tayo4me: I can't help but wonder if you are on GEJs payroll! Telling me I've never read the Constitution, when I'm a law student,...you really want to tell me what the constitution says!

Anyone who understands the English Language will know 'he'may also include 'she', so that explains why a woman can be appointed. Didn't ur little brain tell u if that wasn't d case, nd ur precious GEJ appointed a woman, then he will be going against the provisions of the law.

The law provides that the most senior Justice of the Supreme Court ON THE RECOMMENDATION OF THE NJC is appointed by the President subject to the confirmation of the Senate...all three bodies/authorities are involved, so its not the sole power of the President.

No one is saying u shdnt praise GEJ, but pls don't display ur ignorance or be a muppet in d process
I would expect a law student who actually attends lectures to be able to employ critical thinking and actually stick to the subject of the argument.
Sorry sis, but what you are displaying here is stup!dity. Nobody cares if you are a law student (or apprentice lawyer, lol!), what we care about is if you understand the damn constitution with enough nous to provide as credible an interpretation as I have.

Here are my arguments against Akainzo's mental limp, together with references to the constitution. Thats what I expect you to counter with reasoned points and nothing else:

Beaf:
Akainzo:
Sorry to bust your bubble, he cannot nominate anybody, the CJN position is achieved by rank, and as of now, she is the most senior justice of the Supreme Court. One day, it would be a feather in GEJ's cap for declaring public holiday on christmas day! grin grin

Though I concede that greatness is being thrust on him as it is happening during his tenure.
Crap argument, dude.
The constitution does not say anywhere that the CJN position is earned by rank.
In fact, to utterly destroy the foundation of your argument, the constitution, Section 231 Sub-section (3) says this:

(3) A person shall not be qualified to hold the office of Chief Justice of Nigeria or a Justice of the Supreme Court, unless he is qualified to practice as a legal practitioner in Nigeria and has been so qualified for a period of not less than fifteen years.
The bit in red nails the sad fact that the post was never considered for women, it has taken GEJ to change that.

Further, it says that it is based on recommendation of the NJC and the agreement of the President and Senate; simply put, both the President and the Senate can veto the NJC until they get the guy they want. To forestall that, nothing stops the President from demanding that the NJC submit a basket of names from which he can pick one.

The President appoints the members of the NJC and exercises power over them (3rd Schedule, B - Council of State, 6v).
Guess what? The Federal Judicial Council (which includes the Attorney General) advises the NJC on recommendations for appointment (3rd Schedule, E - Federal Judicial Service Commission, 6v).

The circle of obfuscation completes itself. Init? Please hail GEJ on his appointment of the first female CJN. cool
In a labyrinthal arrangement, the President simply chooses a CJN, sends the name to the Federal Judicial Service Commission, who "advise" the CJN to recommend the name. The CJN "recommends" the Presidents choice and life goes on. Check out the quote below (3rd Schedule, I - National Judicial Council):

21. The National Judicial Council shall have power to -

(a) recommend to the President from among the list of persons submitted to it by -

(i) the Federal Judicial Service Commission, persons for appointment to the offices of the Chief Justice of Nigeria, the Justices of the Supreme Court, the President and Justices of the Court of Appeal, the Chief Judge and Judges of the Federal High Court, and

I posted the provisions of the constitution, which I'm sure you never read.
Just hail GEJ and leave wahala, jare!

Kay 17: Yes, but for the integrity of the judiciary, the convention in courts is to place priority in rank/senority.
Bro, conventions are traditions, not the law. The constitution simply demands a legal practioner of above 15 years, from any field of law and from either the bar or bench.

Starlett: Sorry, Beaf... I have read up the profile of the incoming CJN carefully, but can't see where GEJ is mentioned. Pray, tell us how appointing her is now a feather to his cap.

Last I checked, the rule is that the NJC usually recommends the most senior sitting justice of the supreme court (i.e, longest on the SC bench) to the Presidency for forwarding to the NASS. GEJ has no credit to take here, sorry.
GEJ can nominate any qualified person for the post, but chose to nominate her and give us our first ever female CJN.
My last post contains the letter GEJ sent to the senate. Please read it (and follow through with the relevant sections of the constitution that are quoted).

By the way, why do you think you should see GEJ in her profile, is he her husband or dad?
Politics › Re: Farouk V Otedola - By Festus Keyamo by Beaf: 9:24pm On Jul 04, 2012
The bare-faced denial by Farouk Lawan of his voice on those tapes, and the denial of his complicity despite these overwhelming evidence, gives the clear impression that we are dealing with a hardened, unrepentant crook who is like a thief caught with his hand in the cashbox, but still claims he was only checking the color of the money.

In Japan, such persons like Farouk Lawan would have committed what they call “hara-kiri”.

In America and Europe, he would have resigned immediately from public office in shame and begged for forgiveness.

Unfortunately, here in Nigeria and aided by dubious hired goons, he continues to deny the obvious. What a shame!

As for the House Committee on Ethics and Privileges, their so-called investigation of the scam is nothing but a laughable sham, a diversionary and disgraceful enterprise with a pre-determined end, an unconstitutional and illegal exercise and Nigerians must ignore it.
That is why we are laughing and why Otedola too, went to the House to laugh at the Reps.

We have a huge tragedy that is playing out like a comedy. Lets call it, "the comedy of Farouk."

CBN operates secret account, says NNPC
By Onyedi Ojiabor

CBN Governor Lamido CBN Governor Lamido

The Nigeria National Petroleum Corporation (NNPC) yesterday disowned the controversial secret account at J.P. Morgan.

NNPC Group Executive Director (Finance) Mr. Bernard Otti told the joint Senate Committees on Petroleum Resources (Downstream), Appropriation and Finance investigating the management of the fuel subsidy scheme that J. P. Morgan Account was opened by the Central Bank of Nigeria (CBN) on its behalf in 2002.

The CBN had earlier told the committee that the secret account was opened and solely managed by the NNPC.

But Otti told the committee that the CBN is the sole signatory to the account.

Finance Minister Dr. Ngozi Okonjo-Iweala on Monday said distanced her ministry had no hand in the account.

Though Mrs. Okonjo-Iweala told the committee that she is aware of the account, she denied knowledge of its details, including the number.

NNPC Group Managing Director Andrew Yakubu told the committee that the CBN owns the account.

Committee chair Senator Magnus Abe compelled Otti to appear before the committee to clarify the status of the account.

Otti claimed that the CBN operates the account on behalf of NNPC “right from the outset when the account was opened in the United States”.

He said: “The NNPC has no direct contact with the J.P. Morgan account. The account was opened by the CBN on behalf of the NNPC. It was opened in the last quarter of 2002 by the CBN for NNPC.

“The account is operated by NNPC in the CBN. CBN has its correspondent banks to which NNPC isn’t a party. NNPC doesn’t operate that account; NNPC operates domiciliary account with CBN.”

Asked to be definite if the NNPC or the CBN operates the account and whose money is paid into it, Otti said:

“The money paid into the account is crude (oil) money of Nigeria . We are not party to that transaction. Our relationship with the CBN accounts begins and terminates with that account.”

Otti said the CBN is the only signatory, such that the NNPC is not even on the account mandate.

He insisted: “The CBN is the signatory to that account. We have no relationship with J. P. Morgan whatsoever. We are not in the mandate.”

The committee vowed to ensure that accounts not known to the Constitution are closed and all monies paid directly into the Federation Account.

President Goodluck Jonathan on Wednesday forwarded the name of Justice Aloma Mariam Mukhtar to the Senate for confirmation as Chief Justice of Nigeria.

Senate President, Senator David Mark, read the nomination letter dated July 3, 2012 at Wednesday’s plenary.

In the letter entitled: “Appointment of Chief Justice of Nigeria” Jonathan said the appointment is in conformity with Section 231 Sub-section (1) of the 1999 Constitution of the Federal Republic of Nigeria, as amended.”

The Section gave the President power to appoint a CJN, acting on the recommendation of the National Judicial Council and subject to the confirmation of the appointment by the Senate.

“I have the honour to forward the nomination of Honourable Justice Aloma Mariam Mukhtar, CON, CFR for confirmation as Chief Justice of Nigeria,” Jonathan said.

The President urged the Senate to give the nomination expeditious attention.

ACN is desperately dragging everything into Edo states election. First was the "assasination attempt" in which Oshomole's convoy was riddled with bullets (it turned out to be a mere harmless student demo with no bullets), next it was the grievious mistake that saw them soiling the Oba's name. The latest victim is CAN.

As I did with the Oba's case, I'll predict again that CAN will come out to refute this story. When they do, feel free to call me T. B. Beaf! grin

Just to reiterate, the law courts are where the constitution is interpreted and precedence is set.

The House of Rep has an almost id!otic penchant for acting above themselves; they had the temerity to summon Obj 4 times. On the 4 occasions, Obj refused.
GEJ does not want to give anyone the opportunity to express foolishness so freely and repeatedly, he wants this first occasion to be the last one. That is why the Executive is contemplating going to court to lay the law down once and for all in indelible ink.

Beaf: How do you establish boundaries in a democracy?

Maria de Villota: Driver loses right eye after crash

Formula 1 driver Maria de Villota has lost her right eye following a test track crash.

She was hurt when the MR-01 race car she was driving hit a support truck at Duxford airfield in Cambridgeshire on Tuesday.

It was the first time the 32-year-old Spaniard had driven the car for the Oxfordshire-based Marussia team.

Inspectors from the Health and Safety Executive (HSE) visited the test track on Wednesday.

Marussia said surgeons at Addenbrooke's Hospital in Cambridge "embarked on a lengthy procedure to address the serious head and facial injuries sustained by Maria in the accident".
'Great sadness'

It said: "The operation began yesterday afternoon and she was in theatre until this morning.

"Maria remains in a critical but stable condition."

John Booth, team principal of the Marussia F1 Team, said: "Maria emerged from theatre at Addenbrooke's Hospital this morning after a lengthy operation to address the serious head and facial injuries she received in the accident at Duxford Airfield yesterday.

"We are grateful for the medical attention that Maria has been receiving and her family would like to thank the Neurological and Plastics surgical teams.

"However it is with great sadness that I must report that, due to the injuries she sustained, Maria has lost her right eye.

"Maria's care and the wellbeing of her family remain our priority at this time. Her family are at the hospital and we are doing everything possible to support them."

De Villota sustained her injuries after her car "suddenly accelerated" into the back of the support lorry, according to eye witnesses.

BBC Radio Cambridgeshire presenter Chris Mann, who saw the accident, said: "The top of her car and her helmet seemed to take the brunt of it.

"She didn't move for about 15 minutes."
'Terrible accident'

He said De Villota had been driving at up to 200mph during the testing, but the car was travelling considerably slower at the time of the crash.

Mr Booth said: "With regard to the accident, we have embarked on a very comprehensive analysis of what happened and this work continues for the moment."

Messages of support have come in from the motor racing world, including ones from Ferrari driver and fellow Spaniard Fernando Alonso and Jenson Button.

Formula 1 driver and BBC analyst Jaime Alguersari said in his weekly column: "I was shocked to hear of the accident suffered by Maria de Villota. I know her and her family very well. I still don't know the cause of the accident. There are so many rumours but I want to wait to see what really happened.

"It's terribly sad. Maria is a fantastic person, as are her brothers and her father Emilio, who was one of Spain's first F1 drivers.

"She is a role model, especially for all the females who want to get into F1. So this is a very sad situation.

"Thankfully, she is not in a life-threatening situation so we have to look at the positive side. We will see Maria again."

Lewis Hamilton tweeted: "Just heard about Maria's terrible accident at Duxford. I hope she pulls through. My thoughts and prayers are with her family at this time."

Programming › Re: Are You A Real Programmer? Can You Code With Notepad? by Beaf: 6:34pm On Jul 04, 2012
The OP has simply described the difference between a technician (or other vocational worker) and the skilled professional.

The vocational worker memorises every last step of his job, because they do not understand how things work. So, yes the vocational worker can code with notepad and navigate the internet from the command line. However, it is the developer that builds the iconic landmarks like Facebook, Google, Ebay, Amazon, various phone apps etc; these things cannot be done from the command line, neither can their code be written in notepad (except as punishment for sins like murder - lol!).

By the way, some people view the word, "programmer" as derogatory or old fashioned at best. Most people prefer to be called developers.

I predicted over the weekend, that come Monday, we would hear a rebutal from the Oba, because the matter was being used by ACN as a primitive, reckless and shameless lever to cause embarrassment, for GEJ.
Predictably, their foolishness has instead, splashed stains of a faecal kind on the aura of the entire Benin Royalty, especially the reverred Oba Erediauwa, Omo N'Oba N'Edo Uku Akpolokpolo. It is an abomination.
