He is very right... It is at the discretion of INEC..

But has anybody asked if INEC has already made their discretion known...? The answer is a big Fat YES and Inec's discretion is contained in the Electoral act which was the basis for the new act.

Read this...

Section 60 (5) of the Act states that the presiding officer shall transfer the results including total number of accredited voters and the results of the ballot in a manner as prescribed by the commission” (This is exactly what Alake meant by discretion) .

Now read on

The prescribed manner here is the BVAS, which INEC introduced to ensure that the electoral process is credible.

The BVAS was introduced by INEC in line with Section 148 of the Electoral Act, which gives INEC power to make guidelines and regulations to ensure the full effect of the law.

In view of the above facts.
“the electronic transmission of votes provided by the Electoral Act and in the guidelines issued by INEC has not been complied with”.

Hence the Presidential election results as announced by INEC is non and void.

Has anyone ever wondered why Dino Melaye was insisting that the state Inec reps announcing each result should say that what they were announcing is in tandem with what was uploaded on the server?

Here is the reason...

Section 64 (4) of the Electoral Act states that “a collation officer or returning officer at an election shall collate and announce the result of an election, subject to his or her verification and confirmation that the number of accredited voters stated on the collated result are correct and consistent with the number of accredited voters recorded and transmitted directly from polling units and that the votes stated on the collated result are correct and consistent with the votes or results recorded and transmitted directly from polling units”.

There were no statements by the returning officers that the results being called out were verified and confirmed that they were those directly transmitted from the polling unit.(This last paragraph alone has made the entire results void)

Infact, INEC chairman on many occasions has reiterated that capturing of election results and uploading them from the polling units REAL TIME IS A LEGAL REQUIREMENT TO VALIDATE ANY ELECTIONS meaning without it, any election is invalid.

Alake has just shot APC in the foot.

My fear is just that the Supreme Court might be complicit and may not give the right Judgement cos Nigeria is a country where elephants can fly.

The Independent National Electoral Commission has said it has plans should the Bimodal Voter Registration System fails during the forthcoming 2023 elections.

The INEC National Commissioner and Chairman, Information and Voter Education Committee, Festus Okoye, 'Sunday Politics', noted that the Commission had trained technicians who would be on standby at polling units.

There had been speculations about the possibility of server failures in the course of the transmission of election results through BVAS, especially by some politicians.

Okoye on Sunday noted that the electoral body had already made provision for the use of the BVAS in the over 176,000 polling units in the country. He, however, noted that INEC also made provision for spare BVAS machines in the case of any failure.

"For each electoral ward, we are going to have some spare BVAS to be deployed speedily if there is any issue or any challenge in any of our polling units. We have also trained technical support staff that can also intervene if there is any challenge with the BVAS.

"But if there is sustained malfunction of the BVAS up to the time of the closing of the poll, the Electoral Act demands that we should undermine voting in that particular polling unit and repeat voting within 24 hours," Okoye stated.

He earlier described as "an impossibility", the plan by any politician who was already allegedly harvesting PVCs to rig the elections.

Looking at the embolden, it is clear that INEC did not follow the laid down law hence any result announced is non and void.

I personally consulted my uncle (a retired judge in his 80's) on the interpretation of the constitution.
Mind you He is a member of the 1997/98 constitutional conference that drafted the 1999 constitution.
He said that the FCT 25% clause was added because the President is like the FCT "governor" who now appoints a Minister to run the territory for him.
Therefore, for the President to be the Legitimate head of the FCT, He must have 25% approval of the people in FCT.

FCT is not a state but a federal capital territory.

That is why it does not have a Governor but a minister.

The constitution made it clear that a winner of presidential election must have 25% IN 2/3 of the 36 states and 25% in Abuja (FCT)

This is to demonstrate a wide spread acceptability of the candidate.

So in essence, the winner must have 25% in 24 states(this is twothird of 36 states) and should also have 25% in Abuja being the Federal Capital Territory.

Meaning even if a candidate makes 25% in 30 states, he must still make 25% in Abuja being a federal capital and not a state.

This even gives opposition an excellent reason to file for total cancelation of collated results.

Cos according to this clips, it is even easier for INEC to just snap pictures rather than entering numeric data and this must be done first at the polling units before anything.

So Other parties now have valid reasons to have the entire results announced by INEC null and void.

So long the candidate attain 25% in at least 24 states (Abuja is categorised as "State" in this context), he is good to go. So far, only Tinubu has met this requirements and he also has the highest number of votes. What else do you need.
You are missing it... Yes you can say Abuja is one of the 24 states but the constitution makes it clear that 25% must be made in FCT.

So unfortunately for the riggers, they failed to rig Abuja well.

If Abuja is treated like a state, there won't be any need to single it out.

Let's take a closer look.

(b) he has not less than one-quarter of the votes cast at the election in each of at least two-thirds of all the States in the Federation and the Federal Capital Territory, Abuja.


If winning Abuja is not necessary, the text would have stopped at...

You dont need to get 25% in FCT to be president. FCT is considered a state in the constitution. You just need to have 25% in 24 states, including FCT or not. Then get majority vote across the nation, then you are good to go.

Even going by the screenshot you posted, it shows you dont even know what is 25% of total vote cast. If LP is having 111k votes as the leader, then the second 61k with one LGA to go. it means the total vote cast is not much.

Modified: Go and read section 299 of the Nigeria constitution which already recognise FCT as a state.

And section 134 of the constitution states that; a candidate will be declared winner of a presidential election if he has:

“(a) he has the majority of votes cast at the election; and (b) he has not less than one-quarter of the votes cast at the election in each of at least two-thirds of all the States in the Federation and the Federal Capital Territory, Abuja.


So it means FCT is part of that 24 state required by the constitution to get your 25%, it is not a seperate entity, it is considered a state as stated by section 299.
Simple.
Simple English is the problem here... Abuja is a stand alone
