The north currently has a problem.

As Buhari, and Yar' Adua will contest (on different political platforms) in the 2007 presidential elections, the likelihood of the north winning is negligible.

The strength of the north would have lied in the collapse of their ambitions into a single ambition with a representation in one of them. The possibility is interesting as it is remote.

With this in mind, the South can pull through if the parties in the south can combine forces to back the a single candidate like Pat Utomi.

EFCC made the following report on Atiku after interrogating many people:

That this investigation was initiated at the instance of a request from the United States Department of Justice.

That the request was sequel to an investigation carried out by the U S authorities which involved certain Government officials, institutions and Private individuals in both U S and Nigeria.

That among those directly affected by the investigation in Nigeria is the Vice President of the Federal Republic of Nigeria in the person of Alhaji Atiku Abubakar.

That two state Executive Governors in the persons of their Excellencies Chief Victor Attah and Alhaji Ibrahim Saminu Turaki, the Governors of Akwa Ibom and Jigawa States, respectively were also mentioned in the request.

That in the investigation so far carried out, no wrong doing could be traced to them unlike the case of the Vice President who has been found to have mismanaged the PTDF funds and abused his office.

That the use of the PTDF funds to promote businesses is instrumental to the large scale mismanagement, misappropriation and abuse of office as highlighted in this report.

That Otunba Mike Adenuga who was earlier arrested, interrogated and granted bail failed to turn up when he was invited for further interview as he was said to have absconded.

That the investigation is still on going and may lead to more individuals being prosecuted.
PRAYERS

The Government is hereby requested to approve the following:


That PTDF should be removed from the supervision of the office of the Vice President.

That the Commission should recover all Public funds embezzled from individuals and institutions involved in this case.

That the erstwhile Executive Secretary of the PTDF, Yusuf Hamisu Abubakar, Otunba Fasawe and all those who aided or facilitated in the embezzlement and mismanagement of the funds should be prosecuted.

That the corporate entity of Globacom will be protected and preserved, while legal processes will be taken to recover all shares acquired fraudulently or with public funds.

president can leave the party that put him in power, join the opposition and yet refuse

Atiku's Indictment

On September 18, 2006, Atiku was indicted by the Economic and Financial Crimes Commission, which alleged that he had embezzeled N 71,123,250,000 in campaign funds and made various bribes.

Contrary to Vice President Atiku Abubakar’s claim that his indictment by the Economic and Financial Crimes Commission (EFCC) and the Federal Government Administrative Panel of Inquiry is a premeditated political action intended to halt his presidential ambition, the report of a forensic investigation into the Petroleum Technology Development Fund (PTDF) has said that he is culpable for the mismanagement of the fund.

The Report of the Special Audit/Forensic Investigation of Petroleum Technology Devel-opment Fund (PTDF) From 1999 to May 31, 2006, it submitted that the Vice President’s approval for the release of $20m from the treasury and subsequent placement in Trans International Bank without appropriation and approval by the Federal Executive Council (FEC) was improper and amounted to abuse of office.

I hope you know what is meant by anarchy, when a government disregards rule of law, disobey court orders and lawless then anarchy is imminent.

You've seen nothing yet. Very soon you will see bombs in the parliament and that is anarchy. Ask India they will tell you.

It's just democracy in action. Remember, you have a borrowed political system and Nigeria is just an infant learning to walk with regards to democracy.

Even the advance countries have not yet perfected the system and are still teaching the world how democracy works.

The Nigerian courts, parliament, govt institutions and legal bodies are still confused as to how democracy works.

For example, as per today, Atiku and all the other indicted candidates are disqualified by INEC for not meeting the deadline AND yet, nobody including the press knows where the issue stands. Ask BBC or VOA or US/British Embassy, they will tell you Atiku is finished

Confusing, isn't it. In a military system, you will know today that Atiku is finished but in a democratic system, you expect the court to come to his rescue if the constitution allows it.

Democracy throws up the unknown and confuses us the more. More like magic, the more you see, the less you understand.

And given the fact that the AC refused to submit a new list within the time frame allowed legally, the candidate and the party may have been technically knocked out of the presidential race.

What is the punishment for not filing the declaration?

What is the penalty for making inaccurate statements on this declaration?

Any property or assets acquired by a public officer which is not fairly attributable to income, gift, or loan approved by the Code shall be deemed to have been acquired in breach of this Code unless the contrary is proved.

Can an official be prosecuted for violating this law?

The fifth schedule contains many elements of public officers' code of conduct of which assets disclosure is only one. According to Section 12, any allegation that a public officer has committed a breach of or has not complied with the provisions of this Code shall be made to the Code of Conduct Bureau.

Constitutional Requirement for Candidates seeking election

Under Section 85 (4) (s) of the Personal Income Tax Act, Cap p8 Laws of the Federation of Nigeria, LFN 2004, all candidates, in all political parties, seeking election into public offices, are required to present current Tax Clearance Certificates (TCCs) showing that they have paid their Personal Income Tax as and when due.

"It is in this light that the Joint Tax Board (JTB) calls on the Independent National Electoral Commission (INEC) to furnish the Board with details and copies of the Tax Clearance Certificates of all candidates, in all political parties, who have filed papers with INEC, to seek elective offices in the April general elections," the board said.

Newspaper reports indicate that most (if not all) the political candidates have submitted falsified tax declaration documents. Such is the magnitude of the case that INEC and FG are even objecting to the idea of screening due to the sensitivity of the exercise at this last hour.

Funny enough, INEC boss joked that he does not even have a personal tax declaration.

The world will be shocked if JTB have their way. And JTB have given no sign of relenting on their demand.

Never in history has the JTB verified the tax declaration documents submitted by the politicians.

I understand that most (if not all) has submitted falsified tax declaration documents. Such is the magnitude of the case that INEC and FG are even objecting to the idea. Funny enough, INEC boss says he does not even have personal tax declaration.

The world will be shocked if JTB have their way. And JTB have given no sign of relenting on their demand.

Who says that only EFCC is capable of hunting down corrupt politicians. JTB want to show us it has what it takes to do it, even better.

Does anyone know if Atiku replaced his running mate by the deadline?  I read that Pat Utomi and Senator Obi were in the mix.

The Atiku's fans here have been so busy praising their man and cursing OBJ that they forgot to pay attention to the INEC deadline.

Unless the disqualified candidates can obtain a court order to amend the constitution within the next 25 minutes.

Unfortunately only the parliament can amend the constitution.

Atiku has won many court cases which are unrelated to corruption indictment (my main interest not politics), and we accept the verdict as it is legal and constitutional. No questions!!!

Why can't Atiku and his followers just accept the part of the Constitution that disqualifies him and seek redress at the court to determine his qualification or resign and relinquish his immunity to face prosecution for public trust.

Accepting some part of the Constitution to push his political agenda and trash his enemies (I support) and rejecting some part of the Constitution which his enemies (as he claims) use against him in a corruption indictment is an inconsistency I find difficult to understand.

I like Atiku for his ability to maneuver the laws but I hate him because he acts like a coward. When you are caught in a web of lie,  don't try to hide because the truth will come back to hunt you. Atiku knows that Ribadu has some concrete evidence and he simply wants to continue a fight using his immunity status to buy time.

How many politicians has the EFCC moved against until recently? It's funny because when the EFCC was roundhouse kicking yahoo boys, fraudulent bank chiefs, western union fraudsters etc people were making noise asking them to go after big fish (Politicians).

Of course they knew, as per their experience with Alarms and Dariye, that once they go after politicians, it is because of ethnicity. Oh wait, my bad, it used to be about ethnicity, then it was about third term. I don't know what excuse they are using now. Perhaps 'vindictiveness' is the new excuse.

You know what, Nigeria Politics is stinky, decayed and out of order so to be frank there is little I can write about Nigerian politics and politicians.

My focus is on war against corruption, EFCC and Ribadu. God bless him.

EFCC's work is not easy and Ribadu is working in an extreme dangerous territory. Can you imagine the risk to his life. He must thread carefully and trust me his work is not made easy by the politicians.

Those you refer to are not on the list because there are no substantial evidence to indict them and many are under immunity from prosecution. The EFCC does not rely on gossips but on actual facts and these information are from members of the public. If you have hard documented evidence against these people, please forward it to the EFCC.

I can assure you that the EFCC is probably as we write investigating fresh reports submitted by the public on those you have listed.
