The federal government is at risk of a $2.3 billion fine in arbitration over an alleged breach of contract for the $5.8 billion Mambilla power project in Taraba state.

The project, a 3,050-megawatt hydropower facility, has stalled owing to legal and funding crises after Sunrise Power and Transmission Company Limited (SPTCL), a local content partner, was reportedly sidelined in the project by the ministry of power, works and housing.

SPTCL, who claimed to have been awarded the build, operate and transfer (BOT) contract in 2003, has dragged the federal government and its Chinese partners before the International Chamber of Commerce (ICC) in Paris, France.

A UK arbitration court recently awarded nearly $9 billion against Nigeria over a breach of contract with Process and Industrial Developments Limited (P&ID), earlier given the green light to build a natural gas development refinery.

Meanwhile, the China Exim Bank, which is expected to provide 85 per cent of the joint funding with the federal government for the Mambilla project, has insisted on compliance with due process and terms of the November 2017 engineering, procurement and construction (EPC) contract signed with the partners before releasing funds.

Leno Adesanya, chief executive officer of SPTCL, in a letter dated March 31, 2017 to Babatunde Fashola, minister of power works and housing, had accused the minister of reneging on his promise to support the project.

Adesanya said between 2003 and 2009, SPTCL had spent millions of dollars with financial and legal consultants to raise about $6 billion for the execution of the project, yet the company has suffered a lot over the years “through improper administrative interruptions and interventions”.

“While we feel a deep sense of loss that Nigeria is still discussing this project when it should have been commissioned a long time ago, if the original plan was followed,” Adesanya said.

In another letter dated June 20, 2017 to the then Acting President Yemi Osinbajo requesting his intervention in the matter, Adesanya accused Abba Kyari, chief of staff to President Muhammadu Buhari, of taking the unilateral decision of directing the ministry of power to sideline the company from the contract against the advice of Abubakar Malami, attorney-general of the federation (AGF).

In the letter dated July 24, 2017 to Osinbajo, with a copy to the chief of staff, Malami had said SPTCL should be engaged as a local content partner on the project “as a means of accommodating its prior contractual interests on the project”.

However, Malami backtracked a few weeks later.

In another letter dated August 17, 2017 to the company, the attorney-general of the federation said he issued the previous opinion on the project based on the limited materials provided at the time.

He added that there was no requisite federal executive council (FEC) approval for the project.

“The logical conclusion in the circumstances should be that there was no valid contract between Federal Government of Nigeria and SPTC in respect of the project or at all,” Malami wrote.

In his response to Malami, Gbolahan Elias, a senior advocate of Nigeria, said there was no statute as at 2003 when the contract was awarded to SPTCL requiring the consent of the FEC before a letter of award could be validly issued.

Elias added that the letter of award to SPTCL predated the enactment of the Infrastructure Concession Regulatory Commission (ICRC) Act of 2005 which requires approval of projects and contracts by FEC.

In a recent petition dated November 18, 2018 to the president and seen by TheCable, Adesanya alleged that the company was removed from the contract without due process.

“Mr. President can save the project from being enmeshed in another controversy as it occurred during the government of President Yar’Adua where a Presidential adviser allegedly took millions of dollars in bribes, and eventually led to the removal of the official and the termination of the $1.46b civil works contract,” the petition read.

Of the 100 orders, 50 are optional. So, the airline has the option to modify or cancel the optional orders, depending on the market demand and infrastructural constraints.

Besides, the airline won’t only be plying domestic routes. GAA is also planning to fly African routes as well. With 50 or more aircraft, it’s entirely plausible that they would achieve their goals.

New York Attorney Gen.-elect Letitia James says she plans to launch sweeping investigations into President Donald Trump, his family and "anyone" in his circle who may have violated the law once she settles into her new job next month.

"We will use every area of the law to investigate President Trump and his business transactions and that of his family as well," James, a Democrat, told NBC News in her first extensive interview since she was elected last month.

James outlined some of the probes she intends to pursue with regard to the president, his businesses and his family members. They include:

James told NBC News she wants to be able to pursue state charges against anyone the president were to pardon over federal charges or convictions and whose alleged crimes took place in the state. Under current New York law, she might not be able to do that.

"I think within the first 100 days this bill will be passed," she said, adding, "It is a priority because I have concerns with respect to the possibility that this administration might pardon some individuals who might face some criminal charges, but I do not want them to be immune from state charges."

She's also enlisting help from some prosecutorial heavy hitters, like former U.S. Attorney General Loretta Lynch, as a part of her transition to help her identify important hires for her office with an eye on bringing in experts for its Trump-related investigations.

New York is home to the president's namesake business, the Trump Organization, and it is where Trump's presidential campaign was headquartered and his reelection campaign as well. And it is where a number of key events under special counsel Robert Mueller's microscope, such as the controversial June 2016 Trump Tower meeting, took place. All of that falls within James' jurisdiction.

As a result, she is about to become one of the most recognizable — and powerful — state attorneys general in the country.

"Taking on President Trump and looking at all of the violations of law I think is no match to what I have seen in my lifetime," James said.

Currently the city's public advocate for a few more weeks, James is set to take over for New York Attorney General Barbara Underwood. She was appointed to fill in for the remainder of Eric Schneiderman's term after he resigned earlier this year following accusations of sexual misconduct.

The long awaited dream of having a single currency among the 15 member states of ECOWAS (Economic Community of West African States) to facilitate smooth regional trade in 2020 has taken a huge step forward, with calls of proposal for a name and logo for the proposed single currency.

The idea of a single currency has been in the pipeline since 1983, when leaders of the sub-region met to discuss other issues as well as the integration of the regional economy. However, in 2009, after years of little progress concerning the adoption of a single currency, the regional body in 2009 adopted a roadmap, with the aim of creating the ECOWAS single currency in 2020.

Four years later, in 2013, ECOWAS established a taskforce to oversee the process of furthering the creation of the single currency, given the numerous delays.

The taskforce met in Accra this year and revised the timeline for achieving a single currency. In addition to ten other programs, the task force set 2020 as a deadline for selecting the name of the ECOWAS single currency.

According to the terms of reference published on the Central Bank of Liberia’s website, the competition is open to all citizens of ECOWAS member states free of charge, with winning prizes ranging from US$10,000, US$8,000, and US$5,000 respectively for proposal that comes first, second and third place.

“Accordingly, all proposals for currency name shall not be based on the name of a person, ethnic group or contain expressions directly linked with a religion, country or national institution, among others. On the other hand, the logo shall, among other things, symbolize unity and shared cultural and historical values of ECOWAS.

“Each competitor may submit only one proposal for the name of the currency and/or the logo of the currency. Each participant shall confirm that the proposal is his/her personal and exclusive work and that all resources and data used in the creation of the proposal do not and will never constitute an infringement of moral or, intellectual property rights or the rights of a third person or entity,” the term of reference said.

The term of reference said entries must be mailed to the ECOWAS Commission’s address in Nigeria by November 20, 2018.
