An attack by Nigeria’s Boko Haram jihadists against a Lake Chad army base manned by a regional force has left six Cameroonian soldiers dead, a military source said Tuesday.

“Boko Haram attacked a base of the Mixed Multinational Force on the island of Darak (on Lake Chad) at around 2200 (2100 GMT)” on Monday, said the source, who asked not to be named. He said six soldiers had been killed.

The Supreme Court, Tuesday, gave the Justice Ibrahim Saulawa-led panel of the Court of Appeal in Abuja the nod to deliver judgment on dispute over who should be the flag-bearer of the Peoples Democratic Party, PDP, in the Ondo governorship election billed for November 26. The apex court, in a unanimous ruling by a five-man panel of Justices led by the Acting Chief Justice of Nigeria, Justice Walter Onnoghen, declined to disband the the three-man Special Panel constituted by President of the Court of Appeal, Justice Zainab Bulkachuwa, to resolve the dispute.


Aside dismissing motions to stay proceedings of the appellate court, filed by six chieftains of the PDP in the South West led by Chairman of the party in Ondo State, Prince Biyi Poroye, the Supreme Court, awarded a cost of N1million each to the three Justices of the appellate court.


Poroye and his group had joined the three appellate court Justices, Salauwa, Igwe Aguba and George Mbaba, as 5th to 7th Respondents in the appeal before the apex court.

The Acting CJN, Justice Onnoghen who delivered the lead ruling, ordered that counsel to the appellants, Chief Beluolisa Nwufor, SAN, should personally pay the cost from his pocket. The apex court further ordered the appellants to pay N500, 000 cost to the four other Respondents in the matter among whom included a contender for the PDP governorship ticket, Mr. Eyitayo Jegede, SAN.

Justice Onnoghen held that it was wrong for Poroye and his group to drag the appellate court Justices into the matter knowing that they were only carrying out a judicial duty that was duly assigned to them.

“The 6th to 7th Respondents who are Justices of the Court of Appeal were constituted by appropriate authority to hear and determine the case were not parties before the lower court and whatever they did was in their official capacity as judicial officers”, Justice Onnoghen noted.

He stressed that joining them as Respondents in the matter “was not only an attempt to intimidate and scandalise the judiciary, but to put it in a mild way, an action in bad faith”.

Justice Onnoghen also noted that the appellants (Poroye and his group), had also petitioned a previous panel of Justices of the appellate court that handled the case.

“If the applicants are allowed to continue with this prank, there will be no end in sight and it will not augur well. In the circumstance, there is no merit in this appeal and it is hereby dismissed”.

While concurring with the lead ruling, another member of the apex court panel, Justice Kumai Akaahs, held that action of the appellants was “capable of bringing anarchy”.

However, the apex court panel fixed Thursday to hear the substantive appeal challenging leave that was granted to Jegede to appeal the June 29 judgement of Justice Okon Abang of the Federal High Court in Abuja which recognised Mr.

Jimoh Ibrahim as flag-bearer of the PDP for the November 26 governorship poll in Ondo State.

THE former governor of Niger State, Dr. Muazu Babangida Aliyu, has said that although it is widely held that the place of the woman was in the kitchen, “men also belong there.”

President Muhammadu Buhari had, recently in Germany, declared that women belonged to the kitchen and the inner room in reply to his wife’s protest that some unknown politicians had taken over the administration from her husband.

Aliyu, who spoke in Minna, Niger State capital, at the annual lecture series organised by Newgate College of Technology, said: “Looking at the issue critically, and in Islamic terms, it is actually the man that should be in the kitchen as provided for in the Holy Quran.

“The woman should only be in the ‘inner room,’ while the men should provide all the needs of the woman, including making purchases from the market for the use of the family. “Islam does not permit women to go out indiscriminately, as they are supposed to be in the house taking care of the children.”

Dr. Aliyu, however, said that no matter the situation, especially during recession period, both husband and wife were supposed to work hand-in-hand by supporting each other for the good of the family and society. He also faulted men who took many wives under the guise of religion, saying “the era of men taking many wives has gone.

“Those that have married more than one wife and claimed that the scriptures allow it are doing so ignorantly and out of the tenets of Islam. “What the law says is that if you can be faithful and fair to two wives, you are allowed to take more than one wife. But I don’t see how a man can be faithful and fair to more than one wife at a time.”

Human Rights lawyer, Femi Falana (SAN), has called on President Muhammadu Buhari to immediately direct the Department of State Services, DSS, to comply with the order of the ECOWAS Court and release detained Col Sambo Dasuki (retd), ex-National Security Adviser, on bail without further delay. According to Falana, the continued violation of human rights of Nigerians by the federal government recently resulted in the United States of America banning the Buhari administration from purchasing war planes and other fighter aircraft to prosecute the war on terror in the North East.

In a statement, titled, Why FG Should Release Col Dasuki on Bail, Falana said, while the ban on sale of war planes might be questioned, in view of global fight against terrorism, the federal government should release all political detainees from custody and stop the Police and other security agencies from infringing on the rights of Nigerians.

Falana Falana Recalling that it was General Buhari who promulgated decree no 2 of 1984 to justify the detention of so called political extremists and other subversive elements, Falana said it was under the powers of the decree that former Military President, Babangida, got Buhari arrested and detained. The statement read: “Under the defunct military junta in Nigeria the Constitution was suspended while fundamental rights were put in abeyance.

To justify the detention of the so called political extremists and other subversive elements the Buhari/Idiagbon junta promulgated the State Security (Detention of Persons) Decree no 2 of 1984. “My colleagues and I in the human rights community were regularly detained under the preventive detention decree. But despite the draconian decree the courts never hesitated to order the release of several persons whose detention was patently illegal.

The Independent Corrupt Practices and Other Related Offences Commission (ICPC) has refuted a report that its chairman, Ekpo Nta, had been directed to proceed on compulsory leave from Wednesday.

Vanguard newspaper had on Wednesday reported that the ICPC boss may have been sacked by the presidency.

The report, quoting an ICPC source on Tuesday, said a letter from the office of the Secretary to the Government of the Federation informed Mr. Nta that he should proceed on compulsory leave from Wednesday, October 26.

But in a statement on Wednesday, the spokesperson of ICPC, Edet Ufot, disclaimed the report. It stated that no such letter had been received in the commission.

“The attention of the Management of the Independent Corrupt Practices and Other Related Offences Commission (ICPC) has been drawn to the report in the Vanguard newspaper of 26th October, 2016 authored by one Ben Agande and replicated under different titles by some other online and traditional publications.

“The report purports that ICPC is in receipt of a letter from the office of the Secretary to the Government of the Federation, SGF, informing the Chairman, Mr. Ekpo Nta, ‘to proceed on compulsory leave beginning from today, October 26’. It goes further to impute perceived reasons for the alleged “sack” of the Chairman while quoting an anonymous ‘ICPC source’.


“No such letter or letters have been received in the Commission”, the statement stated.

The statement further disclosed that the ICPC had called the attention of relevant authorities to the matter for appropriate action.

A media aide of the president, Femi Adesina, when contacted by PREMIUM TIMES, said he had no information on the alleged sack.

Mr. Nta was appointed by the immediate past president, Dr. Goodluck Jonathan, in acting capacity in 2011. The appointment was confirmed a year later by the Senate.

He was sworn in on October 17, 2012 by Mr. Jonathan.

The ICPC Act indicates that a chairman would hold office for a renewable period of five years. Should Mr. Nta’s tenure be calculated from the date of his appointment, he would be due for exit this year except his appointment is renewed by the president.

Presidency sources told PREMIUM TIMES Mr. Buhari has no plans to renew Mr. Nta’s appointment based on perceived non-performance; a factor that may have contributed to rumours of his sack.

On December 17, 2015, Mr. Nta was elected member of board of governors of the International Anti-Corruption Academy (IACA) in Laxenburg, Austria.

The ICPC was inaugurated on September 29, 2000 by the then President Olusegun Obasanjo. Its mandate is to receive and investigate reports of corruption and inappropriate cases, prosecute the offender[s], examine, review and enforce the correction of corruption prone systems and procedures of public bodies, with a view to eliminating corruption in public life.

Justice Eberechi Suzzette Nyesom-Wike backed the President, by saying that she belongs to the kitchen, the living room and every room created by God while speaking at the 10th Biennial Diocesan Women’s Guild Conference Thanksgiving Service of the Anglican Diocese of the Niger Delta North in Saint Thomas Anglican Church, Diobu, Port Harcourt yesterday.


According to her, “All women have been through a lot as they strive to build the society.

“Our contributions to societal development cannot be underestimated.

“I belong to the kitchen, I belong to the living room and I belong to every room created by God. So also other women.

“We are created by God to do more. In my own case as a judicial officer, I also belong to the courtroom. Other women belong to different rooms, depending on their professional calling.”

“Women are very important to the development of any community. They form a larger percentage of the workforce that keeps the society,” she added.

Governor Abubakar Bello, who disclosed this while inspecting ongoing renovation at the Justice Idris Legbo Government Secondary School, Kutigi, yesterday, said: “As it is now, majority of the students are not coming out with good results at the end of both SSCE examinations.

WAEC “Instead of throwing away N800 million on examination fees without any corresponding results, this same money could as well be chanelled to renovation of schools, provision of learning equipment and rehabilitation of teachers’ quarters to make them more comfortable to put in their best in teaching.”

The governor, who admitted that the state was still owing both WAEC and NECO N500 million for the last examinations, however, assured the students affected that the debt would soon be settled and their results released.

Six schools, two each from the three senatorial districts of the state, have been pencilled down by the state government for renovation and turning into model schools.

Vivid details of the role played by the police in Rivers State during the aborted arrest of a judge of the Federal High court in Port Harcourt, in the early hours of Saturday emerged yesterday, after sources disclosed that the Directorate of State Services, DSS, in the state informed the Commissioner of Police about the operation before it started.


It was gathered that the DSS in the state had earlier called to inform the Commissioner of Police, Francis Odesanya, that his men were going to effect the arrest. The police boss reportedly complied accordingly by directing his men to cooperate and give them all necessary support.

According to police sources, it was in the early hours of the morning and nobody would have been expected to open his doors freely to visitors, so, the judge refused to open his doors to DSS officials.


The source said: “The DSS office shares the same fence with that of the judge. If they had wanted to accomplish the arrest successfully without much fuss, there are many options left for them.


‘’They should have either scaled the fence to enter the compound or gone with the necessary instruments for the operation.


‘’The governor arrived there with a retinue of members of his cabinet and members of the House of Assembly. While the DSS operatives were dilly-dallying, the governor and his team started obstructing them.

“When the situation was getting intolerable around 1am, the Commissioner of Police arrived the scene. He spoke with the DSS boss and later went to persuade the governor to allow them do their work advising that if there was any breach, it should follow due process later.

‘’The commissioner of police reportedly insisted that the governor should not obstruct justice. When the governor refused to give way, the police boss ordered his ADC to move away from the scene and he complied.

‘’The DSS attempted to move in but the governor, again without his ADC and other policemen that accompanied him who were obeying the Cp’s order, started obstructing them.”


This, according to sources, was the stand-off until around 4am when journalists and other interested parties arrived.

There is palpable tension within the nation’s judiciary triggered by the arrest of some serving Judges including those on the bench of the Supreme Court by operatives of the Department of the State Security Service (DSS) over alleged acts of corruption.
Already, the National Judicial Council (NJC) has summoned an emergency meeting to discuss the appointment of Justice Walter Onnoghen as the next Chief Justice of Nigeria (CJN) as well as the arrest of judicial officers by the DSS.
This came as the Nigerian Bar Association (NBA) declared a state of emergency in the judiciary over the incident.
President of the NBA, Abubakar Mahmoud (SAN) in a press briefing attended by four past presidents of the association – Chief Wole Olanipekun (SAN), Dr. Olisa Agbakoba (SAN); Mr. J.B. Daudu (SAN) and Augustine Alegeh (SAN) condemned what it described as the Gestapo-style of operation of the DSS.
This came as the Chief Justice of Nigeria (CJN), Justice Mahmud Mohammed, the Attorney General of the Federation and Minister of Justice (AGF), Abubakar Malami (SAN) and the National Judicial Council (NJC), a body responsible for the appointment and discipline of judicial officers washed their hands off the gale of arrests carried out by the DSS on the affected jurists.
Media Aide to the Chief Justice of Nigeria, Mr. Ahuraka Isah, who confirmed the arrest of Justices Sylvester Ngwuta and John Okoro of the Supreme Court, however clarified that Justice Walter Onnoghen, who is tipped to succeed the Chief Justice of Nigeria was not affected by the arrest, contrary to some media reports.
The CJN, his aide said, was shocked by the development as there was no single petition against the affected judicial officers before the NJC.
He disclosed that the NJC would hold an emergency meeting on Monday (tomorrow) over the appointment of Justice Onnoghen as the next CJN but could not confirm whether the matter of the arrest of the Judges would also be discussed.
The arrest, which started in Kano and Gombe on Friday swept to some senior judges in the Federal Capital Territory (FCT), Abuja where Justices Sylvester Ngwuta, John Okoro (both of the Supreme Court) and Justice Adeniyi Ademola and his brother judge, Justice Nnamdi Dimgba were affected.
Also arrested in the raid was Justice Muazu Pindiga, who served on the ElectionPetition Tribunal in Rivers State. A competent source told Sunday Sun on condition of anonymity that large sums of money in various denominations, local and foreign cureencies, were recovered from the homes of the judges including banking documents.
For instance, the source mentioned that the sum of N1 billion cash was recovered in the house of Justice Adeniyi in both local and foreign denominations in addition to banking documents and real estate documents, during the exercise. Justice Dimgba, a newly appointed Judge of the Federal High Court, from Abia State has been having a running battle with the DSS over the trial of a retired Air Commodore, Mohammed Umar.
Umar was arraigned before his court over allegations of fraud, illegal possession of firearms and abuse of trust. Although he was granted bail with a bond of N100 million, he is still being held by the DSS.
Irked by the conduct of the DSS, Justice Dimgba had in his ruling ordered the SSS to release Umar or risk being committed by his court.
He further threatened to stop entertaining any case by the DSS unless they comply by orders of his court.
Meanwhile, the Nigerian Bar Association has declared a state of emergency in the judiciary following the midnight arrest of some judges by the Department of State Services. The declaration of the state of emergency was made yesterday evening in Lagos by the NBA President, Abubakar Mahmoud (SAN).
Mahmoud addressed the press alongside four past presidents of the association – Chief Wole Olanipekun (SAN), Dr. Olisa Agbakoba (SAN); Mr. J.B. Daudu (SAN) and Augustine Alegeh (SAN).
The body of lawyers which described the action of the DSS as unconstitutional called on President Muhammadu Buhari to order the immediate release of the judicial officers adding that it was not the duty of the DSS to arrest judges. Mahmud stated: “I want to emphasise again that we are not under military rule and we cannot accept this unholy event and Gestapo-style operation.
“We therefore, call on President Muhammadu Buhari to immediately caution all the security agencies and to respect the rule of law and due process. Any issues affecting the judicial officers, there are established procedures for handling them and we demand that this constitutional process must be obeyed.
“Given the unfolding nature of the event and the seriousness of the situation, the NBA hereby declares a state of emergency as it affects the affairs of the judiciary and I hereby constitute a crisis management team, comprising all past presidents of the association.
“I want to, on behalf of the association, make the following clear and unequivocal demands: we demand the immediate and unconditional release of all the judges abducted from about 9 pm on Friday. The release must be done immediately and without any conditions. Two, we demand that the Department of State Services should limit itself to its statutory and constitutional responsibilities.”
