Politics › Re: NIN-SIM Linkage: Buhari Dragged To Court Over Blocked Lines by zoedew: 5:53am On Apr 25, 2022
adenigga:
President Muhammadu Buhari has been dragged to court over his failure to order the unblocking of millions of unregistered lines.

Naija News recalls that the Federal Government had directed telecommunications companies to block outgoing calls on all lines not linked to the National Identification Number (NIN) as of March 31.

Following the directive, the Socio-Economic Rights and Accountability Project (SERAP) issued a 48-hour ultimatum to the Federal Government to unblock millions of unregistered lines.

In the suit number FHC/L/CS/711/2022 filed at the Federal High Court in Lagos, SERAP sought an order to set aside the directive by Buhari to telecommunications companies to block outgoing calls on all unlinked lines without due process of law.

SERAP joined the Attorney General of the Federation and Minister of Justice, Abubakar Malami, and his Communications and Digital Economy counterpart, Isa Pantami as respondents in the suit.

“While Nigerian authorities have a legal responsibility to protect, ensure and secure the rights to life and property, any such responsibility ought to be discharged in conformity with human rights standards.

“Fundamental rights are regarded as part of human rights and are protected to enhance human dignity and liberty.

“Unblocking the phone lines unlawfully barred from making calls would improve respect for the rule of law, and ensure people’s right to freedom of expression, and access to information, as well as their right to associate with others.

“The blocking of people from making calls constitutes impermissible restrictions on the rights to freedom of expression, information, and association.

“The rights to freedom of opinion and expression and access to information are protected under section 39 of the Nigerian Constitution, article 19 of the International Covenant on Civil and Political Rights and article 9 of the African Charter on Human and Peoples’ Rights (Ratification and Enforcement) Act.

“These rights must be protected online as they are protected offline. Any restriction on these rights must be provided by law, be necessary for a democratic society and serve a legitimate aim.

“The blocking of people from making calls on their SIMs also amounts to arbitrary or unlawful interference with their right to family life, and socio-economic rights, as it unnecessarily or disproportionately interferes with these fundamental human rights.

“The decision to block the phone lines also appears to be arbitrary and lacks any legal framework, independent and judicial oversight. This may allow authorities to act in an unfettered and potentially arbitrary or unlawful manner.

“Under international human rights law, States including Nigeria ‘shall not engage in or condone any disruption of access to digital technologies for segments of the public or an entire population.’ States must refrain from cutting off access to telecommunications services.

“Millions of Nigerians including persons with disabilities, elderly citizens, persons living in remote areas have been unable to capture their biometrics, and obtain their NINs due to logistical challenges, administrative and bureaucratic burdens, as well as the persistent collapse of the national grid.

“The rights to freedom of expression, access to information, and freedom of association, whether offline or online, promote the democratic ideal by allowing citizens to voice their concerns, challenge governmental institutions, and hold the government accountable for its actions.”

The rights are not absolute! Why did the millions not link their lines within time.

Whenever we talk about a pilot who has been killed in a flying accident, we should all keep one thing in mind. He called upon the sum of all his knowledge and made a judgment. He believed it so strongly that he knowingly bet his life on it. That his judgment was faulty was a tragedy, not stupidity. Every instructor, supervisor, and contemporary who ever spoke to him had an opportunity to influence his judgment, so a little of all of us goes with every pilot we lose.
Very true.

This piece is dead on arrival. Who makes the decision on every policy in government under the 1999 Constitution is Buhari and not Osinbajo. Osinbajo loses nothing if he does not get to be President. He is not desperate to be President. Rather it is Tinubu who is desperate to be President. The desperate will masquerade to fulfil their aspiration!

An interim government is unknown to law, so it will be treated exactly like the Shonekan experiment - declared null and void by the courts. And subsequently, the military will be justified to take over.
It may not be known to law but it is not unknown to the military barracks! Shine your eyes Sir!

We shouldn’t have a military coup with soldiers Ruling for six months while the suggested constitution is put in place. I fully support allowances instead of salaries and humongous perks. Each legislator should be entitled to one million Naira annually as allowances, transport and welfare to Abuja for the five sittings in the year in a unicameral house. Politics will be left for the serious minded. If we are serious about running a good country that’s the way to go.

So every Ukrainians are deserving of good treats and good farewell out of the falling Ukraine? While the blacks and other nationals get to find their own way to staying alive?

Isn't that racism when you give priorities to your color more than other colors?
Truth is, Ukrainians must get shipped out first. Others can come after. That is the truth though difficult to swallow. Anywhere in the world the citizens get saved first. The Law of self-preservation is observed when where you are become a jungle! Simon Ekpa in Finland causing trouble in SE Nigeria will soon know how it rolls when Finns get the heat from Putin and real Finns have to be safely evacuated elsewhere safe.

I guess DSS are still the one perpetrating this Evil act, when you speak they insult you instead of them to admit the Truth, they tell you things like “leave our region alone and face bandits”

Killings here and there all for freedom, not even security operative, killing your people again.
The other day one said it's a payback for what the NG soldiers did against the freedom agitators and inside my mind I smiled and shook my head, breeding and supporting terrorist just because you were hurt in the past.
This video bring back memories of the Biafra war, when children starved to death, when people were gunned down for no reason.
This is not the once peaceful East I used to know, it's now a den of terrorist.
"This video bring back memories of the Biafra war, when children starved to death, when people were gunned down for no reason."
And Ojukwu ran away to Ivory Coast. Ojukwu later returned to a State pardon and eventual burial from Nigeria. His wife Bianca has since benefitted from Nigeria getting an ambassadorial appointment! Ojukwu's children are in the best schools money can get in Nigeria(?) and overseas. The Igbo don't seem to have learnt much from history. These days one Ekpa who lives offshore in Finland co-ordinates mindless killings and critical disturbance of the Igbo society in the South-East of Nigeria in the name of achieving Biafra. Nnamdi Kanu ran off like Ojukwu did and was eventually lured and captured in another country by Nigerian security agents. Azikiwe also stylishly left the Igbo to their fate and eventually got a State burial by Nigeria. All Azikiwe children fare well with one particularly a lifetime resident of a prominent five star hotel in Lagos. The Igbo must fight for Biafra by following credible leaders who share in the suffering of the people in the bid to achieve self-determination. Enough said!
