Christianity EtcRe: Kemi Olunloyo: We Should Stop Using Religion As Excuse For Character Defamation by ziga: 9:14pm On Apr 03, 2017
It is not defamation if what you are saying is truthful or there is a basis for your accusation!!!

If however, your statements are not truthful with intent to malign another individual, then that is defamation.

Everybody always believes or claims that anything negative said against them is defamation.

Case study will be all the political and religious arguments on Nairaland. Who is right and who is wrong.

Unfortunately, Religious and Political leaders are never wrong depending on what camp you are on (at least for most people I have seen on Nairaland) This puts Nigerian citizens in a position that could potentially violate their freedom of speech. A very bad thing considering our "Eh sir, Yes sir" culture.

Bottom line is that the courts should be the ones to determine what is defamation AFTER listening to both sides of the story (Court hearing)

But why is this woman in Jail, even before she has been defended and found guilty by a Nigerian (NOT religious) court?

Who told you that defamation is not a criminal offence?
Defamation and false publishing are crimes under the Criminal Code Act and a person found guilty of these is liable for up to two years in prison (Sections 373 – 375 of the Act) or seven years under the section with which she is being charged (Section 516A(1)
@Classcaptain. Thank you for the "clarification"

That doesn't change the matter at hand. Nigerians also have freedom of expression in our constitution.

Therefore, it is up to a court of Law to determine her guilt or innocence.

So, why is she locked up without trial and without bail?
Christianity EtcRe: Prophet Anointed Andrew (SEER 1) Pulled Crowd In Zambian Crusade (Photos) by ziga: 5:20pm On Apr 01, 2017
When there is desperation and poverty, human beings will find something to worship.

When the Israelites were in the desert, they built a golden calf to worship. In their minds, the calf was a representation of God. I guess it is something cultural. Most gods - sango, ogun, osun are represented by something physical and humans are physical, emotional and desire touch. So, this culture has been imported into christianity.

Current day christianity, a lot of religious leaders have become that golden calf.

BTW this doesn't only happen with religion. The same thing happens with how movie or music stars are regarded.

People have mementos in their homes and on them.

I don't think people do it intentionally. It seems to be a nature that is so strong for humans.

Be careful of the people or the things that you make into gods!

I also support her arrest. You don't just wake up everyday and defame someone just to make more money on your blog and think you will get away with it.
Let aunty Kemi rot there, very soon Stephenie Otobo and uncle freeze will soon join her in prison
And someday too, somebody who has more "power" than you will have you arrested and locked up. Maybe even freeze.

The issue is not what she said. After trial, if she loses her case, she would be made to pay damages or forfeit her assets. Chikena.

The issue is people are not supposed to have the right to lock other people up.

And defamation is not a criminal offense. Anybody can say anything they feel like.

Just like you just did. And nobody is locking you up.

If na so, all the poor people in Nigeria will be locked up according to how poor they are and nobody go fit talk again.

At least this woman is not a toddler and she is conscious of all the pains and anguish that her actions can cause. Yet honest human feeling did not stop her.

I don't think this is not what she's looking for all along: public sympathy to pitch one against the other, to be a heroin of some sort, to be persecuted.

She got what she has been toiling for, a prayer answered. Let her enjoy what God have for her at this point in time. God is a rewarder of all labour.

As long as the earth endureth, seedtime and harvest will not seize.
God has no hand in this.

If she wasn't in a Jungle like Nigeria, she wouldn't be in prison.

The pastor imprisoned her because in Nigeria, the Law and Law enforcement go to the highest bidder.

Small time now supporters of this abuse will come on Nairaland to say I jam Senator brother car and I have been in prison for 12 months.

This is Human rights abuse. She can say whatever she wants to say against another man and if he is not happy with it, he can sue for damages. She has no business in prison for a civil disagreement.

Or else, if you disagree with me, I will pay the Police to arrest you and put you in jail too. And no bail for you.

Let everyone condemoning the pastor keep their mouths shut.

You keep comparing Jesus with pastors

Jesus came for the purpose to be lied against, hated and be killed.
So when they did it he didnt fight them.

He even said it that " do you think I cant call on my father to send me Legion of Angels to fight for me? but for this purpose I have come"

No other person has come for same.
No pastor or Christian.

Are you saying if the man of God is attacked with dangerous weapons like they did to Jesus he should keep calm like Jesus?

Who among you would behave like Jesus and wont fight back in the face of danger.

It pains my heart wen I see christians condemning the pastor for getting her locked.

Let her fight for herself if she's right in court.

Anyone among you condemning this will surfer the same fate if you blackmail and u are caught.
And may you also suffer the same consequences as Miss Olunloyo if you say something against another person that is false.

BrutalJab:
Freedom of expression is a notable progress in the advancement of democracy. But freedom of expression does not warrant baseless, unwarranted character assassination.

The reason Christianity is dying is the secularization of the sacred and the non application of common sense in making jokes with God and the things of God. Modern media will make jokes of Christianity and we laugh and regards is normal.

But they do not try that with Islam and because of fear of reprisals. That's how we are dying. We must learn to have respect for limits. Any human being who goes against the law should be punished.
But to resort to indiscriminate and unwarranted outbursts on social media against anyone is unacceptable, especially if it's made to diminish the person and image of anyone and sometimes only to score cheap popularity.

The Pastor is not Jesus, Kemi Oluloyo has committed a crime punishable under the law and therefore must be made to enjoy the fruit of her labour.

Mummy Freeze is next!
So, anybody can have an opinion which may be true or false. If it is true, it is true, if it is false, then that is wrong. The law, on the basis of a trial will determine that.

People do not get arrested for stating their opinion.

Military Juntas tried to suppress that in the past and I am sure you were against that. It is wrong.

I am also certain that you have an opinion regarding the current state of our democracy, whether true or false. but I bet you haven't been arrested on the basis of your opinion.

A lot of people state facts on nairaland and haven't been arrested for it.

If the Pastor feels maligned, it is his right to sue for damages. But in Nigeria where the Law and Law enforcement is in the pockets of the rich and "powerful", people get arrested for stating their opinions and held in prison.

Human rights abuse.

This is a civil matter and Miss Olunloyo has no business being in prison.

But in a Jungle, rules don't exist I guess.

I do not want to be offensive in anyway.. what I meant is that the Pastor can have a one to one discussion with her, forgive and let her go with a warning.... instead of re arresting her . why fight someone you can kill with a finger..sending her to prison and parading her in prisoners uniform is too much of a power show.
You got to feel sorry for her at some point knowing her background and I don,t think that will stop her thou...

Many people have said worst against Jesus and other men of God ... Benny Hinn , Joyce Meyer , Pastor Adeboye even President Buhari , Jonathan etc. The Pastor is a public figure and he should not expect less.

Mat 5< 11 "Blessed are you when people insult you, persecute you and falsely say all ... persecute you, and shall say all manner of evil against you falsely, for my sake.

Of course you are right .. He has no power over her .. but Kemi should always back her stories with evidence before publishing . Who knows if she has evidence to back her claim.

The money they are spending on lawyers can even help some poor people on the street.
Thank you for your reply, and I see that you are looking at the issue from a good and peaceful place.

All I am saying is that for you to think that the Pastor has any right to arrest her is wrong.

Nobody should have that right. Even if the President orders an arrest, it is up to the Police to see if a crime has been committed.

That is just dangerous and can be abused, which is what is happening here.

In any sane community, nobody has the police in their 'pocket" and the fact that I feel offended by somebody doesn't mean I can have the Police arrest them. Whether she has offended this Pastor should be decided by the Law and enforced by the Police.

And I have never seen any sane place where alleged defamation of character leads to a criminal arrest and detention.

Jesus came to re-write the rules. he was against intimidation of the poor and downtrodden.

Unfortunately, religion puts Pastors in positions of power. And Power is really intoxicating. But regardless of this, the Law of the land still holds on Earth. Give to Cesar what belongs to Cesar.

Pastor can sue and if she is convicted, she will have to pay the fines or sentence if she can't pay the fines.

I believe the pastor can have a one to one discussion with her , talk to her about the issue and correct her if possible .. invite her her to church to be ministered to.

Kemi is perceived as someone unstable or with mental health issues and always believe she is fine.

She seems to me as someone with no friends and sees the social media as a way of communicating with people or getting attention.
She has spoken against her own father , talked about her own son possessing a gun , all sorts. They are so many people like her out there , that needs to be counselled , showed love and delivered.
Locking her up wont change anything , she will come out and do the same thing again. It,s all happening in her head and thinks she is a journalist . She has no sound mind.

People like her are not worth punishing . She has lot of issues with herself and everybody. She needs help.

who and Where does she gets her information from?? People might be using her and giving her information knowing she will spill it out to the public.

Not worth fighting with .. If Pastor is truly honest and nothing to hide .... He can pray, counsel her and bring her close to God, assign people to visit talk and pray with her . He should not see her as a challenge but an opportunity to win her to Christ and change her life.

God is able and can touch her.
From what you said here, it appears you know that it is the Pastor punishing her.

What authority does he have over her?

Maybe he has authority over his sheep. but she clearly doesn't want to be his among his "sheep".

The problem with this scenario is that if I find what you just posted as offensive and I have the money or "power", I can ask the Nigerian Police to lock you up.

As "Christians", why are we slaves to money in Nigeria. Money can get you a lot of things but not true freedom.

I don't envy Miss Olunloyo's position but I salute her fight.
