loomjet: Hello everyone, i have been refused spouse visa today and i want to appeal. i need to know if it is a must to use a lawyer. i want my sponsor to represent me in court intead of get a lawyer that is very very expensive.

Reason for refusal 1: You and stated that you met your sponsor in march 2011 and started a relationship in june 2011. You have provided a marriage certificate dated 16 jan, 2013. you and also provided a divorce certificate from ur previous wife.
The divorce certificate states that the marriage has broken down irretrievably since the parties had lived apart for over 3 years , however records in the UK shows that u applied for leave to remain as a spouse of a settled person to ur previous wife in dec 2008. you continued to pursue with this application until it was refused and u left the uk voluntary on the 31/03/2012. Therefore , i am not satisfied that ur previous relationship and dissolved when you met and started a relationship with ur current sponsor. You have provided pics mainly from ur wedding , you stated that ur sponsor visited u in August 2012 and u have only provided evidence dat she travelled for the wedding in jan 2013. You have provided skype call s from june 2012 these show little evidence of communication, at he most only 5 days in a month. you have provided emails however these are dated march 2013 before ur application. you have provided sponsors call records from tmobile from 26 dec 2012 - 11 march 2013 . your sponsor has stated that she has used a call card to ring u in nigeria. however call cards do not show the recipient of the calls and therefore cant take these into consideration. i therefore am not satisfied your relationship is with ur sponsor is genuine and subsisting or that you intend living parmannetly in the uk.

2: You have stated dat u will reside with ur sponsor at her mthers house . you provided satisfactory evidence to show it is a 3 bedroom and is owned by ur sponsors mother. As a result of checks undertaken by this office i am aware from public records that four residents are listed on the electorial roll at the address where ur sponsor resides you have stated on the ur sponsors mother and father resides there however u have not mentioned the 2 other people. I attemted to contact your sponsor on both her landline and mobile to clarify this situation however i was unseccessful in gaining contact. Given that ur sponsor is not living at the property alone it is reasonable to expect u to provide evidence to show that the property is not overcrowed or that you additional presence there will not contravene public heath regulation. You have not provide this am therefore not satisfied u have adequate accommodation without recourse to public funds. I therefore refuse ur application.

These are the 2 reason for refusal. Pls help justwise and anyone who has been thru dis. should i reapply or should i appeal. I dont want to use a lawyer in the uk because it is too expensive. can i use my sponsor to represent me in court?
The two reasons why you were refused were clarity stated, the question now is this.....with paper evidence can you ratify those refusal points? Even if you want to appeal you will still need to argue your points against the refusal with paper evidences. If you can do that convincingly then reapply.

jenni1108: wait so not having lots of funds in your account is grounds to refuse even if your earning over the 18k thresehold??

do they check electrol roll as well, please what else do they check - my husband will be checking either today or tomorrow for the result of the application

please God
What you earn annually matters most than how much you have in your account presently, some people salary goes to rent, bills and other family expenses etc.

Electoral roll check is one of the ways to confirm address you gave during application

Muhammad Javed: Justwise bro, I talk to them through gmail(online) and there reply was that i will receive a sms on mobile and an email but even when i track my application online the status is that its under process at British high commission. I think its useless as i took extra from university thats even over.

Plz reply as soon as possible
Be patient and wait for their sms or email as they told you, they know your resumption date as the school updates their CAS system

TonMon: @justwise unfortunately they're still saying the money cant be transferred to my account. my question now is does the 28 day financial statement rule apply to companies?
Since your company is not an international organisation, govt or university then the 28days rules does not even come into picture in this case. You can't use that company as your sponsor as they did not meet the requirement, they can only sponsor you by leaving that money in your account.

It does appear they only want to help you get the visa without making the money available to you

chomiq3: Hi Everyone, please I need your advise. Am devastated, I was refused a Uk visiting visa for the second time today. To attend a career conference, cos I also wanted to use the opportunity to reunite with my fiance whom I saw last in 2005 as coppers. And we have fixed a church wedding in Oct and come back to Nigeria for the court marriage. There after I'l stay back to apply for a settlement visa. Please what do I do now if he invites me since I stated I know him in UK will it affect me? Or if he comes down to Nigeria will they issue me a spouse/settlement visa? I had 1.4m in the statement with 200k monthly salary.

Here is the Refusal letter

In other to be able to make a decision on whether or not to grant u entry clearance in this category. I have taken into account your stated circumstance in nigeria, the reasons for your visit and your proposed travel arrangements. You stated dat u earn 200k per month as a Project Administrator and that that this trip will cost you £1600. This expenditure is high, when considering ur economic circumstances in Nigeria, given the statements you have made and the documentary evidence you have made presented to support your application. I am not satisfied that your circumstances in nigeria, coupled with your reasons for wishing to travel to the uk are such you have shown that your intentions are as stated or dat u intend to leave the uk at d end of ur proposed visit. I am therefore not satisfied that your application meets the requirements of paragraph 41 of immigration rules.

I have therefore refused your applicatioon because I am not satisfied. On the balances of probabilities, that you meet all of the requirements of the relevant paragraph of uk immigration rules.
Thank you All.
Are you sponsoring the conference or the company you work for?

Ebeano49: (

I agree but I didn't. I was told it didn't matter provided I show I earn enough. How I regret that now ...especially after reading some of the comments on here! I'm not sure anymore if that was the right decision. I pray daily for God to take control as there isn't much else I can do right now.
You don't have much to worry about, your earning is good even as its overdrawn for good reasons, even if you are refused (though i doubt) you can appeal and its a winnable case as you can explain things even better in your appeal letter and in tribunal if it gets to that point.

Ebeano49: I'm new to this forum. Thanks guys for all the good work. Please I advise/reassurance that my wife's settlement application will be ok. Here's our situation.

I met my wife through her cousin in 2012 January. She just finished her NYSC. We had our traditional marriage in December 2012 and wedded at Ikoyi registry in April this year. (I plan to do my church wedding here because I hardly have any friends in Nigeria).

My wife submitted here visa application at VFS Lekki on 25th April.

I submitted ALL documents; payslips,P60, bank statement, rent agreement, letter from employer, my ILR, marriage certificate, pictures, Whatsapp chat history and the lot.

The problem that has been giving me endless concern is that my current account statment was mostly overdrawn in the past six month becuase I have an ongoing project in Nigeria. I earn well over £50k per annum and work for an investment bank in the city of London.

My question is - will my overdrawn account statement alone be a reason to refuse my wife's application?? I got a call from UKBA yesterday because according to them, I am not on the electoral roll at my current address. I told them that is because I moved house in October last year and haven't contacted the council to update the electoral roll. The lady said OK, that she just wanted to clarify.

Please help. This uncertainty is simply KILLING me ... and my wife! Thanks
Did you explain why your account was overdrawn in your application? With that figure you earn you should be fine though it helps to clarify any activity in your account that could cast doubt to your financial standing.

Glamour4real: if not that our leaders are sucking us dry and turning our God so blessed country with rich natural resources to curses what on earth will a nigerian be looking for in the UK. what does Britain have to start with, absolutely nothing. all they have is bad weather, junk foods etc. we are better than them if we have good leaders.
If they got nothing why then are you complaining? You should be happy and save your 3000 pounds after-all Nigeria is better and you have everything you want in Nigeria

TonMon: ok not to bother you, but is it going to be a problem if its in their account? because they actually are ready to sponsor me its just that they just cant transfer the money into a personal account for various reasons. just want to know if it will be a problem if its in the company account
It will be a prob as the company is not a multinational one and their financial capability can not be guaranteed, if they truly want to spend that money on your education then they should give it to you.

They are not ready to sponsor you, because whether the money is in your account or their account you will still need to pay the whole school fees and have 7200 or 9000 pounds to show for your maintenance money.

My company is sponsoring me to do a masters program in the uk and i will like to know if the company needs to have the minimum financial requirement for at least 28 days before the statement can be used to apply for a tier 4 student visa.. my boss says he cant promise that since its a company account and it will have to withdraw money from the account when the need arises
Is your company a multinational one?

opsy4real1: hello to you all on this thread...I need experienced people in the house to profer meaningful advice toward re-applying for a u.k tourist visa anytime frm now after 6years i was denied. I was denied twice actualy of student visas in 2007 and 2008 respectively. In 2006, my refusal was based on d fact that they doubt d genuinety of my sponsor's statement of account and that funding my education wud impose an additional financial burden upon him and that they r not satisfied that the increased financial outlay is commensurate with his current economic circumstances and that such funds wud actualy be available to me in da u.k. . Second time around i reapplied in 2008 and again denied on the ground that 'i was unemployed and i already have a degree from 2006 and yet i av failed to secure any employment and i have failed to submit any evidence of my own financial circumstances. in an overall assesment of d credibility of the application, they r nt satisfied the cost of the study is proportionate to my current economic circumstances or that there are advantages i might derive frm dis course of study. I am nt satisfied, on d balance of probabilities that i intend to follow d course. It further stated that my application also falls to be refused unda paragraph 320(7A) of d immigration rules:where false representations av been made or false documents have been submitted(whether or not material to d applicaton, and whether or not to d applicant's knowledge) or material facts av not been disclosed in relation to d application. You state dat d cost of ur tuition.maintenance and accomodation is to be borne by ur uncle mr. Bleep. As evidence of his means u av submitted 2 vehicle proof of ownershp certificates. As a result of checks made by this office i am satisfied to a high degree of probability that this document is nt genuine and the production of such documents undermines d credibility of my applicatn and causes me to doubt ur intentions in the u.k..(this is my story) Now i am self employed afta workin for a company for 2 yrs btw 2010 and 2012. I registered my biz in jan 2013(abt 7months ago) and now I av a vry gud income and bank balance..i av traveled to 4 countries within last 2 yrs. Now i plan to apply for a u.k tourist visa. Wat r my chances as per my previous applicatns wit dem?
You are serving 10yrs ban. You still have 5yrs to go before you can apply for UK visa again

Dear Vicjustice, once again thanks for your response. Do you think its just easier n straightforward that my child and I applied for a visit visa instead of the family visit and we just book an hotel but I hope from uk embassy records that it does show dat my bf who is my baby dad still presently in the uk. As I ave my sons birth certificate whIch shows it was issued in d uk and his bf record as well. Thank you
What is the different between the process of applying for family visiting visa and visitor's visa?

Banty D: Thank you so much for your time, I'm grateful. I need to know if its alright to go ahead with the spouse visa application and attach a comprehensive supporting statement "in great details" in previous applications with materials to prove the authenticity of our marriage, cos another supposed "quack agent" said to me that I'll have to get a lawyer to overturn the ban in a UK court before reapplying. Please kindly help straighten out this part of my dilemma.
Vicjustice: YOU DO NOT NEED A LAWYER OR ANY SILLY AGENT because, there is no lawyer or "agent" that can help you in this matter, only the credibility of your marriage and the requirements that your spouse has to meet MAY redeem you from the 10 years ban

^^^^^ read that over and over again, if you still want to waste your money with those useless agents then good luck

Banty D: Great stumbling on this platform; I'm glad I can count on you to give sincere advice, I applied to study in the UK in 2008 but my application was declined, I again applied to study in 2010 with my tuition paid in full and evidence of a year living expense in my account but was again declined with a refusal letter stating I used deception (fake bank statement) in 2008. My travel agent who helped with the visa packaging in 2008 later admitted he did played foul in an attempt to impress my Dad who's been of great help to him in recent time. I however reapplied again in 2010 with a supporting statement but was declined again. I got married lately to a British citizen and intend joining her in the UK but my ban seem to be a barrier. Please kindly help on how to go about applying for a spouse visa or what to do to overturn the ban. Looking forward to hearing from you soonest. (What in your own opinion is my best bet?)
Though spouse visa overturns 10yrs ban(for presenting fake bank statement) but you need to explain in great details what happened in previous applications (2008 and 2010) you have to be absolutely honest about those cases else you will be refused and given the right of appeal.

The second thing you need to do is to proof that your marriage is genuine, you do this by presenting materials such as marriage certificate, wedding pictures, evidence of communication( emails, phone call logs, chats, letters..etc)

Get informations. Safe trip
Yes they do, if you decide to have your baby in USA as non-citizen then you are expected to pick up all the bills.

Whether the bill is on your baby's record or yours it doesn't matter, its your responsibility to pay for the delivery.

Yes you will be denied a visa if you can't proof that you paid for the delivery.

AjanleKoko: I for say. Doesn't make any sense to apply the same criteria to EVERY single visitor, considering that some people do regular business, or even own homes in the UK. Many people travel there every summer religiously for holiday. I would be surprised if they were asking for a bond from those categories of people.
Going by some comments here one will get the impression that the 3000 applies to all visas and non-refundable.

Typical of many Nigerians, they read the headline and jump-off ranting

Can't possibly apply to all categories of visitors. Maybe first-time visitors.
6 months visa applicants, basically first timers
