Be prepared to pay like $80 as charges if the person is sending $1000 or more. juntod: Nigeria has never been able to send out money via western union or money gram. The only way out is by wire transfer.Western Union and moneygram transfer used to work in Nigeria, at least I'm 100% sure of 2004-2007. It was stopped due to the activities of money launderers. |

Yes, IRS doesn't put effort into chasing students down, but IRS and DHS and ICE and whatever governmental agency will put in the effort when you're applying for reinstatement cos that isn't a run of the mill thing. And when did we start talking about employment and tax issue here? I thought we were talking about deferment and SEVIS and the status that ensure. I see no reason why you should bring student employment into this. And since we talking about IRS and tax returns, I guess I should ask you if you knew that IRS select tax returns applications for random review and they will ask you to submit additional document even after filling your taxes? Failure for it to add up spells trouble, did you know that? Yeah, people work of-campus and still receive their returns.. but I Nas, won't do so. I won't base my American experience on the fact that someone did it a and it was successful, I will be successful when I do it. I am not here to work but to get an education. And I will do absolutely nothing to jeopardize that. Tax issue is different and many people cheat the system including citizens. Know that the US don't play with immigration. The F1 visa and SEVIS is so straight forward that you really need to follow the guidelines. I suggest you follow immigration discourse and see how the government and everybody is up in arms about it. And lastly, why will I not argue on any point if I was sure about myself? |

It also states that the only condition with which an international student can remain in the US after a leave of absence or deferment is if he/she has a critical illness or medical condition. I really don't understand you, I swear.I suggest you take time and sit down, not in a hurry to reply my post and contradict me and really read what I've been writing all night long. Then you'll see I have been saying the same thing over and over again. Yes, You are allowed to defer your admission for a semester or two. But No, you are not allowed to remain in the US during those period when you are not enrolled in classes. Read my friend, READ! |

If appropriate, the SEVIS record will be terminated as an authorized withdrawal (preferable to appearing simply not to have complied with the terms of status). The student will receive a new I-20 and SEVIS registration when s/he is ready to resume studies. Of course, the student cannot remain in the United States without status simply because the withdrawal was authorized. It would be necessary either to change to some other lawful status in the U.S. to remain legally or else to depart the U.S. and seek readmission as a student, if that is the goal. Students need to be mindful of status and visa issues. As always, foreign nationals should consult with an experienced attorney before taking any action that may impact their immigration status and future options. |

If you're so sure about your argument then I invite you to publish your sources To your question, even a person that defered his/her admission based on medical reasons will still fall out of status if he/she stays back in the US. But the only difference is that the person has a solid basis for reinstatement because he/she has a medical condition. What would be said for the dude who doesn't have a medical condition that chose to stay back in America? What is his basis for reinstatement? The day you take permission from attending school is when your SEVIS record would be terminated. And FYI, your DS would only terminate it and report to SEVIS that it is an authorized withdrawal. So, what do you do when the SEVIS has been cancelled? You can not and never stay in the USA with this. You must go back to your country and reapply whenever you are ready. And the school will issue you a new I-20 and SEVIS whenever you are. As for the question you asked me about pregnant women, I will suggest you read the link I gave you well enough and not just skim through it. I will also copy an excerpt from it and paste it on here... Guidelines to Drop Below a Full Course of Study for Medical Conditions F-1 students with documented medical conditions can take a reduced course load or no course load at all. A student must provide you with medical documentation, which you should maintain in the student’s file. The documentation must be from a licensed medical doctor, doctor of osteopathy or licensed clinical psychologist in order for you to authorize a reduced course load. So yes, as the DSO, you do not have to concur with the medical reason. You must document the reason and then ensure that the student does not exceed the authorized amount of time at less than a full course load. The authorization period cannot exceed an aggregate of 12 months per program level. This means a student who dropped to half time for one semester in freshman year can drop to half time again for one semester in junior year, if needed. |

There is a difference between not returning to school without taking official permission(wilful neglect) and actually taking permission to extend studies for a semester or 2. It is the latter which I am talking about which is possible and is not considered 'falling out of status'. Get this right.You are the one making the assumptions. I am making my arguments based on what I read from the ice.gov website. If you took the time and patience to read my earlier post, I made reference to the fact that you can defer based on medical conditions, but it cannot be more than 5 months. Tell me, isn't complications or the stress of pregnancy a medical condition? Then how/why will deferment by a pregnant woman be deemed as falling out of status willingly? Joenice: @MsNas, I've been following your discussion. You're simply right. For those thinking about defering while in the States, they can switch to Community College.You're kinda right. Why risk the deferment and reinstatement route(which is not sure at all) when you can get a CC? But the option is only available for Undergrads, sadly. |
bigfrancis21: Basically, all you said are under the assumption of wilful neglect on the part of the student to enrol in a coming semester without proper permission from the school. In that case it is not deferment but carelessness on the student's part. Or maybe you are in a haste to forget that deferment, by itself, is an official action taken with the school and to defer/extend admission is an action granted only by the school and it is this particular deferment I am referring to. If a student decides not to enrol in the coming semester without informing the school about it or taking permission from the school, that is when he/she has fallen out of status. It is in this case that the so-called reinstatement comes into play. The student who has willingly fallen out of status, ie failed to show up at the beginning of classes for the next semester, will have to hire a lawyer, file necessary fees for reinstatement and prove with a good cause why he fell out of status.Let me pick you're argument apart for the sake of the people reading this. 1. You said I was basing my argument on the premise of willful neglect on the students' part. I suggest you re-read my post and see that there was no place where I talked about willful neglect. Anybody that decided to defer isn't neglecting nada, he chose to do it willfully because he'she cannot meet the finacial obligations of enrolling in school or for some other reason. 2. I understand deferment is at the discretion of a student, but that doesn't mean there aren't rules governing it. Look at it this way. The sole purpose of your F-1 Visa is to come here to school. You decided to defer and not go to school for sometime, then what is your purpose of being in the country? 3. I will remind you again, deferment isn't in the SEVIS dictionary. I suggest you ask your Nepali friend for the true story. It what he says you will believe and there's absolutely no way for you to know if he's lying or not. 4. How many students who willingly fell out of status can hire a lawyer to petition for reinstatement? I'm pretty sure you're aware that the its a 50-50 chance. It is not set in stone that even after hiring a lawyer to petition for you, you're gonna be reinstated? See why schools tell people who defer their admission to return back to their countries? Or have you not heard about people who are denied admission back into the US simply because their I-20 was not signed before they left? Uncle Sam makes the rules as it deems fit. He tweaks it as he deems fit and there's little or nothing we can do about it. As always, I back my arguments with claims. My suggestion all along has been deferring after a semester or two, if short of funds, to be able to gather money and return back to school.I didn't say you did. But bear in mind that people look on onto this page for advise and some might take any of our ideas (ideas which we have made made out of assumption and in your case because you said people you know have done it). I'd like to make something clear though, SEVIS does not recognize deferment or all those stuffs. Its either you're enrolled or not. And according to F-1 Visa rules you have to be enrolled full time at all times when you're on an F-1 visa or else your Visa and SEVIS is terminated. This is the reason the schools tell people who are defering to go back home so that they don't have to go through the whole process of reinstating their I-20, SEVIS and Visa which might not even be granted by the DHS. There is nothing like deferring in America. You take classes this semester and decide to defer for two years. What does that sound to you? Simply put, You are out of status. Period! If deferment was possible and as easy like that, all of us would defer and go look for employment to bankroll our education. Heck! We will defer for 10 years sef. ![]() The only reason you can defer and still stay back in the United States of America is when you have a documented medical condition. Otherwise, if/when you defer, make sure you pack your bags and head back to your home country. Reinstatement after deferring based on a medical condition is not even automatic. Your request to stay back in the US may be granted or denied. Whoever doesn't enroll for classes in a semester (or defer as you call it) is out of status, is an illegal and deportable from the US. Even if the deferment was caused by sickness, you're still out of status and will need to apply for reinstatement with docs backing your claims of sickness up. All of these shouldn't exceed 5months. So anybody that thinks he/she can defer and come back after 1 or 2 years for reinstatement is on their own. Quick question BigFrancis... you said your friend deferred for two semesters and will be returning next year right? Is your friend illegal or not? Is his SEVIS still active or not? C++ just like C Language and C# is a programming Language and CCNA (Cisco Certified Network Associate) is a certifying exam for Network Engineers. It's not even remotely close to a Computer package. Computer packages are stuffs like Microsoft Office, Microsoft Project, Corel Draw, Adobe pagemaker and stuffs like that. You can use C++ without actually using a computer. You can write C++ codes without having to open Visual Studio or Boole or any of those platforms. Can you use MS Word or Adobe Acrobat reader without a computer? |
