is that am single and no travel experience. So when I told my Aunt that I was deny, she ask me to reapply that she will contact the embassy a day before my neXt interview date.

All I need from you guru's is how soon can I reapply, because am going for Easter vacation. And can anybody help me with the embassy contact.

If you can show you can pay the delivery expenses without resorting to public health benefits meant for Canadians and Landed Immigrants, you don't have anything to worry about.

Delivery related expenses is very expensive. Just so you know.

Am no guru.

Her getting it depends on a lot of factors. Has she traveled before? Where? For how long? When were the trips made? Is she married? Has she got kids in Nigeria? How long has she been working? How much does she earn? Has she got assets in nigeria? Does she have history as a tourist? What's her itinerary in Canada like? Does she know anyone in Canada? If its first time out of Nigeria, why opt for Canada?

All documents she present must answer the above questions. Questions not exhaustive. Canada visit visa isn't easy to get but its possible. You have to prepare well.

1. Securing beds…in Economy Class!There’s a game Nigerian passengers play whenever they’re on-board a semi-full airplane – It’s kind of similar to Musical Chairs…but without the music. Passengers snub the seats assigned to them and scout for a stretch of three to four empty seats before take-off. Handbags and other luggage items are strategically placed on empty seats in the hope for that Business Class experience – pathetic.

2. Making dramatic Nollywood scenes.Whoever said ‘Rules are meant to be broken’ must have been a Nigerian. We’re pretty damn good at breaking rules…into smithereens, just for good measure. There was one woman sat at the front of economy class with her less-than-a-year-old baby. She put her baby down on the empty seat next to her when the seat belt light was off (not sure if that’s proper in the first place but I’ll let her off on that one). The moment the seat belt light was back on, however, one of the air hostesses called her to order and told her to strap her baby in place – RED ALERT! RED ALERT! MAY DAY! MAY DAY! You knew from the way the irritated mother turned her neck with that ‘oh-no-you-didn’t’ expression all over her face that cabin pressure was under serious threat. Needless today she told the air hostess to mind her own business – ironically, that’s what the air-hostess was trying to do in the first place…Safety of passengers…DUH! I can’t remember if the thud I heard later on was due to turbulence or because the baby had rolled off the chair…

3. Taking pictures.You can imagine trying to enjoy a good book when suddenly the corner of your eye picks up the flash photography of some newbie whose obviously hell-bent on convincing everyone back in Nigeria that he/she indeed travel abroad. Newsflash! There may be people with photosensitive epilepsy on-board or nearby pilots wondering if there is a terrorist hijacking, with one unfortunate Nigerian who decided to break one simple rule ‘DON’T MOVE!’ (go figure!)

4. Farting.It’s bad enough you left your assigned seat at the front and decided to come behind me and stretch yourself across four empty seats. Now you’re so generous as to share your flatulence with me in small doses of ammonia-laced farts…not a one-off…periodic discharges which could catch choke me unawares if I dare yawn. FYI, avoid fizzy drinks on the plane if you know you can’t handle your abdominal tract like few pros among us.

5.Drink to stupor.Is it the sheer pettiness of wanting to get one’s money’s worth that would make a passenger drink like a fish? (Remember, its Nigerians we’re talking about here). Of course, it’s not the drinking that bothers me but the mindless banter and laughter at completely ‘unfunny’ things that drives me up the Berlin wall (just like that – after a couple of drinks you’d be in stitches when you read ‘drive me up the berlin wall’).

6. Leaving toilets unlocked.Common sense consistently fails to prevail when most Nigerians use the airline’s restrooms. It all boils down to refusing to acknowledge the instructions/directions carefully displayed all around them. It’s quite simple – you enter the restroom and close it behind you. Right there on door is a slide lock which denotes ‘Slide left to lock and right to open’. Why wouldn’t I be interested in making sure that no one accidentally sees my ‘bits’? Didn’t they notice the green ‘vacant’ or the red ‘occupied’ sign before entering the lavatory? At my last count I’ve walked in on 3 unfortunate passengers who forgot to lock behind (but they all did once I exposed them…makes you wonder, eh?).

7. Sitting ovation.I’m not sure if you can relate but you’re nearing your flight destination and as soon as the plane lands successfully passengers around you start to clap until virtually everyone joins in. Why are they doing this, you ask? beats me – for landing safely or for not crashing into the deep blue sea or for getting their money’s worth after usurping the mini bar…I dunno. The clapping is cheesy in my opinion. I’d much prefer passengers go one by one to shake the pilot(s) for a job well done plane well-landed.

And coming in at a surprise number 8 is Irregular exercise. Make no mistake about it, Nigerians are terrified about premature death, more so than the average civilian (if that makes any sense). I’ve seen the most bizarre repetitions performed from kicking mid-air to punching only your left arm over the seat head in the same direction. Deep Vein thrombosis is no laughing matter so I guess all I have to do is close my eyes next time if I don’t want to behold seemingly amateurish ‘Kung-fu’.

If you already have a visitors visa, you can travel as a visitor. Once you are in the country as a visitor, apply for your open work permit inland. You will be advised how and where to do your medicals by CIC. Also, write a letter you would want a visitor record for the kids. I know its issued at POE's but you will be advised how to get that.

You really dont have anything to worry about as long as your TRV is valid.

You should have applied for your OPW from Nigeria. It would have saved you all the worries. But you will get it as long as your spouse is enrolled full time in a designated learning institution, has a valid study permit and you can show this.

This is how it works bro. As a spouse of a foreign student in Canada, you are eligible for a OWP. However, at time of application, you must demonstrate your spouse is enrolled as a full time student in a designated learning institution.

Now that you have a visit visa, when you get to any Canada POE, do not say you want a work permit. Let the CBSA officer process you and your kids as visitors. If you ask for a work permit, even though you are eligible, you might be suspected as having not expressed true intention when you applied for the visit visa OUTLAND. You don't want that wahala trust me.

when you have been landed in Canada with your kids, you can now apply for an open work permit INLAND without having to leave the country. Its perfectly legal and it will be approved if you can paragraph 1 of this response. INLAND applications arr processed quickly too.

yes your 4yr old will be allowed to attend school without study permit. However, you might require a visitor record for that.

Observe the rules. If you want to work, apply for a Work Visa. Nothing stops you from doing that if you are eligible.

A visitors visa (B or V) is for visit purpose only. You shouldn't seek employment with that.

Thanks bro for the great advice ,am already working on getting invitation from an old friend in Canada. Please how soon can I reapply that it won't look desperate?though the said I can reaply if my story change or have new documents to summit. Do I need any letter of explanations to back the new invitation letter..

What are your ties to Nigeria? Are you married? Do you have kids? Do you have a job with good and fat pay? Do you have properties in your name? Are you involved in any notable community or social activity that requires your presence all year round?

If your application does not convince the VO you will leave Canada, don't waste your time.

You have demonstrated through your application that you can't take care of the expenses you will incure. Don't risk a 2nd application until you have a very good reason to visit.

There are rules my friend and we are obligated to observe them. Visitors' visas are for Visitors - people who don't have taking up employment in Canada as their primary objective.

You may apply as an artist for artist visa or seek asylum. You should do both outland and not when you get there.

Don't let the need for survival compound your issues. Follow the rules like millions of people around the world are doing. Yours isn't the worst or only case.

A friend is helping me out with a conference visa for canada and i want to know my chances of survival.Because right here in Nigeria i earn 80-90k per month but spends almost 20k+ on tansport alone u can imagine the rest.so i want something better.he said i will be given a 3 months or 6 months visa but i don't plan coming back to be frank with u.i am being so real and raw about the whole thing to enable u advice according.i have a degree certificate as well as HSE professional certificate which i know might not have much value there.i also have skills in music.i play sax,keyboard(not much of a proffesional sha) and i am a very good vocalist A1.i want to know my chances of survival and also i want to know if i can make my stay legal within a short.how much do people make out there playing sax and music stuff.is it lucrative out dere.
