Atiku cries foul, says 2-day public holiday meant to subvert court sitting

THE feud within the presidency reached another level on Wednesday as the Federal Government declared a two-day public holiday a few hours to the Supreme Court’s hearing of Vice President Atiku Abubakar’s disqualification case.


In a sudden announcement, the Federal Government, in a statement, said the holiday was necessary to allow Nigerians to travel in order to participate in Saturday’s polls.


The vice president’s camp is, however, crying foul, alleging that the holiday was meant to thwart the Supreme Court ruling on the disqualification of the vice president.


The Supreme Court had earlier fixed Thursday for the commencement of the hearings on the disqualification of the vice president.


Some judiciary watchers even noted that since all the sides to the case had filed their positions and arguments, the apex court could possibly rule today.


All these, however, changed as the release from the presidency described Saturday’s election as a critical one on which Nigerians must fully concentrate.


“President Olusegun Obasanjo has declared Thursday and Friday as work free days to enable people to travel in order to participate in governorship and state House of Assembly elections,” the government said in a statement.


Abubakar’s spokesman, Mallam Garuba Shehu, said the holiday was a “pre-emptive strike” against the Supreme Court which had been expected to take evidence on the disqualification controversy.


“This is pre-emptive strike to subvert the sitting of the court. It is a holiday that nobody needs or planned for and it is not necessary,” he said.


In a statement made available to the media, the vice president’s campaign team said “the campaign finds no other justification of this unnecessary holiday other than a calculated deliberate and sinister attempt to prevent the law courts from sitting to adjudicate on urgent election related matters.


“It is instructive the Supreme Court is scheduled to hear arguments and possibly rule on the power of INEC, to disqualify candidates without reference to the courts in a case brought before it by the Action Congress and its Presidential Candidate, Vice President Atiku Abubakar.”


“The decision of the Supreme Court would have provided relief to the many governorship and state assembly candidates who have wrongfully been disqualified by INEC.


“This action of the president further confirms our position that the government is manipulating state institutions to exclude its opponents from participating in the elections, and that all claims to providing a level-playing field for all candidates are therefore deceitful, insincere and hypocritical.”


“We regard this as an attempt by the government to muzzle and intimidate the judiciary, an arm of government that has so far demonstrated an uncommon courage and independence in the face of a rampaging and lawless Presidency.


“We can only imagine the colossal losses and the enormous damage to an already weak and tottering economy as a result of these unsolicited holidays that the President has inflicted on the nation.

The President has clearly acted against national interest and it is consistent with his declaration that this election is warfare – a matter of do or die.”


The holiday means any outstanding cases relating to the elections are to be put on hold, giving less time to the apex court to deliver a ruling on Abubakar’s case.

More than 90 people were burnt to death yesterday in a fire incident caused by petrol, which spilled from a tanker in an accident in Gadoko Local government Area of Kaduna State.
The victims of the fire incident were said to be scooping fuel from the scene of the accident before they were engulfed in a ball of fire.
The driver of the petrol tanker was said to have lost control over the vehicle, which fell across the road, before its contents were spilled .
According to sources around the accident scene, people in the village shortly after the accident mobilised themselves and started scooping petrol that was gushing out of the tanker,. And just twio hours after the accident, the tanker went up in flames and all those around the area did not escape, they were all burnt to death leaving behind, items that they were using for to scoop the fuel, including buckets, jerry cans and bowls, before they met their untimely deaths.
The charred bodies of victims of the fire disaster were seen scattered around the scene of the accident. Some were said to be passers by including a person that wasreturning from the village market.
Following the incident, the village has been thrown in a mourning mood given that alamost every family there m,ay have lost some of their members in the inferno. Some relatives of the deceased were seen around the scene of the accident, trying to identify and recover the corpse of their deceased relatives.
The Kaduna State Deputy Governor, Mr. Patrick Dangkomi visited the scene of the accident in company of the State Commissioner for Police and members of both the State House of Assembly and National Assembly from the state.
Reacting to the disaster, the Deputy Governor said, ìit is a big loss not only to Kaduna State but also to the whole of Nigeria. It seems that we donít learn from the past that is why events have been repeating themselves in this countryî.
The remains of the victims have since been buried in a mass grave while survivors of the accident are receiving treatment at a nearby General Hospital

Why are Nigerians so “not” Unhappy?

I have patterned the title and contents of this article after a similar article by an anonymous author titled “Why are Americans Unhappy?”  that I came across on the web. Hence I dare not claim complete originality. However, while the guy is wondering what Americans have to be unhappy for, I have been wondering what Nigerians have to be happy for.

A recent study of more than 65 countries published in the UK's New Scientist magazine had suggested that the happiest people in the world live in Nigeria.

In essence, Nigerians because of, or in spite of their situation are happy. So being the person I am, I starting thinking, "What are we so “not” unhappy about?"

Is it that we have electricity and running water 24 hours a day, 7 days
a week? Could it be that 90 % of these happy Nigerians have a job? Maybe it is the ability to walk to the neigbourhood market at any time without fear of your cell phone being stolen or an irate danfo driver hitting you, and get there to see fresh food at affordable prices?

Maybe it is the ability to drive from Lagos to Maiduguri without having to present green notes to the men in black, or our life savings to the other men in black as we move through each state?
Or possibly, the fact that we do not encounter potholes that have become death traps in our travel across the nation’s roads is what makes us happy?
Or the hundreds of clean and safe hotels we would find along the way that can provide temporary shelter? I guess having petrol stations with petrol at normal prices along the way is what we are so happy about.  Or the choice to take a “luxurious” bus to avoid the stress of driving yourself, and still be sure of arriving at your destination on time and in one piece?

Or could it be that when we wreck our car, emergency workers show up and provide services to help all involved. Whether you are rich or poor, they treat your wounds and even, if necessary, send a helicopter to take you to the hospital.

Perhaps, we are happy due to the fact that when we sprain our ankle while exercising at home after a heavy meal, we can easily walk to the nearest hospital for treatment, or the fact that the multitude that suffer from catarrh and kidney ailments are flown to German hospitals at government cost.

Perhaps you are one of the 70 percent of Nigerians who own a home. You may be happy with knowing that in the unfortunate case of having a fire, a group of trained firefighters from the well-equipped Fire Brigade will appear in moments and use top notch equipment to extinguish the flames, thus saving you, your family and your belongings.
Or maybe the fact that your house isn’t fenced round like a prison ,or that you can go to sleep at night with your door unlocked and your windows open for fresh air to get in?

Or if, while at home watching one of your many flat-screen TVs, with regular electricity provided by PHCN, without the disturbing noise of your neighbour’s generator, a burglar or prowler intrudes, an officer equipped with a gun and a bullet-proof vest will come to defend you and your family against attack or loss. This all in the backdrop of a neighborhood free of stray bullets or armed political thugs maiming and pillaging the residents - in neighborhoods where 90 percent of teenagers own cell phones and computers.

How about the complete economic and political freedoms we enjoy that are the envy of everyone in the world? The right to choose our leaders without the People Deceiving People’s party shoving accredited thieves down our throats as candidates seems to be what makes us happy.
Or is it because over 90% of our university graduates are employed even before leaving school? And you can go to work and get back daily without wasting several hours in traffic? And the private sector is provided with such an enabling environment that tyre companies don’t have to move their operations out of Nigeria?

I guess we are happy because our pensioners get paid on time without having to stay on queues for several days to get their peanut gratuities. Or because in the Niger Delta, they drive on paved roads and live in big buildings that are the dividends of having natural resources.

Now, I am beginning to understand why we are happy.  Because we have a president who holds us in such a high esteem that he makes time out of his busy schedule  to visit Lagos when there is a bomb explosion at the military cantonment. We have ministers who serve us so selflessly that our beautiful roads can lay claim to the “Seven Wonders of the World”, while our doctors are so well paid that they never go on strike.

The fact is we are so “not” unhappy because there appears to be so little or nothing to be happy about, that if our happiness were to be taken away from us, and we refused to be happy, there would really be little to live for.

If we don't remain “happy”, what we have will be taken away. Then, the ruling party and its beautiful reform programmes that engender “happiness” in us might be swept out in the coming elections.  Then we will have to explain to future generations why we squandered such “blessings and abundance”.

If we are not careful, this generation will be known as the generation that saw through the screen that covered their eyes and did the right thing by voting out the bad rulers we have , and maybe then we would not be so “not” happy!

May we continue to be happy!

I said earlier that I weep for the living citizens of Nigeria.

Yar'adua , a supposedly performing governor has catarrh or kidney problems ,and flies to Germany, because in 8 years his  'performance' or his party's 'performance' did not include the construction of a modern hospital.

Atiku hits his leg against an object and flies to London because for the past 8 years all the PTDF money they shared was not enough to build a standard hospital.

When you and I fall sick we go to the nearest hospital, where we are even sent away because the doctors want to go on strike!

I wish to thank all Nairalanders for their outburst of sympathy especially to those who never knew AbdHameed when he was alive.

I weep not for him, but for the millions of Nigerians who unlike Yaradua and his acolytes  ,cannot fly abroad when they fall ill.

I have contacted the Nigeria Medical association, the Health Ministry and a few newspapers, if only to generate some discussion on this issue. Things cannot continue like this in Nigeria.

How Obasanjo and the striking doctors killed my friend!

How does one begin a sordid tale like this? How does one begin to recount the atrocities of a nation that derives joy from murdering its best people in their primes? How do I relate how the striking doctors colluded with the Nigerian government to kill my friend ?
How do I narrate the events that led to the death of AbdHameed Olasupo Agberemi on March 5, 2007 at the young age of 32.

Make no mistake about it; I am not attempting to blame God. Neither do I term AbdHameed’s death as untimely, for every man has his destined time, and when it is up, he will go. I am a Muslim, and I believe that to Allah we belong and to Him is our final destination. However, I also realize that something will be the cause of one’s eventual death, and in this case, the causes are inexcusable, as they depict a failure of the Nigerian system.

For those of us who knew AbdHameed very well,or Supo as his secondary school friends called him, it was a privilege knowing him. He was a gift to our generation. Right from his undergraduate days at Obafemi Awolowo University, where he studied Food Science and Technology, all who came into contact with him were amazed at the depth of his intelligence and the width of his thinking. When he put pen to paper, we could only marvel at the strength of his convictions, and his mastery of the written word.
It was no surprise that he never practiced as a Food Technologist for he was destined for greater things.

Right out of school, he formed an NGO, that championed women and children’s rights, a feat for which he was acknowledged both at home and abroad, culminating in a Research Fellowship at the prestigious Emory University Law School, Atlanta.
AbdHameed made several trips to the Hague in Netherlands and to various conferences around the world presenting the products of his scholarship, which some of us were privileged to read.

However, despite our entreaties for AbdHameed to join us abroad, he always chose to return home after his trips, saying Nigeria was the place for him, and he had bright hopes for the future in Nigeria.
Based on this, AbdHameed finished his Masters program in Peace and Conflict at the University of Ibadan, and enrolled for a PhD at the same school but it was not to be.

He started losing faith in the country in October  last year when he had a close encounter with armed robbers in Lagos, which he described thus in his words “Robbers made away with my laptop (containing thousands of documents being my intellectual effort since September 2003, last backup on CDs was in July 2006); my phone and so many contact numbers; flash disk; my international passport with so many visas since 2001; other documents on me at the time, and of course, cash.”
It was a tough loss, but one which he prayed and planned to overcome.

However, his final journey began late December without any warning. He lived in Eleyele, Ibadan with his wife, a practicing lawyer and their daughter. He left the house on the fateful day and made to cross the road to enter a commercial bus. Having checked to ensure there was no oncoming vehicle, he started to cross, when from nowhere, a commercial bus driver at top speed driving on the wrong side of the one-way road crashed into him, inflicting serious head injuries and sending him into an unconscious state.

He was rushed to UCH, Ibadan where he spent two weeks in coma before regaining consciousness. Since then he had been undergoing several surgeries and was getting better.  I had even called several times and spoken to him on phone, and apart from some slight slur in his voice, he sounded almost like the AbdHameed we had grown to admire and respect.

Some weeks later, some complications arose which blocked his trachea and affected his breathing, prompting a surgery which was carried out to fit a breathing tube into his trachea to aid his breathing. The doctors planned another surgery to remove the breathing tube and fix the trachea complications, but this was complicated by the fact that UCH, one of the topmost health institutions in Nigeria did not have a laser knife which was required for the surgery. Hence, they had to reschedule another surgery, while AbdHameed continued to breathe with the aid of a tube.

It was in the midst of all these that Nigerian doctors decided to go on strike. I will not waste time debating the rightness or otherwise of the strike action as it is of no use to me or the bereaved family. I only know that it was one strike too many.

AbdHameed was compulsorily discharged from UCH last week despite his situation, and the family had to make arrangements to take him to a private clinic in Ibadan, while praying that the strike action would be called off soon.

However, this was not to be as on Sunday night, the 4th of March, 2007, complications arose with the breathing tube. The private doctors tried their best, but not being specialists in that field or being familiar with his case, it was to no avail. For six grueling hours, they labored, while my friend gasped and struggled to breath, but at the end he returned to his Creator.

If it was in more advanced countries, I would have dared to sue the government and the striking doctors for complicity in his death, but knowing Nigeria, it will be a wasted effort. I know AbdHameed is not the only casualty of this strike, and that saddens me about the country called Nigeria.

It is eight years since we have had a ‘democracy’, and while the president and his vice fight themselves over sordid allegations, the citizens are left to die away. The common people can die all they want as long as the PDP has its way in the do-or-die affair it calls an election.

I hope the doctors enjoy their allowances when and if they get, it but I will always remember their role in AbdHameed’s death.

May God Almighty forgive AbdHameed and grant his parents and family the fortitude to bear the loss.

I got up unusually early to take care of some business online and with the process going on in the background, I thought I'd see what's happening back home as reported by my usual information source - nigeriaworld.com. Adedibu's interview caught my attention. It was riling in its repulsiveness and yet I had to stick with it all through the 30 something minutes of what might well be the best-documented yet evidence of the injustice that the Black man is saddled with in the experience of the most populous black nation in the world.

There's no point recounting the vileness (everyone should watch the clip for themselves), but this is the type of bed we collectively made for ourselves, and this is what we have to sleep in. The gentleman was oblivious of the flagrance of his odious posture boastfully narrating his thuggery and deliberate disruption of elected governments of his home state over the years.

I ask again, how did we get here? What did we do to deserve this state of affairs? We can possibly get a peep even through recent events in our country's recent politics at the national level. President Obasanjo's failed attempt to subvert the constitution and keep himself in power for a third term was excused as a need to ensure his "fight against corruption" would continue undeterred. However, if the eight years of opportunity he had had been used to firmly entrench a structure of politics that respects the rule of law and promptly disciplines offenders without fear or favor, there would be no concern about handing over power to whoever the people elect.

The current imbroglio between the President and his vice wouldn't be any big deal if rather than stroking the need to be all-important, the presidency had elevated our country's constitution to the level of AWE such that the likes of Adedibu, however uncouth, would be mindful of what they admit to.

Obasanjo will leave office; Atiku or whoever else will probably step in; unfortunately, our constitution would remain unrevered and the likes of Adedibu blithely ignorant of the significance of "legacy".

Obasanjo pimped Nigeria to Shagari and his cohorts. He, practically unlike anyone else in history, got a second chance to put Nigeria on auto-pilot with no concern for man's ineptitude. I fear he failed, and Nigeria remains at the mercy of everything but intellectual or logical reasoning.

Answering the call of nature in Lagos
BBC News is investigating the changing face of business in Africa, a continent once regarded as a high risk location for investors but now increasingly a place to do business.
Sam Olukoya reports from Lagos where a local entrepreneur is benefiting from a niche in the market - providing portable toilets.


Isaac Durojaiye was sure that his business would succeed

"Years back those who evacuated human waste in Nigeria were ashamed to do the job - they covered their faces so nobody could recognise them.

"But all that is changing now," says Isaac Durojaiye - also known as Otunba Gaddafi - who runs a mobile toilet business called Dignified Mobile Toilets (DMT).

"I named it dignified to show the world that there is dignity in the business," says the former bodyguard whose code name while working in government security circles was Gaddafi.

"There is nothing to be ashamed about human waste, it is a reality - we all have to answer the call of nature."

Confident of success

He started the business in 1992 after observing that there were only about 500 functional public toilets in Nigeria, a country with a population of more than 130m.


The toilets are becoming a familiar sight in Nigeria's major cities

"Even then most of the public toilets were poorly maintained," he says.

Mr Durojaiye says his mobile toilets which are made of high quality plastic materials are available for sale, rent and for leasing. DMT maintains the toilets and its specialized trucks evacuate the human waste twice a week from each toilet.

He recalls that when he set up the business he was confident of success given that with a population of Nigeria's size, there is a huge demand for public toilets.

Social service

The toilets are becoming a familiar sight at densely populated public places like bus stops and motor parks in major Nigerian cities.

"We are performing a major social service as we are eliminating the need for people to defecate in public places," he says.

Each toilet according to him typically serves about 100 people each day for a fee of 20 Nigerian naira per usage.

A typical day's proceeds works out at about $15 which is a fairly good income by Nigerian standards.

And for a fee, businesses can advertise their products on the toilet doors. To date, about 25% of DMT's revenue comes from advertising.

The company is also working on plans to recycle the waste collected to generate bio-gas, electricity and fertilizer for farmers.

First female governor in Nigeria

Virginia Etiaba has been sworn in as Nigeria's first female governor after Anambra state legislature impeached Peter Obi for gross misconduct.
She had been deputy governor in the south-eastern state and initially refused to take the position.

Mr Obi said he would not leave office and civil rights groups have criticised the whole process as unconstitutional.

A BBC correspondent says the battle could get more volatile if supporters of the two sides take to the streets.

Shock

Both Mrs Etiaba and Mr Obi, from the opposition All Progressives Grand Alliance (APGA), only occupied their posts in March this year.

They took power after a court ruled that Mr Obi's predecessor had rigged the election in 2003.

Mr Obi told the BBC that he does not feel disappointed by Mrs Etiaba's decision to assume the office of governor as she was "just following the rule of the law".

He said that he would fight the impeachment in court as he "believes in the constitution".

The BBC's Abdulsalam Ahmed in Anambra's state capital, Awka, said 64-year-old Mrs Etiaba looked shocked after the impeachment on Thursday.

"The governor is my boss and he remains my boss," she said at the time.

But on Friday morning she was sworn in by the state's chief judge.

In a brief speech, she said she had accepted the position because of the "peculiarity of the situation".

Election battle

This is the fifth state to start impeachment proceedings against a governor this year.


Ex-Governor Ngige was sacked earlier this year

Some say the recent impeachments are part of the fight against corruption.

But critics say it is often more about rival politicians trying to take charge of the state so they can control the elections due early next year.

Chris Ngige, from the governing People's Democratic Party, had been Anambra's governor for three years, but had fallen out with senior party figures soon after the election.

He said it was because he refused to loot public money to pay them back for their support.

Since Mr Obi took office in March, he has been locked in a power struggle with one of the president's closest aides, Andy Uba, who wants to win the governorship in next year's elections.

Analysts say the impeachment process could only help this ambition.
