festacman: The fact is that Judiciary's treatment of presidential election petitions over the years has always been about avoiding political crises rather than giving justice to petitioners. From Obasanjo, Yar'adua, Buhari and now Tinubu, the worry facing the judges has always been the likely effect of judgement on political stability of Nigeria. Of course, financial inducement or any other interferences may not be ruled out but the mindset of judges is that all politicians are the same and none is worth sacrificing the stability of the country for. Interestingly, in spite of favourable PEPT and Supreme Court rulings in 2014, late Umaru Yar'adua accepted that the election that brought him to office was not free and fair and consequently appointed Uwais committee to suggest ways of strengthening electoral process.
For example in Tinubu's case, outright cancellation wouldn't have solved any problem because: - The acting president who would have overseen new election is Senate President Godswill Akpabio who is dependable Tinubu's ally. - The same INEC team that organized the cancelled election would have organized the new election and even in the situation that another INEC chairman is required, Akpabio would still have power to appoint. - The IG of police who would have overseen the security during the elections would have been a Tinubu boy with 100% loyalty - Same for security chiefs who would have done everything possible to retain their offices as Tinubu losing means loss of job for them. In other word, ordering a new election wouldn't actually solved problem except create political crises apart from heavy financial burden on the treasury.
This is why It is important to make uploading results from polling booths mandatory part of the INEC's transmission of results to the collation centre. Otherwise, the current "go to court" shenanigans will continue. so true, I always believe elections should also be held early enough to allow tribunal judgement before inauguration, but the most important is to mandate inec on compulsory upload and more transparency. |

HIGHESTPOPORI: The appeal court have always been in the pocket of the Executive.The way they dismissed all evidence showed they were not ready for any other outcome than to do the bidding of the people in power.The worst was when they dismissed EU report on the ground that it was not submitted by a particular person.The judges were ready to pick holes in every evidence presented. Hopefully the Supreme Court does a thorough job that would give Nigerians hope in the Judiciary and not just picking holes and looking for technicality to dismiss every evidence presented in court. for real a judicial tribunal just became APC 's advocate when it was supposed to be an umpire. |

OlujobaSamuel: That's where they got it wrong, the tribunal is only meant for voting issues, every other issues (cert, drugs, nominations, etc) might be accepted or dismissed, so you can't bank on it. Either the time is sufficient or not is immaterial, just present relevant witneses. About 10 of the 13 witnesses were disqualified because they have no capacity to speak on what they are saying. Imagine 10witness saying the result given to me at PU is Z while what was declared is Y, That's how the court has always want to see allegations of manipulation. while it is important to stick to the main point in cases like this you can't tell which is going to stick because they all had merit even the 25 percent FCT, the opposition also filed a case too concerning obi's LP membership which the court ruled on also, so you can't tell which is gonna stick. That's why they had to spread the cases with the certificate, dual citizenship stuff, Nigeria can do better by making it's law's less ambiguous. In the election tribunals for both state and federal level varying judgement has been issued that contradicts one another. I still believe the judges were not completely open and bias in some of the rulings. |

I think my analogy still represents the true events, as per your analogy if I refuse to bring my witness provided I have other legal evidence that justifies my claim I don't see any problem with that, as regards why lp didn't provide agents at the tribunal remember LP was challenging the results for the entire state, when each state has over a thousand polling unit, wouldn't it have been too cumbersome if LP had brought thousands of polling unit agent into the court room? Would the tribunal have given each polling unit agent time to present their case? Remember that during the trial a time slot was allocated to each party, now if they where to plead their case polling unit by unit, you know they would run out of time and they also have other cases too like the certificate issues, double nomination to prove. |
