The constitution of Nigeria is very clear. Tambuwal is still the speaker of the house!

Section 68(1) and 68(2) should be read together:

68. (1) A member of the Senate or of the House of Representatives shall vacate his seat in the House of which he is a member if -
(a) he becomes a member of another legislative house.
(b) any other circumstances arise that, if he were not a member of the Senate or the House of Representatives, would cause him to be disqualified for election as a member;
(c) he ceases to be a citizen of Nigeria;
(d) he becomes President, Vice-President, Governor, Deputy Governor or a Minister of the Government of the Federation or a Commissioner of the Government of a State or a Special Adviser.
(e) save as otherwise prescribed by this Constitution, he becomes a member of a commission or other body established by this Constitution or by any other law.
(f) without just cause he is absent from meetings of the House of which he is a member for a period amounting in the aggregate to more than one-third of the total number of days during which the House meets in any one year;
(g) being a person whose election to the House was sponsored by a political party, he becomes a member of another political party before the expiration of the period for which that House was elected;

Provided that his membership of the latter political party is not as a result of a division in the political party of which he was previously a member or of a merger of two or more political parties or factions by one of which he was previously sponsored; or
(h) the President of the Senate or, as the case may be, the Speaker of the House of Representatives receives a certificate under the hand of the Chairman of the Independent National Electoral Commission stating that the provisions of section 69 of this Constitution have been complied with in respect of the recall of that member.

(2) The President of the Senate or the Speaker of the House of Representatives, as the case may be, shall give effect to the provisions of subsection (1) of this section, so however that the President of the Senate or the Speaker of the House of Representatives or a member shall first present evidence satisfactory to the House concerned that any of the provisions of that subsection has become applicable in respect of that member.

The intention of the law is also clear.According to section 68(2),Only the speaker SHALL implement section 68(1),upon any other member of the house.

I am of the humble opinion that the law intended to distinguish the SPEAKER from an ordinary member of the house.

LONG LIVE THE FEDERAL REPUBLIC OF NIGERIA!

Implications of 68(2) is that only the Speaker can effect section 68(1) ,not the inspector of police, nor the president.And looking at the intention of the law,I am of the humble opinion that a member of the house should be distinguished from the SPEAKER of the house.

size38: Nigerian politicians are the worst politicians on earth. If Ribadu was d EFCC chairman then, was it not on d consideration of him being a PDP member he was appointed by OBJ? What edwin clark meant is that Ribadu would have turned his eyes away to corrupt PDP governors then as against doing the job he was appointed to do. If a man like Edwin Clark who was a delegate at d just concluded national Confab could reason like this at his age, nigeria is forever doomed.
This is mis-information.

Ribadu was never appointed as EFCC chairman as a PDP member.This was not a political appointment.Chairman of INEC,Inspector General of Police,EFCC chairman,ICPC chairman etc, are not there because of PDP membership.

Ribadu was never in PDP.

If you ask me,El-rufai/Oshiomole is a sure banker for both the north and the south.

How gullible could someone be,falling to the devilish and divisive antics of Politicians.

How is APC a jihadist party?

The founding fathers of APC have ruled Nigeria before,either as governors(e.g Tinubu) or Head of State(e.g Buhari) and they never islamise Nigeria.Infact Buhari dealt ruthlessly with Maitasini terror sect of those days.

Boko Haram predates the emergence of APC and it is a terror group with international connection and sponsorship from the likes of Al-qaeda.

I just pity your sense of reasoning and gullibility.

The earlier Nigerians unite to fight a common enemy(Boko Haram)rather than exploiting every opportunity to play politics,the better for us as a

Kobojunkie:
We are in the year 2011, and we still have people making comments such as these. Let me educate you for one second. 16000 people have lost their lives to mostly religious violence in the country called Nigeria. Many of them hacked to death simply for not being islamic, or the right ethnicity. When you Central Bank then decides to implement Islamic Banking, in addition with Sharia which has led to the maiming (Amptations of arms, legs, etc. of innocent lives in the north) and the institutionalization of such practices as Almajirism(some state governors actually spend millions of dollars to feed them come festival season), you and every ought to take this panadol because, dufus, it is YOUR COUNTRY AND PEOPLE AS WELL that will likely be affected in the end.

Sharia/Islam did not INVENT no-interest banking. If Banks want to offer No-interest banking services, they ought to be able to do that without needing to link it to one religion, or another. We do not need the CBN making policies for RELIGIOUS banking when it can simply make policies that apply across the board.
Is Kobojunkie contribution more superior?I leave the answer to only intelligent ones to decide.

Amputation of hands,according to the sharia law,is meant to be applied(only by the sharia court,no other person or group of persons),where a muslim
suspect have been found guilty of Stealing.So I wonder what kobojunkie means by maiming innocent lives!

Everything about Sharia is all about promoting morality and sever punishment for evil.Only the evil doer will not support sharia.GOD himself has promised Hell fire for evil doers,so what are we talking abouthuhhuh

We all know that interest or usury is condemned by both religions,I just wonder what the problem is:may be INTOLERANCE.

NO BODY WILL FORCE YOU TO BANK WITH A NON-INTEREST BANK (ISLAMIC BANK IF U PREFER)AND NEITHER IS THE GOVERNMENT GOING TO FUND SUCH A BANK WITH TAX PAYERS MONEY.IT IS OPEN TO THOSE WHO CAN AFFORD THE MINIMUM CAPITAL REQUIREMENT TO SET IT UP,JUST LIKE ANY OTHER CONVENTIONAL BANK.

Pls only those who have read the CBN guideline on the establilshement of this bank should comment.

We have catholic mission schools,health centers, Nigerian Red Cross and the likes in Nigeria,patronised by both xtians and muslims.It is only when it comes to islamic related institutions that the intolerant xtians would start raising unnecessary sentiments.

As a muslim,I attended St.Finbarr's college,Akoka ,because my parents considered the quality and benefits of going to such a school.I was always at the early morning congregation conducted of course in a xtian way.If we were to consider the religious implication,perhaps I would have attended Anwarul-Islam college or Muslim High school,etc.

Many of us are just plain greedy!
The truth is that the principle of Sharia banking is agreed with by the bible.
The bible also frowns at Interest or Usury. This form of Banking also frowns at it. It devices another way of making money.
The banks are part owners of the activity/biz the loans are used for.
Another approach could be not calling it Islamic banking. Callin it a more secular name will appeal to more people like Ethical Banking, etc.

Jus my thot!
The official nomenclature as per CBN guideline is Non-Interest Banking and not sharia or islamic banking!!!!!!!!!!!!!

Principles of Islamic Banking

Islamic banking has the same purpose as conventional banking except that it operates in accordance with the rules of Shariah, known as Fiqh al-Muamalat (Islamic rules on transactions). The basic principle of Islamic banking is the sharing of profit and loss and the prohibition of interest or riba (usury). Common terms used in Islamic banking include profit sharing (Mudharabah), safekeeping (Wadiah), joint venture (Musharakah), cost plus (Murabahah), and leasing (Ijar).

In an Islamic mortgage transaction, instead of loaning the buyer money to purchase the item, a bank might buy the item itself from the seller, and re-sell it to the buyer at a profit, while allowing the buyer to pay the bank in installments. However, the bank's profit cannot be made explicit and therefore there are no additional penalties for late payment. In order to protect itself against default, the bank asks for strict collateral. The goods or land is registered to the name of the buyer from the start of the transaction. This arrangement is called Murabahah. Another approach is EIjara wa EIqtina, which is similar to real estate leasing. Islamic banks handle loans for vehicles in a similar way (selling the vehicle at a higher-than-market price to the debtor and then retaining ownership of the vehicle until the loan is paid).

An innovative approach applied by some banks for home loans, called Musharaka al-Mutanaqisa, allows for a floating rate in the form of rental. The bank and borrower form a partnership entity, both providing capital at an agreed percentage to purchase the property. The partnership entity then rents out the property to the borrower and charges rent. The bank and the borrower will then share the proceeds from this rent based on the current equity share of the partnership. At the same time, the borrower in the partnership entity also buys the bank's share of the property at agreed installments until the full equity is transferred to the borrower and the partnership is ended. If default occurs, both the bank and the borrower receive a proportion of the proceeds from the sale of the property based on each party's current equity. This method allows for floating rates according to the current market rate such as the BLR (base lending rate), especially in a dual-banking system like in Malaysia.

There are several other approaches used in business transactions. Islamic banks lend their money to companies by issuing floating rate loans. The floating rate  is pegged to the company's individual rate of return. Thus the bank's profit on the loan is equal to a certain percentage of the company's profits. Once the principal amount of the loan is repaid, the profit-sharing arrangement is concluded. This practice is called Musharaka. Further, Mudaraba is venture capital funding of an entrepreneur who provides labor while financing is provided by the bank so that both profit and risk are shared. Such participatory arrangements between capital and labor reflect the Islamic view that the borrower must not bear all the risk/cost of a failure, resulting in a balanced distribution of income and not allowing the lender to monopolize the economy.

Islamic banking is restricted to Islamically acceptable transactions, which exclude those involving alcohol, pork, gambling, etc. The aim of this is to engage in only ethical investing, and moral purchasing. The conventional banking system is still available to those who must engage in this unethical type of transactions.

Moreover,the issue of complying with sharia law as per the guide line is because as it is globally accepted(even in Britain and uS,you cannot set up the bank if it does not comply with sharia law),sharia law is the only document that comprehensively explains how non-interest banking could be successfully carried out.It has been tested and trusted,so there is no need to re-invent the wheel!!!!!!!!!!!!!!!!

illogical mind supporting illogical reasoning!

How will Islamic Banking segregate Nigeria,when as it is obtainable in countries where it is practiced,more Christians patronize it even more than muslims.

It is only in Nigeria that people allow religious sentiments to override their sense of reasoning.The basic principle of Islamic banking is simple:No interest on loans or deposit!The provider of funds to a business venture only target profits/loss from such a venture and not burden the borrower with interest payments.

We have catholic mission schools,health centers, and the likes in Nigeria,patronised by both xtians and muslims,no body is talking of segregation.It is only when it comes to islamic related institutions that the intolerant xtians would start raising unnecessary sentiments.

Ribadu himself held a press conference to attribute the failure of the alliance to CPC arrogance and one useless person is putting a very mischievious title that is not in tandem with the content of the post.More disgusting is the fact that many Nairalanders did not even authenticate the title of the post before making comments.

The original title from Next newspaper was was:"they have damaged my candidacy'',and Ribadu was referring to the leadership of CPC.

Papabrowne or whatever is real name is ,must be very shallow in reasoning and an obvious PDP dogma.

People have highlighted what GEj had not achieved and debunked some of the so called achievements,yet he has resulted to very mischievous and absolutely biased appraisal.

PDP AND IT'S AGENTS ARE DESPERATE AND ARE READY TO DO ANYTHING TO DISTORT THE FACTS AND DECEIVE THE PUBLIC!

Please be informed that Nigeria was generating well over  3000 megawatts of electricity before PDP captured power in1999.12years and  a whopping $16bn after,virtually nothing has been added.

The more reason why we should try something truly fresh:Ribadu/Adeola
