The Nigerian Army left their constitutional role as guardians of the territorial intergrity of Nigeria and assumed the role of assasins who invaded Abia to Kill Kanu and his suppoters on behalf of this APC government and silence all voice of dissent.

The dust is now settling with many legal minds declaring the invasion of the home of Nnamdi Kanu illegal and the branding of IPOB as a terror group unconstitutional.

Who or what, by the above definition, is the President of Nigeria?

Is he not a civil authority?

Besides that section of the constitution is simply interpreted to mean that the army may take on roles typically assigned to civil authorities. It does not mean that they require the involvement of those authorities.

I stead of you defining civil authority, read the above section of the constitution. It is the president that has to call on the military to aid civil authorities

If that were true then it means that whoever is president of Nigeria can use the Nigerian Military as his personal property

Kanu's British citizenship is an advantage to IPOB. He can reach places that someone who only has that cursed "Green Passport" cannot.

If Kanu was going to take his British passport and run back to Britain, he would never have left London in the first place to come back to Nigeria where he is a wanted man. I see nothing wrong with Kanu using the advantage he has as a British citizen to help his situation and Biafra

No doubt, the federal government of Nigeria has the duty to maintain law and order in the country. But it is the duty which cannot be carried out outside the ambit of the law of the land. Last weekend, armed troops invaded Abia in Abia state to deal with the alleged threat of Mr. Nnamdi Kanu, the leader of the Indigenous People of Biafra (IPOB) to destabilize the country. It was reported yesterday that the troops have taken over the family house of Mr Kanu and put him under house arrest. I wish to submit, without any fear of contradiction, that the deployment of armed troops in Abia state and the house arrest of Mr. Kanu are illegal and unconstitutional on the following grounds:

(1) By virtue of section 215 (3) of the Constitution the Nigeria Police Force has been conferred with the exclusive power to maintain law and order and secure public safety and public order in the country.

(2) Having filed an application in the Federal High Court for the re-arrest and detention of Mr. Kanu for allegedly breaching the conditions attached to his bail the federal government ought not to have presented the trial judge with a fait accompli by resorting to self help in the circumstance.

(3) Although the President is empowered by virtue of section 217(2) of the Constitution to deploy the armed forces for the “suppression of insurrection and acting in aid of civil authorities to restore law order” he cannot exercise the power until there is an insurrection or civil disturbance which cannot be contained by the police.

(4) Since there was no insurrection in Aba State which the Nigeria Police Force could not contain the deployment of armed troops by the President and Commander-in-Chief of the armed forces cannot be justified in law.

(5) However, if the federal government has evidence of other criminal offences recently committed by Mr. Kanu the Police should have been directed to arrest him and charge him to court without any delay.

(6) Neither the Constitution nor the Armed Forces Act Cap A20 Laws of the Federation of Nigeria, 2004  has empowered the Nigeria Army to arrest any citizen who is not subject to service law.

(7) In the case of Yussuf v Obasanjo (2005) 18 NWLR (Pt 956) 96 the Court of Appeal held that “It is up to the police to protect our nascent democracy and not the military, otherwise the democracy might be wittingly or unwittingly militarized. This is not what the citizenry bargained for in wrestling power from the military in 1999. Conscious step or steps should be taken to civilianize the polity to ensure the survival and sustenance of democracy”.

Regrettably, no conscious efforts have been made by the civilian government to demilitarize the country since power was transferred from former military dictators to the civilian wing of the political class in May 1999. Hence, armed soldiers have been allowed to continue to be involved in the maintenance of law and order in all the states of the federation. Up till now, state governments have allowed armed soldiers to remain members of the police anti robbery squads. They have been deployed, from time to time, by the President to deal with the menace of herdsmen and kidnappers. They have just been authorized to deal ruthlessly with civilians who are involved in any form of agitation for self determination.

There is no legal basis for authorizing the Nigerian army to take over police duties. Even under the defunct military era in Nigeria the military dictators had to declare a state of emergency to legitimize the usurpation of police powers by the armed forces. But under a democratic dispensation the President and Commander-in-chief of the armed forces lacks the power to deploy members of the armed forces in the maintenance of internal security in any part of the country. Hence, in waging the war on terror in the north east region a state of emergency was declared by President Jonathan to justify the deployment of members of the armed forces as part of the extraordinary measures required by him to restore law and order pursuant to section 305 of the Constitution. Thereafter, the President sought and obtained the approval of the National Assembly for the said deployment of the armed forces.

In view of the foregoing, the President should direct the armed troops who have invaded Aba in Abia State to withdraw and return to their barracks forthwith. At the same time, the Commissioner of Police in Abia state should be allowed to take over the case of Mr. Kanu in line with the provisions of the Constitution and the Police Act. If he is indicted in the investigation that is expected to be conducted by the Police he should be charged to court as he is not above the law. But on no account the army should the army be involved in the arrest, investigation and possible prosecution of Mr. Kanu or any other civilian in the country.

In June 2013, Goodluck Ebele Jonathan proscribed Boko Haram as a terrorist Organisation. This, he did, without any recourse to the High Court as most people would expect; and reasonably so.

There are two sections in the TPA act that may be deployed into making such declarations: Section 2 and; Section 9.



The TPA act makes provision for the declaration of a group as being a Terrorist group on a number of grounds.

It is very easy to refer to[b] Section 2 of the act[/b] which makes provision for a process that involves judicial processes, procedures and pronouncement. Most applicable to local terrorism.

However [b]Section 9 of the act[/b]makes express approval for the executive arm to immediately declare a group as a Terrorist group. This is specifically in relation to international affiliations and sponsorship.

In the case of IPOB, there is reliable Intel available to the Nigerian Army suggesting the foreign links and backings of IPOB to certain international terrorism networks.

The move by the Nigerian Govt. is therefore in order and can only be upturned by any aggrieved person who takes the matter to a court of competent jurisdiction. In the mean time, the declaration remains in full force and anybody (either physically or over the internet), found to be soliciting for a terrorist group may be found culpable.

Let us be enlightened.

How? In subsection(b), IPOB has not yet declared a separate state of Biafra so the territorial intergrity of Nigeria is still intact

In subsection(c) there was no insurrection. Insurrection means "violent armed uprising" by a group. Before the Army came to Abia state, was no insurrection. IPOB may have stoned the soldiers during their clash but stonning is not insurrection and neither were the Army acting in aid of any civil authority

Im no Lawyer but section 217 of the constitution spells out the duties of Military:



(a) defending Nigeria from external aggression;

(b) maintaining its territorial integrity and securing its borders from violation on land, sea, or air;

(c) suppressing insurrection and acting in aid of civil authorities to restore order when called upon to do so by the President, but subject to such conditions as may be prescribed by an Act of the National Assembly; and

(d) performance such other functions as may be prescribed by an Act of the National Assembly.


Of these 4 sub-sections, only section c even relates to IPOB and Kanu.

There was no isurrection in Abia state nor were the Army acting in aid of any civil authority.

The invasion of Kanu's home by the Army was a clear violation of the constitution since the Army

The Army also violated its constitutional role by doing the job of the police

Because the Army had no legal right to be where they were, all the people they shot and killed was murder

Nah, not hating, just being factual. This Nnamdi Kanu case is a classic one of a 'spoilt child' running out of control. One of the most difficult things to do is to curb military men that have been trained to kill as a profession.

Never allow them at your doorstep in the first place should have been Nnamdi Kanu's motto and the Southeast leaders. However, Kanu's ego had
run out of control and for a few months he forgot that he is just another citizen.

I frankly don't like the fact that he has by his utterances and actions put millions of lives at risk. If I have to make a choice between Nnamdi Kanu being convicted of treason and millions of people dying, I will have to choose the former.

Only a fool will be looking at a smaller problem and ignore the much bigger problem. Maybe some people were not happy with the way Nnamdi Kanu went about his agitation or some of his utterances but IPOB and Nnamdi Kanu that is the smaller problem out there. Before this opration python dance, there was hardly any act of violence reported against IPOB and they do not bear arms.

The much bigger problem that exists is that if one individual who has no position in government and no political power can cause millions to be at risk just by his uttrances, then Nigeria is not a nation worth the paper it is printed on

So when one person in the East says something offensive , people in the North are put at risk? When another in west says something not palatable , people in thr South are put at risk?

So what is the point of ONE NIGERIA if the people cant rise above mere words? It would make more sense to divide Nigeria into congregations that are more alike and comfortable with each other than be in a Nigeria where different people who dont like are routinely killing each other. People want Nigeria to be together for the sake of being together and not because the country actually works as a nation

Nnamdi Kanu not having any respect for the law is irrelevant. He already has his case in court and the courts will make that determination. What you should be worried about is if the security agencies in Nigeria respect the law.

As for this useless question you asked about the military waiting for IPOB to acquire weapons, yes the should wait unless they have credible information that IPOB is the process of acquiring arms. A crime has to be commited before a person is criminalised. If the government decides to start going after dissenting groups just because of the mere assumption that they may one day acquire arms then that is illegal and dangerous. The law does not operate on mere assumptions

I saw the video of some people looking for Hausas, I didnt see anyone with machete, I saw sticks. I was informed that the boys who were looking for Hausas were NURTW workers who told to warn all Northerners using public transport to travel into Abia about the volatility of the area. If anyone then decides that it was IPOB looking for someone to kill, well its a free world. All I know us that there is no evidence that any Hausa was killed in Abia

As for burning a police station, I cant comment on that because Im just hearing about that

As everybody knows, Nnamdi Kanu has already been charged to court for various crimes such as treason, hate speech, running an illegal radio station etc.

So we are not concerned about what Kanu may have done before being released on bail

Some days ago, IPOB and the Nigerian Army had a clash

The Nigerian Army at first claimed the were passing by when IPOB started pelting them for no reason and that they were no where near Kanu's house

IPOB claimed that the Nigerian Army at firs, went past Kanu's house, but then reversed and tried to enter Kanu's residence when they were stopped by IPOB who demanded to know their mission there. The Armies reply was to open fire on them resulting in one of them being shot in the leg which made IPOB pelt them.

Videos of the guy shot in the leg and IPOB pelting the Soldiers under heavy gunfire has since surfaced

That same day, the Nigerian Army were passing the NUJ press centre in Umuahia when they noticed the press recording them. They invaded the centre and beat up journalists and ransacked the place.

The next day, the Army regrouped and stormed Kanu's residence.

According to Nnamdi Kanu's younger brother, Emmanuel Kanu, the Soldiers arrived abd started shooting sporadically killing 4 people, even the family Dog was not spared. He also alleged that the Soldiers went on a killing spree all over the town and that 22 people were murdered.

Videos and pictures of people killed all over Umuahia have surfaced including including Kanu's bullet riddled home and one of where Soldiers rounded up IPOB members hitting them with sticks and made them lie down in dirty water

The next day, the Nigerian Army declared IPOB a terrorist organisation.

The question is:

Why didnt the Army or the government declare IPOB a terrorist organisation before the military invasion?

So IPOB only became a terrorist organisation after the Army went to Kanu's house?

Are the Army contitutionally empowered to invade homes in a non combatant zone?

Are the Army empowered to shoot unarmed civilians?

Is it the constitutional role of the Army to do the job of the police?

What is the Armies explanation for all the people they killed in Umuahia?

Whn you look at it, you realise that the Army commited too many crimes in Umuahia and only used the declaration of IPOB as a terrorist organisation to justify its human rights abuse and illegal killings
