Let me educate you a little, the constitution of the FRN has no provision for "suspension" of CJN, however it has provision for removal which must actively involve the NJC; the highest judiciary body must review whatever petition against any Judge, including CJN, and recommend the removal as the case may be.

Also, the National Assembly is actively involved in the appointment of CJN based on the constitution. They have to approve the person recommended to the President by NJC upon a communique from the president to the national assembly of the intention of the Presidency to apoint the CJN.

These various processes were violated by the presidency and such violations are impeachable offences against the president, just in case you don't know.

Falana should just shut up already. It is not the allegation or accusations against the CJN that the Nigerian Bar Association is protesting. They are protesting the process of suspending CJN which is an abberation and violation of the constitution.

There is an appropriate procedure dictated by the constitution but not the jungle justice the president adopted.

I anticipate the following:

CCT chairman (Danladi Umar) and other judge that refused to acknowledge and apply the injuction issued by the Federal Court of Appeal on the trial should be retired for the questionable recommendation to Presidency, which the president relied upon, to suspend the CJN.

Approval should be given to the Attorney General of Federation to prosecute CJN while still in office. The suspension of the CJN must be pronounced null and void pending the determination of his cases in the courts. However, the CJN has the option to resign or remain in office while his tenure last despite being prosecuted.

The impostor CJN (Ibrahim Mohammed) purportedly sworn in by the president should be retired with immediate effect.

Effort should be made to determine the case of Onnoghen in courts as soon a possible to put this matter to rest.

I would have requested that the NJC recommend the suspension of Onnoghen pending the determination of his cases in the courts but that will make the judiciary play into the hands of the FG because they will not confirm whoever NJC recommends to presidency in good time hence, creating the lacuna that was prevalent before Onnoghen's recommendation was confirmed in the first place. Presidency will deliberately leave that position empty and inactive till all election tribunals and cases of their interest are determined. This APC goverment does not want to be challenged by a formidable arm of government like the Judiciary.

Fraudulent or not, this is politics and it is about Rivers state election. Don't let us shy away from reality. Currently INEC do not recognised any Apc candidates from Rivers state ( Governor, Senators, Reps ). How is that possible?

If that should be the case, then we should be worry about the rulings on outcomes of election cases.

For some time, I avoided comments about Prof. Yemi Osinbajo's faith and his conduct so far in office.

However, I am not surprised about his character thus far. It is rare to see men that wanna combine the pastoral office with such highly political offices.

There is difference between a suspension and removal...
I am sure u saw the order by the CCT....if not, google u will find it. Suspension is not removal...in Law, nothing like assumption or nothing like suspension is tantamount to removal. That is how people win cases or get cases thrown out based on technicalities. Like i said, blame the constitution not the executive.

Do you have provision for suspension of CJN in the Nigerian constitution? If we have to rely on the literal meaning of Suspension and Removal, you still don't have a tenable case.

A CJ that knows the rules of law should have bowed out.

An accused is innocent until proven guilty by a court of competent jurisdiction. Even if he admitted to have forgotten to enter the accounts on the previous declaration form, he filled another declaration form, some years later, that indicated those accounts.

Mind you, he is not in your court hence you can't judge his case and conduct a kangaroo suspension/removal of the CJN without reckoning with the process stipulated in the constitution. You have to ultimately try him in court and he can only be removed from office upon the recommendation of the NJC.

These are 2 different things. Blame the 1999 constitution not the president. Besides a court of competent jurisdiction gave the order....
Same way the constitution did not stipulate hpw.long the EFCC chairman can act, same way the constitution dod not stipulate if the CBN governor can be removed.
All this a technicalities issues with the constitution...

Did Mr President follow the procedures of the constitution concerning removal of the CJN? No!

When did this court of competent juridiction serve the purported verdict? Courts don't give verdict in abscence of the prosecution and defendant attorneys. They were all represented in the last court session and there was no such verdict.

I see you are trying to distinguish between suspension and removal. As long as the CJN can not perform his duties in your case of suspension, it is tantamount to removal and there is no valid excuse for the president to inflict such dangerous blow on another arm of government that the president should not control.

When Jonathan suspended the CBN governor, several people and I also indicated that it was an aberration. However, there is yet a fundamental issue with the suspension of the CJN that you (supporters of the action) all failed to recognize:

There are three arms of government in Nigeria's democratic system of government: Executive, Judiciary and Legislative arm of government. They are designed to create checks and balances in the system of government and to be independent of control from other arms despite working in harmony to govern the nation appropriately.

The CJN is the head of the Judiciary hence an independent arm of government. The president has no business or power to suspend a CJN especially considering the dictates of the Constitution of Nigeria.

The president desecrated the constitution that he swore to protect with that action; the president went overboard in exercise of his powers.
