Section 34(5)(b) of the Constitution allows the Police to DETAIN a suspect who has not been charged or arraigned before a court of law BEYOND the otherwise mandated 24 or 48 hours WITHOUT CHARGE in circumstances that would be deemed “reasonable” given the circumstances of the case. The NON-FUNCTIONING of courts due to the JUSUN strike would IMHO be one such circumstance. > |
