TravelRe: Uk Student Visa/tier 4 Pbs - Your Questions Answered Part 4 by mimilyrics:
This is the issue. I understand where you're coming from but you seem not to understand my point. I only answered the questions asked and I must have missed where the poster mentioned account building as his/her intention (if stated anywhere because I didn't see it) which was exactly why i asked about why the comment was taken down. But for you to now make a statement as to me aiding the circumvention of the student visa rules isn't okay.

Haven't I on previous occasions asked that you removed whatever part of my comments that might be misconstrued by others in the past? So for me to ask why this comment was removed should have been enough for you to give the benefit of doubt before concluding that I was deliberately encouraging someone to go against the student visa rules.

Simply explaining that my comment might be misconstrued by others or the OP based on the OP's intentions would have been enough explanation instead of casting aspersions on my person.

At least on previous occasions when my comments were removed while responding to or cautioning certain posts, I didn't have to ask you because I knew that those posts had to go.

justwise:
This is pure misrepresentation and you know it which was why I was shocked to read that post from you. There is no way to explain this away.

Account building just to get a visa and return the money is fraud simply. People can do whatever they want outside this thread but we should not encourage it here.

You have been doing a good job here but in this particular case you got it wrong.
TravelRe: Uk Student Visa/tier 4 Pbs - Your Questions Answered Part 4 by mimilyrics:
Sigh! I only answered the OP's questions, not explore his reasons for asking, it doesn't mean that I was encouraging him to break the rules.

He asked if his friend could transfer to him and I said yes which is true. He also asked if it would raise flags and I said no, it's not always necessary to capture the day the funds hit the account. These are questions that even family/friend sponsored Nairalanders have asked and the answer has always been in this vein.

I also further explained that sometimes source of funds are probed and sometimes they are not depending on if the the ECO is able to ascertain that the funds are truly available to the applicant. This even happens in the case of family giving you the money ie. Someone has been given money by an uncle here and the reason for that was asked during the interview.

These are questions that have been asked on this thread by people who are funded by family and the answers I gave are not exclusive of the Tier 4/Student visa rules. Whatever I said was in line with what I typed above which is not outside of the rules and not an encouragement for circumventing the rules.

justwise:
Yes you encouraged the op to go ahead and allow his friend to transfer the money, you even go as far as saying he should come up with a reason and source of money is not probed.

As far as I remember, the person was getting funds from a friend but can't remember seeing that it was just to show maintenance (maybe I missed it) hence my question.

There have been questions surrounding getting gift funding from family and friends and my answer was in line with that and the student visa rules so if you felt that the person was trying to circumvent the student visa rules, I understand you removing the comment and my response but pls don't say that I was encouraging the person to circumvent the student visa rules as that wasn't the case.
justwise:
[/b]

Please show me where that rule is published, a rule that says a friend can transfer money into an applicant's account just to show for maintenance money.
TravelRe: Uk Student Visa/tier 4 Pbs - Your Questions Answered Part 4 by mimilyrics: 4:52pm On Nov 06, 2020
Really? How did I do that pls? As far as I remember,
my answer was in line with T4 rules.
Did I miss something in the comment I responded to or is money from family and friends now against the T4 rules?
justwise:
[/b]

I was surprised to see you encouraging someone to circumvent the student visa rule. You really think that was a good idea?

It's allowed. See the travel section in the link below: https://www.gov.uk/guidance/new-national-restrictions-from-5-november#education-school-college-and-university

Child dependants can use either of their parents' accounts as long as there's a birth certificate that proves the relationship. All you need to so is to ensure that the children are stated on your husband's application as his dependants too.

Thanks as I await your responses.

Then I guess that you should speak to your school so that the discount is reflected on your CAS because if not, you'll need to show the £1,100 in your account.

Normally, your CAS should have details of your school fees, payment made, scholarships/discounts and outstanding balance.
Your outstanding balance should be £0 in this case and if this is so, you only need to show your maintenance in your account but if it's not so, check with your school to ensure that the right figures are on it.

Good evening great people. please i need help. my total tuition is £12,100 however, i was given an opportunity to deduct £1000 pounds as early payment discount. so i've paid the net amount 0f £11,100. but i received my CAS today and the total payment stated on CAS is £11,100. my question is do i have to show the balance of £1,000 with my maintenance fee or just the maintenance fee as this might reset may 28days balance and also how much is the standard & priority VISA fee. Oh! I don't have info on this.
jargo192:
hello no.
what i mean is I need a financial house or sponsor. Living expenses plus fees balance that must be kept in an account for 28days. I have paid my acceptance deposit.
TravelRe: Uk Student Visa/tier 4 Pbs - Your Questions Answered Part 4 by mimilyrics: 2:07pm On Nov 04, 2020
Input details for your preferred option ie. 1. Use the school address.
2. State that you'll be using an AirBnB or hotel accommodation for the first 2-3 weeks from where you'll search for a suitable accommodation to rent and move to.

dadawig:
Thanks @mimilyrics for the swift response.

As advised, I just clicked NO to Do you know where you will be staying in the UK and it brought out the question below in bold.

Give as much detail as possible of where you intend to stay, for example in a hotel, private housing, or with friends. Include the names of anyone else you will live with and their relationship to you.

My question now is should I ignore to answer the above and just input my school address?

Thanks

2. Yes. See application link: https://visas-immigration.service.gov.uk/apply-visa-type/dependant?_ga=2.85580889.1159341780.1604250868-1159481724.1592400843
3. No. Use your school address. After you get your visa, you'll need to get an address where you'll self-isolate at. This will be filled on your passenger locator form prior to your arrival in the UK.
4. Not necessarily.
5. No if you've never gotten a NI number.
6. No.
7. No, if the money is in your account. He only needs to submit his account if his maintenance is in it.
dadawig:
Hi Justwise and other gurus in the house. I have been following up with this thread and I have gotten a whole lot of information which has helped me to begin this journey. I am married with 1 child, I am the primary applicant and will be going to the UK with my husband and my child. The 28 days funds in my account has now matured and about to apply for Tier4 Visa for myself and my 2 dependents.

However, there are some concerns I need to be clear with on the visa application form and I would appreciate if I can get answers from the experts here. Below are my questions.

1. For confirmation. Will my visa type be Student Visa since there is no Tier 4 visa on the form

2.. For confirmation. Will my spouse visa type and child visa type be Partner Dependant visa and Child Dependant visa respectively?

3. What will be the answer on the Visa application form which says Do you know where you will be staying in the UK? I do not have an accommodation in the UK yet though.

4. Will I add my husband where it says does anyone rely on you for financial support? I am asking this question because my husbands living expenses 6120 pounds is in my bank account. Although he is the bread winner.

5. Do you have a UK National Insurance number?

6. Will myself or my husband require Cover letter and budget sheet breakdown.

7. Will my husband provide his bank account statement?

Sorry for my plenty questions.

Thank you ALL.

1. An attestation of results with the right dates or a letter from WAEC stating the error from WAEC is okay.
If for any reason, you can't get it from WAEC, use the affidavit with an explanation on what you've done to get the error amended by WAEC.
2. Yes.
3. It doesn't matter. Only change your name if you wish to do so. You can be married and still use your maiden name, just state that you're married and list your husband's details in the spouse/partner section.
viciouswoman:
Pls mimilyrics attend to my questions.

1 my date of birth on my waec is different with the one on my passport..can affidavit suffice? And letter from waec?

2. I have 3 names on my waec and 2 names on my passport..can affidavit suffice?

3. I'm married but I'm yet to change to my husband name.
Should I do a new passport carrying my husband's name to clear the issues of the names?

Pls kindly advise...and anyone who's has same experience should pls comment.
Thank you

In that case, you wouldn't be able to take the child with you since you wouldn't be able to care for him by yourself while studying (my opinion) but make sure to include him as your dependant in the part of the form that requires it so that you can always make an application for him in future.

Yes, your calculation is correct, I calculated for 2 dependants (your husband and a child).
awumen:
1. This is my calculation,
9135 - For me @ 9 months
6120*3 is 18360 For Hubby&2 kids at 9 months.
2. Is my calculation right, guess you lrs came with 2 dependant?
Total 27495 excluding tuition fees.
Many thanks.
quote author=mimilyrics post=95660081]2. Your tuition balance + your maintenance (£1,015*9) + £680*9 for each of your dependants. Total maintenance for you, your husband and child will be about £21,375 excluding your tuition fees.
Add some extra money as a buffer against inflation if your funds will be in a Naira account.
3. It depends on your preferences.
Some apply with dependants so that they can travel at the same time to help prevent homesickness as a result of time away from home/family.
Some apply separately because they'd like to travel ahead of their families to conclude living arrangements so that the family doesn't feel the initial stress of moving in.
Some people apply for their dependants after they get their visas/BRPs to avoid cases where the application is wasted in case of a refusal that can't be upturned with AR.
Some apply together anyway as long as they are sure that all the requirements have been ticked exactly how UKVI wants it.
TravelRe: Uk Student Visa/tier 4 Pbs - Your Questions Answered Part 4 by mimilyrics: 2:00am On Nov 04, 2020
1. When you get married, just make a dependant application for your spouse and include your marriage certificate and other docs (communication evidence, pictures etc.) that prove that you've got a genuine and subsisting relationship with her.
2. You should be able to since schools are still open and the airports are not closed.
3. Do a google search of the airlines you have in mind and read their travel updates for passengers.
Ebohmiracle:
While applying for my visa I wasn't married yet, I did not put anyone as a dependent, but now I'm thinking of getting married before I travel and later my wife can come in as a tier 4 dependant. I don't know if this process can fly.

2. Then please I want to know if I can travel during the lockdown to England.

3. I want to know the list of airlines that requires a Covid test before flying
TravelRe: General UK Visa Enquiries - Part 4 by mimilyrics: 1:53am On Nov 04, 2020
How do you prove that you're innocent in the case of a fake bank statement if the submitted statement if the bank is stating that the statement isn't from them? If it had been a refusal when the applicant was below 18, it would have still been easy to prove the applicant's innocence.

Refusals based on deception and misrepresentation are one of the hardest to prove innocence in especially when the institution that the document purportedly originated from can confirm the authenticity of the statement.
Kingdessy2242:
@mimilyrics kindly go through the rules please, maybe something positive might turn up. From what I can deduce 320 7B comes in play if you’re unable to prove that you’re innocent
TravelRe: General UK Visa Enquiries - Part 4 by mimilyrics: 1:48am On Nov 04, 2020
The only time that you can claim to be unaware of using fake documents is when you're below 18 as you can always "claim" or attribute the mistake to your parents' or someone else who had control of your affairs.
As an adult, the onus is on you to ensure that all your application information/documents submitted are true and correct.
The period for auto-refusal is 10 years as the ban/auto refusal starts counting from the date of the last refusal based on the 320(7a) refusal even if an application is made 3 years after.
You can try to explain it though if you think that you can really prove your cousin's innocence.

TravelRe: General UK Visa Enquiries - Part 4 by mimilyrics: 2:15am On Nov 03, 2020
A refusal under 320(7a) triggers a ban. Reapplying means an automatic refusal and is accompanied by notice of a 10-year ban if not included in the 1st application refused on that grounds.

You need extra £3,800 for your first non-British child and £2,400 for your 2nd (and any other) non-British child.

Hello All,
Thank you for the good job being done here. The posts have all being quite educating.

I was married to a woman here in UK but divorced before marrying my Nigerian wife.
My ex had 2 kids for me and they are both British citizens. They children are not living with me.
My question is, in calculating my income threshold for support, will I have to add the additional 3,800 for the child my wife will bring from Nigeria or I will have to include for my other two children in the calculation plus 18,600 pounds for my spouse .

@Justwise and other gurus kindly give an insight. Thanks

1. It's okay. You're not required to bear your husband's name or change your name after marriage.
2. It's okay as long as your last and first names stay the same on all your documents. If in doubt, use an affidavit to back up the name variation.
3. Get an attestation of results from WAEC to change the DOB as this can actually create some doubt for the ECO. You'd need an affidavit and birth certificate to get this corrected and I'm not sure how long this currently takes.
If your WAEC wasn't stated on your CAS, you don't need it.
4. Answered above.
5. You don't need to change to your husband's name if you don't want to. Your marriage certificate is evidence of your union.
If you decide to take on his name and get a new passport, you don't need an affidavit since your marriage certificate is a link to your current and previous name and it is enough proof of name change for UKVI.

viciouswoman:
Hi, please I would appreciate a respond to this issues

1. I'm married but I'm yet to change to my husband name

2. My passport bears 2 names but my waec and degree bears 3 names

3. Date of birth on my waec was wrongly spelt so its different with the one on my passport

4. I intend to apply for tier4 visa for msc with my husband so I'm thinking of getting affidavit for these corrections above.

5 should I do a new passport and change to my husband name?

You should be able to use it since it's a standard savings account service and it's provided by a CBN-licenced bank. It's similar to Monzo, Starling et al whose bank statements are acceptable by UKVI.
Just ensure that the statements are signed and dated in line with UKVI requirements.

For avoidance of doubts, you can check with WEMA and also check the student visa guidance on acceptable bank statements.
