OKOATA: I be kid thanks, but druglord won't rule Nigeria. What he is trying to say is that there is nothing like Interim in the constitution and it doesn't exist in the electoral process. Going by the law the person holding the certificate of return MUST be sworn in pending the conclusion of the case before the tribunal/supreme court. Except you are saying rule of law should not be followed in which case you can be asking for interim government or coup or recolonization by the western world or war etc. If it is rule of law you want to follow, then let's concentrate on the cases in court, as for May 29th, a president must be sworn in. On another platform, I had discussed this issue of not joining Atiku and the fatal effect it may have on Obi's petition. That's even before Obi filed the petition, at the time he was only focused on challenging Tinubu.
For Obi to rightful get himself declared 1st from 3rd position, he has two hurdles to cross. That is, he has both Tinubu and Atiku to contend with.
He would have to prove that the number of votes secured by Atiku earning him the 2nd place were not validly gotten.
And he can't successfully do that without joining Atiku and PDP as interested parties. They have to come and defend themselves and their votes.
The Tribunal will never nullify a candidate's votes and 2nd position behind him. The court will not decide against the interest of a necessary party that is not brought before it. That would be a gross violation of the principle of fair hearing.
As it is now, Atiku's 2nd position remains unchallenged before the Tribunal. And that may be highly fatal to Obi's case. This is the main issue here o. I'm really tripped by this technical observation. I must confess I didn't see that too when I was reading through Obi's petition (maybe because I'm not a lawyer), but how Obi's lawyers missed this beats my imagination. I'm really looking forward to how this very point would be argued because it's pivotal to the whole case. We learn everyday. |

The preliminary objections are quite punchy - sammarily: 1. Peter Obi does not have locus to contest the election and bring the petition at all;
2. failure to add Atiku/PDP to the petition is a huge miss, as PO can’t be declared winner if at all he is successful without first discountenancing Atiku’s votes;
3. no pleadings on polling units disruptions individually; and
4. PO’s petition is fraught with pre-election matters - and the Tribunal itself does not have jurisdiction to hear the matter.
Law is interesting! Let’s see how this place out and watch out for the Defence & potential cross petition. APC lawyers seem good at fishing for technicalities. I'm particularly intrigued about your point 2, I don't know how Obi's lawyers missed that. I'm really looking forward to how that point will be argued. We learn everyday |

This is just the defendant's reply to the petition, we have not even gotten to the pre-hearing stage, let alone proper trial.
The LP now has 7 days to apply for pre-hearing or 5 days to respond to the defendant's new facts which I believe there is. However, it is expected that the Tribunal will respond to the Objections first, during the ruling proper.
A Presidential election petition of this magnitude will naturally not dwell on technicalities.
1. That Obi was not a registered member of the LP before May 24 last year.
This is at best puerile. Does the APC have the locus standi to challenge? NO.
a. Once there is no locus standi, there is no jurisdiction. Jurisdiction is the lifeblood and existence of any case. Once there is no jurisdiction, no matter how finely delivered a case is ruled upon, it becomes null and void, ab initio.
Only a member of the LP can challenge the membership of Peter Obi. The Court can best describe the APC as meddlesome interlopers and busybodies.
b. This matter is a pre-election matter. Membership, nomination and sponsorship of any Candidate in a political party is a pre-election issue that should be filed not more than 14 days after the cause of action at the FHC.
Same suit was brought up by a political party, the APM and the Appeal Court ruled in February 2023, that they do not have the locus. The PEPT or SC will not even delve into the merits but shut it out for lack of locus standi.
2. Non-joinder of Atiku Abubakar & PDP This again should likely not upturn anything. This is an election petitions tribunal and it is declaratory in nature.
It is an independent and individualistic appeal, at best, this is academic considering that the PDP & her Candidate are also in Court. It is urging the Court to subject to intellectual argument and satisfy intellectual prowess which cannot answer the questions in the live issues to be determined in the suit.
3. Arrangement of tables, etc.
Is this enough to throw out the petitions before we even get to the stage of hearing in the petitions? In my humble opinion, NO.
I believe all 3 Objections will be dismissed so that we can really listen to the REAL ISSUES.
What the defendant has done is not unexpected, raise up issues to dismiss the suit.

IamPlato: Israel had always feared Alex, Alex had beaten him three times before now.
This is a fixed fight to create another one. Not at all, if you know about all those fights you wouldn't have that assumption. By the way I watched all 4 bouts. The first 2 was in kickboxing, long ago. Isreal obviously won that first match but bad decision from the judges gave it to Alex (virtually every professionals of the game attested to that). The second game which was a rematch had Israel winning all the rounds only for him to get careless in the final round and a lucky left hook from Alex KOed him. The last 2 bouts were in MMA and recent. By the way, Isreal fears no one, he's the one that requested for the match with Alex, Alex was not yet in line for title fight, he still had like about 4 people ahead of him he needed to beat first to get to Israel always call for difficult fights, he requested for him because he has literally beaten everybody in middleweight division. The first match has Isreal wining, infact, Israel almost KOed him in the very first round, Alex was saved by the bell, but again maybe by sheer luck Adesanya tripped on his legs in the final round and he never recovered till Alex won, This rematch is a masterclass of MMA from Adesanya, he didn't let Alex off the hook this time, he got him and finished him. Israel has always been having the better of Alex in all their fights but has been somehow been finding himself on the losing end. As I said earlier, Alex will now have to go queue up before he can get to the level to fight Adesanya again, and I don't see him getting there anytime soon with the likes of killers like Whittaker, Vetori, Costa and even Bruno waiting in line. windvane: there is no 3 expect Pereira beats fighters through the rank..I doubt if Pereira can beat a Costa He cannot survive against any elite wrestler who can grapple, especially with a glass jaw like that. People like Whittaker, Vettori will ground and pound him to stupor. Adesanya was able to survive those guys because of his experience in MMA and his mixed style. Perreira has a long way to go to acquire that and age is not on his side (35), so, I agree with you I don't see any way back to the top for him challenging for the belt again. We learn everyday. |

If you're supporting Tinubu just says it straight up... Rather than these sitting on the fence and all words... He is for everybody and for nobody. He has told Tinubu outrightly that Nigeria need somebody youngers, that they should look for an intelligent younger person and he (Tinubu) should use his influence to get the person elected, Tinubu refused. This is what INEC must tell us. What he meant is what we have been saying that the opposition gave APC this election on a platter of gold. Add Atiku's vote plus Obi plus Kwankwanso, that's about 15 million votes compared with 8 million votes of Tinubu. More people voted against him than the people that voted for him. AyakaDunukofia: The knowledge has been in public domain that Abia state's tributary at Obuaku is nearer to the Atlantic Ocean than the Port Harcourt's. King Jaja actually used the maritime pathway to haul palm oil down the beachhead.
Having stated that, the ports at Port Harcourt and Akwai Ibom, If allowed to operate at maximum capacity, would solve Igbo merchants' problems. The outcome would be that:
a) the proximity of these ports to the Igbo hinterland is very negligible.
b) the long distance from the east to Lagos which precipitated the need to reside in Lagos would not be there anymore. Most Igbo merchants would enjoy doing their businesses in the comfort of their palatial mansions in the east currently left for the cockroaches.
c) The city of Aba would by default become one of the biggest container terminals in Nigeria given her proximity to Port Harcourt. A distance that is about that of Tin Can Island to Oshodi.
d) Most Igbo businesses would wind down to maintaining subsidiaries in Lagos.
e) Land patronage by the Igbo in Lagos would decline.
f) the need to buy land from these contiguous port cities would not increase from what it currently is.
g) Upsurge in real estate business in Igboland
h) the removal of railtracks from the "Exclusive list" to the "Concurrent" would put SE states under pressure to link the states with rail lines.
i) More air traffic at the well-built Anambra airport. And as well as Imo and Enugu etc. Would be win, win for everybody. Nigeria as a whole would be better for it. But... the phobia the other parts of Nigeria still have is that the direct access of East to the sea might not be good for Nigeria because the spirit of Biafra is still very much rive in the East and in case it gets to the level of waging war against Nigeria again to break away, the East will have unbridled access to arms and ammunition through the sea.
