passionup: Guys, I have a similar issue. Had overstayed for 1yr 9months and used a fresh passport when coming back. I was fingerprinted at gatwick as I told immigration that my previous passport was lost and I had to get a new onw to travel at my cost. Came back to nigeria and reapplied. I had added my initial passport to my visa application which I had gotten it stamped here in lagos but didn't add the passport I returned with when re-applying. They refused me, banned me for one year and asked me what happened to the passport I came back with and how come my previous passport that I declared missing has resurfaced in nigeria with an entry stamp on it. I was at a loss as to how to answer those questions. I was banned for one year and at the end of the ban period, I reapplied again and I was refused with the same reasons as to what happened to my previous passports and the entry stamp which I haven't till date been able to explain out. I need solutions to my dilemma now. Who has solutions for me now as I need a british visa asap now. Who knows a strong and influential immigration attorney that can handle this case? I need referrals pls. Someone shd kindly help. Thanl you and expecting to hear your opinions.
Friend, your ban is not for one year, but for eleven years.
You got a one year ban for overstaying in the UK, and then another ten years ban for the use of deception by which you made a false declaration that your passport was lost, and then you had it fraudulently stamped for deceptive purpose.

I applied for uk tourist visa and the application was denied due to the following reasons.
You have declared no friend or family in the UK and state that you will stay at a motorway hotel. I recognise that you submitted reservation for the hotel.however this hotel is many miles away from central london, is not situated near any tourist attractions or has access to public transport. Additonally, I notice that you have not given any details of how you intetnd to travel from the hotel to the choosen destinations on a daily basis or that you have the means to cover the cost of travel whilist it is not a prerequisite I would have expected you to submit evidence of plans made in the uk and evidence of your intention whilist there. This has undermine your intentions and am not satisfied that your circumstance in nigeria as stated. Therefore, am not statisfied under the balance of probabil. Bla bla bla.
Please advice on what to do next? Should I re-apply or go for administrative review. Am married with two kids.
It is always advisable to have good knowledge of a place before applying for a visa to visit the place: if you knew that the hotel is a long distance from the place where most of your activities would be taking place, you wouldn't have used it for visa application.
Yes, there are some very good hotels situated in isolated areas (in fact, some of the best hotels with highest stars are usually located away from town/city centres) but know that the occupants of such hotels usually have transportation means arranged and they often go in groups or they join one, and their schedules and programmes are usually arranged by travel agents. But in your case, you booked for a hotel in a distant area, and yet, you have no provision for mobility, that alone suggests that you do not have enough knowledge of the place that you claimed you would be seeing neither do you know the location of your hotel, and yet, you have no obvious arrangement in place:
Administrative review would be a waste of time because, the Visa Officer is very reasonable in refusing your application: it is your own error. If you must re-apply, correct the errors.

@naira_man: If you apply for another visa, you will be automatically refused under their general reasons for refusal i.e u've overstayed more than 28 days,most times the ban will start from the date you re-apply, whenever that is, and not from the date you return (vicjustice pls confirm?)....if you don't declare your previous visit, they will ask you what happened to your previous passport,you are required to give details of all ur previous passports, if you say that the current passport is your first, they will ask you how you got to the UK to obtain another passport since your place of birth is Nigeria (which you would have indicated on the form)and the place of issue of your passport is UK.
In my opinion your best option is to apply for entry clearance, tell them the truth, they will refuse you (see the application fee as your fine for overstaying), and the ban will start, after the expiration of the ban you can now re-apply and they will now consider that application on its own merit.

Know that the visa officer is not going to hurry up the process just to meet your schedules.
My friend, your circumstances are too hasty, and this is not how to apply for a visa.

Do you mean that you intend to submit your application on Thursday the 29th with the entered date of travel as December 11th? If so, that would be way too tight.
As for the flight reservation, that is not necessary.

There are neither rules nor regulations regarding the date of travel, and you are not obliged to travel on the exact day that you entered on the application form, that question is just a senseless formality.
But it is reasonable to enter a (not-too-near) date because, you are advised to allow the embassy enough time to process your application to avoid being refused the visa for reason of tight schedule

Irish visa usually takes 2 months and they usually don't get in touch with you until the second month.

Though, not always the case, but it is generally easier to be refused a visa than to approve it: delay is often a positive sign that an application is given a consideration for approval since it takes only an instant to refuse a visa. So, relax.

Are you saying there's no chance at all once you are still a student?
There is a chance for a student to get a tourist visa, there is no where in the regulation that suggests student shouldn't be given a tourist visa. But yet, the regulation says that even if an applicant is able to meet every requirement, the Visa Officer still reserves every prerogative to deny him/her a visa by virtue of his own initiative.
And given that only a few of the single people applying for tourist visa intend to return to Nigeria after travelling abroad, it is logical for Visa Officers to issue visas only to applicants who are able to demonstrate their home ties or (obligations to return to Nigeria for) beyond reasonable doubts; but unfortunately, students often find it difficult to prove ties/obligations: and sadly, their education or schools are not deemed enough hence it is extremely difficult for students to get tourists visa if they are not able to sponsor themselves

You have stated that your trip to the United Kingdom is to be sponsored by your mother, However, i must take into account your personal and economic circumstances in Nigeria when coming to my decision.

You have stated that you are a studentand i acknowledge that you have submitted a letter from this institution confirming you are a student. However i note that the letter contains no details of when you are expected to graduate and you have submitted no evidence of fees payments. As such you have failed to establish that your circumstances are such that your departure from the United Kingdom would prove to be an attractive prospect at the end of your visit. Therefore i am not satisfied that you are seeking a genuine visit or that you intend to leave the UK at the end of your visiit.

You state that you will stay with your Uncle in the uk at *ADDRESS* however you have not provided any evidence to suggest that you related as claimed, despite having the opportunity to do so. there are a number of documents that you could have submitted with your application to confirm your relationship. In the abscence of such documents, i am not satisfied that he is your uncle and that he is genuinely prepated to accomodate you. Therefore i am not satisfied that you will be adequately maintained and accomodated whilst in the UK or that you are able to meet the cost of the onward journey.
These other thing about your uncle and maintenance (whilst in the UK) ane all secondary reasons for the refusal, you would still have been refused even if you provided overwhelming evidences to substantiate your relationship with your uncle: the primary reason for your refusal is the fact that YOU ARE AN ADULT WHO IS NOT ABLE TO SPONSOR HIMSELF, your parents sponsorship might have been acceptable had you been applying for a student visa, but as a tourist (or fun traveller), you need to be capable to sponsor yourself and to have somewhat of an obligation (or home ties) to return to Nigeria for.
As harsh as it might seem, i must encourage you to withdraw your reapplication plan because, I don't see how you can get through it if you applied again in your current circumstance.

Why are you looking for a short cut over something that take process?
If it is not mandatory for the company to pay taxes because it is new, wouldn't the company be demed ineligible to be used for visa application.
Why not let the company go through the normal regulation before applying for the visa?
Well, this is a Nigerian revenue matter, I'm not an expert in it

I am a business owner, and was refused entry clearance thus:

You state you re self employed as a ... for...since....and that u have a current monthly income of 190k from all sources. i am not satisfied that you have provided adequate evidence to substantiate this claim. though you have shown evidence of your employment, u have failed to show evidence of your income generated frm this business, e.g. income tax clearance for yourself and your company, etc, in support of the applicatn. In absense of such documents, i am not satisfied that your circumstances are as claimed....

I provided my company accounts, though my company was initially a sole proprietorship and was only incorporated as a limited liability abt 4 months ago. I didnt include any tax clearance cert, but i included tax payments receipts for myself, which, under d sole proprietorship structure, is also 4 d company. I failed to include payments receipts, no payslips(I am the oga, so i pay myself anyhow grin)etc, and did not explain how the company makes money. I have now obtained my company (the LTD) tax clearance, but this shows NIL earnings/Tax payments, cos d company is less than 6mths as a LTD, hence tax payments do not apply.

I want to reapply now, and will explain how the company makes money, and also attach all necessary evidence of payment from our clients, and all other sources. However, my state inland rev folks say i have to pay abt 170k for my personal income tax clearance cert. Can i reapply without this, if i properly include all other things? Cos i feel all they want is evidence of how the money comes in?

It is not only how the money comes in that they want to see, but rather also, (as a self employed owner of the company), the Visa Officer will be interested to see how genuine both you and the company are: and to prove your legitimacy, you must have up-to-date tax records otherwise, you would be considered as a business man in corruption.
I like to recommend that you apply for the visa in due time when you have the revenue paperworks.
If you have proper documentations and you have good taxes records, i see no reason why you'd be refused a visa.

Krucifax: There is now news here in the fact that most Nigerians as much as they'd hate to hear it are very backward people not far removed from beasts of the forest. Their so called education and church/mosque attendance has failed to impact reason in them.

Look at the commentators above as examples of what is wrong with Nigeria. They actually don't understand why you can't just kill somebody without any civil and judicial process. They don't understand what it means to be a human being and how normal human beings behave. This was a group action by all kinds of people from the community with no word of protest from anyone.

Few things a Human being would ask him or herself.

1. Is the accused Human and deserving of human treatment?
2. Can i prove without doubt the accused has committed said crime?
3. As per above how am i entitled to make above judgment?
4. What right do i have to kill another human without provocation and not in defense?
5. Do i have a moral conscience if so how can my actions be right?
6. Is the society in complete anarchy and without police, courts and prisons to justify my actions?
7. Is it possible that i may go to jail for my actions?

The above is non-exhaustive and can be written on many things Nigerians do that can be titled The Average Nigerian vs Normal Human Beings!

state some lovely place to visit with ur sister and stated that ur sister will get u bus pass and take u arround during ur stay
Yes, the monthly income is not bad, but that doesn't represent "financial ties" because, his bank statement is not that financially imposing. However, a job that pays up to N136k monthly is enough to represent obligation (not "financial ties") to return to Nigeria for.
You talk about his sister taking responsibility for his welfare, but do you think that this is what the Visa Officer wants to hear?
How about his accommodation in the UK?
If you assume that his sister will provide that, have you considered whether she has suitable house to host a guest, do you know the nature of contract that she has with her landlord?
And if her sister's house does not meet the requirement, do you think he has enough money to pay hot hotel/lodging accommodation?

Man, we are talking of N864k, (though big money, but the Visa Officer who knows the value of Sterling won't see it so) even if it is available for use, the Visa Officer would not (be encouraged to) issue a visa to someone whose travel would ruin his entire savings and return to Nigeria broke?

tayoTFC: 3, ensure u request for ur bank statement in the bank and tell them the purpose so that it could be print on a letter headed paper for embassy purpose and stamp by appropriate authority

If you have other means of income and the sources pass through revenue office documentations, then it would be good to use them. But if you are getting your money in hand and you have no dealings with tax office, then, such fund is questionable and you would be seen as a corrupt business man.

She and her husband sent all the required documents . he has promised to sponsor everything from travel to money available etc. he is very okay in the uk. his closing balance is at 12k pounds. I want to know my chances, i have my contract, leave letter, id card, statement,i have been here for a yr and 3 months. I deposit the money given to me by my boss directly into my account and i put paid in by my company. They also transfer my salary to me via internet banking either from their personal account or company. Then i also receive money from my sisters at least 50K monthly and i have a house that was willed to me.My company also transfers hugh sums of money to me to make some transactions eg to get stock. how do i explain all these on my application.i have also been refused twice when i was in school because my sister and i have different fathers but the same mother

At this time, I have about 864k in my account as closing balance in my statement, going by this tread I noticed it sounds more like a crime to have that much considering my salary monthly, however, I do A̶̲̥̅ few sales apart from work. I sell african cothings in large scale part time, thus my balance as it nw seems my salary is untouched. Now, my question is, what do I fo to ensure this doesn't count against me considering my previous refusal. What do you suggest I do. I inheritted A̶̲̥̅ small shopping mall where I get rent from, although the finance does not go to this account I am using to apply, what are your thoughts as to my presentation and how best do you think I package it considering I intend applying myself and sponsoring my self this time.. You really do think that 864k is "that much"?
Well, there is a high chance that you will be refused the visa on financial ground because, the visa officer would not believe that you are willing to spend your entire savings for a trip to the UK and then return to Nigeria in poverty

Though your record will be looked into, but your spouse visa application will be treated in its own merit.
Now, you need to get over your past and concentrate on how to prove to the home office that your marriage is not one of convenience which is designed to get you back into the UK: if you are able to prove this, then, your wife's citizen rights as well as your rights as a spouse of a UK citizen would prevail with time.

Noswaa: pls vicjustice and justwise,i really need your attention here,i applied for Canada study permit earlier this year and i was refused,i am married with one kid and i presented all the necessary documents only that my employer and he is also my cousin is my sponsor and he used company account and my personal account,the reason for the denial was that i have no fund to cover the cost of my study without working in Canada and that i will not return to Nigeria after my studies,i secured admission to study bsc in economics to start from 3rd year,because i have bsc in education economics and i work as marketing executive.i submitted my company sponsorship letter,affidavit of sponsorship,company documents and statement of account,then i submitted all my credentials,good gpa,pay slip,statement of account as co sponsor with my husband,marriage cert,birth cert,nysc cert,award letters etc.Now i want to reapply and my husband will be my sponsor,he is a Doctor but he is not practicing in Nigeria,and i wish to change my course to any business course on pgd level,the course will be for 1 year program and my husband statement of account will be above 4million by the time i will reapply but it may not exceed 5 million, pls tell me the exact thing you think we should present to the embassy because i think we may have almost all of them now,thank you
I regret to say that I do not fancy making list of documents to every visa applicant... this info had been given over and over and over again, and besides, the lists are available in embassy's website.
You were obviously refused the visa because the person and the sector that you used as sponsors are not appropriate to be be considered liable for your responsibility. But with your husband (as your sponsor this time) you stand a better chance unless the visa officer judges that your studies might have great impact on your husband's finance.

If you are not a prisoner or someone with governmental restrictions, how would a government office be involved in your personal decision to invite whoever you wish to visit you?

My previous immigration history was spoiled for reasons I will explain to you. I came to the UK in 2009 to study at northop University; it started really well and then went downhill, as i will explain to you. My studies were due to start September 2009; unfortunately I didn’t arrive in the UK till October 2009 due to visa delay. When I went to the university to sort my accommodation out, I was told that it wasn’t ready yet, which resulted in me waiting 3 months. In that time I stayed at a friend’s house, which was not ideal and worried me more with my accommodation situation. My first year at university went very well and I had handed all my assignments in on time, i later found out that I had failed a few subjects, which was very disappointing. After having a conversation with the university they agreed to let me repeat the year, 2011-2012. During that year in February I met my girlfriend rachel, which turned out to be the best thing that had ever happened to me. Unfortunately my studies did not go so well. I failed to hand in a few assignments on time in to university. At that time I had a lot of family problems happening in Sri Lanka, which is no excuse but at the time I just could not concentrate fully on my studies, I did inform the university of my problems, which they replied that I should just try my best. On the 15th of September 2011 I went to my homeland of Sri Lanka for a holiday, to which I had a letter from the university giving me clearance to come back to the UK to study. While I was in Sri Lanka I had received a letter from the university saying that I had failed my course and that there was no chance that I could resist the course. I was devastated, not only did I want to carry my studies on but also wanted to carry on seeing my girlfriend rach. I made the decision to come back to the UK to try and sort my studies out. I met with the university to discuss my situation, but they said there was no chance. At this decision I’m sure you can understand I was devastated. I tried to apply to other universities with no luck unfortunately. During this whole time mine and Stephanie relationship had become a serious relationship, she has helped me throughout the whole upsetting situation, I don’t know how I could have got through it without her. She is my rock. I got very stressed and depressed at the fact I could not get in to another University, it was a very hard time in my life. When rach asked me to move in to her 2 bedroom house with her and her daughter shasha , I couldn’t have been happier, it lifted my spirits. I moved in to the house on the 10th of November 2011. With being stressed and depressed, then going to feeling happy to have moved in with the woman of my dreams, I forgot to change my old address. Through this whole time we tried to find different collages and universities, rachel was very helpful with this matter, we later found out that we were late for the academic year. On the 12th of February 2011 I proposed marriage to my lovely Stephanie; I was so very happy when she said yes, it was the best and happiest feeling I’ve ever had in my entire life, being with rachel has changed my life. My visa was valid until 31st of January 2013, but decided to go back early to organise our wedding, i left on the 9th of April 2011. When I first came to the UK in 2009 it was never my intension to meet anyone, but meeting rachel has been the best life changing experience I have ever had, I’ve never felt this kind of love for anyone, and I wouldn’t change it for the world. Throughout my entire time I was trying my hardest to find another college or university I putmy whole effort in to finding one that would give me a chance. Unfortunately that was useless. I realise I have breached the rules, and I have done that without realising it, I had some much on my mind with trying to sort out my university as soon as possible, my family problems was a lot for me to handle. All I can say is that I really apologise about what happened and promise I will never breach or break the rules again.

On the 15th of October 2012 after spending six months apart from Rachel and shasha, they came to Sri Lanka for our wedding which took place on the 20th of October 2011. Unfortunately rachel family could not join us on our special day, which upset rachel a lot, but my family were there to make her feel at home. Our marriage ceremony was held at my beautiful home, with 20 of my family and a few close friends. It was the best day of our lives, after the ceremony we went to a hotel for the night which was a lovely surprise for rachel and shasha. rachel and shasha stayed for 2 weeks and during this time we did lot of fun days out. On the 31st of October 2011 rachel and shasha left Sri Lanka to go back to the UK. It was a very sad time for all of us, the worst feeling that my new wife had to leave me. All my family were very upset also, as they had grown close to both shasha and rachel, they love them so much. Everyday I spend away from my wife breaks my heart a little. rachel and shasha are my life now, I want to settle down and spend the rest of my life with them, I have never experience this kind of love and I am never going to give it up. I now feel my life is complete.

Not intending to be discouraging, but if you ask me, I'd say too many irrelevant contexts, this is more of a romance essay than a formal letter to an official authority, in my opinion, there's is no need for these extra romance details.
By the way, who is Stephanie and who is Rachael? I got confused.

kachy: It is being reported that at least 60 Nigerians resident in the United Kingdom have been deported because of various criminal offences. While some of the deportees had contravened immigration rules, others were deported for their involvement in crimes such as rape, stealing, smoking and selling of hard drugs. Some were also deported because they  used fake visa or engaged in fake marriages.

Some of the deportees at the airport said they had lived in the UK for long but could not get residence permit. They narrated their experiences to PM News and gave reasons for their deportation.

Bathlomew Sunday, an indigene of Anambra State, southeast Nigeria, said that he lived in UK for nine years but could not get residence permit. Sunday said he had to engage in a contract marriage to get the permit but was later caught by the British immigration, which deported him to Nigeria. He said he was not allowed to take any of his possessions before he was deported, adding that it was at the airport that he discovered other Nigerians were also deported. Sunday explained that the British government made it difficult for immigrants, especially Nigerians, to get residence permit, saying that they didn’t plan to stay there illegally.

Another deportee, Daniel Uche, who hails from Enugu State, said that the global economic meltdown has made it difficult to get jobs in the UK, thus many Nigerians are struggling to survive. Uche said there are no jobs for foreigners in UK, and to survive, many engage in shady businesses.

Also, Peter Nkwocha from Delta State said he travelled to UK about seven years ago, but he was arrested and later deported because he was wrongly accused of rape. Though he said he denied the allegation, he was arrested and later deported when the British authorities discovered he had a ‘contract’ marriage during investigation.

From their accounts, it is clear that they knew they had committed some offences – staying in UK illegally without residence permit, having ‘contract’ marriages, engaging in shady businesses and more. Isn’t it sad that Nigerians have to resort to committing such crimes just because they want to live in foreign countries such as the UK.
