When the issue came up at the High Court, the APC Deputy Governorship candidate showed proof that he had sworn affidavits in respect of the name changes.

See below a screenshot of a news story published last year when the high court ruled.

The question is, are sworn affidavits no longer valid?
I think he should have gone further to make a public declaration of change of name.

A confused party!! First the said Diri does not have the required spread, latter PDP bribed judiciary and Mary Odili is PDP, now INEC is wrong!
A pre-election matter was settled since November 12 when Abuja High Court declared APC candidate-less. The supreme court only affirmed the lower court ruling.

Perhaps you need to go back to school to understand the meaning of forgery.

So if my Bsc certificate reads John Mark and MSc reads John Chidi Mark Adamu, backed by affidavit of change of name,I am a forger, abi??

And the court was unable to prove that I stole or forge the two certificates.

Clowns every where on Nairaland!
You are the clown here. No university will issue you a certificate that has a name not known to them at the time of your admission. If you were admitted as John Mark, how can a university now turn around and add Chidi and Adamu (unknown to them) to your masters certificate?

Please, go back and read OPs post, the name Eremienyo DOES not exist anywhere in his academic records. So why use such in an election as crucial as governorshiphuh Something is fishy and smelling real bad -FORGERY!!

For your information, change of name is A PUBLIC issue and must be done by publication so people who knew you as A will now know you are now B, not affidavit that is only filed away without the general public being informed.

I am also asking same question my brother.

Where is the forgery or false information of fundamental naturehuhhuh
The forgery is introducing Eremienyo not anywhere in his certificates. Typo and misspelling as well as first name before last name can be overlooked. Not bearing an entirely new name in a governorship race.

The truth will soon come out. I suspect the man used another person's admission into secondary school. Those days in the 70s and 80s you have to be properly admitted into secondary school. Many students who got more than one admission sold them to those who could not pass common entrance. The real name is Eremioye but all these years have been bearing another person's name. The proper thing to have done is do a publicised change of name. Instead went to get affidavit. The latter is ot enough for change of nsme.

mushystuff:
First, I have edited my post. Secondly, please fill me in on the Bauchi scenario. I don't quite have the details so I can't comment just yet.
Back to this issue, for Kogi, silly as that was, the greater common sense would have been for Faleke to become the governorship candidate and not nominate one over him just as would have been the case if Audu had died after they had been sworn in. Placing Yahaya over him was based on religious and tribal considerations plus the working relationship would have definitely been sour so that is why Faleke turned it down. Bottom line though is that there was no disqualification and elections had yet to be concluded.

For Bayelsa however, this issue was a pre-election matter. Again by the electoral law, a ticket is joint except that of legislative positions. The fates of both parties are tied and what affects one affects the other too. Like I said, grounds for disqualification do not include death. If the Bayelsa deputy candidate had died(God forbid), we would not be having this scenario. However, he's been caught in a crime of forgery! Since they haven't been sworn in, they are still joined together. Even if they had been sworn in, because it's a pre-election matter, it would have still affected them both because the implication of the judgement is that APC did not have any candidate.

No party can nominate a governorship candidate without a deputy, INEC will not accept such incomplete nomination. The court is therefore saying that since the deputy was not qualified, he was not a candidate ab initio. APC therefore did not have a candidate so their participation in the election is an exercise in futility.
The Kogi case was left to rest due to ignorance. If PDP had gone to court on the ground of wrong substitution maybe a precedent would have been set. In Bayelsa, the matter was pre-election. PDP went to court to stop APC and INEC from accepting Lyon and deputy nomination for forgery. The High Court disqualified them. Then APC went to procure an appeal that allowed them to participate in election. If you recall INEC said they were going ahead with the elections inspite of various court rulings. Now the final verdict is that APC was never qualified to participate. Sad but this us the law.

ejimatic:
PDP Candidate Can't Be Sworn-In

The nation is still stunned by the Supreme Court judgement delivered on the November 2019 governorship elections held in Bayelsa. The five-member Supreme Court panel
had invalidated the candidacy
of the All Progressives Congress, APC, David Lyon and his running mate and ordered that the Independent National Electoral Commission, INEC, issue a fresh certificate of return to the candidate of the party with the next highest votes who meet the constitutional requirements.
While the People's Democratic Party, PDP, and its candidate have rushed to the street and the media to celebrate, a close perusal of the election results of the actual elections last year shows that the candidate of the PDP, Duoye Diri, and his running mate also failed to meet the minimum constitutional requirements to be sworn-in as governor. This may mean that's it's too early to celebrate.
The constitution is quite clear that to be declared winner of a governorship election, such candidate must have garnered at least 25% votes in at least two-thirds of the total number of local government areas of the state. Two-thirds means that for a candidate to be sworn-in, he must have garnered at least 25% votes in at least 66.7% of the total local governments in the state. The PDP candidate fell agonizingly short, at about 63 percent.
Bayelsa is quite peculiar in this regard with only 8 LGAs, the winner of a governorship election must garner at least 25% of votes in at least six Local Government Areas, LGAs. This means that 25 percent votes in five out of eight LGAs that the PDP candidate got in this case is not enough to have him sworn-in. According to the constitution he needs 25 percent in six states. Even if sworn-in, a strict interpretation of the constitution will have him removed before long.
This is surely going to bring up a constitutional crisis because you can be sure that APC and PDP are in for another round of anxious returns to the courtrooms.
A summary of the governorship elections results are as follows
Ekeremor LGA results: Passed
APC: 21,489
PDP: 18,344
Southern Ijaw LGA results: Failed
APC: 124,803
PDP: 4,898
Ogbia LGA results: Failed
APC: 58,016
PDP: 13,763
Yenagoa LGA results: Passed
APC: 24,607
PDP: 19,184
Brass LGA results: Passed
APC: 23,831
PDP: 10,410
Kolokuma/Opokuma LGA results: Passed
APC: 8,934
PDP: 15,360
Nembe LGA results: Failed
APC: 83,041
PDP: 874
Sagbama LGA results: Passed
APC: 7,831
PDP: 60,339
Stop wailing over Bayelsa. The matter is PRE-ELECTION. The High Court already nullified APC candidacy on November 15th or so. The SC just validated that judgement. Put simply, APC was NEVER qualified to participate in Bayelsa guber election. Just like Rivers and Zamfara, APC goofed big time because they had no qualified candidate for the election. All the votes received by them on elevtion day became INVALID VOTES.

Jones4190:
Why Diri cannot be sworn in as Bayelsa state Governor despite supreme court verdict

Results of the Bayelsa guber election.
1. Ogbia LGA:
APC - 58,016 *80.8%*
PDP - 13,763 *19.2%*
2. Yenagoa LGA:
APC - 24,607 *70.3%*
PDP - 19,184 *29.7%*
3. Brass LGA:
APC - 23,831 *69.6%*
PDP - 10,410 *30.4%*
4. Okuma/Opokuma LGA:
APC - 8,934 *36.7%*
PDP - 15,360 *63.2%*
5. Nembe LGA:
APC - 83,041 *99%*
PDP - 874 *1%*
Sagbama LGA:
APC - 7,831 *11.9%*
PDP - 60,399 *88.5%*
7. Southern Ijaw LGA:
APC - 124,803 *96.2%*
PDP - 4,898 *3.8%*
Now ⅔ of 7 LGAs is 7x ⅔ = 4.7
This means the person to be declared winner must score 25% votes in at least 5 LGAs. But from the above results PDP scored 25% in only 4 LGAs. So no one may be sworn in in Bayelsa tomorrow.
INEC will have to conduct fresh elections for Bayelsa.
Stop waiiling. Since APC have no candidate, all votes to APC becomes invalid, just like votes to PRP or Fresh Party without candidate.

The Bayelsa case was NEVER a compensation for the fraud in IMO. The high court already declared APC ineligible for the elections 3 days to the elections, but APC hurriedly went to Court of Appeal and bought a reprieve. All that happened before Imo fraud. Now, a Daniel came to judgement in Bayelsa, affirming the position of the high Court. Where is the compensation?
We are waiting for Kogi fraud to be sounded. Good the "big Brothers are watching".

When Kogi state APC guber candidate Abubakar Audu died before he was declared elected, expectations was that his deputy based on the joint ticket was going to assume the position of governor elect. It never happened.

Now we have a situation where a deputy governor elect whose candidacy was removed and the governor himself removed with him based on joint ticket.

But we also have several deputy governors removed from office via impeachment, it will be logical that any deputy removed from office based on impeachment, the governor must also leave office based on joint ticket.

The only option here is to say when both candidates are sworn into office, their joint ticket seize to exist but before then, they have a joint ticket.

But? Why does the deputy governor takes an independent oat of office if the ticket is joint?

I think this is the most controversial supreme court verdict of all time.

The victory of APC in Bayelsa was a victory backed up by the formal president, Goodluck Jonathan.

APC sees Lyon as a mole planted by the formal president into APC to undermine the party's agenda. APC could not have that.

In addition, APC needed to send a message to the formal president that he doesn't call the shots. By allowing PDP to win (whom the formal president was against), it would weaken the formal president's influence the state.
Guy give up. This case was already settled by the elders in the court of heaven.
Politics › When Will IGP Order The Arrest Of Senator Senator Biobarakuma Degi-eremienyo? by Validated(op): 5:16pm On Feb 13, 2020
With the nullification of APC candidature of David Lyon and Senator Senator Biobarakuma Degi-Eremienyo (Deputy-Governor elect) on greound od certificate forgery of the latter, the obvious thing to have done by IGP is to immediately arrest Senator Senator Biobarakuma Degi-Eremienyo for forgery and fraud. Both the Criminal and Penal Codes that apply in the southern and northern parts of Nigeria prohibit forgery. Sections 463 of the Criminal Code which provides for three years imprisonment for forgery while sections 362 to 364 of the Penal Code deal with forgery with punishment of up to 14 years.

Section 465 of the Criminal Code Act defines forgery thus:

“A person who makes a false document or writing knowing it to be false ,and with intent that it may in any way be used or acted upon as genuine ,whether in the State or elsewhere, to the prejudice of any person, or with intent that any person may, in the belief that it is genuine, be induced to do or refrain from doing any act, whether in the State or elsewhere, is said to forge the document or writing.

A person who makes a counterfeit seal or mark, or makes an impression of a counterfeit seal knowing the seal to be counterfeit, or makes a counterfeit representation of the impression of the genuine seal, or makes without lawful authority an impression of a genuine seal ,with intent in either case that the thing so made may in any way be used or acted upon as genuine, whether in the State or elsewhere, to the prejudice of any person, or with intent that any person may, in the belief that it is genuine ,be induced to do or refrain from doing any act ,whether in the State or elsewhere, is said to forge the seal or mark.

The term “make a false document or writing “ includes altering a genuine document or writing in any material part, either by erasure, obliteration, removal, or otherwise; and making any material addition to the body of a genuine document or writing; and adding to a genuine document or writing any false date, attestation, seal or other material matter.

It is immaterial in what language a forged document or writing is expressed.

It is immaterial that the forger of anything forged may not have intended that any particular person should use or act upon it, or that any particular person should be prejudiced by it, or be induced to do or refrain from doing any act.

So, what is the police waiting for to arrest and prosecute this fraud! He has been using same certificate up to the Senate Chambers and collecting bogus pay on false pretense and must be in jail.

There is NO compromise. The issue is VERY CLEAR. You forge certificate, you are disqualified. APC is fond of certificate forgeries. His deputy obviously had a hand in his victory and since the foundation of the joint ticket is fraudulent, the ticket is useless from start.
