The court said Umahi and Igwe did not controvert the deposition that total votes scored in an election belong to a political party.

Justice Ekwo said evidence abound that the 2nd defendant (APC) contested the Ebonyi State governorship election held on March 9, 2019, with its own candidates.

“It can be noted that the con­stitution does not deal with the issue of defection lightly”, the court stated, adding that “the 3rd and 4th defendants cannot transfer the votes and victory of the plaintiff on March 9, 2019, to the APC.

“Office of the Governor and Deputy Governor of Ebonyi State belongs to the plaintiff and not the APC.

“The option for Umahi and Igwe is to vacate office and wait for next election to contest elec­tion on the platform of its new party”, the court declared.

The court said the act of the APC, Umahi and his deputy is aimed at “dismantling the 1999 constitution”.

Consequently, the court de­clared that under the democrat­ic system operated in Nigeria, the plaintiff (PDP) won the majority of votes during the election and is entitled to enjoy same till the end of tenure of office for which the election was made".

The judgement of the court aside from looking at the Constitution also was on the basis of evidences and facts. They did not deal with the issue of defection rightly and frontally. Who should be blamed? Umahi's lawyer failed woefully. Maybe now he will add Ozekhome to his legal team to help him out.

If you are sponsored by someone, does it not presuppose that the person is responsible for you in the issue that binds you together as long as you remain with him?

Even if the word "governor" is not mentioned in section 177(c) quoted, he belonged to the PDP, was sponsored by the PDP.

We should get to a point in our democracy where issues like decamping must be addressed. You do not change the goal post in the middle of the game. If you got a position on the platform of a party, you should be expected to be with that party until your tenure expires. Hopefully all those in the state and national assemblies are shown the way out with this.

The judgement is what it is- a mere pronouncement. Its only utility I see is it making it alot more difficult for incumbents to change parties at will.

INEC upon receipt of the CTC is expecteyy kd to comply with the judgement. But I thybsnink that if Umahi goes to appeal, INEC may choose to delay in the execution of the order.

Hopefully anyway, Umahi gets removed for his arrogance when he defected to APC.

It's a procured judgement.

Before 2019 election, Governors Tambuwal(Sokoto), Uthom (Benue), Ahmed (Kwara) changed party. More recently, Obaseki changed, Matawale changed party.

They couldn't be prosecuted bcoz, change of party is not a ground for removing a serving governor. Only 3 grounds :

impeachment,
death, and
resignation

Where is it written in the Nigerian constitution that if a governor changes Party, he would lose his seat?

Even in the recently passed Electoral Act, national assembly members didn't say anything about changing party and losing seat in respect of Governors and President.

They nominated you to replace a governor and you're happy about it. Ask yourself, why me? On what legal reason?

Even the judge in his judgement demonstrated confusion when he said.... the second person during primary should replace the governor. The judge continued that ...or the Party should conduct another primary to pick a replacement.

So which one should we take? Is that judgement or advice or suggestion?

From which Electoral Act is he ruling? Or from which section of Nigerian Constitution? He should have quoted the sections but he didn't. He couldn't cite any judicial precedent say Mr A vs Mr H in a case.......NLR...

This is actually a good development, most political parties have been reluctant to test the law as it concerns members defecting to another political party. I pray Umahi appeals the judgement and the case eventually gets to the supreme Court so we can clearly know what the position of the law is.

Hopefully the Supreme Court can revisit its judgement in the Atiku case of 2007 after defecting as the VP to contest under ACN for the president. This time I hope the court can look at the constitution from another perspective just like Justice Ekwo. It should serve as a lesson to all political office holders who decamp.

The judge never misfired. Judges give judgement on the basis of the evidence brought before it and not based on emotions or sentiments. If PDP were able to do their homework by proving beyond reasonable doubt to the judge that there were no crises in the party at the time umahi defected, and umahi's lawyers were not able to convince the judge that there was crises in PDP, my dear any judge would fairly award the case in favor of PDP, and you can't blame the judge for awarding the case in favor of PDP who did their homework and were able to prove their case with facts. So in essence, judgements are based on your ability to prove your case with facts and evidence, and not by blowing up sentiments and emotions.
Truth is, I however actually see umahi winning at the supreme court because the Chief justice is probably sympathetic to the APC. But if the supreme court decides to be unbiased, then umahi is finished especially with the sagacious lawyers that PDP has as governors like Wike and Tambuwal who know the right button and spot to press legally to finish an individual.

You said it right, but you nearly spoiled it for me when you mentioned the Supreme Court. I do not see Umahi winning it. I only see Umahi delaying to complete his tenure. PDP’s lawyers always seem to make their cases properly.

We must get to a level where our politicians must be stopped from jumping parties and creating unfair balances using flimsy excuses.

The judge must have weighed the balance of evidence before him in arriving at his judgement.

As at the time Umahi defected, PDP were in crisis over its former National chairman Uche Sevondus.
