Brytawon: I was walking around when i saw a cashier hand this little boy his money back, the boy couldn't have been more than 5 or 6 years old. The Cashier said, 'I'm sorry, but you don't have enough money to buy this doll.'' The little boy turned to the old woman next to him, ''Granny, are you sure I don't have enough money?'' She replied, ''You know that you don't have enough money to buy this doll, my dear.'' Then she asked him to stay there for just 5 minutes while she went to look around. She left quickly. The little boy was still holding the doll in his hand. Finally, I walked toward him and I asked him who he wished to give this doll to. 'It's the doll that my sister loved most and wanted so much for Christmas. She was sure that Santa Claus would bring it to her.' I replied to him that maybe Santa Claus would bring it to her after all, and not to worry. But he replied to me sadly. 'No, Santa Claus can't bring it to her where she is now. I have to give the doll to my mommy so that she can give it to my sister when she goes there.' His eyes were so sad while saying this, 'My Sister has gone to be with God. Daddy says that Mommy is going to see God very soon too, so I thought that she could take the doll with her to give it to my sister.'' My heart nearly stopped. The little boy looked up at me and said, 'I told daddy to tell mommy not to go yet. I need her to wait until I come back from the mall.' Then he showed me a very nice photo of himself. He was laughing. He then told me 'I want mommy to take my picture with her so she won't forget me.' 'I love my mommy and I wish she didn't have to leave me, but daddy says that she has to go to be with my little sister.' Then he looked again at the doll with sad eyes, very quietly. I quickly reached for my wallet and said to the boy. 'Suppose we check again, just in case you do have enough money for the doll!'' OK' he said, 'I hope I do have enough.' I added some of my money to his without him seeing and we started to count it. There was enough for the doll and even some spare money. The little boy said, 'Thank you God for giving me enough money!' Then he looked at me and added, 'I asked last night before I went to sleep for God to make sure I had enough money to buy this doll, so that mommy could give it to my sister. He heard me!'' 'I also wanted to have enough money to buy a white rose for my mommy, but I didn't dare to ask God for too much. But He gave me enough to buy the doll and a white rose.'' 'My mommy loves white roses.' A few minutes later, the old lady returned and I left with my basket. I finished my shopping in a totally different state of mind from when I started. I couldn't get the little boy out of my mind. Then I remembered a local newspaper article two days ago, which mentioned a drunk man in a truck, who hit a car occupied by a young woman and a little girl. The little girl died right away and the mother was left in a critical state. The family had to decide whether to pull the plug on the life-sustaining machine because the young woman would not be able to recover from the coma. Was this the family of the little boy? Two days after this encounter with the little boy I read in the newspaper that the young woman had passed away. I couldn't stop myself as I bought a bunch of white roses and I went to the funeral home where the body of the young woman was for people to see and make last wishes before her burial. She was there, in her coffin, holding a beautiful white rose in her hand with the photo of the little boy and the doll placed over her chest. I left the place, teary-eyed, feeling that my life had been changed forever. The love that the little boy had for his mother and his sister is still, to this day, hard to imagine, and in a fraction of a second, a drunk driver had taken all this away from him. I'm speechless.....àlmost at the brink of tears. A little boy's happiness taken by a drunk idiot! Stiffer punishments should be given to persons who commit such crimes just like the police men in the post. Its not all about talking on nairaland. 2019, I must present myself for election; my state's House of assembly for starters... |

christinie: let me give you some legal lectures. Pick up your pen and paper and write. Am gonna try to type as simple as possible. The existence of an offence can be proved through eye witness account, confessional statement and circumstantial evidence. See the case of Nguma V. A.G. Imo State (2014) 233 LRCN 41 @ 51 H.9. Eye witness account is when a person who was at the scene of crime identifies the accused as the one who committed the offence in question. Confessional statement of the accused: in the case of Uche V The State (2014) 10 ACLR 184 H.7 it was held that a free and voluntary confession which is direct and positive is sufficient to sustain a conviction. The Supreme Court in the case of Okeke V. State (2003) 15 NWLR (PT 814) P. 25 @ 41 stated that: "Confession of an accused person to the commission of the offence plays a major part in the determination of his guilt and a court of law is entitled to convict on the confession if it comes to the conclusion that the confession is voluntary." "Also it is trite that a man or a woman may be convicted on his own confession alone and there is certainly no evidence stronger than a person's own admission or confession as such is admissible." See the case of Agboola V. State (2013) Vol. 225 LRCN (pt 1) 159 @ 169 R. 11 & 12. Circumstantial evidence: it is settled that for circumstantial evidence to support a conviction in a criminal trial it must be cogent, complete and unequivocal. It must be compelling and must be such that leads to only an irresistible conclusion that it is the accused and no one else who committed the crime. It is trite law that for circumstantial evidence to ground and sustain conviction it must meet the following conditions: A. It must be irresistible and unequivocally lead to guilt of the appellant. 2. No other reasonable inference could be drawn from it, and 3. There must no other co-existing article which could weaken the inference. See the cases of Idowu V. State (1998) 11 NWLR (PT 574) 554 @ 370. Alfred Aigbadion V. State (2000) 7 NWLR (PT 666) and Ogedengbe V. State (2014) ALL FWLR (PT 752) P. 1724 @ 1751. Hold on a sec! Are u a lawyer or judge?!! rationalmind: I'll answer your question but let's consider this hypothetical scenario before I do.
Let's assume for a second I lie to them I haven't seen them. However, someone in the mob insists they check my house. On searching the house, the man, his wife and two kids were found. What will happen next isn't so hard to imagine. They will only not be killed, I'll also be killed together with them.
The reason you think lying is the only resort is because you have failed to consider the likely consequences of lying.
Now to answer your question, I'll have to be engage them in a honest communication, plea and negotiation which I believe will produce better results than lying.
N.B: As much as I can, I try to always run away from keeping secrets. But no matter what, we all have secrets. Everyone has got some skeleton in his waderobe which he wouldn't want the world to know. In that hyperthetical scenerio, as a devout muslim who is know as such by the mob, they would take your words seriously. If you fear that on the contrary they decide not to; insisting on searching ur house, so you would perfer to give up that family to be slaughtered like goats right in front of you, just not to tell a lie or keep a " secret". If you do that, you have already died within you before even dying in the physical, your "moral" conscience is dead already. You said you would negotiate and communicate with the mob. Negotiating with an angry mob? Negotiate with them on what terms; that you have them in your house but 'please they should spare their lives'? By doing that u have already written your death sentence! |

All Animals deserve to be treated with respect, and I applaud him for doing this.. I do know animals deserve compassion too, but I'm wondering whose life means more to him humans or animals. There is a woman living directly opposite my house. She has ten cats; she feeds and cares for them. She even pays some1 to take care of the cats; the guy comes every evening to feed the cats. Never been in her haus but I can bet those cats have a room to themselves in the house with a wardrobe and the bed they sleep on would be more comfortable than yours. But to pluck orange from that woman compound na die.
