Full cross examination report: A Chief Pathologist with the Lagos State University Teaching Hospital (LASUTH), Dr. Sunday Soyemi, has told the Coroner Inquest into the controversial death of Sylvester Oromoni, that a blackish substance was found in the boy’s intestine during autopsy. While answering questions on Tuesday under cross-examination from Counsel to the Oromoni family, Femi Falana (SAN), Dr Soyemi, however, testified that no test was carried out to determine what the blackish substance was. Lekki-based school, Dowen College, has been in the eye of the storm since the demise of a 12-year-old student, Sylvester Oromoni Jnr. But the school has denied the claim, saying instead that he sustained injuries while playing football with his mates. Find below the conversation between Mr Falana and the Pathologist below: Falana: You did say, that when you were opening up the body, you found a blackish substance in the intestine of the deceased? That’s correct, said the pathologist. Falana: Did you send the black substance to a toxicologist? To which the pathologist replied No. Falana: Don’t you think the blackish substance should have been taken to a toxicology laboratory in view of the allegation that the boy was poisoned? Again, the pathologist replied No. This prompted Mr Falana to ask, “What is the blackish substance?” Pathologist: It could be anything. It could be faecal stool matter mixed with embalming fluid. Falana: It could be anything, we don’t know. Yet without conducting a test, you dismissed the conclusion of the pathologist in Warri who came to the conclusion that the deceased died of acute lung injury arising from chemical intoxication? Pathologist: I took samples of the oesophagus and the stomach to the laboratory and looked at it under the microscope and they were essentially normal. Falana: What laboratory did you use? LASUTH or one outside? Pathologist: I didn’t take it to a toxicologist laboratory. LASUTH has no toxicology laboratory. Falana: LASUTH has no facilities for testing for poison, when such tests are needed, it is sent abroad. Pathologist: That’s correct. Toxicology, according to the English dictionary, is the branch of pharmacology that deals with the nature, effect, detection and treatment of poisons and poisoning. In response to further questions from the Counsel to the Nigerian Bar Association (NBA), Bernard Onigah, the Pathologist gave reasons why a toxicologist test was not carried out. Pathologist: In conducting toxicology, I need to take blood, urine and the vitreous fluid in the eyes, all of which will be sent to the laboratory for test. I also need gastric content in the stomach. All these were not available at the second autopsy. When asked why they were not available, the pathologist said, “the stomach had been opened by the first pathologist and nothing was found. The blood, urine and eye fluid had been sucked out during embalming and put in the Formalin, the embalming fluid. The lawyer then asked, “Are you telling the court that it is impossible to take samples for toxicology as at the time the body was brought to you for an autopsy?” The pathologist replied, “that’s correct”. Counsel to Dowen College, Anthony Kpokpo asked the pathologist the impact a noxious substance, chemical or poison introduced through the mouth will have on the oesophagus or the stomach. The pathologist replied, “I’ll expect to see a bruising of the lining of the stomach and the oesophagus.” Kpokpo: Did you see any bruising in the lining of the deceased’s stomach or oesophagus? Pathologist: No The cross-examination also dwelled on the cause of death with the pathologist insisting that the late Sylvester, died of Septicaemia. Septicaemia is when bacteria enters the bloodstream, and causes blood poisoning which triggers sepsis While being led in evidence by the Director of Public Prosecution, DPP Lagos, Dr. Jide Martins, the pathologist testified on his findings during the autopsy. He said the findings indicated a generalised infection of the body. “It was an infection of the lungs, the deceased also had an infection of the liver, the kidneys, infection of the right arm, the soft tissue of the muscles covering the bone below the ankle. The summary of these is that he had generalised infection.” Dr. Soyemi said, “This could have been treated. What could have been used in treating was massive dose of antibiotics, intravenous fluid and blood transfusion.” He added that based on his finding, the illness could have been properly managed if the boy was taken for proper treatment. It was not a terminal case at all, the doctor stated. The doctor however noted that the medical condition could lead to death if not properly treated, adding that the “mortality rate is high.” Mr Falana asked, “can massaging of the body and an injury lead to infection?” The doctor replied no. The senior lawyer again asked, “If there’s an injury and it has been massaged repeatedly, can it lead to the removal of the skin or part of the skin?” The doctor replied in the affirmative. The senior advocate asked, “Are you aware that the ankle injury of the deceased was subjected to massaging in the sickbay of Dowen College on the 21st, 22nd & 23rd? Dr. Soyemi said, “Not aware.” The pathologist also spoke to some “sensitive photographs” of the autopsy report which were shown in court to describe the procedure and methods of the post mortem. One of the pictures showed the deceased with his name tag, another showed an incision made in the chest area. A few others showed vertical marks on the chin (post mortem injury), “a recent external circular injury on the right ankle,” reddening on the lower part of the two legs (this shows that the embalming fluid did not get to that part of his body), the white brain shows that there is not enough blood in the body. “Prior to the conduct of autopsy, I did a total body radiograph to rule out any skeletal injury, that is, fracture, none was found. And the radiologist confirmed there was no fracture,” he said. He faulted the initial pathologist in Warri describing his autopsy as a botched autopsy. In the first autopsy carried out in Delta State, the pathologist, Clement Vhirterhire said the 12 years old died from “acute lung injury due to chemical intoxication.” “Before I started the autopsy, the doctor who conducted the first autopsy was in attendance and was in attendance throughout. So, I observed that the autopsy was not properly done. All that was not properly done are documented in my statement,” Dr. Soyemi said. “For example, at the first autopsy, the pathologist never opened the oesophagus; the oesophagus is the food pipe. He also did not open the trachea, it is the air path through which we breathe. “These are vital things that he should not have missed out. “He concluded his report as chemical intoxication. For one to be intoxicated with chemicals, that chemical has to pass through the oesophagus, which is the food path. If one has not opened the food path, he cannot talk about chemical intoxication. Mr Femi Falana, however, noted that the pathologist should not be allowed to comment on the first autopsy because it was not tendered as evidence in the inquest. But the DPP, Dr. Martins, said that the witness should be allowed to comment on it because he is an expert and the coroner inquest is a fact-finding exercise. “He is an expert witness and he holds a duty to the court and he understands the issues that are relevant to the determination of this inquest,” Mr Martins said. When the coroner appeared to allow the comments, it led to a heated exchange between him and Mr Falana. The coroner said, “This is not a regular court. You are already casting aspersions on the court and my person. I allowed all parties to speak, I listened to everybody, the rules of evidence do not apply.” “You say this at your convenience,” Mr Falana responded. Reacting, the coroner said he took exception to the statement adding that “If you have a problem with me personally sitting on this inquest, the avenues are there. I’m not a tyrant, I fear nobody; I owe my duty to God. Learned silk is saying I do that at my convenience. Take that back.” Mr Falana however said he had no cause to question the coroner’s integrity. “Your lordship, if I have created the impression that I question your integrity, I take it back.” The coroner also apologised for raising his voice at the learned silk. He ruled that he would take any comment that would assist in the fact-finding. He, however, asked the DPP to limit his questions to the evidence tendered in court. On media reports of the post mortem proceedings, Mr. Femi Falana asked the pathologist Dr Soyemi if he had authorized one of his colleagues, Dr. Nwigwe Chikodili Isabella, to speak on Arise TV about the findings of the autopsy. The pathologist said that he did not give any such authorization. He also testified that this was not normal practice and admitted that he was embarrassed when the report was being discussed on TV. “I was embarrassed because she didn’t perform the autopsy, she observed all through and it’s not the normal practice even if you have done the autopsy,” he said. Next time let people be referred to the right agencies with allegations let it be investigated before people take extreme positions. Who can repay the damage done to those accused boys and their teachers who spent Christmas locked up for a crime we now know they didn't even know anything about. matrix199: Even the family knew the Autopsy they did in Delta was fake that's why they didn't tender it as evidence at the Inquest. The only reason why they shared the report to the press a few days before the main autopsy came out is so people will not believe the real autopsy. Just imagine the parents of the boys in Dowen didn't have money to do their own that's how they would have used fake everything to put those boys in prison. A pathologist, Dr Sokunle Soyemi, has informed an Ikeja Coroner’s Court that the first autopsy was conducted at Warri, Delta, on the late Sylvester Oromoni Jnr., a 12-year-old student of Dowen College, was botched. The News Agency of Nigeria (NAN) reports that Soyemi, who has 17-year experience in the field of pathology, made the claim on Tuesday while testifying for Lagos State Government at an inquest set up to unravel the cause of the student’s death. He was led in evidence by Dr Jide Martins, the Director of the Lagos State Directorate of Public Prosecution (DPP). “I observed the first autopsy was not properly done. All the things that were not properly done were documented in my report. “At the first autopsy, the pathologist never opened the oesophagus (the food pipe). He also did not open the trachea (air pipe). These are vital things he should not have left out. “The conclusion in his report was chemical intoxication. For one to be intoxicated with a chemical, that chemical has to pass through the food path. “If one does not open the food path, one cannot talk about chemical intoxication. The chemical that should be injurious to one should pass through the oesophagus. “It should not have been anything near chemical intoxication if it did not pass through the oesophagus,” Soyemi said. The witness said further that the pathologist who conducted the first autopsy in Warri, Delta, did not look into the lungs of the deceased and also did not detach the heart from the lungs as was the standard practice. “If he had done that and weighed the lungs, the weight alone would have told him that something was wrong with the lungs. “Your honour, these are a few of the things he did not do. I will say that he did a botched autopsy. Your honour, this is the cause of the controversy concerning this case,” Soyemi said. Counsel to the Oromoni family, Mr Femi Falana (SAN), however, objected to the evidence of the pathologist. He said that Soyemi was testifying on a matter (first autopsy report) which had not been tendered before the inquest by the DPP. “We urge the coroner to stop the move by the DPP to turn the witness to an expert in a matter that is not before the court. The learned DPP should have tendered the first autopsy report and asked the witness to compare it with his own. It is not his duty to speak on another autopsy report,” he said. Responding, the DPP said that the witness, an expert witness, was speaking on the state of a body which was before him prior to carrying out a postmortem. “He owes this court a duty to explain all the issues that are relevant to the determination of this inquest. “He needs to explain to this court the findings of the examination he carried out,” Martins said. The Coroner, Mr Mikhail Kadiri, in a short ruling, allowed the testimony of the pathologist on the first autopsy. He said the witness was shedding more light on the autopsy he conducted on late Oromoni particularly the state of the body of the deceased. The coroner said that the information would aid the inquest in its fact-finding mission. Following the ruling, Soyemi revealed his findings to the inquest. He said the late Dowen College student had lobal pneumonia (infection of the lungs) and infection of the liver. “He also had an infection of the kidney and an infection of the right ankle, the soft tissue and the muscle covering the bone of the ankle. “Against these findings, his death was ascribed to septicemia, lobal pneumonia with pyelonephritis (infection of the kidney) arising from the pyelonephritis of the right ankle. “The summary of this is that he had a generalised infection,” Soyemi said. He adjourned proceedings to Feb. 14 for the continuation of hearing. NAN reports that it was alleged that the 12-year-old student died on Nov. 30, 2021, from injuries sustained in an attack by five senior students of Dowen College for refusing to join a cult. It was also alleged that he was forced to drink an obnoxious substance by his attackers. The Lagos State DPP Advice released on Jan. 4, however, disputed the allegation, stating that an autopsy conducted in Lagos revealed the real cause of his death as acute bacterial pneumonia due to severe sepsis. Summary from 8th February Autopsy findings 1. The pathologist ruled out any body trauma from bullying. 2. The pathologist restated that Sylvester died from an infection in his right ankle ( football Injury) That was poorly treated and led to a kidney and liver infection. 3. Slyvester would have survived if he was treated with antibiotics 4. That the autopsy report from Delta shared online was botched, the Pathologist I Delta didn't open the throat and so could not declare chemical intoxication without checking the throat. 5. The Family didn't bring the Delta Autopsy as evidence in the findings 6. Femi Falana objected to mentioning the Delta Autopsy report which led to a shouting match. |

Video and photo slideshows of late Mr Oromoni Jnr. was played at the inquest. One of the videos was Closed Circuit Television (CCTV) of November 23, 2021, which showed the late student arriving home from school. In the footage, he could not walk into his home from the vehicle that brought him. He had to be given a piggyback into his home. Following the playing of the footage and audio, Mr Kpokpo described tendering of the documents as an “intent to ambush the other side”. “The content of this flash affirms our earlier assertion that it was deliberately kept away from us. “The videos that we just watched and the managed audio we listened to had always been in the custody of the family of the deceased and were brought at this stage for shock value. ⓘ “In the circumstances of what we are seeing, we are constrained to go and view all the materials put before us. “I pray that my learned friend is kind enough to extend the courtesy to us as we did to them so that we will be appropriately prepared to cross-examine the witness to move forward,” he said. Update 7th February 2022. Slyvester Oromoniyi: Inquest 7th February 2022: 1. Slyvesters Father and sister were billed to testify yesterday. 2. His sister is a minor and so her testimony could not be taken in the presence of the media. Minors are protected in legal proceedings, it is normally taken in chambers or only Lawyers and those directly involved in the case are allowed to witness it. 3. Video and Audio evidence was tendered by the family. Video showing the state at which he got home and an audio conversation of a phone call with a classmate of Slyvester and Slyvester's father. 4. The Lawyers to Dowen objected that they had not been given time to study the evidence and the Judge gave them till 14th to study the evidence and have it represented. 5. The testimonies of the pathologists who conducted the autopsy will be taken today the 8th. |

buchizy: I am sorry for your ( friends) experience. However he is within his rights to go to court or human rights. Will they take a child away from the mom and give him? I doubt it, instead he will be asked to pay support for the child and be given visitation rights. A child needs both father and mother, a mother cannot keep a child away from the father because he doesn't want to pay bride price. It is actually good they go to welfare and decide how they will both contribute to raising their child. 1 Like |

eyinjuege: Health insurance is not the issue, cost of treatment is not the issue a family that can afford Dowen or Falana is not poor. Medical costs here is not as expensive as what obtains in America. Even poor patients here crowd fund or beg to get money for treatment where insurance is not available. The doctor himself admitted to treating with prayers and not strictly following the protocol after the initial referral. It is not defensible |

eyinjuege: I have been following the process and the family witness said they conducted tests and a scan on the 27th and were referred to the specialist hospital in Oghara. The tests showed Enlarged Liver but instead of going to the refered hospital this doctor with knowledge of the report chose to treat for malaria. The doctor cannot escape liability on this. A family that can afford a family doctor and Dowen fees can't be compared with the financial capacity of market men and women. |

eyinjuege: It seems you are not following the whole process of the Inquest. So a family member testified on Friday he said thr boy was taken for a scan on the 27th and it showed an enlarged liver. The hospital where they had the scan referred him to The specialist hospital in Oghara. The doctor however countered the referral and chose to treat him for malaria. The doctor in his Testimony also confirmed that he and the parents attend the same church and he believes in a combination of prayers and treatment. This for me indices him, he didn't act in the best interest of the patient but allowed the relationship and church doctrine guide him. The doctor should be responding to a medical board and defend his licence |

sisisioge: Again this is just the Doctors testimony. The school will call it's witnesses and the autopsy report will be examined by then we will know what led to the liver damage. It is best to wait for the review of the autopsy report if you want to know what led to the liver damage. It is the family who requested for this Inquest. Everything about the boys death will be examined including what happened in school and shared here. Answers will not come in one hearing but hopefully the Inquest should be done by February ending. You will hopefully get your answers . |

Dr Aghogho Owhojede has revealed that Sylvester Oromoni, the late Dowen College student, was not taken to a hospital for treatment. NAN reports that Owhojede, the Oromonis’ family doctor for 15 years, testified before an Ikeja Coroner’s Court on Tuesday. The medical doctor was questioned by counsel to Dowen College, two accused students, the Lagos State Government and the Nigerian Bar Association (NBA). He recalled treating the teenager for acute malaria at the family home in Warri, Delta, from November 26 to 30, 2021. Owhojede also told Akin George, Lagos State Government counsel, that he attended the same God’s Grace Ministry International Church with the family. The doctor added that Oromoni was taken to church for prayers for an unspecified number of days by parents. “What was your response to the treatment at a church as opposed to a proper medical facility?” George asked. “I am aware that the church is not a treatment centre. I am not against prayer, I will prefer a combination of both prayer and medical treatment,” the doctor replied. The doctor disclosed that on the day Oromoni died, he referred him to Delta State University Teaching Hospital, Oghara, for further treatment. Owhojede said the boy could not be taken there because his condition deteriorated and he gave up the ghost.
