The Federal High Court sitting in Abuja, on Thursday, dismissed the suit the Peoples Democratic Party, PDP, filed to declare the seat of Governor Ben Ayade of Cross River State and his Deputy, Ivara Esu, vacant, following their defection to the ruling All Progressive Congress, APC. The court, in a judgement that was delivered by Justice Taiwo Taiwo, held that the duo could not be sacked from their positions, other than through statutory procedures that were stipulated in sections 180, 188 and 189 of the 1999 Constitution, as amended. It held that defection to another political party was not stated as one of the grounds for the removal of either a governor or his deputy. “The 3rd and 4th Defendant cannot be removed except by Constitutional provision. “This court has no power to declare vacant the seat of the 3rd and 4th Defendants”, Justice Ekwo held. A groom’s best man at Gaida area of Kumbotso LGA of Kano State has stolen wedding gifts belonging to the bride worth N500,000.
The incident happened a week after the wedding as the suspect was in possession of the house keys of the couple.
Speaking on the incident, the vigilante commander of Gaida, Shekarau Ali, said the groom reported the case and they arrested the suspect after an investigation.
According to him, the suspect got the keys from the relatives of the bride with the claim that he was going to hand them over to the groom.
He further said, “The groom asked for the return of the keys but he refused. When he saw that the couple had gone out of the house, he opened the house and stole the wedding boxes (gifts) and food items.”
He added that they are investigating him and will subsequently hand him over to the police.
Meanwhile, the suspect confessed to the crime, saying it was the devil that made him betray his friend and pleaded forgiveness.

The Federal High Court sitting in Umuahia, Abia State has ordered the Attorney-General of the Federation to immediately delete Section 84 (12) of the Amended New Electoral Act.
Justice Evelyn Anyadike on Friday held that the section was unconstitutional, invalid, illegal, null, void and of no effect whatsoever and cannot stand, as it is in violation of the clear provisions of the Constitution.
The section says: “No political appointee at any level shall be voting delegate or be voted for at the Convention or Congress of any political party for the purpose of the nomination of candidates for any election”.
In the suit marked FHC/UM/CS/26/2022, Justice Anyadike further stated that Sections 66(1)(f), 107(1)(f), 137(1)(f) and 182(1)(f) of the 1999 Constitution already stipulated that appointees of government seeking to contest elections were only to resign at least 30 days to the date of the election and that any other law that mandated such appointees to resign or leave office at any time before that was unconstitutional, invalid, illegal null and void to the extent of its inconsistency to the clear provisions of the Constitution.
While signing the Electoral Bill into law last month, President Buhari had asked the National Assembly to delete section 84 (12).
President Buhari had argued that “Section 84 (12) constitutes a disenfranchisement of serving political office holders from voting or being voted for at conventions or congresses of any political party, for the purpose of the nomination of candidates for any election in cases where it holds earlier than 30 days to the national election”.
However, the Senate refused to consider the president’s request and threw out the bill seeking the amendment of the section, with lawmakers stressing that an amendment would be going against the civil service norms and would be injurious to the well-being of the society.
On Wednesday, the AGF said following the Senate’s refusal, the Federal Government will consider all other options available to it before a position will be taken.
Malami further explained that even though it is the responsibility of the lawmakers to legislate, if it becomes necessary, the government will exploit other options which will include either putting forward another request to the parliament for reconsideration, approaching the court, or accepting the law just as it is.
Addressing newsmen after the court sitting on Friday, Counsel to the Plaintiff Emeka Ozoani, (SAN) stated that by this judgment, the National Assembly is not required to further make any amendments to the section as the import of this judgment is that Section 84(12) of the Electoral Act is no longer in existence or part of the Electoral Act.

The owner of Burger King said the operator of its 800 stores in Russia has "refused" to close the sites despite demands to suspend trading. Restaurant Brands said it had contacted its local partner, Alexander Kolobov, to shut the shops following Russia's invasion of Ukraine. But it said "complicated" contracts with overseas partners mean it is unable to "walk away" from these deals. Many Western firms have shut or suspended their Russian businesses. However a small number, including Burger King and UK retailer Marks and Spencer (M&S), have been unable to do so because their stores are run by franchise partners under "complex" legal arrangements. The BBC has contacted a representative for Mr Kolobov for comment. In a letter to staff , Restaurant Brands International president David Shear said: "We contacted the main operator of the business and demanded the suspension of Burger King restaurant operations in Russia. "He has refused to do so." Mr Shear added that making any changes to its local Burger King business "would ultimately require the support of Russian authorities on the ground and we know that will not practically happen anytime soon". The US says China will face harsh "consequences" if it aids Russia in its invasion of Ukraine, according to US media reports.
Unnamed officials reportedly told multiple US news outlets that Russia asked China to provide military assistance after it began the invasion.
The Chinese foreign ministry described the allegation as disinformation from the US.
The exchanges come as top US and China officials prepare to meet in Rome.
US media outlets, citing Washington officials, say that Russia has in recent days asked China specifically for military equipment, including drones.
In a CNN interview, US National Security Adviser Jake Sullivan said they were "communicating directly, privately to Beijing that there will absolutely be consequences for large-scale sanctions evasion efforts or support to Russia to backfill them".
"We will not allow that to go forward and allow there to be a lifeline to Russia from these economic sanctions from any country, anywhere in the world," he said.
He added that while the US believed China was aware that Russian leader Vladimir Putin was "planning something" before the invasion happened, Beijing "may not have understood the full extent of it".
"Because it's very possible that [Mr] Putin lied to them the same way that he lied to Europeans and others," Mr Sullivan said.
In response, a spokesman for the foreign ministry in Beijing, Zhao Lijian, said the US was spreading disinformation.
He added that China's stance had always been consistent and that China was playing a constructive role in promoting talks.
Mr Sullivan is due to meet Yang Jiechi, a member of China's top decision-making body, the Politburo, and the head of the Central Foreign Affairs Commission, on Monday in Rome.
Reuters news agency quoted a US official as saying that during the meeting, Mr Sullivan would spell out the consequences and isolation China would face if it increased support for Russia.
China has so far refrained from condemning Russia for the invasion and has said Moscow's "legitimate security concerns" should be taken seriously.
But Beijing at the same time has expressed "unwavering support" for Ukraine's sovereignty. It has also called for peace and has said it is ready to help end the war through diplomacy. Several countries have urged China to do more to stop Russia's invasion.
The EU and US help Ukraine, China helps Russia; if that's how this goes, then it's a delineation that will make the war in Ukraine an even more consequential one.
The White House has decided to make public its claim just as President Biden's top security adviser is due to meet with China's most senior diplomat. It appears to be a tactical move, to put pressure on China; presumably to either confirm or deny it.
The bigger aim could be to try to make Xi Jinping weigh up the pros and cons to his current position of what was last week called a "rock solid" relationship with Moscow.
Remember that it was just weeks ago, as the Winter Olympics opened in Beijing, that Presidents Xi and Putin declared a new alliance that had "no limit". Military aid could, clearly, be part of that.
But in the days after Russia's invasion China has condemned the UK, the US and others for giving weapons to Ukraine's military, saying they were adding "fuel to the fire".

Iran's Revolutionary Guards force says it targeted an Israeli "strategic centre" with missiles that struck the Iraqi Kurdish city of Irbil overnight.
Twelve missiles hit areas around the US consulate overnight, causing material damage and wounding one civilian, the Kurdistan Regional Government said.
The US said no Americans were hurt and that its facilities were not damaged in what it called the "outrageous attack".
Israel's military and government declined to comment on Iran's claim.
But Kurdish officials accused the Revolutionary Guards of seeking to use "baseless" propaganda to justify targeting civilian locations.
Taxi driver Ziryan Wazir said he was in his car near the US consulate when the missiles struck at around 01:00 on Sunday (23:00 GMT on Saturday).
"I saw a lot of dust, then I heard a very loud noise. The windows of my car exploded and I was injured in the face," he told AFP news agency.
A local television channel, Kurdistan24, posted images of damage to its offices cause by the blasts.
Iranian state media cited a Revolutionary Guards statement as saying the force had targeted "the Zionists' strategic centre of plotting and evil" in Irbil with precision-guided missiles in response to "recent crimes".
The Revolutionary Guards had vowed to make Israel "pay" for an air strike near the Syrian capital Damascus on Monday that killed two senior Iranian officers.
The Kurdistan Region's Council of Ministers said: "This cowardly attack on Irbil... allegedly under the pretext of hitting an Israeli base near the US Consulate in Irbil, targeted civilian locations and its justification is only to hide the disgracefulness of such offence."
"We reiterate that the propaganda of the perpetrators of this attack is far from true."
Iraqi Prime Minister Mustafa Kadhimi also condemned the attack.
"The aggression which targeted the dear city of Irbil and spread fear amongst its inhabitants is an attack on the security of our people," he tweeted.
"Our security forces will investigate and stand firm against any threats towards our people."
