There can ONLY be factions in political part if d factions are recognized by INEC (and INEC hv come out to clearly state that they do not recognize any faction in PDP and only deal with Tukur's NWC). Moreover, a court already declared that there is NO FACTION in PDP- that is d subsisting Legal and therefore ONLY situation until another higher court discharges the order. Those people who just left or wud leave PDP decamped as INDIVIDUALS in d eyes of both d law and INEC; and d law says that they MUST vacant their seats if they are Legislators. Do I need to tell you that d PDP wud MAKE SURE that this wud happened? Bamanga Tukur already told them that. Just watch as d real politics begin...

Managing Factional Crises
Constitutional provisions such as the aforementioned seem clearly meant to manage factional crises in political parties, like the current one involving PDP, New PDP, and the members of the National Assembly and the about seven governors that have identified with the splinter group.
This aspect of the constitution has been used by political office holders as a basis to dump their parties and still retain their positions.
But now, questions are being asked as to what constitutes a division or faction in a political party, and who determines whether a faction exists or not in a party, among other issues. These are questions for the courts to determine. But the split in the PDP presents an interesting scenario'' #copied

In Adamawa, Rivers, Kano PDP will clear the seats. Especially Rivers.
Niger and Jigawa are still a doubt for APC.

INEC’s Position on PDP crisis:

INEC, in its response to an earlier letter by the faction’s national secretary, Olagunsoye Oyinlola, dated October 2, a copy of which was obtained by THISDAY yesterday, affirmed its recognition of Tukur as the authentic leader of the PDP’s National Working Committee (NWC).

According to the INEC letter with the title “Notification of change in the leadership of PDP and request for formal recognition,” it stated: “The commission acknowledges the receipt of your letter dated September 1 and 23, 2013, respectively wherein you requested the commission’s recognition of the Abubakar Baraje faction of the newly elected National Working Committee.

“You will recall the commission monitored the national convention and the special national convention of the PDP held on March 12, 2012 and August 31, 2013 respectively which took place at the Eagle Square Abuja, after notices to the commission. A National Working Committee was elected at the two conventions wherein Alhaji Bamanga Tukur emerged as the national chairman,” adding that: “The commission will not withdraw its recognition of the leadership of the PDP elected at the election duly monitored by the commission.”

By INEC refusing to withdraw recognition to the Tukur-led PDP, it has actually put paid to the issue of faction, thus legitimizing the Tukur NWC. Whether this is the end of the road for the nPDP is another thing altogether. But INEC as the regulatory body for political parties has issued the nPDP a red card and have been sent out of the political field of play.

And the Court Decision

From the legal front and in response to a legal suit filed by the nPDP in Lagos, Justice Oludotun Adefope-Okojie of the Ikeja High Court, struck out the suit filed by the Baraje PDP faction against Tukur and three others, for want of jurisdiction.

The breakaway faction of the party had asked the court to stop Tukur and other officers of the party from parading themselves as national officers of the PDP pending the determination of the case. The plaintiffs in the suit are Baraje, new PDP Deputy National Chairman, Dr. Sam Sam Jaja,  Oyinlola and the PDP, while the defendants joined alongside Tukur are the Deputy National Chairman, Mr. Uche Secondus; Women Leader, Dr. Kema Chikwe and National Publicity Secretary, Mr. Olisa Metuh.

Tukur and his co-defendants had in their preliminary notice of objection filed through their counsel, Chief Joe Kyari-Gadzama (SAN) and Mr. Emeka Etiaba, on September 18, asked the court to strike out the suit for want of jurisdiction. The lawyers had also argued that the writs of summons did not comply with the mandatory requirements of Section 97 of the Sheriff and Civil Process Act because they were not signed.

But counsel to the claimants, Mr. Robert Emukpaeruo, had argued that the court had jurisdiction to entertain the suit contrary to the objections being raised by the defendants.

In his ruling, Adefope-Okojie held that the Lagos State High Court had no power to assume jurisdiction over a matter which originated outside its territory. The judge said the applicants had averred in their affidavit that the course of action, which was the special convention of the PDP took place  in Abuja.

According to the judge, the plaintiff had also averred that the PDP had its registered office in Abuja and that none of the defendants was resident in Lagos State. In view of this, the Judge said the doctrine of enforcement of judgments was not relevant to the suit before the court.

Adefope-Okojie summed her ruling thus: "I hold that with the defendants not resident in Lagos and the subject matter originating in Abuja, the High Court of Lagos State has no power to assume jurisdiction over this suit."

As a result of this, a red card may have though been given to the nPDP by the court, unlike INEC position; there could be an appeal or a fresh case filed within the Abuja where all the combatants reside.

Their seats cannot be constitutionally rendered vacant. I expect additional defection from the house and senate in coming days. I'm sorry to say that GEJ's days are numbered.

You must have some illusion about the geographical area and the people of the North. If you are thinking the north is Kano and Sokoto or Hausa/Fulani you have a lot to learn. Let me remind you that what you refer to as the North comprise of Taraba, Gombe, Benue, Plateau, Kaduna, Kogi, Kwara, Niger and Adamawa all of which have sizable population of Christians and minority tribes who don't give a damn about the call for a return of power to the north because it won't serve their interests. It has never been in their interest and they are no fools!

Jonathan will only be a fool by not exploiting this obvious divide in the north. A strategists would tell him the home truth - to forget about Kano and Sokoto. He can never win there! If I were him, I will start right now to pump money and empower people in these aforementioned "swing" states, give them juicy political appointments and court their leaders - both political and traditional. He has all the oil money to buy anybody. Goodluck to him sha.

payless: Jonathan is about to be consumed by his lack of political width and charisma. He is being led by sycophants who don't really mean well for him except for their pockets. I expect Tambuwal and other Northern legislators to declare for APC by February. This should confirm why I said many times that PDP is a Northern party that is supported by some southern slaves mostly based in South-east and South-south. The Nigerian Constitution favours the North more than any other region because, the North dominates the National Assembly; in terms of number. There are more than 68% of PDP legislators in the House of Representatives and Senate. I expect these Northern PDP legislators to desert PDP and move to APC. Jonathan will be left with Akpabio, Orji, Obi, Mimiko, Elechi, Chime and the governor of Cross-River State, Bamanga Tukur, Anenih, Okupe, Gulak, Abati and few others.........

One thing that I know is that, you don't fight the North politically. It is never advisable to let the North have a common enemy. When you fight the North, they tend to come together and fight their opponents regardless of their party affiliations. All the Northern Governors who claim to be in support of Jonathan are currently under pressure to dump Jonathan. Governor of Bauchi and Katsina will be put under a lot of pressure by Emirs and Sultan to dump Jonathan by end of next year. These governors will definitely dump him. Normally, the Northern elites do not favor Buhari but they are ready to support Buhari to get there and deprive Jonathan the second term he so much crave. The North has been threatened by Jonathan utterances of "Igbos are my back bone" "the votes I got from the North only came from Igbos". Those utterances were wrong by the President of Nigeria. As a a matter of fact, it was Sultan of Sokoto and some Emirs who declared support for Jonathan in the North when IBB, Atiku, Adamu Ciroma and others were giving Jonathan tough time. This was at the time of tension in the North in 2011.

The goal of the North is to get anyone from their region elected as President. It doesn't matter who that person eventually is.

Jonathan and his political rookies have woken up a sleeping giant.
God bless you: no wonder is planning to bribe about 700 northearner for his second time ambitions according to gov Aliyu Babangida of Niger state.

What is wrong with you people? Even Aturu himself acknowledges that any member of the house or senate can change parties, but unlike governors who can change parties at will, house members must show that there was division within their party. Anyone who believes that there is no division within PDP is very dishonest and stupid, or lives in Mars.


Listen to minute 1:46 of the video and hear Aturu say that all that is required is to show division within PDP for those non governors to switch parties without losing their seats or having them rendered vacant. Even if the legislators do not switch, they can still vote as they see fit. Either way, GEJ and PDP are finished. BTW: I'm tired of educating you people. Denial is normal in cases like this one where you see your world crashing down right in front of your eyes.

The division that must be shown is a legal evidence (recognized buy designated authorities e.g INEC) to prove that the party is divided already.

Not some rofo-rofo media stunt.
It's even funny when the media houses say APC "merged" with New PDP.
Is there a party called new PDP?
They are trying to avoid the terms "decamp" or "defect to" but they are not smart enough.

You will find that these guys , despite being conventionally educated, will always lack political sophistication because their clannish nature and ethno-religious prejudice against others will perpetually prevent them from appreciating what politics, a game of numbers and alliances plus strategic planning, is all about.

We are seeing politics playing out before ours yet some naff and politically gauche 'throwbacks' prefer going around shouting "boko/Yoruba" Party, "Yorobu and aboki gang-up" and other such illiterate and prejudiced drivel.

I really pity some people and how their mental 'stumbling blocks' (divisiveness, prejudice, ethno-religious jingoism, paranoia, persecution complex et al) will always prevent them from seeing what matters .

are PDP members. There are small parties
like the Labour Party, a faction of APGA
and the Accord Party.
“What does this tell you about which party
will control the House?
“Again, more members will likely defect in
the days ahead; anything is bound to
happen.”
The PUNCH gathered that the PDP
originally had 208 members before the
crisis, out of which 57 joined the New
PDP.
The leader of the defunct New PDP, Mr.
Andrew Uchendu, had claimed that the
membership was actually up to 100.
“We are more than 57; there are more that
are behind the scene.
“We are up to 100,” he had claimed.
A National Assembly official said, “If you
take Uchendu’s position, it means the APC
will have 237 members in the House.
“That is more good tidings for the
opposition in terms of which party will be in
control.”
There were doubts on Tuesday over which
side of the divide the Speaker, Mr. Aminu
Tambuwal, belonged.
His home state governor, Aliyu Wamakko
of Sokoto State, is one of the seven rebel
governors.
The speaker has been evading taking a
categorical stance on the crisis since it
broke out.

I expect Tambuwal and other Northern legislators to declare for APC by February. This should confirm why I said many times that PDP is a Northern party that is supported by some southern slaves mostly based in South-east and South-south. The Nigerian Constitution favours the North more than any other region because, the North dominates the National Assembly; in terms of number. There are more than 68% of PDP legislators in the House of Representatives and Senate. I expect these Northern PDP legislators to desert PDP and move to APC. Jonathan will be left with Akpabio, Orji, Obi, Mimiko, Elechi, Chime and the governor of Cross-River State, Bamanga Tukur, Anenih, Okupe, Gulak, Abati and few others.........

One thing that I know is that, you don't fight the North politically. It is never advisable to let the North have a common enemy. When you fight the North, they tend to come together and fight their opponents regardless of their party affiliations. All the Northern Governors who claim to be in support of Jonathan are currently under pressure to dump Jonathan. Governor of Bauchi and Katsina will be put under a lot of pressure by Emirs and Sultan to dump Jonathan by end of next year. These governors will definitely dump him. Normally, the Northern elites do not favor Buhari but they are ready to support Buhari to get there and deprive Jonathan the second term he so much crave. The North has been threatened by Jonathan utterances of "Igbos are my back bone" "the votes I got from the North only came from Igbos". Those utterances were wrong by the President of Nigeria. As a a matter of fact, it was Sultan of Sokoto and some Emirs who declared support for Jonathan in the North when IBB, Atiku, Adamu Ciroma and others were giving Jonathan tough time. This was at the time of tension in the North in 2011.

The goal of the North is to get anyone from their region elected as President. It doesn't matter who that person eventually is.

Jonathan and his political rookies have woken up a sleeping giant.
this is your opinion about the north. the north you see is not longer united and those you mentioned above include the emirs cannot determine the votes of the north. if they are, buhari will have won 2011 or rather atiku. regional and religion difference will always divide the north. watch and see how 2015 will surprise you.

This is a defining moment in the lives of Nigerians. These people mean business. They are are out in full force to nail Jonathan. Jonathan has done his worse and showed all his cards. It is too late for him now. Any abuse of power will be met with revolt and public sympathy for his victims. The House of Representatives breaking into APC hands will be the straw that finally broke the camel's back.

I expect Jonathan to exercise his best behaviours and go into dialogue with his opponents but I expect those Governors to rebuff him.
